Listers Interesting story about the pitfalls of ECommerce payments. http://www.businessdailyafrica.com/Corporate-News/I-M-Bank-suspends-online-… As one of the few acquirers (The others are Barclays and KCB, soon to be followed by Chase Bank) this doesn't auger well for online card payments in the country. Fortunately for us we have other payment gateways we can use. I'm curious to know what impact this will have on eCommerce in the country. Anyone can share insights? The main expected result from this workshop is to organize participation of the African community to contribute in the relevant script based work currently being undertaken to further promote Internationalized Domain Names in indigenous African scripts (e.g. Ethiopic) and through the use of Latin script for African languages. Listers Apologies for cross posting. Interesting developments in the mobile money. Safaricom moves to court to compel Airtel to remove M-Pesa branding from its agents shops. http://www.businessdailyafrica.com/Corporate-News/Airtel-removes-M-Pesa-bra… I'm curious. 1. Does Airtel own these agent shops? Or are they exclusive Airtel shops? If they are independent shops why sue Airtel? 2. Is Safaricom acting anti-competitively? Compelling mobile money agents who deal with competitor products to stop dealing with them? In other words is exclusivity something that passes muster in our commercial laws? 3. Whilst I have absolutely no problem with Safaricom protecting its brands I'm curious how this helps them in the long term except to continue perpetuating their 'Green Monster' badge in the face of the public. Us Kenyans have a love-hate relationship with Safaricom. We love Safaricom and hate it at the same time. This is an interesting conundrum for any brand. How to harness the negative and positive energies from customers to grow their brand equity. I hope someone at Safaricom is listening. On a related matter on the issue of dominance and abuse of market position:- Why do we need a consultant to tell us what is already obvious in the Telco sector? I think the regulator is throwing too much bureaucracy at an issue which can be resolved over a cup of tea with the various protagonists in the industry. Just saying.. Kenya to rival Nigeria in local content production

Bwana Walubengo has written a good piece on local content and it's regulation in his popular Op-ed pasted below. For avoidance of doubt Walu, I've included here the definition of Local content as laid out in statute. Its very clear from the regulator's perspective on WHAT local content is. Another issue you raise is the quality of local content. Well, my answer would be, let us try and try and try until we get it right. Nollywood grew from not giving up. KENYA INFORMATION AND COMMUNICATIONS (BROADCASTING) REGULATIONS, 2009 “local content” means the total of all television or radio programmes which fulfil any five of the following conditions— (a) the production is made in either Kenya’s native languages or official languages of Kenya; (b) production was done in Kenya; (c) the content deals with issues that are unique and relevant to Kenyan audiences; (d) at least twenty per centum of the share of the production company are owned by Kenyans; (e) a majority of the artistes are Kenyans; (f) the location of shooting, in case of audiovisual programmes or performance was in Kenya; (g) the author thereof must be a Kenyan national and in case of co-authorship or multi-authorship fifty per centum or more of the authors must be Kenyan; (h) the production is made under Kenyan creative and technical control, but does not include news and commentaries; 35. Local content (1) The Commission may require a licensee to commit the minimum amount of time, as maybe specified in the licence, to broadcast of local content or as may be prescribed from time to time by the Commission by notice in the Gazette: Provided that where a broadcaster is, unable to comply with the foregoing, the Commission shall require such broadcaster to pay such an amount of money, as may be prescribed by the Commission into the Fund. (2) The Commission shall from time to time prescribe a minimum local content quota for foreign broadcasting stations that broadcast in Kenya. Kenya Information and Communications Act, 1998 “Kenyan programme” means sounds or vision or a combination of both whose content comply with the classification of local content as may be required by the Commission from time to time. 46K. Regulations on broadcasting The Minister may, in consultation with the Commission, make regulations generally with respect to all broadcasting services and without prejudice to the generality of the foregoing, with respect to— (a) the facilitation, promotion and maintenance of diversity and plurality of views for a competitive marketplace of ideas; (b) financing and broadcast of