Their Network accepts SMS from Telkom Wireless but replies to these message instantly report "message sending failed" although Safaricom still eat your balance.
We have been at Telcos malpractices since 2005 and now it is time to change the strategies. We are filing a lawsuit against Safaricom Ltd and we need as many petitions as possible. Kindly send your electronic petition directly to me assist our lawyers in filing the suit.

If the messages and calls are getting from one network to another it implies an interconnection agreement already exists. This is could very well be a technical problem involving GSM/CDMA messaging protocols or other reasons which may be non technical. If consumers have been complaining and the provider has nothing to resolve the matter or issue refunds, consumers have a right to seek redress through other avenues. The best and simplest resolution would be for the provider to review their billing records for SMS sent to Telkom Wireless and credit those accounts for billings made while ensuring that the problem does not occur again. In regards to recourse there is plenty of recourse particularly for prepaid accounts as opposed to post paid accounts where the provider has already received funds and failed to deliver a service that has been paid for. As a user of both networks, the messages have been flowing too well from both networks until some time ago ( I think on 10thof this month) , when they became erratic, and finally one leg. (TKL to Safaricom only). This certainly means it is not a technical issue, but rather may be another issue that the two operators need to come out and tell Kenyans. Being robbed blind like this in our own soil is not good. Lawsuits that may ensue may not augur well for our economy, more so if the courts establish the case of a provider abusing a dominant position or some other underhand tactics in the marketplace.
