Cofek to sue CCK for defaulting on television deal
“Customers who fail to pay subscription fees on time will continue to access the must-carry free-to-air services (FTA) for a period of at least two weeks,” read a letter from CCK director-general Francis Wangusi (pictured, below left) to pay-TV providers. Through the letter, CCK is reneging on an earlier agreement with Cofek that made it compulsory for pay-TV companies to give subscribers access to all free-to-air channels, even without a paid-up subscription. You've got it all wrong. Mr Kenyan Guy has been accessing Uhuru Park (Free Channels) for free, liked it and had no problem with paying for Transport ( TV) to get there. Then some fat cat tells him, how about we plant a few more flowers and manicure the Uhuru Park gardens? Ofcourse the guy says yes. The guy curiously asks "... Will all this be for free?" Ofcourse, the fat cat replies. All you need is to buy a one time Uhuru Park Access Card, which will only cost 5k from one of our Companies, StarUhuru! The guy, reluctantly parts with the 5k, on the promise of a much better Uhuru Park. Shortly thereafter, and after a few visits to Uhuru Park, which indeed has more trees and flowers (aka channels) the fat cat changes the tune. ".....Upgrading Uhuru Park cost us a lot of money. @Ngigi Actually a slight deviation to that Kenyan Story. 1. Pay 5k one time fee and only access certain parts of Uhuru Park. 2. Pay 2k upfront and 1k every month and we will allow you to access other parts of Uhuru park that the 'Watus' don't have access to... You are right Ali. As the two reference terms denote: FREE-AIR gives one FREE access all the FREE channels while PAY-TV is for pay to receive and the menus of the two are different. The latter is a business segment that has been in existence in our industry for sometime now. It didn't just come with Digital Migration. If one, knowingly, subscribes to PAY-TV, it would not be fair to start seeking for free channels within that arrangement as long as FREE-TO-AIR option exists. The latter is a business segment that has been in existence in our industry for sometime now. It didn't just come with Digital Migration.

As the names suggest, FTA decoders do not require any monthly subscription or payment while pay TV decoders are relatively cheaper but require subscribers to pay a monthly fee. Pay/subscription decoders also enable access to a bouquet of additional content. In light of the foregoing, no consumer will be denied access to information on account of inability to afford monthly subscription fees. Kivuva, Going by their adverts and random checks at their retail outlets, the two firms are giving consumers the right information. As Ali has alluded, there are two types of set top boxes or decoders: pay TV (aka subscription) and Free to Air ( FTA).
As the names suggest, FTA decoders do not require any monthly subscription or payment while pay TV decoders are relatively cheaper but require subscribers to pay a monthly fee. Pay/subscription decoders also enable access to a bouquet of additional content.
In light of the foregoing, no consumer will be denied access to information on account of inability to afford monthly subscription fees.
CCK has so far type approved over 40 different models of FTA decoders for use in the country.

1. FTA one which I think is substantially higher. I think almost 5k 2. Subscription one which is like 2k.