local content; (c) mandating the carriage of content, in keeping with public interest obligations, across licensed broadcasting services; (d) prescribing anything that may be prescribed under this Part. http://www.nation.co.ke/oped/blogs/dot9/walubengo/-/2274560/2890270/-/y4ede… Recently the Communications Authority of Kenya (CA) announced that broadcasters would be required to allocate 40 per cent <http://www.businessdailyafrica.com/Corporate-News/CA-demands-60pc-local-TV-…> of their programming to local content. This is just the beginning. Within four years, the broadcasters are expected to scale this up to 60 per cent. What this means, essentially, is that local radio and television stations must find local content to fill up the space, currently dominated by Mexican soap operas on TV and foreign music on radio, across their 24-hour programming. There are two views regarding whether this is a good or bad idea. >From a government perspective, the push for regulation is meant to force media owners to invest in local production, rather than opt for the easier, cheaper option of buying third-rate soap operas from Mexico. In order to meet the 40 per cent local content quota, there must be significant production of local movies, documentaries, music and interviews among others, yet the ecosystem to support local production is not as cheap as most people would imagine. *HEAVY INVESTMENTS* For example, producing a movie requires heavy investments in both equipment and technical expertise, ranging from scriptwriters, actors and stage designers to editors, producers and distributors, among others. Furthermore, a 30-minute production may actually take three weeks to put together. Now think about producing such a series, once per week, four times per month and forty-eight times per year, and you will realise why most local stations may avoid sustaining local productions. It’s obviously cheaper to buy Mexican soap operas and fill up our airwaves rather than invest in local production. What the government is saying here is that cheap is eventually expensive, in terms of lost opportunities to fruitfully engage the youth within the creative industry. The alternative view to the local content policy is that current productions are of such poor quality that they would not merit any airtime. Furthermore, forcing stations to broadcast 60 per cent local content contravenes the liberal nature of our broadcast industry. Broadcasters want the liberty to choose what content to serve their consumers. *WHAT'S LOCAL CONTENT?* If consumers prefer Mexican soaps, so be it — after all it's their taste, their choice. No one should therefore purport to dictate what is good for the consumer by subjecting them to the so-called local content quotas. Besides, what exactly is local content? Would a film such as *The Lion King*, with its African theme, or *Out of Africa,* with its Kenyan theme constitute local content? What of the movie *12 Years A Slave*, in which our very own Lupita Nyong’o played a leading role? What about those documentaries on Kenyan wildlife that dominate NatGeo Wild on satellite TV? Do all these films qualify as local content despite their overwhelmingly foreign production? How are we going to determine what is local content, in other words? Will the decision be based on the theme, the script, the cast, the location, the production crew or mixture of all of the above? *MORE QUESTIONS THAN ANSWERS* Whatever the case, how will we stop Kenyans from simply switching channels — away from the local broadcasters whose content maybe deemed too local — and subsequently continuing to watch their preferred foreign content on other channels? This might effectively mean local stations will lose "eyeballs" and the associated advertisement revenue to the foreign competition, which in turn may mean we are losing rather than creating local jobs within the creative industry. Clearly, there are more questions than answers in the local content debate. However, one must remember that you can come up with local content without necessarily creating local jobs. The Investors Information report separately lists Telkom as owning 39.1 hectares of land and real estate properties along Nairobi’s Ngong Road with 11 residential buildings, a sports club and offices all valued at approximately Sh4 billion. Telkom owns 23 per cent stake in TEAMs, a 5,000-kilometre undersea fibre optic cable that links Kenya to the global internet superhighway through Fujairah in the UAE. The company, which was sold to French firm Orange in 2007 at Sh27 billion, also has a 10 per cent stake in another undersea optic cable, LION2, a 2,700-kilometre cable that connects Kenya to the global network through Mayotte in Mauritius, and an eight per cent stake in the East Africa Submarine System cable. Telkom operates 3G, CDMA, GSM and Wimax