Day 9: SECTION 21: LEGAL PROCEEDINGS and SECTION 22: LEGALITY OF ACTS
Dear Listers, Only two more days to go; so please feel free to respond to any issues from Day 1-9 under the correct headers. Yesterday, we discussed the dissolution of CCK; transfer of staff; and transfer of rights, liabilities and obligations. Kerubo said it should be clear that CCK will be dissolved only when the ICCK Act is passed. Therefore, she suggests a revision to the meaning of 'effective date' in part one to read: "effective date" means the date that this Act shall be passed, which date shall be determined by the Cabinet Secretary by Gazette notice. Stanely Murage on the other hand suggested that Section 20 should have terms like "assets, and probably treaties, etc " as some may not be covered under the usual rights. Catherine you forgot about the annual report Section 16 provides as a bare minimum and the reports only processes and activities . this is very reactive The ICCK should go beyond the data and figures and make a statement of the status of the industry with a pointer on the direction of the ICT sector in line with the national aspiration and global context . this status will include the financial health of the ICT sector e.g. CBK and other regulators publish a combined proforma financial statement for the sector to give a overview of the health of the sector , other regulators also give space for subsidiary organs to be captured in the report . thus the report should capture Appeals tribunal and the NCS who are largely funded by ICCK .
