East African Legislative Assembly to Debate Bill On Regional Electronic Transactions

The East African Community Electronic Transaction Bill 2014 will go through a second reading even as partner States target to deepen their economic ties through faster and safer ICT-based platforms. “Top on the agenda during the two-week period are two key Bills which are expected to sail through the 2nd and 3rd readings respectively. These are the EAC Electronic Transaction Bill 2014, and the EAC Creative Industries Bill 2015,” the bloc’s secretariat said ahead of next week’s session of the East Africa Legislative Assembly (Eala). The Electronic Transaction Bill 2014 targets to encourage electronic-based transactions as a more efficient mode of linking both the private sector and governments in the region. Most government regulatory procedures are expected to go electronic. “The Bill further wants to promote technology neutrality in applying legislation to electronic communications and transactions and to develop a safe, secure and effective environment for the consumer, business and the governments of the partner States to conduct and use electronic transactions,” the EAC secretariat further said. Eala has already undertaken a series of public hearings to source for stakeholders’ views on the Bill. EAC countries are currently implementing a series of seamless systems, including a joint tax collection and cargo clearing system known as Single Customs Territory (SCT), to improve the flow of goods and reduce dumping. Under the SCT deal, clearing agents within the EAC have been granted rights to relocate and carry out their duties in any of the partner states as part of a strategy to improve the flow of goods and curb dumping. Importers of commodities covered under the SCT are required to lodge import declaration forms in their home countries and pay relevant taxes to facilitate the export process. Joining the scheme The tax authorities in the respective countries then issue a road manifest against the import documents submitted electronically by the revenue authority of the importing country. Kenya, Rwanda and Uganda were the first to take up the SCT arrangement starting April 1, 2014 with Tanzania joining the scheme two months later. Several commodities including steel, edible oils, confectionery and milk are currently traded between Kenya, Uganda and Rwanda under the SCT platform. Cement, cigarettes and neutral spirits were the first products to be handled under the SCT scheme. Talking of paying electricity bill, normally there is a fixed charge of 174 kshs for prepaid domestic users. Now for the same i have to pay for the 174ksh every month no matter the consumption. Suppose i consume10 units a month that means i only spend 100ksh or less as direct consumption. My arguement is If i am charged a cost of +22 then a unknown cost of +40 from both parties(mobile money service provider and electficity company), as the cost of paying the 174ksh and subscribing for 10 units @100+kshs. Then the costs are to much considering the 10units for 100+kshs is a cost on itself to many. Also my arguement here is that there should be control for what should be charged to consumers and at what level. Secondly, they should apply some sort of discrimination(price discrimination) depending on the type of consumer. "There has been over 44 million page views since the portal launched making the portal one of the highest and most accessed government site. There have been 2.6 million actual interactions with the data - downloads and embeds," informs Kwamboka. Making government information available in this way promotes the development of useful "apps" based on the data, encourages researchers and watchdog groups to use the data to make suggestions for improving government and life of Kenyans, and makes state agencies more efficient by allowing access to information. As the portal celebrates its fourth year, there is already substantial data that is available and the public can use it to: - Be able to track and locate the health facilities closest to them. Additionally, they can find the hospitals that are appropriate to their needs as well as the category they fall under. Data on distribution of health services creates the opportunity for more targeted investment in public health infrastructure - such as prioritizing new hospital construction in underserved areas. - Find the nature, type and effects of natural disasters that strike their local community thanks to a datasets that has more than 10 years of this kind of data. - Find the location of donor and government funded projects in their community as well as the stage of execution. "Access to information held by the state is a crucial component of democracy. It allows the public to be aware of governmental decisions that can impact the environment and individual lives. Access to information also allows the public to participate in critiquing and thereby improving governmental decision-making," says Mr Kyalo. In noting the challenges that users have faced over the years when interacting with the website the team has worked to improve overall user-experience by including such features as: - *Open about analytics. *This involves openly displaying site performance analytics, showing the total number of public datasets, charts, maps, views loaded as well as the no of datasets per main category. - *Open about data and the reality of data release cycle.