Listers, The solution has been found internally and there is a IT strategy that is being run by the organisation. The essence is to build an enterprise grade solution that integrates into the current IT estate. Therefore the right party needs to architect, build, implement, deploy and maintain the solution going forward. Agree with KRA's approach, but communication gone out has seem to not help the cause. KRA's approach has a budget of 1 billion shillings... There are quite a number of enterprise systems built with a lower budget. I'm quite sure it's a pro If they were really looking for an enterprise grade system, wouldn't they have involved the innovator from the onset? Something does not add up. "Where the enterprise uses the technovation or communicates it to a third person, the technovator shall be entitled to a remuneration the amount and method of payment of which shall, in the absence of an applicable collective bargaining agreement, be fixed by mutual agreement between the technovator and the enterprise".

Something tells me that they are not completely dumb and won't expect to shift the same numbers of this product as e.g. a low-end smart phone. Even if they only sell, say, three, they still had headlines, and people who go to the shop to just look at this baby might buy something else that's a tad more affordable. I think that it is actually a crime that our ministers and MPs get paid this much. According to the World Bank, Kenya is a low income country, and 45.9 percent of the country lives in poverty, and the GNI per capita is $820 dollars. That means that this TV is worth almost 20 times (TWENTY TIMES) than the average annual pay of the average Mwananchi. People, am I the only one who thinks it is shocking that our Ministers get paid 20 times more than the national average pay for a YEAR in one month? Explained to some extent in the book 'Why Nations Fail' by Daron Acemoglu & James Robinson. Nations with leadership that's elitist, extractive and self-centred leads to increased poverty. Sadly, such leadership seems to be the norm, rather than the exception in Sub Saharan Africa. True and sustainable wealth will be achieved when the norm is to have equal property rights, affordable access to justice, education etc. Make it easier for people to be included in production/wealth generation not more difficult. If we have such a nation (as has sort of been in the US for the last two centuries) it will be easier to build and sustain wealth. This will be better brought to the fore with the devolution where societies that have been relying on government handouts will realise that moving from a net consumer to a net producer takes more than 5 years, which is the reason I will not stand for governor (I have resolved myself to buying a degree from an online university, maybe even a PhD) during this trial phase. So as the electorate we prefer to get the 50/- dished out during the campaign period than hope for a more permanent solution from the MP, in exchange the MP spends Kes. 100 Million during the campaign and spends the next 5 years trying to recover from the hole this dug into their pockets by regularly increasing their remuneration to keep ahead of inflation. Our MPs have increased their pay from a paltry 7,500/- 30 years ago to the current levels all because we, the electorate, have kept raising campaign costs by demanding larger and larger pesa pap. Which explains why there are rarely any dissenting voices in parliament as they propose to increase their salaries every other week, as all wear the same shoe and they all know where it bites. Look around at many of our former MP's they are a shadow of their former selves, more so those who believed that they where there to serve the electorate, the ones who used their time in parliament enriching themselves are at times better off. Please ask the same question to someone whose parent has been involved in politics, they will tell you that the amount paid is too little to make up for the emotionally and financially damage to the children and spouses. Unfortunately I don't think such changes can start from the grassroots. A leader willing to take the flack and protect his bureaucracy as they do their jobs. When we allocate responsibility to everyone, we allocate it it to no-one. A decisive person that is willing to deal with security, economic and policy issues with a clear plan with the interest of the citizens as a priority. It must start from the top. Which explains why there are rarely any dissenting voices in parliament as they propose to increase their salaries every other week, as all wear the same shoe and they all know where it bites.
Look around at many of our former MP's they are a shadow of their former selves, more so those who believed that they where there to serve the electorate, the ones who used their time in parliament enriching themselves are at times better off.
Please ask the same question to someone whose parent has been involved in politics, they will tell you that the amount paid is too little to make up for the emotionally and financially damage to the children and spouses.
The system is broken, how do we fix it?

