The multi-stakeholder institution charged with administering Kenya’s Internet domain .ke, is hoping to iron out differences over its recent restructuring in its annual general meeting on Friday. The meeting, which will be held in Nairobi, brings together registrars, government representatives, Internet businesses and other people interested in the ICT sector.Speaking on Thursday, the organisation’s change manager, Mr Sammy Buruchara, said the forum would provide a good platform for the board of the institution to iron out issues facing the company.“It will give the board of the Kenya Network Information Centre (KeNIC) an opportunity to clear the air over all the allegations arising from the ongoing organisational restructure and create rapport on the way forward,” Mr Buruchara said. The AGM comes at a time when the institution is facing questions from the public over its decision to fire all its employees in what it says is an organisational
restructure.A number of board members have also left KeNIC in the past two months. In an email, Information and Communications Permanent Secretary Bitange Ndemo termed the decision to terminate employees’ contracts without consulting stakeholders as drastic and unprocedural.“Even in the Government, firing employees has several steps that must be followed to ensure security of tenure. This came as a surprise, yet we are supposed to be stakeholders. We must all respect the spirit of the Constitution, especially in such a multi-stakeholder agency,” Dr Ndemo said.In reaction, Mr Buruchara, who is on a three-month contract to oversee the execution of an institutional assessment report prepared by ZappKaas Consulting and Training Ltd, said KeNIC is an organisation with a working board and people should stop questioning its decision.Currently, KeNIC is the administrator of over 20,000 domains at the .ke registry.
@Ndemo just made some remarks... 1) that perhaps KENIC finds a way to include ALL stakeholders (i.e. anyone with a .KE string). 2) that perhaps KENIC Board members should serve not more than two terms (max 6yrs) walu. --- On Fri, 8/24/12, robert yawe <robertyawe@yahoo.co.uk> wrote: From: robert yawe <robertyawe@yahoo.co.uk> Subject: Re: [kictanet] Talks to resolve row at KENIC To: jwalu@yahoo.com Cc: kictanet@lists.kictanet.or.ke Date: Friday, August 24, 2012, 9:31 AM I am at the kenic meeting where I thought we would be well represented but as expected there are more kenic board members than kictanet representatives. ------------------------------ On Thu, Aug 23, 2012 23:10 BST Grace Githaiga wrote:

Sammy B. the current Change MAnager at KENIC clarifies that contrary to media reports KENIC Staff were NOT fired. There was restructuring at the organisation and existing staff offered new ToR/Terms with the option to either accept or reject (self-retrenchment with a handshake option). He adds that his role is extremely temporary and he will move out of KENIC as change-manager/CEO asap. walu.
Walu, That position is not true. If you are paid Ksh20,000 on a 3year contract, then after two months your contract is modified to Ksh5,000 on a three year contract, you cannot accept that offer, unless you are paid all your outstanding pay for the three years and your contract terminated. This is what happened to Ringera when he lost his KACC job. The staff might instigate new-unwanted lawsuits to our beloved KENIC. Are there any lawyers who can give us a legal perspective? Did the change manager say what were the crimes of the staff that were sent home? Regards On 24 August 2012 12:18, Walubengo J <jwalu@yahoo.com> wrote:

Kenic AGM Questions. For the "observers", I wish you can ask these questions: 1. Is there conflict of interest if the "change manager" / CEO of KENIC is a player in the domain registrar business? 2. As a regulator licensing authority, what is the role of CCK in the Kenic board? NB: Independence is a prerequisite for any telecommunications regulator in this case CCK. Regulator independence involves: the separation of the regulator from the operators that it regulates; lack of political influence on the regulator; and an open and transparent regulatory decision making process. The multi-stakeholder institution charged with administering Kenya’s
Internet domain .ke, is hoping to iron out differences over its recent restructuring in its annual general meeting on Friday. The AGM comes at a time when the institution is facing questions from the public over its decision to fire all its employees in what it says is an organisational restructure.A number of board members have also left KeNIC in the past two months.