* Data release calendar to inform when new datasets become available. - *User Views: *World-class visualizations made by the public (by users who can register for free on the Open Data portal). Show case interesting visualizations made by users who use the portal on a daily basis. - *Integrating the Open data Blog with the portal*. A blog that moves beyond data to information and helps citizens make sense of data, by presenting it in a narrative format that combines text and visualizations. Experts, Journalists, analysts can help tell the story about open data its use, and its impact. - *New Interactive Visualizations with Data Lens Pages *Includes a number of multiple lens viewable on a single page that are interactive and dynamically linked to any user and can simply interact with and look at the parts of data they are interested in. For Example, a lens can contain a map, a few bar charts, timelines, and search bar in one single view. The project though has not been without its challenges. The greatest one being lack of awareness by the general public and various stakeholders on the availability of this resource that can be used to improve decision making and enrich the economy. "While we still face some resistance in data publishing by the various government institutions we have put in place measures to mitigate this which is why we have devised the new strategies that will allow us to engage other government institutions better." says Kwamboka. As it is, the future of the project is unfazed, and the team looks forward to providing better and more up to date information, enactment of the access to information and data protection laws and more partnerships with institutions to help popularize the use of open data. "This amazing resource is available to the public for free. People should know this and take advantage. It's the way to making better decisions for oneself, the community and country," concludes Kwamboka. The initiative has been widely acclaimed globally as one of the most significant steps Kenya has made to improve governance and implement the new Constitution's provisions on access to information. The Kenya IGF, and the shortfalls of the process

And interesting piece by Walu on Nation newspaper on the Kenya IGF convened by KICTANET. http://www.nation.co.ke/oped/blogs/dot9/walubengo/-/2274560/2827636/-/y8k7d… While there is no negotiated outcome, the IGF informs and inspires those with policy-making power in both the public and private sectors to come up with workable solutions to the challenges of an evolving internet. It was no different this time, with the local edition of KE-IGF convened by the Kenya ICT Action Network <http://www.kictanet.or.ke/> and its partners. Senior government officials, and industry players, media, academia and human rights groups, amongst others, were present to discuss the evolution and development of the internet. After protocol was observed stakeholders quickly got into the packed agenda <http://www.kenyaigf.or.ke/index.php/about-kigf/kigf-programme> for the day. The first item dwelt on enhancing multi-stakeholder cooperation in the development and evolution of the Internet. It was noted that decisions regarding the Internet, and how it is evolving, are largely determined by the developed, global north, with very little input from developing countries. Furthermore, at global level, the same active participants from developing countries tend to contribute repeatedly, with little or no opportunities for new blood and new ideas. This does cast doubts about the merits of "multi-stakeholder" approaches, given that, ultimately, they tend to be dominated by the same actors – be they in industry, civil society, government or academia. Clearly, there is need to interrogate and expand the multi-stakeholder principle in order to align it properly to its ideals. One other item that came up during the morning session was the issue of Net Neutrality <https://en.wikipedia.org/wiki/Net_Neutrality>, which has attracted little attention from policymakers in East Africa, even if it is a burning issue in advanced economies. In the developed North, net-neutrality has been framed as a battle between content providers such as Google, YouTube, Facebook and Netflix, and telecommunications companies, who make their infrastructure available for content distribution to consumers. The telecommunications companies feel that content such as YouTube is creating undue traffic congestion on their networks, and needs to be compensated separately – over and above monthly payments for access. They also feel, the telecom providers feel the advertising revenues that content providers are enjoying should be shared equitably in order to compensate for the traffic congestion triggered by content-based websites. Of course, the content providers do not want to hear about sharing advertising revenues, They argue that infrastructure providers are already compensated through the standard bandwidth access payments, and that further that charging content providers more for access would mean treating their content and access differently and unfairly, thus violating the fundamental and founding principles of an open and neutral Internet. Locally, telecommunications companies seem to be reacting to net neutrality differently, by providing free internet access to content sites like Wikipedia, Facebook, and Internet.org amongst others. Whereas this may look like a generous offer to speed up the uptake of Internet services, it inherently favours foreign content providers over potential local content innovators wishing to compete with similar content. *UNCOORDINATED RESPONSES* Security laws that allow security agencies to intercept citizen communications were cited as setting a worrying trend. Whereas the need to enhance national security by governments was acknowledged, contributors felt it was necessary need to observe an appropriate balance between security procedures and citizen liberties as enshrined in the Constitution’s Bill of rights was necessary. .... Participants, however, raised concerns as to how these two initiatives were working together, and more importantly, how they interface with national security organs such as the NIS, the CID, the Central Bank and the Judiciary, among others. In the absence of a legal framework to shape a coordinated cyber-response between stakeholders, Kenya is likely to remain vulnerable to cybercriminals and their activities. At some point in the industrial revolution the american economy was support almost completely by oil steel snd electricity which where controlled extremely by monopoly. These drove to great social and economic disparity and a great gap between the wealth and not just rich, and the poor. Politics intervined at one point that allowed the wealth trickle to the or and thus an environment for innovation competition and creativity I dont see any case of capital flight in any case due to the politics involved. Unless the foreign investors are threatened and the environment in kenya becomes risky we will still have airtel prefer kenyan market and even continue to invest in assets within the contry simply because of the challenge that they are exposed to. If the risk is too high then the returns must guarantee the opportunity cost. Would Safaricom get a licence in the first place in these markets? 6. We have seen how multinationals steal from Kenyans by evading taxes through transfer pricing, declaring false losses, etc. Why would we want to kill our crown jewel in support of thugs? 7. In a similar manner we want service excellence achieved through people excellence in the civil service. Without happy people, we shall forever be complaining why things aren’t working, even with the best ideas floating around. *FRUSTRATING BUT VITAL* I have sat in meetings where a Minister walked in with a 12-item agenda and talked through it, without any input from senior civil servants. Some, if not most, bureaucrats are completely inaccessible, even to their senior staff. The little that we achieved at the Communication Ministry was due to the fact that there was constant interaction between industry, the general public and the Ministry. *We leveraged technology to gather information from platforms such as KictaNet <http://www.kictanet.or.ke/> (where the public vented their anger towards government and we responded to each and every question).* *Some of the issues raised on the platform led to policy statements. We need such a window in every Ministry. It gave me a chance to regularly write and explain our actions, and how much we had incorporated ideas from the public.* Granted, it is a frustrating thing for a leader to do, but it is the best way to gather ideas that will change our current status. This is the age of collaboration. Every idea has its place in creating change. Humility does not cost anything but, in my view, it is the missing link between what the public expects and the goals that the government wants to achieve. Leaders need time to listen and actively learn from others since no one has the monopoly of ideas. But even as this sounds simple, it rarely happens. It is because of that kind of openness that the document remains relevant today. Even though the firm had a global network, it relied on local input to come up with a comprehensive vision. The recent fiasco surrounding allegations of compromised Integrated Financial Management Information System (IFMIS <http://www.ifmis.go.ke/>)passwords and attempts to embezzle funds from government coffers should serve as a wake-up call. The integrity of our information systems is an urgent priority. To be fair, Kenya is not the first country to experience IFMIS challenges. The objective of IFMIS is in line with most automation projects – to increase efficiency, transparency and accountability. Role and integrity of Surveillance system in Kenya

During the IGF, I had asked CA what measures are in place to ensure citizens surveillance data collected from telecoms service providers is not used by mischievous individuals to achieve dubious means. Well, here is an example... "Though not captured in the report, sources privy to the investigation also revealed that the Directorate of Criminal Investigations is on the spot because its detectives possibly tampered with official telephone data in a bid to conceal crucial evidence that could help in the case. It shows that telephone logs from a mast in Tigoni which would have placed the televangelist at or near the scene of the accident were erased. The effect of this was that records of the persons who may have called or received calls from the pastor are unavailable." ... Then there is data obtained from a local mobile telephone service provider that was expected to show the location of individual handsets, prior, during, and after the accident, so as to give clues on the location of their owners. Though not included in the report, a source privy to the investigation said this is the data which was probably interfered with and some crucial details deleted. For instance, while it gave the calls and SMS data for July25, 22 and 29, those recorded on July 26 and 27 were missing. Hello @Mwendwa, comparing safaricom and the likes of mumias telecom kenya and mumias is not right. I dont think safaricom is playing the same field as these companies, and again they aint shell companies if u get to understand there objectives. Safaricom has been able to thrive because it has allowed innovation to thrive yet if we look at the case of telecom kenya the beauracracies that was involved did not let the idea of innovation thrive within it, and again i dont think kenya airways is even close to be at the same table as saf, for aguement sake maybe a restructuring of its capital will let them out of the hole for a bit say why borrow money to buy expensive boeings yet wherr u borrow there is a cost and where r buying there is eve a greater cost than remaining vile vile! Someone agued some times back that the case in turkana where they are seeing a vgreat economic development for a short span may not hold since there are no right institution that can channel the growth and development to a level as norway. My point being that since the structures and policies thst has led to the status of mumias we archaic ( if thats the word) and that they were allowed to thrive in a modernized environment where competition thrives hences the porus nature of the organization. If we dont allow institutilnal restructuring in our country we may never get to where norway is assuming our major resource is not just oil like norway but any other that u think fits in my arguement. At some point in the industrial revolution the american economy was support almost completely by oil steel snd electricity which where controlled extremely by monopoly. These drove to great social and economic disparity and a great gap between the wealth and not just rich, and the poor. Politics intervined at one point that allowed the wealth trickle to the or and thus an environment for innovation competition and creativity I dont see any case of capital flight in any case due to the politics involved. Unless the foreign investors are threatened and the environment in kenya becomes risky we will still have airtel prefer kenyan market and even continue to invest in assets within the contry simply because of the challenge that they are exposed to. If the risk is too high then the returns must guarantee the opportunity cost. Hello all From a finance point of view. Availing critical financial services to the worlds unbanked population is mandatory to economic growth and development. Somali is one country out of two in africa