Listers This statement by the Chairman of the Federal Communication Commission of the U.S. is worth repeating here:- After more than a decade of debate and a record-setting proceeding that attracted nearly 4 million public comments, the time to settle the Net Neutrality question has arrived. This week, I will circulate to the members of the Federal Communications Commission (FCC) proposed new rules to preserve the internet as an open platform for innovation and free expression. This proposal is rooted in long-standing regulatory principles, marketplace experience, and public input received over the last several months. It's time to bring it to the mainstream. Let us not be lulled by the innovations that have happened in this country through an ambiguous policy on ICT to think that we can continue like this without at least some clear rules of engagement. Let us not forget that a former minister of finance once tried to kill Safaricom's Mpesa because a strong finance industry lobby felt threatened. Today we can't imagine life without Mpesa. Let us not take this for granted. I would like to propose a forum of different stakeholders:- 1. TESPOK 2. ISOC - Ke 3. Media owners association 4. Government (Ministry, ICTA, CA, KENET) 5. Drake 6. KEPSA 7. Computer Society of Kenya and other ICT Associations 8. COFEK 9. And other interested parties. It is incumbent on us as leaders in various fora to stand up and be counted on this. We can start this discussion in ernest by reviewing where we really are as a country on this important subject matter. For example the freedoms we enjoy in the context of Net Neutrality that we have taken for granted. I'm gratified to note that the Government is taking a firm stand towards certain aspects of Net Neutrality but I contend that we need to solidify and institutionalize the gains made so far. With the 3 main broadcaster now having to plan to review their video presence and the type of services they will deploy and avail to the market. Change is good and this sort of stance should make the current Broadcasters innovate and see what will be the best commercial framework to deliver the content they have been delivering over the baiju last years. In our view, there will be more opportunities to deliver online video via portals or applications on smart TV etc. There are possibilities of delivering as a part of a channel lineup. The opportunity that is missing here in Kenya is to be able to access accurate programming information and really a good content aggregator in the market who can help prepare the content for all the different TV and Radio programming or channel line ups. Bernard, Great innovators started with wild ideas and yours is a wild as they get but yet loaded with substance. Would you mind discussing it further offline and I put you in the direction of the person dealing with anchor investments in Konza. It is a brilliant idea. There are 3 main fibre cables near Konza and there is plan to pull one of this in...a last mile issue in a sense. I know the Board of Konza are keen on some sort of hub like the one you are talking about, where you can put some people together to work on something. Seriously one should read the stories of Silicon Valley (and not we are not replicating this) but there is so much learning that shows your idea is not far-fetched. We need to explore it. The only challenge is the accomodation but Governor Mutua did promise that he would ensure he is building 'dormitories' for Konza so while the housing is being sorted out this is great start. Imagine you put these people there, then put a research lab near it, a university nearby.....what will happen. you are on to something. If someone can give me one example anywhere around the world, anywhere, that litigation has worked to reduce priracy I will give them 1000 bob. In fact, copyright owners are to blame themselves for piracy, you guys are familiar with, "This content is not available in your country." Netflix charges people for licensed content yet copyright holders are pushing Netflix to restrict content in countries outside the US. People who can afford content will mostly pay, if it's convenient and not via loops.

Let's look at the example you given and compare it to pirating content. When I steal your goat, you no longer have a goat but I do. When I "steal" your content I have a copy and you have a copy. You've lost nothing. You still have your copy. Trying to draw parallel to physical objects is, sorry to use this again, disingenuous. As for the artists from rural Kenya, don't pretend this fight is for them, it's for your bottom lines. All the local services mentioned so far, despite being a pirate I've used them all, only have the "popular" artists from Kenya on them. Try find an artist like G'Zay from Nakuru, he's a great artist find him on soundcloud and listen to Hakuna Matata, and you come up empty. The rural artists you seem so concerned about make their money the way any selfrespecting artist does, through performances and merchandising. First Brian, Can I be frank? I missed the ICT community and do not force me to explain myself. You remember how active I was pre-government. But I did learn a lot in government and I will encourage more of you to do a stint in public service. We need the ICT brains from within [and do not ask why didn't you stay, I did 3 years try it :-), it is a rewarding experience if you choose to look at the positive] but I can guarantee you I remained a stickler for perfection and detail. I learnt patience but I am still the same old Nyaki and you will see a lot of me going forward. Would be nice to organize a drink and this is my suggestion how. 1. I have spoken to the Master Developers of Konza (MDP2) about a possible moderated discussion on the Konza project, the vision, the progress, where we are and the role of the ICT community. 