It was also an eye opener for the Government to see how the US Government partners with local firms to enhance development in their country and create opportunities elsewhere. As the private sector we have made it clear that Government needs to work with local firms to develop this nation and not only award ‘big’ tenders to foreign companies who will come with their own working terms and conditions. As a Kenyan businessman, it is very sad when I see some people opposing the decision to award a local company a big tender such as the Lamu coal project tender, while fighting for ‘foreign’ companies to be awarded. It is embarrassing how we all talk about dealing with unemployment yet we are not ready to empower credible local firms to create employment for young people. I wonder if at all those opposing are indeed patriotic Kenyans and want to profit the Kenyan people. It is high time Kenyans benefited from tenders of this magnitude. My friends, sometimes it is not about what you will spend but rather the outcome of your expenditure. The outcome must be of more value. Honestly, I am happy for the 37,000 plus shareholders of Centum who have won this tender. This is a step in the right direction and we look forward to Government partnering with credible local owned firms that are result oriented to develop this country and its people. The youth of this country will develop the coal plant and it will create a livelihood for them and their families. We have the capability to do much more if we partnered together. Let’s give Kenyans a chance to develop their own country. (Dr Kirubi is a Kenyan industrialist and a shareholder at Centum)

Last month – August 2014, there was talk of a private public partnership by the Kenya Citizens and Foreign Nationals Management Service, under the Ministry of Interior and Co-ordination of National Government dubbed Umoja Kenya and a company of Israeli origins that was not mentioned. The value of the PPP was pegged at Ksh 9 billion with our government already reaching out to private entities to form anchor clients for when the revenue taps will be open with a projected Ksh 25 billion payday. By Emilar for APCNews JOHANNESBURG, South Africa , 03 September 2014 The Association for Progressive Communications (APC) and the NEPAD Planning and Coordinating Agency-e-Africa Programme are pleased to announce the call for applications for the second African School on Internet Governance to be held in Johannesburg, South Africa, from 12 - 15 November 2014. Internet Governance (IG) is usually defined as the development and application, by governments, the private sector, and civil society of principles, policies, norms, rules, decision- making procedures, and programmes that shape the evolution and use of the internet. While few contest the definition itself, the respective roles, responsibility, power and influence of various stakeholder groups continue to be the subject of intense debate. Also contested is the institutional ecosystem within which decisions that impact on the internet are being made, as well as the principles on which such governance should be based. What is not contested is that (a) IG is complex and and participating effectively in IG processes is not easy, (b) African participation in IG, be it in technical, social or political spheres, is insufficient and (b) few African countries have established sustainable open and inclusive policy discussion forums where government, civil society, businesses and technical people are able to interact effectively and collaborate to develop consistent national and institutional strategies aimed at mobilising the internet for economic, social, political and cultural development. The first Summer School on IG (SSIG) was held in Europe in Meissen in July 2007. It has become an annual event and has given rise to the South School on IG held annually in Latin America for the last four years and an Asia Pacific school that took place in 2011. The first African School took place in Durban in July 2013 and was a huge success, producing 35 "graduates", many of whom have since gone on to play leading roles in internet governance debates in Africa and elsewhere. Topics to be covered include: - History and overview of IG - Policy, development and human rights - Regulation and management: standards, protocols, gTLDs, ccTLDs, internet intermediaries - Multi-stakeholder approaches to IG: roles and processes, challenges and opportunities - Topical issues such as the so-called 'right to forget', the NETmundial and its aftermath, the new African convention on cyber security, and the proposed African Declaration on Internet Rights and Freedoms. More than 175 participants drawn from all over Africa and the rest of the world, gathered for the annual Africa Peering and Interconnection Forum (AfPIF), which seeks to improve Internet interconnection and traffic exchange in Africa and contribute to increase quality of access of Internet as well as reduce the costs of Internet. Currently, most African providers have to route their Internet traffic through Europe or North America, even when the traffic is for networks within the continent or within the same country. As an example, for one to access a Senegalese website from the Gambia, the connection will have to go through Europe, which negatively impacts the speed and reliability of the connection. In the past eight years, Africa has