Dear all, Good afternoon. May I seek your kind indulgence to divert your attention from the very nice exchanges on this forum so far. I am sure most of you subscribed to 411 and 6667 have by now received this SMS message "Government overturns decision by Communications Commission of Kenya (CCK) Chairman Philip Okundi to sack Director General Charles Njoroge. Minister Samuel Poghisio says his contract to be renewed". The issue of governance at any institution especially CCK is critical. Let us not gloss and keep mum over it. Of course our position is public knowledge. We have always long sided with the Board decision before they even firmed up the same. The Minister has disregarded his Board's advice, however biased they may have been. He cannot fire the Chairman as he is appointed by the Chairman. By the way, I must insist that this is not anything personal with my good friend Eng. Njoroge but we feel it is time he gracefully left the CCK renewal of contract notwithstanding. Kindly be polite even if you sharply disagree with our position. Thank you. I agree with you fully Stephen. I do not want to get into other details, although they may apply at some point, that the CCK MD, Njoroge, is Michuki's real or step brother. That is not the point at the moment. The point is, the board has clearly outlined the reasons why he does not merit a term renewal. There were benchmarks that had been set when he signed the contract and if he did not deliver on the benchmarks, he should not use his connections in government to try and force a renewal. Nobody owns a public office. Under the current legal framework, is the Minister acting within his powers in reinstating the DG? If he is, regardless of what the Board thinks, what we have is a governance nightmare that needs to be fixed. Looking forward to the independent commission. What happens when a board is acting in what appears to be against the will of majority of the Kenyans?

Nothing. Appears does not equate to the actual will. Seriously though, this matter is neither here nor there. If the Board has a mandate and acted within that mandate, then the DG should only adhere to that, the imagined "will of the majority" notwithstanding. If it is true that he flanked the interview for the renewal of his contract, and there is no provision that his performance (as perceived) can lead to a reprieve, then the rules of the game must be followed. We should learn to act based on facts/rules, not emotions/perceptions. OTOH, if the law allows "the Minister" to overturn decisions made by the CCK Board, then that, too, is playing by the rules. At a personal level, while not considering whatever rules were being followed, I'd have thought that an individual's contract should be renewed based on performance appraisal. If the DG failed an interview which is part of this appraisal process, then he should leave quietly. This is what no one is willing to tell us about.