frequencies that are critical to the rollout of the increasingly important data services as the voice market continues to shrink. People familiar with the ongoing buyout talks said that while real estate properties and the frequencies have become key selling points for Telkom, potential buyers have been going deeper and scrutinising how much of the assets are not tied to the company’s heavy debt load. There has also been interest in the technology Telkom is running. “Telkom Kenya has a rich mix of frequency spectrums and assets portfolio that would attract any potential investor but sound investment decision goes beyond these,” our source said, adding that potential investors are looking at things such as the number of active sites the company has, revenue streams, and control of revenue leakages such as fraud on fixed lines. Curiously, the investor report does not include Telkom’s debt but other reports have shown that by August 31, 2014, its debt to equity ratio stood at 16 – a figure that is way above the statutory limits. To compound matters, the two shareholders are yet to agree on how to handle a Sh1.2 billion award that the High Court gave former employees who were retrenched in 2006. The study demonstrates, among other things, that domain name registrants are more familiar with new generic top-level domains (gTLDs) than general Internet users who have not registered a domain. Survey participants were questioned about their awareness of new gTLDs, as well as their perceived sense of choice, experience and trust related to the current gTLD landscape. The study completes phase one of a series of ICANN-commissioned surveys intended to inform a review of competition, consumer trust and consumer choice (CCT)<https://www.icann.org/resources/reviews/aoc/cct> in the Domain Name System. A second phase, which will be launched in approximately one year, will serve as a comparison to these baseline findings. Nielsen surveyed 3,357 domain name registrants aged 18+ in Africa, Asia, Europe, North America and South America. The survey was administered in 17 languages and participants were drawn from 24 countries. The research, conducted in two waves between February and August 2015, was designed to create a meaningful baseline of data on registrant attitudes regarding new generic top-level domains. "This survey provides us with a better understanding with how registrants view the domain name space and Internet and will help inform future reviews of the program," says Akram Atallah, president of ICANN's Global Domains Division. Along with the Global Consumer Survey<https://www.icann.org/news/announcement-2015-05-29-en>, whose results were published in May 2015, ICANN commissioned this survey in response to recommendations from the Implementation Advisory Group on Competition, Consumer Choice and Consumer Trust (IAG-CCT). ICANN conducted an open RFP<https://www.icann.org/news/announcement-2-2014-07-16-en> and signed a contract with Nielsen to conduct the study in November 2014. The findings will be a key input for the CCT Review Team to consider. Awareness of new gTLDs high among registrants, particularly in Asia Awareness of new gTLDs is higher among registrants than among general Internet users – 65 percent of registrants reported awareness of at least one new gTLD versus 46 percent of general Internet users. Interestingly, while 65 percent of general Internet users said they had visited a domain in a new gTLD, 64 percent of registrants reported the same. Asia stands out when it comes to awareness – 70 percent of those surveyed said they were aware of at least one new gTLD. Only South America comes close to that level of awareness, with 66 percent of respondents from the region indicating familiarity with at least one new gTLD. More registrants also said they're likely to consider a new gTLD for registering domain names in the future – 61 percent versus 52 percent of Internet users. As with Internet users, the top three choices for registering a new gTLD name were .EMAIL, .LINK and .CLUB, which were selected from a fixed list of new gTLDs. Registrants generally trust the domain name industry Registrants and general Internet users generally place the same levels of trust in new gTLDs and the domain name industry, with some slight differences. Registrants are slightly less trustful (70 percent of registrants versus 73 percent of general Internet users) that entities will take precautions regarding who gets a domain name, but are slightly more trustful (75 percent of registrants versus 71 percent of general Internet users) that those same entities will give general Internet users what they think they're getting. Unsurprisingly, registrants across the board favor no or few purchase restrictions on domain names in new gTLDs. Registrants aware and cautious of abusive behavior online Abusive