seen a considerable increase in submarine fiber optic cables as well terrestrial backbones connecting cities and towns across most African countries. Nevertheless, this considerable investment has not produced an equally considerable reduction in the cost of access to the end user nor an increase in local content and applications. One of the reasons is because the traffic continues to be routed through Europe and North America just as it did when Africa was connected to the rest of the world using satellite links. “With so many of the continent’s networks not directly interconnected, initiatives to develop capacity for implementing Internet Exchange Points (IXPs) are critical. The support of country code Top Level Domains (ccTLDs) is also a major priority. The deployment of security solutions and IPv6 are critically important, as is the development of mobile and wireless Internet technology,” said Sofie Maddens, Senior Director of Global Services at the Internet Society. Dawit Bekele, Director of the African Regional Bureau at the Internet Society, added, “It is time for the digital integration of Africa. In this increasingly digital world, direct Internet connection between Africans, whether within the same country or across different countries, is critically important for socio-economic development.” There are many barriers to African Internet interconnection. Many obsolete laws and regulations are still not favorable for interconnection. Even though Africa has undeniably considerable content to offer for its citizens and the rest of the world, most of the content is not yet digitized or on-line. Even when it is on-line, it is often hosted outside the continent requiring users to use expensive international bandwidth to access it. AfPIF addressed the challenges of local content generation and hosting, and explored ways to change the current status quo of the African traffic in line with the vision of the Internet Society, which is to have 80% local traffic in Africa by 2020. Smart privacy and government: unlocking value from personal identifying data

Before this issue gets to a level where it has either been sufficiently abused or raises enough voices to draw due attention, the government must take leadership in both driving policy and education of the citizen on the benefits of “smart privacy”. Smart privacy would allow one to know who is accessing uniquely personal identifying information and for what purpose, providing an audit that would leave all parties comfortable transacting in personal data while preventing rogue data peddlers from hiding in the very same shadows that government agencies, as evidenced by Snowmen’s expose also currently use. The Expanding World of Poverty Capitalism

In Orange County, Calif., the probation department’s “supervised electronic confinement program,” which monitors the movements of low-risk offenders, has been outsourced to a private company, Sentinel Offender Services. The company, by its own account, oversees case management, including breath alcohol and drug-testing services, “all at no cost to county taxpayers.” Sentinel makes its money by getting the offenders on probation to pay for the company’s services. Charges can range from $35 to $100 a month. The company boasts of having contracts with more than 200 government agencies, and it takes pride in the “development of offender funded programs where any of our services can be provided at no cost to the agency.” Sentinel is a part of the expanding universe of poverty capitalism. In this unique sector of the economy, costs of essential government services are shifted to the poor. In terms of food, housing and other essentials, the cost of being poor has always been exorbitant. Landlords, grocery stores and other commercial enterprises have all found ways to profit from those at the bottom of the ladder. The recent drive toward privatization of government functions has turned traditional public services into profit-making enterprises as well. In addition to probation, municipal court systems are also turning collections over to a national network of companies like Sentinel that profit from service charges imposed on the men and women who are under court order to pay fees and fines, including traffic tickets (with the fees being sums tacked on by the court to fund administrative services). When they cannot pay these assessed fees and fines – plus collection charges imposed by the private companies — offenders can be sent to jail. There are many documented cases in which courts have imprisoned those who failed to keep up with their combined fines, fees and service charges. “These companies are bill collectors, but they are given the authority to say to someone that if he doesn’t pay, he is going to jail,” John B. The technology works by exploiting an essential fact of all cellular networks: They must keep detailed, up-to-the-minute records on the locations of their customers to deliver calls and other services to them. Surveillance systems are secretly collecting these records to map people’s travels over days, weeks or longer, according to company marketing documents and experts in surveillance technology. The world’s most powerful intelligence services, such as the National Security Agency and Britain’s GCHQ, long have used cellphone data to track targets around the globe. But experts say these new systems allow less technically advanced