In a nutshell, with the agreement, there is bound to be challenges in relation to data transfers. The Data Protection Act provides that transfers should be to countries that have data laws similar to ours. The US does not have concrete data protection laws. Will we use the trade agreement to with away our data to a country that has no data protection laws? Will we use the trade agreement to with away our data to a country that has no data protection laws?

Hi Listers My two cents on the FTA . The problems with data protection not withstanding, back to the original question Ali asked why there are 9 American companies on the FTA negotiation list; while on the one hand they might argue that these MNCs are also registered here (if that's the case), the bigger issue is what is the real benefit to Kenyan companies. This is reminiscent of the problems that the Economic Partnership Agreements (EPAs) with the EU caused where local producers ended up being disadvantaged getting the short end of the stick of being relegated to raw material providers, no participation and disadvantaged in costs with lack of government subsidies as opposed to the EU producers. As long as this is the case, the local producers do not get value for their produce, with very little value addition, we end up buying back our own products as imported goods when they are sold back to us as finished products. While this consortium seems to have Kenyan companies, it would be insightful to know the composition of those Kenyan companies, and if the 9 MNCs are representative or take the centre stage at the negotiations as Kenyan companies then that is problematic as there is no real negotiations with no real participation of Kenyan companies - still a case of scoring own goals- another short end of the stick to local producers where we remain relegated to raw materials producers and net importers of finished goods. Our industries can't grow under such trade agreements. Regards Beryl On Wed, Sep 2, 2020 at 9:03 AM Ali Hussein via kictanet < kictanet@lists.kictanet.or.ke> wrote:

Will we use the trade agreement to with away our data to a country that has no data protection laws?

However you look at it, Kenya is going to be slaughtered at the negotiation table. At least 12 US companies are representing and negotiating for Kenya against US. We know where they get their briefing. I wonder how many Kenyan companies domicile in US are representing US in negotiating with Kenya.

Hi Fiona: Great that TESPOK is representing local companies in the FTA Negotiations! Interestingly I was instrumental in bringing some of US Business Chambers representatives to Kenya, introduced them to top GOK Officials! It’s obviously not in their interest to have a KENYAN-AMERICAN former US Embassy staff responsible for ICT Programs in the Africa Region participating! I would like to privately provide you some key inputs that could assist your bargaining for us! Some of those US companies are pure SHARKS! Beware some of them are married to Kenyans for BIASHARA! Baraka and good Morning! On Thursday, September 3, 2020, Fiona Asonga via kictanet < kictanet@lists.kictanet.or.ke> wrote:

Dear Listers & Ali: This is just DOWNRIGHT WRONG! So in essence it’s the US Companies benefitting from the FTA 90% and not the Kenya companies? Well short of it, am one of the ARCHITECTS of Huduma Centers application which I developed for my PhD awarded July 31, 2006 in the US! Big fight ensued with a Technology Company in Washington DC that wanted to own 90% of the app at the cost of 10%! I DECLINED and returned back HOME am Kenyan CITIZEN US Permanent Resident since 2001! That’s pure IMBALANCE OF TRADE! It’s better that GOK owns Huduma Centers 100% hata kama hawakunilipa chochote than have IRISH-AMERICANS owning it 90%! Challenge those 9 companies add KENYAN-AMERICANS like our Afrika ICT Strategies Inc! Is KEPSA Clean? How many BRITISH-Kenyans sit on KEPSA Board? Ali, listers. Please remember that "Trade Agreements" are about "self-interest" of those initiating the process. They are not primarily intended to help developing countries. In our current situation, the other party has long experience in that field, including NAFTA(Mexico, US, Canada) in 1994.For a general brief on this subject, please read Chapter 3,"Making Trade Fair", of the book - Making Globalization Work, by Prof. Stiglitz, who won Nobel Prize in Economics in 2001. Regarding our strategy, I would say the following. "A country is not a big company", according to Prof. Krugman, a Nobel Prize winner in economics. He further adds" The skills learned in business are not useful while formulating economic policy. Even the best businessmen are often very poor in formulating economic policy. Business is about self interest while economic policy is about National Interest. It would therefore be naive to let private interests lead or even dominate national interest matters. They're good at what they do but lack competence in matters of public policy. John Kariuki Sent from Yahoo Mail on Android On Wed, Sep 2, 2020 at 15:53, S.M. Listers, There are a lot of things going on here, the spirit of AfCTA is to discourage bilateral TAs but again self interest trumps everything. US FTAs with developing countries are usually quite predictable save for few issues ie Taxation, beneficial ownership etc. That said, I think TAs are overrated, US/India have traded for more than 30 years on human ICT without any deal as it were - India produces the best ICT brains, the US buys them, no questions asked, no favours demanded. Most trade deals are political (agency grandstanding), citizens of different countries trade with each other because it's beneficial to them. Take for example Pakistan, they are the biggest buy of KE tea. The simple reason is because they cannot bear to import tea from next door India, however the suits will lead you to believe it's because of the KE-PAK trade deal. The UK recently announced that non-graduate Kenyans will be allowed to get work permits and work in the UK, what you is not outlined is, when UK leaves the EU on Jan 31, it will no longer access the Eastern Europe fruit pickers/ packers and this is where our brothers and sisters come-in, again some-one will stand on a podium with an ugly suit and say it's because of the UK-KE trade deal. Ali, listers. Please remember that "Trade Agreements" are about "self-interest" of those initiating the process. They are not primarily intended to help developing countries. In our current situation, the other party has long experience in that field, including NAFTA(Mexico, US, Canada) in 1994. For a general brief on this subject, please read Chapter 3,"Making Trade Fair", of the book - Making Globalization Work, by Prof.

Lastly before i forget, KE does not have any TA with Somalia or its many splinter states, yet we have 5 flights everyday to Somalia ferrying Miraa! I still quite see what the US angle is, time will tell.
