I respectfully disagree with @Eshuchi, @Githaiga et al. The discussion on the CAK decision is a policy one. Our responses must focus on that and clearly reiterate what may be connived to be media pluralism and diversity. Similarly, we must understand that KBC is on a deathbed. Poor programming. No financial resources. Obsolete equipment and technology. High debts. Why doesn't the national government utilise KBC? Why do they use private media ? What is the cost of media in National government? why must that right for County Government be subjugated at the altar of...? The argument that we have enough radios may suffice from an operational point but ask yourself why we thought it imprudent when KBC had numerous radio channels why did we advocate for more community, commercial and public media service entities. The decision is has no basis in law but may be justified when other factors are brought to bear like a group of counties deciding to start one station as opposed to exclusive 47 stations. There are many radio stations that the country governments could consider going into partnerships with, and still meet their communication goals. @Ahmed, you asked about costs. Creating partnerships with existing stations that already have listenership in the counties would serve as a mechanism to facilitate public communication which in my view, is more prudent with regard to the spending of county monetary resources. A media station requires diverse content, everyday. After communicating a public announcement, what else would air? How do we interpret Part IX of the County Governments Act? Section 95: (1) A County government shall establish mechanisms to facilitate public communication and access to information in the form of media with the widest public outreach in the county, which may include— (a) television stations; (b) information communication technology centres; (c) websites; (d) community radio stations; (e) public meetings; and (f) traditional media. (2) The county government shall encourage and facilitate other means of mass communication including traditional media. On a 200kHz 'channel' spacing, there are only 150 distinct frequencies available. If one county is granted a licence, it won't be long before the other 46 counties would want in on the act. Of course, frequencies may be re-used based on geographical separation - but this requires a level of planning skill they maybe don't have? The 'constitution' excuse is just a convenient way of avoiding the issue ;) Cheers, Tony On 21/09/2016, Ali Hussein via kictanet < kictanet@lists.kictanet.or.ke > wrote: BQ_BEGIN The Communications Authority of Kenya (CA) has denied county governments BQ_END BQ_BEGIN permits to set up radio stations, stirring a fresh storm between Nairobi and BQ_END BQ_BEGIN the devolved units.