I think that it is actually a crime that our ministers and MPs get paid this much.
According to the World Bank, Kenya is a low income country, and 45.9 percent of the country lives in poverty, and the GNI per capita is $820 dollars.
That means that this TV is worth almost 20 times (TWENTY TIMES) than the average annual pay of the average Mwananchi.
People, am I the only one who thinks it is shocking that our Ministers get paid 20 times more than the national average pay for a YEAR in one month?

Another thing is to raise the salaries of unskilled staff. Benevolent self interest. This will allow them to have some form of dignity and raise children who can participate in the skilled labour market. Our MPs have increased their pay from a paltry 7,500/- 30 years ago to the current levels all because we, the electorate, have kept raising campaign costs by demanding larger and larger pesa pap.
Which explains why there are rarely any dissenting voices in parliament as they propose to increase their salaries every other week, as all wear the same shoe and they all know where it bites.
Look around
at many of our former MP's they are a shadow of their former selves, more so those who believed that they where there to serve the electorate, the ones who used their time in parliament enriching themselves are at times better off.
Please ask the same question to someone whose parent has been involved in politics, they will tell you that the amount paid is too little to make up for the emotionally and financially damage to the children and spouses.
The system is broken, how do we fix it?

I think that it is actually a crime that our ministers and MPs get paid this much.
According to the World Bank, Kenya is a low income country, and 45.9 percent of the country lives in poverty, and the GNI per capita is $820 dollars.
That means that this TV is worth almost 20 times (TWENTY TIMES) than the average annual pay of the average Mwananchi.
People, am I the only one who thinks it is shocking that our Ministers get paid 20 times more than the national average pay for a YEAR in one month?

Why then would KRA be buying its property from a third party? I will give my 2 cents from a legal perspective ....There is no standard legal way that is used to deal with copy right issues touching on employee and employer relationships,mostly different countries have different national legislation to deal with the issue ....and IP rights or laws differs substantially between the two main legal systems in the world today, the common law system and the civil law system. In the common law system e.g. in the United States and in the United Kingdom (Kenya has borrowed from the two), the investor (employer) benefits from its employees’ intellectual creations. In those countries the employer is the initial owner of the employees’ intellectual property rights produced in the course of the employment. The employer is treated as the first owner, but not deemed to be the author. Therefore the duration of copyright, for example, is measured with reference to the life of the employed creator. Further on, the national laws in these countries make it clear that contractual provisions, whether expressed or implied, can affect the employer’s initial ownership. In the civil law system to which most of the countries of Continental Europe –Germany, France and the Nordic countries, for example – belong, a legal person such as an employer, may not generally be deemed the first holder of an intellectual property right. Those rights are normally linked to individual persons. Therefore, an employer may normally only obtain intellectual property rights by assignment by law or in contract. Since Kenya lacks exhaustive and detailed legislation to deal with copyright issues of this nature I will borrow from the EU.The European Commission published proposals for copyrights within the EU,If you look at Directive 91/250/EEC on the Legal Protection of Computer Programs,. Article 2(3) of the Directive contains a mandatory requirement on employees’ programs.The employer shall exclusively be entitled to exercise all economic rights in an employee’s computer program, where a program is created in the execution of the employee’s duties or where the employee is following instructions given by the employer. It is an automatic legal transfer of the copyright in computer programs. However, if the parties agree, the employed author of the computer program can recover the rights through a specific clause in the employment contract or a separate agreement on the exploitation of the computer program made by the employee (waiving the legal automatic transfer of rights). My advice to the concerned employee is he could have found away of handling the issue amicably with the employer. Short of sounding pre-judicial he can not stop KRA from tendering for the software or using it.But all is not lost he can sell it to county governments and help them collect revenue from real estate as well. Interesting response from the Commissioner General, what I am unable to understand is the part of his statement that " KRA is only looking for a database and not a computerised system" for 1 billion shillings. Before this statement he made an even more interesting one “Our approach in this respect is informed by the fact that KRA’s core business is tax collection and not the development and maintenance of property or other databases.” so why hasn't KRA outsourced the SIMBA system and other applications? We have very smart people wasting away in large organizations which should have outsourced them, not hired them as employees. In fact have advised some App Devs (with an e-police solution) to apply for a KICTB software development grants + guidance on IP Protection. Looking forward to good things for Kenya!
