Hello all, I am a victim of this matter, and i would like to point out that the actual charge being levied for the "undelivered" sms is actually ksh 10/= and not even the published sms rate of Ksh 5/= to other networks. By way of this message, i hope also CCK and the courts will give this matter expeditious action. Dear Mr. Joseph, Consumers have lost money and I only see two ways of resolving this matter: 1.) Guided by alternative dispute resolution proposed by the President, we have an urgent meeting at CCK offices to discuss compensation for every affected consumer; or 2.) We meet in court. At this moment, I suppose we are both aware that anything we say can and will be used in a court of law. Regards, Alex Gakuru --- Michael Joseph <MJoseph@Safaricom.co.ke> wrote:

Dear all Do we have the facts to justify the word "swindlers’? Can someone prove the story below with facts? I think this is what Eric Aliguila's questions were leading to and we must try our level best to share information that is and can be authenticated with facts. Unfortunately the use of strong/sometimes inappropriate words/language without supporting facts has appeared on a number of postings recently and is really disturbing. So here’s a reminder of some list serve rules as a refresher to avoid stepping on each other’s toes. * Mind your manners - * Be polite - virtual members are real not a cyberspace borg with no feelings. * DON’T TYPE ALL IN CAPITALS - It sounds like you’re shouting! RIGHT? * Watch your words - They can’t see your face, and the emotions in words can get misinterpreted. * Kick the bad language - People are listening. * Laws are laws - What’s real in the real world are the same in cyberspace. * Be simple - Send text simply, no bold, italic, underlines etc. The simpler the better. Not everyone has the same system as you. They may just get a load of muddled codes that are really annoying! * Briefs - Don’t be repetitive, so edit out the stuff you really don’t need to send. * Flame wars - Don’t send rude or offensive e-mails or postings. If you get flamed, don’t do it back, let someone in authority know, its abuse, remember laws are laws. * Who are you? - Tell people who you are, it’s rude not to. * Looks count - What you write shows what you’re like. Rubbish grammar and spelling doesn’t look good, and the same rules apply when typing and writing. * Newbie tolerance - You’re an expert in cyberspace, don’t forget there are newbie’s trying to learn as much as you had to. * Be ethical in your posting. Don't lie, plagiarize, or deliberately do harm to another forum user. alice munyua ------------------------------------------------------------------ Michael Joseph wrote:

I think allegations are the proper place for a forum of this nature, without them we would not have received the unequivocal promise of an investigation into the matter from Safaricom. An investigation which will, at the very least, accelerate the resolution of this issue and may well avert a long and tedious legal process. While I agree people should be respectful, lets not be afraid of spirited and sometimes contentious debate. alice <alice@apc.org> wrote: Dear all Do we have the facts to justify the word "swindlersâ? Marilyn, Strange Ms Munyua's courtesy advisory never reached me though still prefer http://www.ietf.org/rfc/rfc1855.txt Courts exist world over for a purpose, inconvenient and costly as it is to everyone. To avert resorting to them an investigation by CCK should establish, among others, the "total unfairly collected sums of money over a long period of time from unaware consumers" by Safaricom. Status quo remain because often we keep treating symptoms instead of getting to the root causes of problems and fixing them. Alex --- "Marilyn M. Kamuru" <mkamuru@emanageafrica.com> wrote:
