The Global theme for this year is ?Evolution of Internet Governance: Empowering Sustainable Development?. This theme will be supported by eight sub-themes namely: 1. Cybersecurity and Trust; 2. Internet Economy; 3. Inclusiveness and Diversity; 4. Openness; 5. Enhancing Multistakeholder Cooperation; 6. Internet and Human Rights; 7. Critical Internet Resources; 8. Emerging Issues. 9. Enhancing working partnerships between stakeholders (Multistakeholderism). We would like to focus on 4 or 5 of these themes, or even include topics that we think are important to this country but may not be on the global list. Further, the event is scheduled for a day and it is important that we focus on a few topics which will allow for meaningful discussion(s). Once we agree on the topics, as is the tradition, we will hold an online moderated debate which will then result in the f2f KIGF. And so in the spirit of participation, we are requesting you to please help us prioritize the topics by voting for 4 to 5 out of the list by this coming Friday (June 12). This happened in India and there's no proof it's happening here but it's not hard to imagine something like this happening here. He posted the proof to GitHub and tweeted about it <https://twitter.com/thej/status/606126370364649472>: He posted the evidence showing that javascript was being quietly inserted, and that it apparently tried to insert some sort of toolbar <http://www.storypick.com/airtel-sends-legal-notice-indian-coder/>: That's all super sketchy. But that's just the very beginning of this story. Because days later, Thejesh received the most ridiculous legal threat letter <https://archive.org/stream/LEGALNOTICETOTHEJESHGNCEASEANDDESISTINFRINGEMENT…>, coming from a lawyer named Ameet Mehta from the law firm Solicis Lex. It claims to be representing an Israeli company, Flash Network, which is apparently responsible for the code injection software... and it claims that by merely *revealing to the public* that Airtel was doing these injections, he had *engaged in **criminal** copyright infringement* under the Information Technology Act, 2000. If that sounds familiar, that's because we wrote about <https://www.techdirt.com/articles/20140824/06590028306/indian-state-passes-…> that ridiculous law last year, noting that it would technically allow people to be put in jail for merely thinking about infringing someone's copyright. And the Solicis Lex lawyers, to show they're not messing around, *cc'd the police* on the letter they sent: The crux of the "copyright" claim seems fairly ridiculous: *The said code is closed source software and our client is sole proprietor of the same. Therefore, no one can use the said code without obtaining license from our client against payment of fees and/or royalties and on commercial and legal terms acceptable to our client. Your aforementioned actions constitute a blatant violation of our client's copyrights and other proprietary rights in the said code. * Remember: all Thejesh GN did was *show the code that Airtel inserted into * *his** browser*. If Flash Network thinks that showing the code that it dumps into each of your browsing sessions is criminal copyright infringement, just about anyone who does a "view source" could be guilty. That's a plainly ridiculous reading of the law. On top of that, the lawyers sent a DMCA notice to GitHub, which caved in and *took it down*: This is despite GitHub's recent promise <https://www.techdirt.com/articles/20141016/17030128852/github-promises-to-a…> not to take things down without first alerting the users in question. Absolutely everything about this is *insane* and bad. The initial injections by Airtel/Flash are bad and dangerous. Both companies should be called out for such javascript injections. But, Flash's response to not only threaten *a completely bogus* copyright takedown/cease and desist claim, but also to allege *criminal violations* that could lead to jail time just adds an insane layer on top of all that. Even arguing that merely posting screenshots of the injected code is civil copyright infringement is crazy. And then issuing a DMCA takedown to GitHub (not to mention GitHub agreeing to take the screenshots down...). All of it is ridiculous and a clear abuse of copyright law to silence someone who revealed Airtel and Flash Network were up to questionable activities. For those who argue that copyright is never used for censorship: explain this story. Of course, it all seems to be backfiring in a big way. Flash may have wanted to hide what they were up to, but now it's getting much, much, much more attention. Maybe, next time, rather than threatening whistleblowers of your bad practices with claims of criminal copyright infringement, Flash and Airtel will think more about their own crappy business practices that put users at risk. CAN USF BE USED TO SUBSIDIZE FTA TRANSMISSION

Listers, Recently, Multichoice has indicated that it may need FTA users of its GOTV service to pay a small annual maintenance fee to cover the cost of transmission. This issue has repeatedly raised hackles because, licensed pay-TV providers like GOTV and Startimes are also required by law to carry FTA channels, the "Must-carry" rule. It is not clear who is supposed to cater for the cost of this transmission. Typically, FTA analogue transmission costs were recouped through advertising. So it would seem that there is an issue that needs resolving here particularly when you consider that if there is any after service required, like a problem with the set top boxes, be it GOTV, Startimes, Safaricom etc you return them for service to the respective platform owner. Which raises the question, given that we have a Universal Service Fund to which Telcos/Broadcaster/Network operators contribute to which is meant to facilitate access to Information and Communication Technology to all, why can't this Fund be used to subsidize access to these FTA channels to those who wish to have them? The CA should consider shielding viewers who want to have FTA channels from other incidental costs by reimbursing platform owners for the cost implications of the "Must-carry" rule. My two cents. JG

I think the report is trying to say: “…if Kenyans were to pay for being online they would be spending 45% of their earning…” not: “…on average, Kenyans spend 45% of their income on getting online…”. Furthermore, the same article cites that “...60% of Kenyans use the Internet regularly”. I find these stats very hard to believe. A lot more detail is needed to demonstrate this to be the case. A reception was held for ICANN Community members and the Turkish stakeholder community to raise awareness about these important issues. *Internet Week in Turkey, 6-19 April 2015 * This was quite the informative week! One of the highlights was the Chairman of Turkey’s Internet Improvement Board and some of its members paying a visit to the ICANN offices and presenting to the staff the Board’s work and strategy on encouraging the use of the Internet across Turkey. Another key event during this week was the ISOC Turkey conference where key topics were discussed, such as how globally, the digital economy is soaring past the offline economy; leading to countries assess how best to ensure their nation’s policies are capable of supporting the Internet growth in their countries to fully take advantage of the economic benefits. Specific to Turkey, was how Internet users have grown substantially to nearly 40 million subscribers today with mobile Internet users leading the way. This is particularly noteworthy, when one considers the Turkish Presidency of the Group of 20 is also focusing on inclusive and robust growth strategies, and the digital economy can play an important role to support job creation and trade. Finally, Internet Week in Turkey reminded us that the Internet has prospered tremendously due to the multistakeholder model, were diverse stakeholder groups, such as governments, businesses, academics, private users and others can convene to determine what the future of the Internet will look like. The three workshops organized had around 30 participants; 7 countries from the SEE region - Montenegro, Bosnia and Herzegovina, Croatia, Slovenia, Bulgaria, Romania, Serbia and participation from the EuroDIG and ICANN. >From the first day, the discussion on IDNs was the hot topic of interest. The overall experience was very interesting – no major issues, yet the majority think that this is a hot topic. So, the real question from this round table was - why is that? Is it culture or something else? The multistakeholder process provided a heated discussion for the end of the day, with queries on the practicality of implementation to representativeness, accountability and how to safeguard the use of the multistakeholder model. *Bucharest, Romania* Held on the 13th March 2015, the *Workshop on domain names and the Internet. What does the future behold?* Was quite interesting. Organized in two sessions, first one was covering New gTLD world, and second was about MS model. The Ukrainian GAC member Alexander Tsaruk moderated the Round table. Moscow, Russia -Workshop on ‘Internet Governance in Year 2015’ - March 18th The organizers of the Workshop (the Diplomatic Academy of the Ministry of Foreign Affairs, and the Center for Political Studies in Russia) invited 40+ experts from different federal institutions, think tanks, Internet business community, academia and mass media. The discussion was very open and frank, and allowed stakeholders to present their position on the current issues on Internet governance. The government bodies (Foreign Ministry and ICT Ministry) stressed the importance of BRICS and Shanghai Cooperation Organization, as well as WSIS process, for discussing Internet Governance matters. The IANA Stewardship transition was cited as one of the most important projects that should be successfully implemented by the end of this year. All participants confirmed that the accountability and transparency of ICANN is of great importance for the success of the Transition process. Moreover, some experts confirmed, to understanding and acknowledging the fact that though ICANN is a technical and not a political organization, it has become a real opinion-leader on many items on the agenda of Internet Governance. Moscow, Russia -Russian Internet Governance Forum– April 7th The 6th Russian IGF was held in Moscow, organized by the Coordination Center of .RU (ICANN supported this event as a Silver Partner). I don't think Safaricom's offering needs to compete with with Zuku quite yet, atleast on offering unlimited internet anyway, particularly because Safaricom has a much wider potential customer base than Zuku right now. It'll take Zuku quite a bit of time before they are able to boast similar coverage with Safaricom particularly because Safaricom has proven determined to upgrade their base stations to 4G and Zuku just won't be able to compete on that level. I do think that they have to get more consumer friendly pricing but I don't think they need to go unlimited yet, it'll just burden their network without a distinct advantage to them. @Wash, I agree with you and Wakaba. And Zuku does keep the communication coming so that as the customer, you are almost always informed of challenges they are experiencing and of course asking you 'to bear with them'. And this bit about keeping customers informed is very important. Kplc customer service/communications team should do a benchmark tour at Zuku! PS. Hi all Can anyone at Zuku who is on this list please let us know what is going on? I have had literally zero connectivity from them now for almost two weeks at home. Complaints through their customer service line, Twitter etc have not helped. All I get is a mechanical customer service rep telling me 'Service will be restored in due course and we are sorry for the service interruption!' Needless to say I have already 'vukad' to Safaricom's 'TheBigBox', however I still have a full month of service from Zuku. In the interest of trying to 'help' them I thought I'd pen this here because this kind of service is just unacceptable in this day and age. When it comes to availability of Government Services, this government gets an A- from me for effort. We must appreciate the strides we are making. We still have ways to