I think the discussion here is a clear illustration of the Board’s thought process and by extension its poor decision. We first want to decide whether we agree with what the creative is portraying before we decide whether they deserve the right to say it or not. Hence a convoluted argument on whether we like/accept/condemn/loathe the LGBQTIA. We have missed the point entirely. Going back to what I said earlier on the media shutdown, whether we think highly of something or not, we must respect the author’s right to say it.

Actually this does affect ICT policy. The Kenya Film Classification Board, according to its chair and the board itself, has the power to block(viewing/distribution) of not just films but really any video it deems to violate so called  "morals and values" of Kenya. This a a threat not just to free speech but any businesses that make/distribute/sell videos online. The extremes of this were demonstrated when the board chair claimed that the video of that unfortunate deputy governor that surfaced the last couple of weeks was not authorised by the board and should be taken down. Hiding behind article 45 of the constitution is an impressive bit of slight of hand by the board. LGBTI community is not looking to get married, yet, they want to be treated as human beings. 

All this said I think it's time we got rid of the penal code in its entirety.

There are many issues of morality in relationships, but what does the
sexual orientation of the partners have to do with anything?
