Should the Data Commissioner report to a Board?

Dear Listers, The parliamentary committee that investigated the recent Worldcoin saga made several recommendations that, among others, are stated on page 115, Section 6(d), as follows: Amend the Data Protection Act, 2019 to provide for a Board where the Office of the Data Protection Commissioner (ODPC) reports to or accounts to on its daily operations. Do you agree? https://www.kictanet.or.ke/why-the-data-commissioner-should-or-shouldnt-repo...

Hi @David Indeje <dindeje@kictanet.or.ke> , I don't know, the rationale is not clear to me. The current office has barely settled for us to create a structure above it. My thoughts On Tue, 5 Dec 2023, 8:10 am David Indeje via KICTANet, < kictanet@lists.kictanet.or.ke> wrote:

Hi David, Way to go. The confusion around worldcoin saga necessitated creation of the office to avoid future occurrences of the same. Kind Regards, Paul Sent from my iPhone

Paul, Please elaborate , the ODPC existed before Worldcoin, what exactly did they do wrong beyond registering them as a Data Controller, in my humble opinion the Jury did not seem to be well informed on the subject they were adjudicating, its imperative we call out such issues. Policy should not be driven by emotions, it requires logic and long term thinking. Regards On Tue, Dec 5, 2023 at 7:22 PM Paul Magacha < magacha.cirrus.techvue@gmail.com> wrote:

This is an interesting one. On one hand, I feel that for governance purposes that might not necessarily be a bad idea. However several questions need to be interrogated:- 1. What are other jurisdictions doing in that score? For example, the GDPR implementation in Europe. What is the organizational structure around it? 2. Did the parliamentary committee overstep its mandate by asking for this? What is their expertise in this area? 3. What are the hidden reasons for this? As far as I'm concerned, when it comes to politicians look for non-verbal communication.
