Dear Listers . Following the release of the following regulations :- 1) Data Protection (Civil Registration) Regulations 2020 2) Registration of Persons (National Integrated Identity Management Systems (NIIMs), Regulations 2020 Today we shall cover the first on* Data Protection* and we shall discuss the NIIMs regulations tomorrow . The following are a few questions to guide our discussion:- 1) On the definition of Civil Registry a list of public agencies has been given, should these regulations apply to other state agencies which collect personal data for example the National Employment Authority, NSSF, NHIF etc or would these fit under a separate set of regulations? 2) What happens to existing civil registry databases, shall there be a transition for example IPRS, this is missing in the current draft? 3)The regulations make provisions for requests by public entities what about provisions for requests by private entities? 4) Do you feel that adequate provisions have been made for the protection of your data that will be held by civil registries? Financial Sector Deepening (FSD-Kenya) and IPA will also extend technical support to this study. The main objective of the study is to identify and address potential consumer protection concerns in the regulated and unregulated digital credit markets. The specific objectives of the study will include— (a) Provide evidence regarding the size and nature of the digital credit market. (b) Identify potential consumer protection risks and consumer outcomes within Kenya's digital credit sector. (c) Increase transparency and comprehensiveness of product information and terms and conditions. (d) Address probable fraud in digital financial services. (e) Improve consumer redress for digital credit products. (/) Increase consumer control over personal information to expand choice and competition; and (g) Inform the development of policies to ensure adequate consumer protection across regulated and unregulated lenders and equal protection of all Kenyan consumers. In Conducting the study, the Authority — (a) Shall hold such number of meetings in such places and at such times as it may consider necessary for the proper discharge of its functions; (b) Will receive views from members of the public and receive oral and written submissions from any person with relevant information; and Any party from whom the Authority may require information from in furtherance of the study will be under an obligation to provide the information in and failure to do so shall be an offence under section 18 (6) of the Competition Act, 2010. Members of the Public with relevant information may also submit oral or written submissions to the Secretariat within twenty-one (21) days of publication of this notice. Good morning listers, Today we will talk about Digital Hailing Services Regulations and the licensing of the Service Operators under part 1 of the regulations. Looking at the document, it seems like the NTSA is trying to regulate the industry following the recent incidents that have come up: eg accidents, assisted crimes and digital taxi drivers woes. These regulations will require any digital hailing services; Uber, Bolt, and Swivl, to register in Kenya and operate under the Kenyan laws. They will also obtain operating licences from the NTSA. We would like to hear your views on this: a. Are the regulations necessary? b. Is NTSA the right/best body to regulate Digital Hailing Transport Services? c. What are the likely impacts in the transport industry, Information Society Sector and gig economy? etc d. Should multinationals be subjected to different licensing requirements?
