Hi all, Valid issues being raised. It might be a good idea to have a town hall meeting to discuss this issues since there seems to be a lot of misunderstanding. Is this something CA would be willing to consider? Rachel or Wambua? Considering the contribution of the Internet to the Gross Domestic product and the role of trust in ensuring uptake of Internet and telecommunication services it would be worth clearing the air and ensuring that we do what is right for the country and the sector. I am sure this is something KICTANET can coordinate. Regards On 2/20/17, Nanjira Sambuli via kictanet <kictanet@lists.kictanet.or.ke> wrote:
Not to mention that COFEK also claim they weren't consulted. Public trust of both govt and Telcos here is compromised. And it's up to CA especially to clear the air by proactive communication, not just chiming in when public fears have been stoked.
It can't be emphasised enough, it's an election year. Fears -unfounded or not- are easily stoked.
Additionally, as someone mentioned, CA needs to explain further the "surveillance" equipment it is supposedly deploying. What will be monitored etc. I refer to https://twitter.com/ninanjira/status/819809470544953344

Another look at the whole scenario, would be that the entire issue has been "politicised" by the telco's since they know the potential impact on their commercials. A lot of Kenyans use the chinese fakes, and as such a lot of the cariers traffic passes through these "fakes". Could it be that genuinely CA is looking at a purely device focussed and not user content? Consider that the "breaking news" was as a result of leaks by the telco's on the letter sent by the CA and it's requirement of them. I think this is also potentially a valid twist to the narrative. That being said, the onus is on the CA as a public body to show beyond doubt their intentions are not malicious.

I would be interested with a response from CA on the issues raised by the kenya human rights commission on the phone tapping

Which mobile phones are these that will be transmitting election results? Isn't this so far-fetched?

I thought it wise to share my views with you. Tapping and listening to phone calls and reading messages may not be the main reason why the government wants access...
The question we should be asking is... why now? Why during an election year?...
My take is that.. someone wants to access the mobile phones that will be sending tallied results from polling centres so that they can doctor them before they reach IEBC. Kenyans should be vigilant on anything that happens from now onwards... till election day...Be vigilant wherever you are!!

Thank you for your prompt response. However, other than take your word for it it would also be prudent for the Telcos (Safaricom, Orange, Airtel) to also let us know their thoughts on this without fear of being victimized.
Steve? Anyone from Orange here with authority to speak? How about Airtel?

Dear listers,
We are aware about the misleading reports in the media. The Authority will address the media shortly to clarify and explain how the system works. There is no infringement of privacy. As a matter of fact, no information leaves the MNOs. Instead the system queries the databases (whitelist, type approved devices etc) to determine the genuineness of a device before service is given. What part of that is infringement of privacy?
We will share the statement with you to help all of you understand. No one needs to be instilled with fear that is generated by parties with vested interests. we want to eliminate illegal telecoms traffic through SIM boxing, counterfeit devices, substandard devices etc, for your good as the public. Not the other way as portrayed in the media.

But on what legal basis is the phone tapping being done? The closest connection I can see to the issue of counterfeit devices is the Type Approval Regulations, 2010. If this is the basis, how can subsidiary legislation be used to limit a right like privacy? Could CA clarify on what basis this is happening???

From Tuesday, the government wants to be allowed to listen to your calls, read your texts and review your mobile money transactions.
The government, through the Communications Authority of Kenya, has ordered mobile phone companies to allow it to tap their computers.