Internet behavior, including spam, malware, phishing and cybersquatting are a concern for domain name registrants. Awareness among general Internet users and registrants is comparable, with registrants reporting slightly more familiarity with stolen credentials (71 percent for registrants versus 67 percent for general Internet users) and cyber squatting (54 percent for registrants versus 40 percent for general Internet users.) Across the board, registrants also report more personal experience with abusive behaviors included in the survey: phishing, spamming, cyber squatting, stolen credentials and malware. Perhaps because of greater familiarity with abusive behavior online, registrants as a group reported less fear of falling victim to abusive behaviors online. To combat their concerns, registrants are more likely than average Internet users to change their Internet habits, purchase an identity protection plan or simply stop making purchases online. The only strategy registrants are less likely to pursue than general Internet users is to purchase antivirus software for their computers to combat phishing or cyber squatting. Who's registering domain names? The registrants surveyed said they primarily register domain names for personal or small business use. The survey, which was only open to those who had registered at least one domain name, showed that registrants surveyed are mostly male (62 percent) compared to general Internet users surveyed, whose male audience made up 55 percent of the consumer survey sample. Registrants surveyed also skewed younger, with 70 percent under the age of 45, similar to the consumer survey, where 68 percent of the sample population was comprised of those under 45. .COM, .NET and .ORG were the most registered TLDs cited in the survey, gaining 72 percent, 31 percent, and 23 percent respectively of the names registrants reported holding. .COM was cited most in North America with 84 percent of the sample reporting registering a name in that TLD, while only 53 percent reported holding .COM names in Europe. While 80 percent of those surveyed said they had one to five domain names registered, only 40 percent indicated they registered duplicate domain names in different TLDs, with the highest number of duplicate domain registrations reported in North America (46 percent of the sample). Nearly half (49 percent) said a TLD's familiarity was the main factor in choosing which TLD to purchase. Additional study highlights include: * Registrants say a well-known TLD is a key factor in determining which domain name to purchase – more important than a reasonable price. * 61 percent of registrants find it very or somewhat easy to register a domain name. That figure rises to 76 percent in North America and 66 percent in Europe. * About half of registrants would prefer a cheaper, quicker, less complicated experience when purchasing a domain name, as well as a notable desire to make the process of registering in multiple TLDs easier. About the Global Registrant Survey and Supporting Materials The Global Registrant Survey was conducted by Nielsen on behalf of ICANN. The data collection phase of the survey took place from February 19 to August 13 2015, and the final report was delivered in September 2015. A total of 3,357 domain name registrants aged 18+ representing Africa, Asia, Europe, North America and South America were selected based on ever registering a domain name and being a decision maker in domain name registration decisions meaning they were aware of the purpose of the domain name and in which TLDs the name had been registered. East Africa readies to stem crime via phones

When you lose and phone and want it blocked, you need to obtain a Police abstract. You then have to go to Safaricom CC to get the IMEIs blocked. If you have a Dual SIM phone as I do, and you use different SIM cards from, say SIM1=Safaricom, SIM2=Airtel, despite it being one device, you have to take two steps - Report to Safaricom to block SIM1 and then also report to Airtel to block SIM2. I know someone things it makes sense that way, but this is one device! If they shared the database, shouldn't any of them should just go ahead and block both IMEIs?? The problem with Kenyan content is the quality of the material. Case in point, in the link shared earlier the top three local blogs are gossip sites which IMO post garbage. I think the biggest problem we have here is that people prefer International content and sites to Kenyan sites in general. You'll find that if I write a story about A, he'll never even bother to share it but if an International site does it, it's a real honour to them and they'll share the hell out of it. Also, even just news consumption. It's always better if it's foreign. A lot of traffic also goes to social networks and porn sites which we really don't have here.