that is not given any finacial assistance to its balance of payment through the IMF and the likes. Last year alone they recorded a growth in GDP of 3 percent. Thanks largely to its money transfer system that has helped boost the growth. Digital financial inclusion is mandatory to growth and development of economies (third world economies) where batter trade in some of these region is a norm, lack of proper health care services and a resilient poverty may be due to lack of relevant education, financial awareness, and proper planning from the income generating population. Services such as health insurance, banking, if addressed properly in a non exploitive manner may lead to greater saving and investment opportunities to these communities. Through use of the digital realm which has penetrated through the communities then services like money transfer can be a greater contributor to the economic and social development of these communities where a discrimination in pricing chargwes can be applied to favour a 200 kshs transfer that costs 53 kshs. People are afraid to save where it cost them, they are also afraid to spend where it cost them much more than holding money at home or having the money into a preferrable legal tender (as livestock for batter trade ). I don't have the full details of what transpired but I do know one thing (or two):- We are wasting too much time discussing an issue which the market will address - sooner rather than later. Instead of Regulators and policy makers spending too much time debating on whether Safaricom is dominant or not I challenge them to create an environment that will ensure that such discussions are pointed in the right direction. For example:- 1. Do we have ubiquitous broadband in the country? When we talk about high speed internet do we mean Nairobi or Kenya? 2. What is the Universal Access Fund doing? Where are the reports for us to interrogate? 3. What is our definition of Net Neutrality and how will this affect the growth of critical infrastructure going forward? 4. Under telecoms law, "potential abuse" is the concept used and applied "ex-ante" unlike competition law where "abuse" sanctions are applied ex-post and for reasons which are well known, this would be too late in telecoms sector. As an exception to the general application of competition law, mere dominance under telecommunications law triggers additional regulatory sanctions while applying competition law principles. Remember that CAK is also a competition regulator for telecoms sector but mainly uses "ex-ante" approach. Listers Apologies for cross posting. Safaricom was again on the dock two days ago at the Senate that was sitting to discuss this issue. I don't have the full details of what transpired but I do know one thing (or two):- We are wasting too much time discussing an issue which the market will address - sooner rather than later. Instead of Regulators and policy makers spending too much time debating on whether Safaricom is dominant or not I challenge them to create an environment that will ensure that such discussions are pointed in the right direction. For example:- 1. Do we have ubiquitous broadband in the country? When we talk about high speed internet do we mean Nairobi or Kenya? 2. What is the Universal Access Fund doing? Where are the reports for us to interrogate? 3. What is our definition of Net Neutrality and how will this affect the growth of critical infrastructure going forward? 4. Are the Telcos collectively behaving badly? And what can be done to address this issue? I mean stuff like 'expired' bundles, Fair use Policy (whatever that means!), basic customer service etc. 5. What is our position on Privacy and Cyber Crime? 6. Does the average Kenyan understand the pitfalls of freely sharing information online? And how can we protect them without curtailing their freedoms? 7. In the wake of the GES Conference what next? My humble opinion is that this continuous talk of Safaricom being dominant is akin to Wagging the Dog. S. Department of Commerce's National Telecommunications and Information Administration (NTIA) to the global multistakeholder community. This presents a seminal opportunity for the public to evaluate the proposal as a whole and how it meets the criteria established by NTIA. The ICG is encouraging the public to review the proposal and share their reactions and comments during the public comment period here <https://www.ianacg.org/calls-for-input/combined-proposal-public-comment-per…>. The transition of IANA's stewardship represents an important Internet governance milestone. The proposal for how to carry out the transition is the result of a tremendous undertaking by the global multistakeholder community, including the operational communities with direct operation or service relationships with the IANA functions as well as global business, civil society, governments, and Internet users. The proposal was developed through a transparent community-led process, open to and inclusive of all interested stakeholders. "The dedication that the Internet community has exhibited to the IANA stewardship transition is nothing short of remarkable," said Alissa Cooper, Chair of the ICG and member of the Internet Engineering Task Force (IETF) community. "The public comment period presents an opportunity for the public to assess the transition proposal in its entirety and for the ICG to build a public record demonstrating how the proposal meets the expectations set out by the U.S. Government." "It has been a big undertaking to develop a proposal that meets the criteria set forth by the NTIA," said Patrik Fältström, Vice Chair of the ICG and Chair of the Security and Stability Advisory Committee (SSAC). "I am confident that after receiving and analyzing the public comments, we will be poised to put this proposal forward to the U.S. Government for review and approval." In parallel to the ICG, a Cross Community Working Group (CCWG-Accountability) was formed to facilitate the process of developing enhancements to ICANN's accountability in light of the transition away from the U.S. Government. The CCWG-Accountability proposal will be available for public comment on Monday, 3 August. The public should direct comments about the Enhancing ICANN Accountability proposal to the CCWG-Accountability and comments about the IANA Stewardship Transition proposal to the ICG.
