Hi Susan, Many thanks for the question. We are the ones who elect the members of parliament. It is our responsibility to build their Capacity in areas that have gaps. KICTANet works very closely with the Parliamentary Committees of ICT and Innovation and its equivalent at the Senate. Other industry bodies such as KEPSA and KAM do the same while at Regional level we have the African Parliamentary Network on Internet Governance. In light of the issues we are dealing with, we need to do more as a preemptive measure to make sure that they are well capacitated to debate on issues that touch on digitization and digitalization. Thank you Best Regards On Wed, Jun 19, 2024 at 2:21 PM Obunga Guya via KICTANet < [email protected]> wrote:
Hey Barrack,
Follow up question,
Whose responsibility is it to build capacity for Lawmakers, is there a provision or mandate somewhere?
Kind regards, Susan Otieno On Wed, 19 Jun 2024 at 12:19, Barrack Otieno <[email protected]> wrote:
I think we still need a lot of multistakeholder engagement and Capacity Building for Lawmakers. This became apparent during a conversation i had with a former member of Parliament yesterday.

Hey David,
I think Law makers should uphold constitutional rights (in this case right to privacy) and set out parameters for the Revenue Authority to execute its manadate.
Before creating a situation that could violate the right to privacy. Lawmakers should first consider establishing safegurads or consider alternatives that have a less risk of violating peoples rights.
We talk about privacy by design and default in data protection, this can also be applied by Lawmakers in how the uphold constitutional rights in the Laws they make.
Kind regards, Susan Otieno

Dear Listers,
Kenyan lawmakers are debating the finance Bill 2024 that would exempt the Kenya Revenue Authority (KRA) from the Data Protection Act. This means KRA could access your data, like mobile money records, without a warrant.
*Why is this a problem?*
1. Privacy Violation: This bypasses your right to data privacy enshrined in the Kenyan Constitution. 2. Unfair Assumptions: KRA might assume all mobile money transactions are taxable income, leading to harassment of innocent citizens. 3. Slippery Slope: This sets a precedent for other government agencies to seek similar exemptions, weakening data protection overall.
What should Lawmakers prioritize? <https://www.kictanet.or.ke/should-kra-bypass-privacy-laws-to-collect-taxes/>