@Mwendwa, my arguement is open to correction. In my view, to understand crypto currency its first best to understand its objective which is to avoid control and regulation and therefore having a decentralised management of these medium of exchange. A miner will create value through the commodity and underwrite it with an internet company and the company allows the medium to circulate and trade within its clients and users and therefore achieving a relative/absolute no-control from monetary authorities. The value of the currency remains volatile mainly due to the nature of its environment (the internet economy) which may be imperfect or perfect market, or efficient and inefficient market. Your Excellency President Uhuru Kenyatta Sir, I suggest that you liberalize the basic education sector. You could invite interested Kenyan investors to take up public school and run them for an agreed period of years. The Government would then pay a minimum school fees for all children in all schools. A given school may choose to offer education at the minimum school fees offered by the Government or increase based on the available facilities and standards. This will enable the Government to offer education to all children in Kenya. The schools will employ the teachers privately. Eight local universities are among 25 institutions which have submitted bids to provide 11,000 public primary schools with computer tablets when the first phase of the Sh17 billion laptop project takes off next year. Kenyatta University, University of Nairobi, Multimedia University, Moi University and Masinde Muliro University of Science and Technology are among the institutions of higher learning that have submitted their bids. Also eying the project, now rebranded as the Digital Literacy Programme, are Jomo Kenyatta University of Agriculture and Technology, Meru University of Science and Technology and Strathmore Research and Consulting Centre. The curriculum will be regulated by the Kenya Institute of Curriculum Development (KICD) and the project is being overseen by the Ministry of Information Communication and Technology through the ICT Authority. Hi all @Ali crypto currency (bitcoin, bitpesa etc.) is some form of medium of exchange used online. Us economist would prefer calling it an online commodity that acts as a derivative for the internet economy or market. It is different from paper money in others in that it is completely decentralised unlike paper money. What It means is that most central bank acknowledge its existence but have no control or regulation over it. Some economist compare it to gold. Gold can be found in reserves of countries and yet a miner can mine it at his/her farm and derive value from it. @Grace, crypto currency thrive in online( internet economies ). companies are coming up witj the commodity as an alternative to other mediums whose cost are much higher compared to crypto currency. Another significance is that with the growing GDP contribution of internation remittances to kenya most from expatriates; which is know the second largest contributer to the GDP, it can be a great relief to Africans by reduced cost of transferring money from abroad. ( which is at 15$ for every 100$ from the current international remittance companies.(i stand corrected). Then there is the introduction of competition in the industry. UN Broadband Commission: Global Broadband Growth in Decline, 4 Billion Still Offline

New figures in the report confirm that 3.2 billion people are now connected, up from 2.9 billion last year and equating to 43% of the global population. But while access to the Internet is approaching saturation levels in the developed world, the Net is only accessible to 35% of people in developing countries. The situation in the 48 UN-designated Least Developed Countries is particularly critical, with over 90% of people without any kind of Internet connectivity. *Google/France Ruling -v- Twitter Politwoops* This particular case ties in with the revocation of Netherlands-based Open State Foundation (OSF) access to Twitter’s API in August 2015. In 2010, OSF created Politwoops, a tool to publish tweets deleted by politicians. As the tool gained traction spreading into over 30 countries, Twitter was under pressure from politicians to explain why their right of expression was being tampered with, seeing that deleting a tweet is a form of expressing what you want (or don’t want, as it were) to be known of you. Twitter explanation went something like: “No one user is more deserving of that ability [to delete a tweet] than another. Indeed, deleting a tweet is an expression of one’s voice.” OSF is arguing that Twitter’s reasoning and justification conflates political figures transparency with their privacy. The people they represent need to know what their officials think about, not just for one moment but also across time. In fact, judicial rulings have over time recognized this need and particularly hold that public officials do not receive the same treatment for privacy as man-on the street (or Twitter streets). The question then is, between the citizen’s right to information and public officials’s right to privacy, what comes first. The French/Google case might be a little different in that it combines both private and public citizens compared to Twitter’s private versus public. However, this points to a growing discomfort between privacy, freedom of expression and access to information.