governments to track people in any nation — including the United States — with relative ease and precision. Users of such technology type a phone number into a computer portal, which then collects information from the location databases maintained by cellular carriers, company documents show. In this way, the surveillance system learns which cell tower a target is currently using, revealing his or her location to within a few blocks in an urban area or a few miles in a rural one. The market says that there is a skills gap as we slowly try to transition to a knowledge first economy that places a premium on technical skills to serve the data driven marketplace. There is no one currently with their finger on the pulse on the exact need since no hard data has been collected on the same. The government on the other side of the spectrum has committed Ksh. 2.5 billion towards the construction of at least sixty technical institutes and has been running the flagship Uwezo Fund targeted at youth, women and persons with disability capitalized at Ksh. 6 billion and about 5.35 billion approved for disbursement for the current financial year. Yes....except that the most vocal civil society are funded by alien governments, vested interests and private corporation to whom they have alligience. When the funders say "jump" they automatically jump, without questioning. So? What quarantee is there that the biometric data will actuall not be stored in far flung places, accessed under foreign laws? Number two; Its interesting how diasporic views lash at many local, such as these, initiatives, yet in the developed countries where they live collection and analysing ofDNA (let alone biometric) info of cheating wives, hubbies, rapists, murderers, etc is routine yet they never raise a voice. Anyway, government is obligated to have indisputable proof of her citizens. Otherwise government can then legitimately decline to issue such a person a national ID and or passport, if exist doubts about their indisputable citizenship status. Alternatively, every citizen excercises their "right to be forgotten" by the government and we all live happily ever after. But if i recall well the key contention/plea was that the appointment of Public University staff into the various ICT Boards to be be found illegal. it appears the judges are in agreement. However, considering the amount of intelkectual talent within public universities - dont you think it is discriminatory that that group of staff are barred from contributing to national development at a Board level? 11 December 2010 , I found myself at the base of a 60 meter tower somewhere in Sagana, with the agenda of the day as bungee jumping. Having rounded up some close friends, we had decided to do something different that would push the limits and get the adrenaline pumping. Being the heaviest of the lot at 80kg, I had to go last as they would need to change cables for my jump (read as…no one will have jumped with your cable configuration). Prof. Kulubi, Your reading of Dunga, J ruling is perfect save for the part you suggest amendments to ICTA Act. That would still be futile unless Art. 260 CoK is amended first. Again, there is something lawyers call "spirit of law" as regards public officers. The spirit envisaged is that you ordinarily can't stand up to the appointing authority. The law should have stated "independent directors" like the case of CA. Again, even if you didn't earn a cent and you were to be away for more than 3 years, UoN is established as a public not private institution. Best of you resign and get appointed! Finally, and on a lighter note, must ICTA be run as if it is the ICT corner if UoN SCR (Senior Common Room). Would it have been good to blend with say doctors, bankers, security etc "experts"? Point being ICT is not about its mentors/seers only but it's a way of life for everyone including the Pope and most wanted criminals. Section 6(2)(e) of the Order which provides that the Board of the Authority shall consist of “not more than six persons, not being public officers, appointed by the Cabinet Secretary, by virtue of their specialist knowledge and distinguished service and experience of at last seven years in matters of information and communications technologies, e-Government, e-Commerce, law, finance, or human resources management.” 3. Section 260 of the constitution gives the interpretation of public office as: “public office” means an office in the national government, a county government or the public service, if the remuneration and benefits of the office are payable directly from the Consolidated Fund or directly out of money provided by Parliament; 4. The judge in his ruling states (Section 42 of the judgement) states: " In my view where a statute donates powers to an authority, the authority ought to ensure that the powers that it exercises are within the four corners of the statute and ought not to extend its powers outside the statute under which it purports to exercise its authority." The judge is simply saying that the Legal Notice gave the CS powers to appoint “not more than six persons, not being public officers” and further the State Corporation Act under which the Order was made requires that such appointments are staggered (to ensure continuity in the business of the Authority). 