2. Based on this discussion after one week either moderated by our dear Walu or Prof Waema or GG or Muriuki Mureithi (not me to avoid conflict of interest issues) we can consolidate our views in a Report like we used to which we submit to the Authority etc. 3. The basis of this Report would then be a face to face discussion (the drinks and bitings we used to have at Landmark....hoping kina Joe Mucheru, Alice Munyua, Edith Adera, yourself, Walu, Tim Waema, Barrack Otieno, Muraya, Muriuki Mureithi etc will all turn up. This can be an opportunity for the Konza team to engage you all and then discuss your suggestions and their own. Doesn't that sound like a plan. They are busy now but I can guarantee you they will consider it. I know for a fact that the broadcastors were given a chance to form their own distribution network in 2009/10 and they couldn't agree on ownership and shareholding. That they are doing everything in their power to frustrate our migration effort because they couldn't get along strikes me as profoundly unfair. The airwaves belong to the public and are held in trust by the government on our behalf. Are we saying that KTN, Ciitizen and NTV are the only stations with good content? Radio Africa has proven that there are people willing to distribut their content for free to reach us the public. Dr Catherine Adeya-Weya, who has been the acting chief executive officer of the Konza Technopolis Development Authority for two years, said she had decided to quit and let someone else come in and lead the project. It was, however, clear from her statements that bureaucratic tendering, resource constraints and the slow pace of takeoff had largely influenced her decision. "I just felt someone else needs to take over this project after acting for almost two years. I may have considered staying if confirmed, but I may not have wanted it. For a project of this magnitude, we require the right calibre of staff, and a proper and sufficient recurrent budget. ''What I was being paid as chief executive was less than what I used to earn in my former role in the private sector and so it is hard to attract the high calibre staff with that remuneration," Dr Adeya-Weya said at a joint press conference in Nairobi with board chairman, Mr John Ngumi, on Tuesday. *PERFORMED WELL* Mr Ngumi said Dr Adeya-We ya had performed well despite being in an acting capacity for the entire period. Airtel writes to regulators over Safaricom's market share

Airtel Kenya has written to Communications Authority of Kenya (CA) and Competitions Authority of Kenya (CAK) asking that Safaricom be declared a dominant player in the market. Airtel Kenya, which is targeting a bigger share of the country’s voice, SMS, data and mobile-money transfer business, claims Safaricom has been using its dominance to prevent others from growing their business. It is asking the two regulators to intervene and stop the telecommunications sector’s slide into a monopoly where the market leader, allegedly has freedom to do whatever it wishes. FRANCIS WANGUSI, DIRECTOR GENERAL, COMMUNICATIONS AUTHORITY OF KENYA (CA), ON THE ADVERTISEMENT BY NATION MEDIA GROUP, STANDARD GROUP AND ROYAL MEDIA SERVICES, RELATING TO MEDIA TRANSMISSION SERVICES 21ST JANUARY 2015 It has come to the attention of the Authority that three media houses, namely Nation Media Group Limited, Standard Group Limited and Royal Media Group Limited have jointly been running a misleading advertisement on Television and Radio since Friday 16th January 2015. The said advertisement purports that Startimes and GOtv are illegally carrying their content thereby infringing on copyright and neighbouring rights. The advertisement goes farther to instruct consumers not to purchase Startimes and GOtv pay-tv set-top boxes to watch CITIZEN Television, NTV, KTN and QTV. In addition, the advertisement allege that the three media houses are the exclusive vendors of Free-To-Air set-top-boxes that can enable the public to view their channels The Authority is gravely concerned by the misleading content in the advertisement and wishes to advise the industry and the general public as follows: 1. The advertisement by the three media houses is misleading to the public, is offensive to the market. It is equally in gross violation of the legal and regulatory framework governing the sector; 2. The tone of the advertisement, its content and timing is intended to cause confusion and disrupt the digital migration programme; 3. The digital migration framework allows for the distribution of the ‘Free-to-Air’ signals on the digital platform under the “must-carry principle” . This was supported by the ruling of the Supreme Court of Kenya in September 2014 . It allowed for the availability of Free-to-Air channels to the public through all set-top-boxes (FTA and Pay TV). The advertisement dissuading consumers from purchasing set-top-boxes from other suppliers approved by the Authority is therefore misleading to the public and portrays anti-competitive conduct by the three media houses. Consumers need not be constrained to purchase a specific set top box to view the content of the three broadcasters whose content is Free-to Air; 4. The Authority has type-approved more than 65 set top boxes which are available in the market today. GOTV and Startimes set top boxes are duly type-approved by the Authority and are therefore authentic decoders in the local market authorized to carry the Free-to-Air Channels of the three media houses under the auspices of the “Must Carry Principle; 5. The sale of set top boxes in Kenya is a free market. Consumers can purchase type approved set top boxes from any vendor registered by the