COFEK: Formalin in Milk
I know milk has nothing to do with ICT but i shared this concern with COFEK and they ignored it. Which consumers or issues do COFEK prefer to deal with? I don't have evidence but Kenya Accreditation Service (KENAS) and KEBS should be able to provide accountability because the milk producers are all showing the KEBS logo for quality.
I am a layman in this, just very concerned about because presentations are coming from health and nutrition experts talking about this.
Please try and see what you can do for the consumer.

Personally, I think COFEK is not the right organization to deal with issues like this. We are not going to send COFEK after every food manufacturer or any other manufacturers when the issues at hand *are not* those that are perceived to exploit (for lack of a better word) the consumer's rights. I also don't think we should be referring all red herrings to COFEK because if we do, it will lose it's main focus which is consumer protection. I am not an advocate for COFEK, but by bringing up this issue here, I can sense some witch-hunt against COFEK. Let's start by appraising ourselves with what COFEK defines as its mandate. Only then can we know what exactly needs to be referred to them. This Milk issue is a matter of public health and we have a whole ministry handling that. Just my though. Such issues should not only interest the state (and its various agencies, e.g. Ministries of Health, public health agencies, KEBS etc.) but also Cofek as a consumer group. Such issues may seem mundane but they can have a great impact on people's health. We remember not long ago that contaminated milk caused the death of a number of children in China. I do agree that COFEK should have interest in this, but they should by no means the first point of contact to deal with a public health issue. Should we pin down COFEK to everything and ignore those charged with the responsibilities?? Well, COFEK should go after KPLC for not delivering on their mandate - too much blackouts! I don't have evidence but Kenya Accreditation Service (KENAS) and KEBS should be able to provide accountability because the milk producers are all showing the KEBS logo for quality.
I am a layman in this, just very concerned about because presentations are coming from health and nutrition experts talking about this.

That we are discussing "formalin in milk" on a respected ICT mailing list confirms some of our inherent fears but we will not get there. Yes, it is within our broad (policy) mandate. But as I am sure most listers refer ICT issues to the regulator (CCK) first and/or seek his opinion, and considering our capacity challenge (not funded by taxpayer), it will also be only fair that people who complain about our services first check with regulators (Kenya Dairy Board in this case) before they refer matters to us. Again, reporting an alarmist issue with no iota of evidence - and asking us to "investigate" - from the unknown to the known - can only go as far as referring to the competent bodies. Why? We have no laboratory of our own and no surplus funds to start sampling all milk for formalin - as the complainant in this case never even pointed us to the geographical area or company that could have been importing contaminated milk. Nonetheless our Consumer Dialogue Forum 4 on September 12 at Intercontinental on food additives raised this issue. The Chief Public Health Officer Dr Ombacho who was present discounted the fears. Formalin is a chemical normally used to preserve dead bodies. Formalin has many negative impacts on human health. If it becomes part of food, it turns into formic acid in human body and increases acidity level. More intake of formalin can cause breathing problems, coma and even death.
US Environment Protection Agency and International Agency for Research on Cancer count formalin as one of the cancer-causing agents.
Can COFEK try and investigate this.
With so many deaths being reported from cancer and every urban dweller entirely dependent on milk from the shops right from early childhood, we are very exposed if this is actually true.
Stephen, please advice if you shall investigate this further and protect the consumer.

Thank you Dorcas for bringing the issue of milk to the list. There is a brand in the market that has a shelf life of a month without any refrigeration, yet it's not Ultra Heat Treated (UHT). As consumers we should be very very scared. I've resorted to only buy milk from the national Milk processor, since as a government owned entity, they have no need for obscene profits gotten through illegal means. But lets not be naive about COFEK. As many private entities go, the highest bidder gets to call the shots. Remember the only one rule for success ... "What's in it for me?" The consumer body will first represents the interests of those that bankroll it, before looking for other interests. Isn't this obvious? Consumer movement is about services and products and not policing the public and public policy. In Digital Migration the Government did not want to interfere with the market. The free market economy has a self adjusting mechanism that benefits the consumer. Rich people will rush to buy set top boxes at introductory pricing which often is higher and as the market slows down, the prices are adjusted to accommodate new customers. The price of set top boxes has come down from a high of Kes. 12,000 to Kes. 1,500 not because cofek intervened but due to demand and supply forces. Soon multiplex operators would give free set top boxes as more people buy Digital TVs. I liked Windows 8 when it came out and could not afford it but I have got to wait for the prices to be reasonable to me. How come cofek has not fought for poor developers to access it? With all due respect to Dr Ndemo, courts exist for a purpose. When we are not able to resolve our issues both in public and private sphere, we must accept without conditions, a third arbiter-the Courts.Citizens must and will forever in Kenya engage in public policy. The days when a few technocrats pushed decisions without caring how they may affect the citizenry or involving them are long gone. Technocrats must be held to account and judicial proceedings are just part of that however vexatious defendants think. I sincerely doubt that COFEK went to Court to entirely stop the digital switchover but to seek that the process is not just left to market forces because markets fail and often so. The scandals in the banking sector and the economic recession are clear pointers that a market can only be trusted if it has clear strong regulators and an informed citizenry. How do we explain the approval and sale of set-top boxes of a lower version yet we knew that we could have gone for a higher version straight on. Who did the approval? What were the incentives etc? With regard to the digital switchover, while it is clear to all that the digital transmission technology that analog TV stations all over the world are adopting has the potential to bring new openness and diversity to the airwaves. But the process is costly and highly politicised. If the political decisions are not well thought through and the decision-makers not fully held accountable there could be be big dangers on free flow of information and thus democracy. I believe, the Ministry of Information, CCK and COFEK have a duty to Kenyans to calm down, stop shadow-boxing and embrace genuine dialogue. They must work with all other stakeholders to head off any would-be negative effects and ensure that digital technology makes good its potential to create new and varied forms of on-air expression.