5. Given this ruling, one could say that the only loophole to appoint the two dons is to use the argument of the 2nd respondent that Nairobi university makes money from other sources and therefore there is doubt that the dons were drawing salary from the Consolidated Fund or directly out of money provided by Parliament. In this regard, the judge states: "Based on the material before me I am not convinced that the mere fact that the 1st and 4th interested parties may be permanent and pensionable employees of the University of Nairobi necessarily qualify them to be public officers as defined under Article 260 of the Constitution." I know that this is where you appear to be convinced that the dons could be re-appointed. The problem here is that the burden of proof will lie with dons or applicants for the position of Board members. In my view each don seeking to serve on the Board of the ICT Authority must under the prevailing Order prove that he or she in on an unpaid leave (also called leave of absence) from the public university for a period longer than 3 years; or that all his remuneration will come from a research project/parallel students’ fees/consultancy for the whole of the three years that he or she is serving on the Board. This is not a common practice since most universities have ceilings on the length of unpaid leaves and the accounts of fees from parallel and regular students are often mixed. I therefore believe that the easier solution is to either keep the dons away from the Board of the ICT Authority for the time being while awaiting a substantive Bill to establish the Authority to be drafted and tabled in Parliament, or alternatively to review the Order establishing the Authority and gazette it afresh. On a lighter note, I am not interested in serving on the Board of this Authority. The parent ministry would go through the policy formulation process including stakeholder consultation and approve the policy that a new state corporation was necessary and also list its functions. In this particular case, this step was not necessary since the policy was gazetted in the Executive Order No. 1 on the reorganization of Government. 2. Second, the Ministry would get a body or individuals with necessary sector and legal expertise to draft the Legal Notice which would be reviewed at ministerial level before being forwarded to the Permanent (now Principal) Secretary. For the ICT sector, the National Communication Secretariat would normally perform this function as provided for in Section 102 of the Kenya Communications Act. Not only did it have technical experts, it had a legal expert and could use consultants where necessary. The Permanent (now Principal) Secretary would, after seeking approval from the Minister (CS), forward the Legal notice the Attorney General for review. 3. The Attorney General would read the Legal Notice and highlight any areas which fail to comply with the Law (Constitution, Acts of Parliament and Subsidiary Legislation) and recommend correction or redrafting. If satisfied, the Attorney General would forward two copies of the Legal Notice to the Permanent Secretary with a cover letter indicating that the President may sign if he agrees. 4. The President would sign the Legal Notice (if he agrees) and a copy would be forwarded to the Principal Secretary who would forward it again to the Attorney General who would now give it the Legal Notice number (in this case Legal Notice No. 183) and forward it to the Government Printer for publication. Away from the government bureaucracy, what happened in this case is that the drafters, as highlighted in the court proceeding, were content with having the CS of Treasury and the CS of the Parent Ministry as the only two central and county members of the Board of the Authority. By doing so, they also complied with the provisions of the State Corporation Act which provides for a maximum of three. Indeed, I fully agree with them on this matter. But they used the words ‘public servants’ when drafting. Unfortunately and most likely unknown to the drafters, the Constitution of Kenya 2010 had defined a public servant in such a manner that it goes beyond central and county government employees. So we have the unfortunate situation where dons from public universities can sit on the Boards of most State Corporation and even Councils of the Public Universities (which as also state corporations) but they cannot sit on the Board of the ICT Authority. My personal opinion is that the situation can be corrected by either appointing another Board while excluding the two dons and also staggering the appointments or alternatively withdrawing the legal notice and gazetting another one which fulfils the intention of the drafters and provides for staggered terms of office. Upon rigorous interrogation, the court was not convinced by this argument and therefore this ground was strikingly shattered by the court. Thus as far as the ruling goes, no one should deny Walu an opportunity to sit on the next ICTA Board under the pretext that he is a "public officer". But why should the cabinet secretary be precluded from appointing public officers to his list? Isn't this discriminatory? These questions can be best answered by analyzing the composition and context within which boards operate. For instance, when completely structured, ICTA Board should consist of the following: -A chairman (appointed by the President) -PSs 1. ICT 2. Treasury 3. Lands and Housing -CEO (The first CEO to be hired