Authority. The full list of approved set top boxes and registered vendors can be freely accessed on the Authority’s website; 6. The Authority has neither received any application nor granted any type-approval of any set top box model from the three broadcasters, individually or collectively, for sale in Kenya. It is therefore illegal to purport to advertise set-top-boxes that have not been type-approved by the Authority; 7. The Authority has also received a formal complaint from Gotv and Startimes that the three media houses have refused to Air their digital-migration related advertisements which is potentially an anti-competitive conduct prohibited by law. While this complaint has not been investigated, the Authority notes with concern that it has itself been a victim of such refusal to carry advertisements both in the electronic and print media owned by the three media houses, yet the advertisements are aimed at educating the public on digital migration. In view of these gross violations by the three media houses as enumerated above, the Authority has decided to take the following administrative actions: 1. Withdraw the temporary authorization granted to the consortium by the three media houses (under the consortium identified as Africa Digital Network). Subsequently the Authority shall reposes the frequency spectrum resources allocated with immediate effect; 2. Decline to continue with the process of issuance of a Network Facilities Provider Tier 2 License for self-provisioning to the three media houses, pursuant to Gazette Notice Number 9088 dated 19th December 2014. This is on account of the above violations of the legal and regulatory framework. The process shall therefore await the ruling and determination of the Competition Authority of Kenya and the Board of the Communications Authority of Kenya on the violations by the three media houses. 3. Liaise with the Kenya Revenue Authority (KRA) and Kenya Bureau of Standards (KeBS) to bar the importation of set top boxes by the three media houses considering the purported set top boxes are not type-approved by the Authority; and 4. Invite the Competition Authority of Kenya to investigate the cartel-like behavior and anti-competitive conduct and take appropriate regulatory remedies. We further wish to inform the public that registered vendors have in stock different models of approved Free-to-air and Pay-TV set top boxes that are readily available locally for purchase. More than 1.2 million set top boxes have been purchased since migration in Kenya began. At the moment, the market has more than 1.5 million set top boxes in stock. As we progress into the second phase of the analogue switch-off in the country, consumers are encouraged to purchase set top boxes of their choice ahead of switch-off in order to enjoy digital television. The withdrawal of the temporary self-provisioning authorization granted to the consortium and the repossession of the the allocated resources does not in any way prejudice the availability of the services of the three broadcasters. The broadcasters are at liberty to avail their content on the digital platform through the existing licensed Broadcast Signal Distributors. Let me reiterate that the Authority does not condone contraventions of the Act by any of its licencees. The Authority will continue to execute its regulatory mandate with a view to ensure successful migration of Kenyans from the analogue to the digital platforms and ultimately for the growth of the ICT sector in Kenya. Dear Friends, [Apologies for possible duplications] We would like to bring to your attention the civil society call for expressions of interest to participate in the Global Conference on Cyberspace 2015 (GCCS 2015) and a civil society pre-event, hosted by the government of the Kingdom of the Netherlands, and taking place in The Hague on 16 and 17 April 2015. Following on from the London (2011), Budapest (2012), and Seoul (2013) Conferences, the 2015 event in The Hague will provide an opportunity for strategic level discussion of key cyberspace issues. The Conference aims to examine core issues related to the cyber domain, structured around the three main themes of Freedom, Security and Growth. Focus will be placed on exchange of knowledge and ideas on these issues and the development of concrete solutions. The Conference will encourage multi-stakeholder participation from the worlds of business, academia as well as civil society. A day and a half civil society pre-event will take place in the run-up to the Conference (14-15 April) to facilitate civil society coordination and input into the main Conference. An in-depth training on cyber security issues will be offered as part of this pre-event. In addition, an online training curriculum will be made available to the wider public. The Conference organisers are interested in a balanced and diverse participation and in supporting those who will find a practical use for the training and attendance offered. The Expression of Interest Form, in addition to logging interest in attending the Conference and the civil society pre-event, will also serve as a platform to capture requests for financial support. Limited financial support is available for a number of civil society participants. Dear Mr Bwire Mostly verbal rejections. In one case, when we to run joint ads with Gotv and StarTimes, one media house demanded we remove the other logos. We did. Given our budget constraints, we only ran one ad on our own. Another media house flatly rejected any ad on digital migration. We have confidential (we can't share) internal correspondences requiring high level clearance on digital migration ads in both print and broadcast versions. Is our ICT GDP growth unable to match national GDP growth?