go but a glass half full - not half empty is a better way to look at it. For me, what I find most impressive is the thinking behind mixing 'analogue' and digital. Take the Huduma Centres. I think this is a master stroke of building a bricks & clicks model to serve the public taking into consideration that Internet Penetration is still below 50%. The eCitizen Portal, despite UX issues is another feather in the cap of this government. Well done Dr.Matiang'i and Team. Internet2 has been a strong partner with NTIA as a recipient of a $62 million Recovery Act broadband grant. With this grant, Internet2 has lit or upgraded over 18,000 miles of a national fiber backbone network. This 100 gigabit per second backbone is accessible to more than 93,000 community anchor institutions through Internet 2's partnership with regional research and education networks. Several of these networks also received NTIA grants so we know that in Michigan, North Carolina and numerous other states, the good work of Internet 2 and the research and education community is driving higher speeds and lower cost broadband for schools and other institutions of learning. However, I did not come here today to talk about broadband. My topic today is Internet governance. This is an important and timely issue for everyone who relies on the Internet but particularly for the members of Internet2. As your website states, "the commercial Internet we know today was shaped by the vision and work of the people and organizations in the Internet2 community." Indeed, we only enjoy the Internet today due to the engagement of the academic community decades ago. The first four nodes on ARPANET, the experimental network from which the Internet evolved, were universities: UCLA, Stanford, the University of California at Santa Barbara and the University of Utah. The first message ever sent was between UCLA and Stanford. We know from history that this first attempt to login crashed the system but the problem was quickly fixed and the rest is history. New challenges to the Internet emerge every day, whether they are related to cybersecurity, privacy, or the free flow of information across borders. As we confront these challenges, we continue to debate a key question that has dominated international discussions over the last decade or so, specifically who should govern the Internet? Who should make the decisions that determine what the Internet of tomorrow will look like? How can we ensure that the decisions made today will enable the Internet to continue to thrive as the amazing engine of economic growth and innovation we enjoy today? The debate has focused on two very different choices. One choice is that governments alone should make the key decisions on the governance of the Internet. This is the choice favored by authoritarian governments that want to restrict the information available to their citizens. The other choice is to rely on all stakeholders to make these decisions through what is known as the multistakeholder model of Internet governance. What do we mean by the multistakeholder model? One expert defines the multistakeholder model as different interest groups coming together on an equal footing to "identify problems, define solutions, and agree on roles and responsibilities for policy development, implementation, monitoring and evaluation. <http://www.ntia.doc.gov/print/speechtestimony/2015/remarks-assistant-secret ary-strickling-internet2-global-summit#_ftn1> [1]" >From that description, there are two key attributes to emphasize: participation and consensus decision-making. Let me start with participation. Internet policy issues draw a much larger range of stakeholders than traditional telecommunications issues. One key benefit of multistakeholder processes is that they can include and engage all interested parties. Such parties can include industry, civil society, government, technical and academic experts and even the general public. The Internet is a diverse, multi-layered system that thrives only through the cooperation of many different parties. Solving, or even meaningfully discussing, policy issues in this space, requires engaging these different parties. Indeed, by encouraging the participation of all interested parties, multistakeholder processes can encourage broader and more creative problem solving. The second key attribute is consensus decision-making. It is important that stakeholders come together on an equal footing. The best way to ensure that all parties are treated equally is to make decisions on a consensus basis. Final decisions need to reflect the views of all stakeholders as opposed to just the views of only one of the stakeholder communities involved. Multistakeholder organizations such as the Internet Engineering Task Force and the Internet Corporation for Assigned Names and Numbers (ICANN) have played a major role in the design and operation of the Internet and are directly responsible for its success. Within the Obama Administration, we believe that maintaining and extending this model is important to ensure the continued growth and innovation of the Internet. There is bipartisan support for the multistakeholder model of Internet governance. Both Republican and Democratic administrations have consistently emphasized that the multistakeholder process is the best mechanism for making decisions about how the Internet should be managed. Congress agrees. Earlier this spring, the Senate unanimously passed Senate Resolution 71, which states that the "United States remains committed to the multistakeholder model of Internet governance in which the private sector works in collaboration with civil society, governments, and technical experts in a consensus fashion." Today, the Internet is at a critical juncture. We are continuing to oppose efforts by authoritarian regimes to replace multistakeholder decision making with a process limited only to governments. This debate came to a head in 2012 at the International Telecommunication Union's World Conference on International Telecommunications (WCIT) in Dubai. At this meeting, governments split over whether the ITU, a United Nations organization