Kivuva, 1. You can't send email questions at 12.45 for an AGM that started at 8am :( 2. Why did you not come in person to have these and other concerns you have raised addressed? 3. A frequent comment that came out at the AGM was that the very low turnout out is indicative of Kenyan's propensity to "shadow box" and shy away from meaningful engagement. Brian, I gather that most of those questions were asked, therefore we were well represented by the "multi-stakeholders". But from the onset, the so called "community" was invited to "Observe" the AGM. Such a bad tone was in bad taste, and it worked the desired results of low turnout. As Robert put it correctly, the community work was to tweet and FB the proceedings :( Regards On 24 August 2012 14:42, Brian Munyao Longwe <blongwe@gmail.com> wrote:

The multi-stakeholder institution charged with administering Kenya’s
Internet domain .ke, is hoping to iron out differences over its recent restructuring in its annual general meeting on Friday. The AGM comes at a time when the institution is facing questions from the public over its decision to fire all its employees in what it says is an organisational restructure.A number of board members have also left KeNIC in the past two months.

It is not possible to excuse the 40 who did not show up after confirming attendance. However, with only two days notice to adjust our schedules it was likely that a great number of those who would have wanted to be there to observe would be left with no choice but to follow proceedings via the kind updates of those who did make it. The questions may have been late but as a community I see nothing wrong with finding ways of accommodating remote participants even though KENIC made no such arrangements. To reiterate what Brian as said, KENIC catered or 70 participants who had indicated that they shall attend only for 30 people to show up.
Please, when you are sure you have no intention of attending do not register as you cause the organisers to lose money. It is time we realised that sending a confirmation is not the same as clicking "like" on facebook or on an advert.

Kivuva,

Mark Not in China. This is an interesting topic on ethics and the profit motive. Probably beyond that its criminal. Dr.Ndemo raises a point that is beyond this though. How have we opened up our countries to everything when we should actually be making a case for protecting nascent industries from unfair competition? For example Japan and Korea still protect their motor industries even after 20 years; America and the EU still has major subsidies for its agricultural sector. And the list goes on as can be seen by cases piling up at the WTO:- http://www.wto.org/english/tratop_e/dispu_e/dispu_by_country_e.htm#complaina... An interesting fact: Only Egypt and South Africa have cases pending both for or against them at the WTO. This begs the question:- Don't African countries have issues to be resolved at the WTO? Doesn't Kenya? Last time I checked we were members... This issue of fake eggs just brings to the fore the implications both from a health perspective and an economical one the effects of free trade across borders without proper mechanisms to protect citizens and local industry.
And the list goes on as can be seen by cases piling up at the WTO:-
http://www.wto.org/english/tratop_e/dispu_e/dispu_by_country_e.htm#complaina...
An interesting fact: Only Egypt and South Africa have cases pending both for or against them at the WTO. This begs the question:-
Don't African countries have issues to be resolved at the WTO? Doesn't Kenya? Last time I checked we were members...
This issue of fake eggs just brings to the fore the implications both from a health perspective and an economical one the effects of free trade across borders without proper mechanisms to protect citizens and local industry.

Maybe I am digressing but as KICTANET shouldnt we be coming up with solutions not just comments. Daktari, if a local developer had a solution for KPA to scan all these containers but does not meet all those stringent procurement rules, how can they introduce their solution? Mr. Lusega, I see so many great software solutions but we have never managed to recognize our own creativity. This is probably what Ngugi called decolonizing the mind. Last Friday I launched Bata Online at Sankara Hotel. What made my day was that Bata will utilize our own Liko's payment gateway, Pesapal. These in my view would be some of the incremental gains that will create confidence among ourselves. The current procurement law is a reflection of how distrust ourselves and we all have to blame. We abuse any minor loophole that exist to the extent that even well meaning projects are hurt. We simply must begin to embrace those values we created in the constitution. Sad that we want to legislate values when more than 90% of us belong to some religion. Counterfeit eggs must provoke us to build systems that will ensure the security of our people. How can we leverage on technology to protect our produce from the farmer to the market? Do we have a farmer database? Can we use such technologies such as RFID to enable sources and traceability of produce? I this is why we went to school. Ndemo. Kenchic has had a farm-to-fork system for a while now and I believe this is what prompted the likes of KFC to set up shop here. Even the produce in Marikiti should be traceable to the individual farmer that grew the stuff. This will force accountability and in the case of contaminants Isolation and further action. Juakali methods are a detriment to everyone. On Tue, Aug 28, 2012 at 10:10 PM, <bitange@jambo.co.ke> wrote:

This is shocking to say the least. Local markets must be protected. The story about free markets is hogwash since the countries that preach it the most do not allow foreign companies to dominate their markets. This reminds me of the political nightmare that ensued when a Chinese company attempted to buy an american oil company. And this happened in the 'freest' country on the planet. We must lock down our markets. On Tue, Aug 28, 2012 at 7:21 AM, Ali Hussein <ali@hussein.me.ke> wrote:
