Our newly rebranded communications regulator faces many challenges

Recently, the communications regulator formerly known as CCK rebranded, and is now known as the Communication Authority of Kenya.During the launch ceremony presided over by none other than President Uhuru Kenyatta, the chairman of the regulatory board handed over to the Exchequer a fat cheque of Sh4 billion in dividends from the previous year. Lister's, According to a recent report that was commissioned by ICANN and published by the Boston Consulting Group entitled, The Connected World, greasing the wheels of the Internet Economy, digitally driven economic growth continues to be one of the few bright spots in a sluggish global economy. Reducing or eliminating numerous factors that inhibit online interactions and exchange could cause this growth to be even faster and could have an even bigger impact. Questions 1) To what extent is the policy environment facilitating the expansion of infrastructure which is one of the major factors limiting access to online activity? 2) To what extent is the policy environment facilitating the development of skilled labour and availability of Capital that would support the development of digital businesses? 3) To what extent is the growth and development of payment systems and enhancement of data security affecting the degree to which citizens and consumers engage in online activities? 4)To what extent is the policy environment promoting the use of local content as well as facilitating Internet openness? Dear Listers, The Kenya Internet Governance Forum will be held on 3 July 2014. As has been the case before, the meeting will be preceded by an online discussion whose report will be ratified during the face to face meeting to be held on third July 2014. This years meeting will be convened by the Internet Society Kenya partner through the Kenya Internet Governance working group and its partners and sponsors This years meeting will focus on the following key thematic areas: 1) Policies enabling access/Net Neutrality 2) Cyber security 3) Internet as an engine for growth and development focusing on Internet and Human rights as well as Social Media and Hate Speech The discussion will be held over a period of three days, starting today . The draft programme for the Kenya Internet governance forum is available on the Kenya Internet Governance Forum website www.kenyaigf.or.ke/index.php/about-kigf/kigf-programme. Thank you

Government was supposed to export abroad and train, in britain and israel an initial 250 newly recruited and trained police officers handpicked from our universities for this purpose. I happen to know that the budget for this training is rather generous and a lot of the capbilities for this system are not in public domain. Safaricom does not oversee the security curriculum and apart from two people (both young kenyans) who are exclusively responsible and intimately involved with most parts of the project everything else is GOK. Ethiopia has been trying to put together a new generation digital monitoring and security system with aspects similar to what kenya i doing. Their consultant was kenyan. they have the same Huawei/ZTE mess we have. dont forget that in security issues what you see is not often what inr eality is the case. And meanwhile, the criminals, run and hide ads are still running. We really have a GOOD opportunity to develop capacity locally if there is a determined effort. Back in the 1980s (??) Moi challenged universities to produce the Nyayo Car. This was done, despite the poor quality of the product. But it demonstrated that our people can do it given the challenge, the chance and resources. Had we proceeded on that path, we could be producing a Kenyan car, however rudimentary. Indeed, we could even be producing substantial ranges of spares even for foreign models (just imagine the engineering knowledge, project management, quality assurance, etc capabilities we would have acquired by now.) What's more, results from such investments don't end up confined where they were initially targeted. A lot of US aerospace and military research realizes many applications/products for civilian use (example = microwave tech!). Talking of Booze Allen, I thought they also did our Cybersecurity Master Plan? Or not so? Ali: what's our "national interest" and how many, even in government, understand it, act in concert with it and remain patriotic enough to live to the promise! This is in an environment where a large segment of Kenyans can even sell their mothers for "30 pieces of silver". You can "hear" utter: damn the national interest, if one existed and understood thus. Security Situation in Kenya

Listers, In case you might not have heard, there has been a very serious security breach that has occurred in Mpeketoni, Lamu that has so far claimed close to 50 persons. The details on this are here http://www.nation.co.ke/news/mpeketoni-Lamu-gunfire-al-shabaab-terrorism/-/… To put this into context, Mpeketoni is the largest town, bar Lamu, between the Somali Border and Malindi and the center of commercial activity in the region. So, as much as a lot of us might not know it, the fact that Al-Shabbab could drive trucks full of fighters into such a town and commit these crimes and then leave should send all the security-bells that we have ringing. This is exactly how Boko Haram started in Nigeria and we are seeing it played out here right infront of us. I think its time that we spoke as the local ICT Community and came up with a stand on what in our opinion needs to be done in ICT Terms to secure this nation. TAKING STOCK OF WHERE WE ARE AS AN INDUSTRY

Listers Once in a while we must take stock of where we are at as a country beyond ICT because it is the environment we live in that ensures we succeed or fail. There is no doubt that this country has come a long way since 'independence' and the bad old days of the KANU Regime. What have we achieved since Multi-Partism? 1. Freedom of speech and association, a more competitive political landscape and the De-Godization (my own words!) :) of the Presidency. 2. A somewhat level playing field in the pursuit of happiness (read economic activities) 3. A more tolerant (not sure) society? 4. The 'discovery' of mineral resources (the wags have it that certain people high in government knew about the potential of our extractive natural resources long time ago and for whatever reason didn't move ahead to start exploiting them) and the potential economic empowerment for the country. 5. And for our industry a robust playing field filled with hope and enthusiasm for the future. 6. The right regulatory environment for most sectors (especially ICT) is emerging and although a work in progress a step in the right direction. 7. Almost universal access to financial services through the use of mobile technologies. Where have we retrogressed? 1 Moi warmed us about the ills of Multi-partyism and that it will breed tribalism in its most virile form. Are we seeing his self-fulling prophesies come to light? 2. The more things change the more they remain the same? What has really changed in the political playing field? 3. The recurrence of corruption networks. 4. Religious extremism never seen before and the almost ineffectual response by our disciplined forces. 5. A retrogressive regulatory environment? Or is it that there is less engagement with the industry then we have been used to in the last decade? I'm writing this because we MUST TAKE STOCK as an industry and ensure that we understand the environment we live in and how we can come together to change it. To give you an analogy I borrowed from Tom Friedman's famous book ' The World is Flat' - if the Operating System is flawed then it doesn't matter how good your desktop productivity tools are since you won't even be able to access them! What role can we play as an industry beyond penning opinions in lists like these, blogs and social media engagement? EFF to Court: U.S. Warrants Don't Apply to Overseas Emails Microsoft Fights to Protect Data Held on Servers in Ireland San Francisco - The Electronic Frontier Foundation (EFF) has urged a federal court to block a U.S. search warrant ordering Microsoft to turn over a customer's emails held in an overseas server, arguing that the case has dangerous privacy implications for Internet users everywhere. The case started in December of last year, when a magistrate judge in New York signed a search warrant seeking records and emails from a Microsoft account in connection with a criminal investigation. However, Microsoft determined that the emails the government sought were on a Microsoft server in Dublin, Ireland. Because a U.S. judge has no authority to issue warrants to search and seize property or data abroad, Microsoft refused to turn over the emails and asked the magistrate to quash the warrant. But the magistrate denied Microsoft's request, ruling there was no foreign search because the data would be reviewed by law enforcement agents in the U.S. Microsoft appealed the decision. In an amicus brief in support of Microsoft, EFF argues the magistrate's rationale ignores the fact that copying the emails is a "seizure" that takes place in Ireland. "The Fourth Amendment protects from unreasonable search and seizure. You can't ignore the 'seizure' part just because the property is digital and not physical," said EFF Staff Attorney Hanni Fakhoury. "Ignoring this basic point has dangerous implications - it could open the door to unfounded law enforcement access to and collection of data stored around the world." The government has argued that allowing a U.S. judge to order the collection of data stored abroad is necessary, because international storage would make it easy for U.S. Internet companies to avoid complying with search warrants. But Microsoft asserts that the government's legal theory could hurt U.S. technology companies that are trying to do business internationally. Additionally, EFF argues in its amicus brief that the government's approach hurts Internet users globally, as it would allow the U.S. to obtain electronic records stored abroad without complying with mutual assistance treaty obligations or other nations' own laws. Listers Internet Giants are fighting back their governments' request for data and access to their networks in the wake of Snowdenia. http://www.nytimes.com/2014/06/07/technology/internet-giants-erect-barriers… This is a natural reaction to the fact that most of these companies have seen a significant decline in customer confidence regarding their ability to maintain integrity of their data. Cisco for example has seen it lose market share in Asia and Europe because of perceived NSA installed back doors to their routers. This is an interesting lesson on how government action can detrimentally affect private sector competitiveness.
