How can www.co.ke, a sub domain of co.ke be owned by someone else? 

This does not make sense.

My proposal is not for the domain to be sold, but rather, the A records for the #2 .co.ke domain (and their attendant mx records), the domain could still be maintained by Kenic, and all they do is point to the coke servers.