Dear Listers, One would expect ICT to be the fastest growing economic sector in Kenya. Incidentally its not. In fact there's a declining trend; according to the rebased national accounts data of 2014 - see visualization attached. The absolute ICT GDP figures have grown modestly from KES 50 billion in 2006 to KES 68 billion in 2013, and quite dismally when compared to national GDP which grew from KES 1.8 trillion to KES 4.7 trillion over the same period. Granted researchers suggest that much of the positive impact of ICT is felt indirectly in other economic sectors, are we seeing a suboptimal growth of ICT's direct contributors to GDP over the years? Dear Mr Mbugua, Many thanks for your well-informed (… save for the unfair attack on us at the end) critique (which we have re-published on our website). Clearly, both Communications and Competition Authorities have allowed excessive leeway to the trio of KTN, NTV and CitizenTv to stifle industry competition to the pain of consumers. It is unfortunate that the 3 media houses declined adverts of their competitors – but wake up to a prominent back page story of “advanced set top boxes” being “on the way” as if DVBT-2 type-approved STB’s don’t exist. Kenya is using DVBT-2. Perhaps the consortium will be using DVBT-3 or 4 or whichever qualifies to be “advanced”. Let us leave that to CAK of Waiyaki Way. The CAK of Haile Selassie Avenue must intervene, possibly at their convenience. Truth however is that - never again and never again – should Kenya’s ICT sector allow excessive dominance of 1, 2 or 3 players – which decide what is news for Kenya, when and how. As of now, we have been restrained to comment on these issues since we are parties to the active suit before the Supreme Court on digital migration. We may appear to be “quiet” but if the 3 media houses control over 80% of the news outlets, and you want to criticize them – will they have any airtime or print-space for you? The answer is no. At Cofek, we blame the so-called digital government for playing ping-pong on digital migration. Senior GoK officials are shielding the 3 media houses for selfish gain. At least we know but can’t name 3 of them. They know themselves. Yet we find solace in the fact that one day, just one day, Kenya will fully migrate. The dominance, chest-thumping and egos will go. Media empires will slowly but surely crumble and … become castles in the wind – as they tumble to competition from hundreds of more focused and niche-based news outlets. They can wine and celebrate the Supreme Court recent ruling. They can make more advertisements on simulcast. They can block competition and criticism. They can peddle their evident influence. They can compel people to read their self-made news about themselves. They can do all manner of things. But let them know or be told two things – consumer is king/queen and innovation is an unstoppable wrecker. It will catch up with them. Like the story of mobile telephony versus defunct Telkom Kenya landline. That time is coming. That time will come. So God help NMG, RMS and SG! So, today, Daily Nation decided to lead the back page with the news that the three media houses that run KTN, Citizen and NTV will be importing over 1 million of their own set top boxes to retail at about Sh2500 by end of March. http://www.nation.co.ke/news/Advanced-set-top-boxes-on-the-way/-/1056/25872… 150,000 of them will be launched within this month. It sounds like big news and indeed, occupies a prominent space in the paper until, wait, haven’t there been set top boxes being sold in the country on the streets, shops, supermarkets everywhere? Yes, but belonging to Multichoice GOTV, Startimes and independent set top box vendors. So, why is DN packaging its plans as big news? Precisely because acting against the spirit and letter of the Kenya Communications Amendment Act (2009) as well as other Restrictive Trading countermeasures, the three outlets have been stifling information about the existence of other players in the digital migration field even as they seek to tie up digital migration in court. In the meantime, they are importing their own equipment and planning to use their platforms to exclusion of others to market themselves. This is illegal. The Communications Authority of Kenya must begin to enforce the regulations and demand that these media houses, accord the same amount of fair coverage to all players in the digital migration arena or risk losing their signal distribution license. Licenses must come with terms and conditions and one of those should be that you cannot use existing licenses to unfairly black out competition. So far both the regulator and the other players have been very tolerating of this consortium but it should be clear to them that it doesn’t mean that they cannot be held up in the same courts of law they are using. Other Free to Air channels like Kiss, K24, Family, GBS etc can contest the award of the signal distribution license to a cartel that has shown it is willing to abuse its market power to retain market share. Vertical integration of media houses : - TV, Radio, Newspaper can also be challenged to enforce fair competition not to have the newspapers be used by their owners to advertise the consortium’s set top boxes while refusing to carry adverts for rivals platforms like GoTV or Bamba TV? Both the Competition Authority and the CAK have a responsibility to speak up on this issue. Cofek, in the meantime after wreaking havoc in the migration process with their busy body ways in 2013, have been unusually quiet in the face of very anti-consumer behaviour by the three media houses.
