Is Kenya Putting the Chill on Internet Freedoms?
Dear listers, Greetings from Kampala! I wanted to share with you our our recent briefing on recent developments on Kenya in regard to Internet freedoms. See: http://www.cipesa.org/2015/03/is-kenya-putting-the-chill-on-internet-freedom... We hope to see some positive developments in the coming months. Regards, Lillian
@Lillian, Interesting piece on internet freedoms in .KE Whereas the incidents cited are true, I still think the freedoms gains in the new 2010 constitutions are far-reaching and it would require several years of sustained and systemic attacks for any regime to effectively claw them back. I have not been to Kampala in recent times but on a comparative and lighter note:- I hear M7 might have put .UG where Mo1 had contained us in the mid-late 1990s in terms of freedoms :-). It would be nice if you also shared the report on Internet Freedoms in Uganda (if available). rgs. walu. Thanks @ Walu, Not sure I can confirm those rumors on .UG but yes, an update on developments in Uganda will be shared soon. What I can say is that Uganda is moving fast in the internet freedoms area with a draft Data protection and privacy bill in place and yet to be tabled in parliament. See: http://tinyurl.com/l6ydggd. I know Kenya has tabled its bill in Parliament, so lets hope it to gets enacted this year. As the article has rightly put, most of the unconstitutional laws passed overnight were overruled by the court. It should be noted that Kenya has one of the most Independent judiciary in the region. Infant, the public perception of the Judiciary and criminal justice system has improved tremendously as compared to previous years. It should be note the threshold for admissibility of digital evidence is very high in any court of competent jurisdiction. I don't see the new evidence act changing the game. Just deleting an offending tweet or Facebook post is enough to cause the prosecutor sleepless nights. Any screenshot of a tweet or Facebook post will not suffice in our courts, unless Facebook and Twitter themselves corporate with data requests. From experience, we knows such requests are honored 0% of the time. The Silicon Valley types have no respect for our Judicial system. Finally, there is a bill of rights in place, that among other things guarantee freedoms speech, expression, and association.