competitively by the CS, the successors to be hired by the Board) -Not more than six other persons not being public officers The global trend in governance is that of public-private stewardship. Thus, if the CS was allowed to nominate the six other persons from the public service, the weight of the board would heavily tilt towards the executive side and questions of independence would naturally arise. Public-private combination also helps resolve the potential challenge of ideological inbreeding. Over the years, we advanced the logic to have the various public agencies within the ICT sector converged. When the executive order on the same was finally signed by the President, we anticipated a drastically bright future for the Kenyan ICT sector. At the same time, we recognized that there are a range of issues that require harmonization in the course of time. On this basis we have variously pleaded with the ministry to convene a multi-stakeholder forum so that the ICT community can ventilate their concerns and make contribution to policy. This to no avail. In good faith, we have also invited the ministry to useful events where business relevant to them is transacted but they have failed to show up. In the true African spirit, we have optimistically hoped that they will reciprocate our multiple invitations, at least with a single invite even to their lowest profile event, only to harshly realize that "our hopes are not valid". All along, we have held a strong desire to support the Kenyan ICT excellence dream. However, without fear of contradiction, I regrettably submit that the modus operandi at the ICT ministry has tragically deflated the ICT momentum and enthusiasm that prior leadership strove to gather. Never has it been so difficult to offer a helping hand at the ministry! I nostalgically miss the times when Hon Rege, Hon Mutahi Kagwe, Hon Poghisio, Dr. Ndemo were at the helm. Those are the days when the PS or Minister would stay late into the evening consulting stakeholders and ooze visions of wisdom for the sector the following dawn. Court battles were alien to the sector. My personal holding is that courts should only be applicable as a last resort. Litigation procedures and outcomes in their nature are very adversarial. There are majorly two possible outcomes in a court process; a fabulous winner and bitter loser. Engagement and Consultation on its part produces an endless chain of winners. But if the Kenyan ICT sector can only be successfully steered through chamber summons, sworn affidavits and court decrees; then my heart bleeds. In July 2014, the government put out an advert calling for volunteers to what has been positioned as an exciting one year programme for those aged between twenty two and thirty years, with an additional requirement that one be a recent university graduate. The exact nature, structure and opportunity was not clearly articulated which led to a conversation with some industry peers on the possible permutations that the project may take. With funding from Canada’s International Development Research Centre (IDRC), OCSDNet is jointly coordinated by the Centre for Critical Development Studies (CCDS) at the University of Toronto Scarborough (Canada) and iHub (Kenya). OCSDNet aims to support researchers and practitioners from the Global South to carry out research or projects that will lead to deeper understanding of whether, and the conditions under which open knowledge production processes could lead to development outcomes, such as economic and educational opportunities, improved health and food security, and policy reform. By contributing to this new area of study, OCSDNet will also build a community of open science practitioners and leaders who will influence policy dialogues pertaining to the role of science and innovation in development. Research Focus: OCSDNet aims to investigate a broad range of questions, including: How do researchers in various institutional contexts practice “openness”? How can open science approaches benefit researchers in the Global South? Will OCS lead to novel insights and solutions to entrenched development problems? Can greater participation of citizens in the planning and conduct of scientific research increase its application in addressing local development goals? How can the sharing of knowledge as a public good be weighed against protection of various forms of rights? To explore these and related questions, OCSDNet will provide funding support for up to 15 case studies from eligible countries. Friends, The Universal Service Fund (USF) is a tried, tested and successful idea where it has been implemented well. The intention is noble: to help take (in our case) telecom services to disadvantaged areas where companies may not make as much money as others. The fund is supposed to help fund infrastructure in such areas or offer it as compensation/incentive for those that venture to such areas. In Canada, for instance, one enjoys similar quality of service and access to telecom services in Nunavut (a vast, sparsely populated territory near the North Pole) as in major urban and business centres as Toronto, Montreal, Calgary, ... and the like. In my opinion, it has taken longer than usual to operationalize the fund in Kenya! The recently appointed team should accelerate the process and hence drive the benefits intended to mwananchi in areas that qualify to benefit from the fund.
