Dear Listers, A court has ordered the University of Kabianga to pay a former University of Nairobi student Sh500,000 for using his image in online marketing and soliciting funds from a regional bank without his consent. Sitting at the High Court in Kericho, Justice Asenath Ongeri declared that the university violated fundamental rights to privacy and human dignity by publishing an image of Mr Shimlon Mwangi Kuria without his express consent. So many gaps here. I suppose the university has an inhouse designer or even if they commissioned one for this task, do they know the source of their images or any material that is used? If a designer is not utilising image source such as Unsplash or Canva or other such places that have both free and paid for images, then I think these are the ones to educate first. I suppose the University of Kabianga has a corporate communications office or PR office or something equivalent to that? How are they qualified to hold those offices without the knowledge that what they put out in public needs to be without question? It's not just about privacy. It's about monetization in the digital world. We are going to see a lot of these unless corporates start appreciating the New Digital World Order. In another life, 😀 models were used to signing release forms based on geographical parameters - for example, 'you can only use my image in Kenya and East Africa'. Now we are seeing release forms speaking of global coverage and separate digital platforms coverage. I like the Point raised by Kathy Mwai.Most Corporates do not employ trained Communication Experts.A Comms expert would have developed a Communication Policy for the University which guides on Public Relations and Adverting such as in this Case. The same expert would have guided the University on the end-to end of using third parties to endorse their Brand. Most Corporates have a dim view of Communication expertise and sadly it can get to where Kabianga now finds itself. And the need for this is now urgent and critical as we move into the Digital Space where Digital citizens have very peculiar Communication Needs and Behaviours.
