A helpful overview, thanks. More reporting on cyber crime would be helpful - the CMCA does prescribe audits for critical infrastructure and having these audits publicly available would be one way to increase public knowledge in this area. Due to financial considerations, many people use older hardware and older software and pirated software leading to greater exposure to risks. Would it be possible to estimate the magnitude of fines and sentences that cyber crimes should attract? Behavior online is perhaps not so different from behavior offline - are fines and sentences for physical crimes sufficient? Other than using the stick to deter bad actions, ar there carrots that can promote good behavior? Kenya has had a number of cyber security competitions, mostly promoting technical expertise for programmers. There is probably a need for a section of legal professionals to have programming skills and some programmers to obtain some understanding of criminal and business law - this can of course be done outside traditional educational settings, but having it incorporated in traditional educational settings would be helpful.

Additionally, the ever-evolving nature of cyber threats often outpaces legislative frameworks, making it difficult to address new forms of cybercrimes. 2. I agree with you on the need to review our penalties in the CMCA as imposing higher and more stringent penalties for cybercrimes will act as a powerful deterrent, discouraging potential criminals from engaging in such activities due to the increased risk of severe consequences. But this begs the questions, which other listers can chip in, i.e.: 1. How high a penalty do you think will suffice? 2. How do we accurately compute the enhanced penalties which we so need? For example: S.31 on cyber terrorism has penalties of up to 10 years imprisonment, a fine of Kshs. 5 million or both. S.21 on cyber espionage has penalties of up to 20 years imprisonment, a fine of Kshs. 10 million or both. Then there is S.19 pertaining to unauthorized disclosure of passwords or access codes which has penalties of up to 3 years imprisonment or a fine of Kshs. 5 million or both. And yet with GOK embracing e-governance, with over 14,000 services uploaded on E-Citizen with a target total of 21,000 services, with the private sector also embracing digital transformation the unauthorized disclosure of passwords and access codes can have serious socio-economic and national security repercussions to our Republic. *Dear Barrack,* FYI ... the cases that have been prosecuted under the CMCA have all been in lower courts and thus not accessible via the Kenya Law Reports. As at last year just slightly over 200 cases had been prosecuted. Of those only about a third of those matters were successfully completed. A few were appealed though. There has been a challenge prosecuting CMCA related cases effectively due lack of adequate capacity and so most of them that were not successfully prosecuted had evidence challenges pertaining to its insufficiency, improper/illegal collection, inconsistencies with requirements under the Evidence Act and or unavailability of crucial evidence. As such we need to enhance much need digital evidence collection, preservation to ensure court admissible and sufficient evidence can be adduced by enhancing the capacity of the legal cycle on such matters i.e. law enforcement officers, prosecutors and the bench to ensure these matters can be effectively prosecuted and justiciable decisions made from a space of adequate competence of the CMCA related matters. *Dear Ali,* You had requested the link to the CMCA.
