We may end up having more regulators than service providers being regulated...the craze is in all sectors...the tragedy is that the regulators are supposed to be supported by the regulated...we ought to move from regulating to facilitating and finally to enabling.Over regulation is disabling.

Subject: Re: [kictanet] Proposed Film Bill

We are seeing a scenario in Kenya today where everyone is rushing to legislate and regulate. I guess this is a result of progress. With progress comes all sorts of players, rent seekers and gatekeepers who want to have a piece of the pie. The thing is that we MUST remain vigilant and ensure that we all adhere to the new constitutional framework.

All good points!

"Is one supposed to obtain a licence to write or create these games like with films." In this age of mobilephone filmmaking and microfilms, I'm wondering, will that budding filmmaker in Turkana have to apply for a film license in order to make her zero budget, independent 40 second experimental mobilephone microfilm? How many days or weeks will she have to wait for the paperwork? Is there a film office in Turkana or will she be required to come to Nairobi? Could Huduma centres also deal with filmmaking paperwork? How do we strike a balance between regulation and innovation?

Interesting.

1. I thought a KFCB already existed, or which is that one of Mutau who has been having problems with US visa and suppressing and opposing LGBT rights and atheists?
2. It's like an afterthought that someone decided to throw in the computer games. Is one supposed to obtain a licence to write or create these games like with films. The part of the document that deals with films and stage plays substantively does not deal with computer games.
3. The part about ISPs is thrown in by someone who is completely ignorant. ISPs do not deal with content; they don't even see it (and they should not!). An ISP is just a conduit or facilitator. Do these people expect an ISP to employ people to screen content of their clients?
4. If we are not careful Kenya will start going backwards as more people come up with all kinds of proposed legislation; what is there to stop film makers moving to neighbouring countries and taking all those jobs with them?
5. Speak up!

Dear Tony,

Yes, it's the one. Of special interest to ISPs is section 39.