in which only nations have a vote, should have more control over the Internet. A majority of countries there supported greater governmental control. However, since that conference, we have seen a growing acceptance of the multistakeholder model around the world, but particularly in developing countries. Democracies in the developed world have long supported the multistakeholder model of Internet policymaking. The Organization for Economic Cooperation and Development (OECD) adopted a set of principles for Internet policymaking in 2011 that strongly endorse multistakeholder cooperation. The OECD principles state, "multistakeholder processes have been shown to provide the flexibility and global scalability required to address Internet policy challenges." What is now emerging is greater acceptance of the model in developing countries. A year ago, Brazil hosted the successful NetMundial conference, which brought together a wide range of stakeholders including technical experts, civil society groups, industry representatives and government officials, all on an equal footing with each other. At this meeting not only did participants agree that Internet governance should be built on democratic multistakeholder processes, the entire meeting was a demonstration of the open, participative, and consensus-driven governance that has allowed the Internet to develop as an unparalleled engine of economic growth and innovation. Most recently, at the ITU's 2014 Plenipotentiary conference in Busan, Korea late last year, we saw the fruits of all our work to preserve multistakeholder Internet governance. The United States achieved all of its objectives in Busan, including keeping the ITU's work focused on its current mandate and not expanding its role into Internet and cybersecurity issues. This validation of the multistakeholder model comes at a critical time. Last year, NTIA announced its intention to complete the privatization of the Internet Domain Name System (DNS). Key to the operation of the DNS is the performance of important technical functions known as the IANA functions, the most well known of which is the maintenance of the authoritative root zone file, the telephone book for the Internet that supports the routing of all traffic to websites. The process of privatization of the DNS began in 1998, when NTIA entered into a Memorandum of Understanding (MOU) with ICANN to transition technical DNS coordination and management functions to the private sector. A year ago in March, NTIA asked ICANN to convene a multistakeholder process to develop a proposal to take the final step to complete the transition of the U.S. stewardship over the IANA functions to the international community. We did this to ensure that the multistakeholder model for DNS coordination continues. Some governments have long bristled at the historical role the U.S. government has played in the DNS and have used our continued stewardship of the DNS as an excuse to argue for greater government control over how the Internet is governed. When we announced this transition, we outlined some specific conditions that must be addressed before this transition takes place. First, the proposal must support and enhance the multistakeholder model of Internet governance, in that it should be developed by the multistakeholder community and have broad community support. More specifically, we will not accept a transition proposal that replaces the NTIA role with a government-led or intergovernmental organization solution. Second, the proposal must maintain the security, stability, and resiliency of the domain name system. Third, it must meet the needs and expectations of the global customers and partners of the IANA services. And finally, it must maintain the openness of the Internet. We are pleased that the community has responded enthusiastically to our call to develop a transition plan that will ensure the stability, security and openness of the Internet. The community is in the process of developing proposals related to the specific IANA functions as well as examining how to ensure ICANN remains accountable to the global Internet community. I am confident that engaging the global Internet community to work out these important issues will strengthen the multistakeholder process and will result in ICANN's becoming even more directly accountable to the customers of the IANA functions and to the broader Internet community. Some of you here today are likely participating in the stakeholder discussions to design the transition plan. Others of you are no doubt wondering why you should care about this transition and what is at stake for you. The members of Internet2, such as universities and research institutions, depend on the free flow of information. Completing the privatization of the Domain Name System is an important step to ensure that the Internet remains a global platform for the free exchange of ideas, commerce and social progress. Failing to complete the transition, as we promised 17 years ago, risks breaking trust in the United States and in the underlying system that has enabled the Internet to work seamlessly for consumers and businesses. Introducing this uncertainty could have a significant impact on American companies that depend on the Internet to do business if other countries respond by erecting barriers to the free flow of information or worst case, abandoning the long-held belief in the power of a single Internet root. The transition plan is being developed by the Internet's stakeholders and must be a proposal that generates consensus support from the multistakeholder community. All of you can play a role to ensure a good outcome. First, I encourage you to participate in the transition planning process. You are an important constituency and those crafting this plan must hear from you as this transition progresses. Second, stay informed on the progress of the transition. When the community completes its consensus plan, let your voice be heard in support of completing the transition. We all have a stake in this transition and in ensuring the Internet remains an open, dynamic platform for economic and social progress.
