Bandwidth trotting and protocol blocking was banned by EU in 2014. Mobile carriers used to block access to Skype because it hurts voice, calling, and text-messaging revenue. So part of why we have been calling for a Net Neutrality law in Kenya is to protect the consumer, and also have a stand. Currently, the ISP can do whatever they want. The model to adopt is upto the community. > 4. Hussein gives certain characteristics of a "market" but probably leaves out a very critical one: Choice. The best market is the one where ALL service providers are given the opportunity to offer their services and consumers are left to choose. At the end of the day it is the consumers that decide which companies and services survive and which wilt along the way. Why choose for the consumer beforehand by barring certain services or business models? Be careful before you imprison yourself with your own words :). In the same breath of choice, who decided which websites a consumer should have access to? Why choose for the consumer beforehand? :) Why limit consumer choice? At another level, consumers are not usually very knowledgeable in what they want, or even what is good for a country. I'm ready to bet that if one country allows zero rating, and another country provides reliable affordable broadband, then the one with affordable broadband will experience faster economic growth. I don't think they know how Netflix works and in any case the service is compliant in that it gives the user the ability to create a kids account where there will only be kids content. But even if we were talk regulation, I don't see how they would do that. Dear All- Facebook is hosting a roundtable to discuss the issue of online violence against women and our platforms, in Nairobi, likely in February. This is mostly about learning from key women’s rights orgs and others with a clear view on the scope of the issue and with ideas for how to address it. We’ll also talk about some of the things we are doing already, with the view to learning how to do better. It will be hosted in Nairobi, but it’s meant to be a regional conversation, so we plan to fly in important voices from across sub-Saharan Africa. ---- Brazil has lifted its ban on WhatsApp // The Verge Brazil has lifted a temporary ban on WhatsApp, one day after a court in São Paulo ordered telecoms to block the popular messaging service for failing to comply with an order related to a criminal case. In an decision handed down today, Judge Xavier de Souza, who did not issue the original injunction, said "it does not seem reasonable that millions of users are affected" by the company's failure to provide information to the court, and ordered that the ban be lifted. He recommended that a higher fine be imposed against the company, which failed to comply with two court orders pertaining to the case. The ban went into effect at midnight local time on Thursday, and was due to last for 48 hours. The Facebook-owned app is immensely popular in Brazil, where more than 100 million people use it as a free messaging alternative to expensive mobile plans. Brazilian telecoms have urged the government to crack down on WhatsApp, arguing that its free voice call service is unregulated and illegal, though officials have yet to implement new regulations. @Mwendwa - I like to see it more as a relationship between the individual and the state. Privacy to citizens, transparency from governments. Some governments hide under the sovereignty/westerners debate to close reasonable debate on these issues. The power relations between cross border data transfers is real and requires our attention but I think companies should be seen for what they do and not from where they are from. Blanket condemnation of Silicon Valley is missing the point here. Local companies here in Kenya might actually be the biggest threats to your freedom than a far off multibillion dollar co. Brazil got me by surprise. Of all governments, after the popular passing of the Internet 'Bill of Rights’ last year, NETmundial and this year’s IGF. They even offered to host Snowden. This got me! As it relates to privacy, it is neat to know WhatsApp has been working with OpenWhispers on end2end encryption. As at September 2015, WhatsApp had 900M Monthly Users. By securing and encrypting this huge number of users globally, WhatsApp is changing the future of communication as we know it and they should be supported by all those who believe in privacy and human rights. Interesting headline in today's Daily Nation highlighting intrigues surrounding talks on the Information Technology Agreement at the Nairobi WTO meeting. Ironically no-one seems to be bothered that the host, Kenya, has not signed that agreement that would have led to much more affordable ICT products for consumers. Maybe we are too tiny a speck in the ICT universe.

Bitcoin is a form of un-regulated digital currency that is not issued or guaranteed by any government or central bank. Domestic and international money transfer services in Kenya are regulated by the Central Bank of Kenya Act and other legislation. In this regard, no entity is currently licensed to offer money remittance services and products in Kenya using virtual currency such as Bitcoin. This is to inform the public that virtual currencies such as Bitcoin are not legal tender in Kenya and therefore no protection exists in the event that the platform that exchanges or holds the virtual currency fails or goes out of business. A report <http://www.worldbank.org/en/results/2014/04/04/savings-of-44-billion>by the World Bank (April 2014) had this to say: There are five “corridors” – a country to country transfer – with an average fee higher than 20%, all of them in Africa. Migrant workers in South Africa, for example, paid an average of just over 23% in fees on the money they sent to Botswana in 2012, making it the most expensive remittance channel in the world.Sending money from South Africa <http://www.theguardian.com/world/africa> to Mozambique was the second most costly channel, with an average 22% fee imposed on transfers. “Forcing migrant workers to pay as much as $50 to send $200 is wrong, especially when they are sending salaries they have earned in the hope of supporting their families back home,” An earlier report <http://www.odi.org/remittances-africa> by ODI (April 2014) raised the same point. Linking this back to Kenya - there are systemic hurdles denying entry into the remittance market innovative, cost effective competitors and this, in concert with existing market dominance forces, keep costs high. Waithaka, Ahmed What you have articulated is at the crux of the matter. CONTROL. To Barrack’s question:- 1) If you were the Governor CBK or CS Finance? How would you handle Bitcoins? (with limited knowledge on technology matters?) That is, I believe a critical component of Policy and how the government of the day chooses who is appointed to what docket. But to answer your question in a straight forward way:- If I were the Governor or CS Finance I’d first take the steps to ensure public interest is preserved. I would then call in the proponents of this particular case and try and find a way for them to work together as we extend our policies and regulations to encompass cryptocurrencies. The fact that we ignore them doesn’t mean they don’t exist. I certainly don’t want to be the proverbial Ostrich sticking its head in the sand and wishing away all its problems. But then, this is just hypothesis right? :-) My humble advise to Regulators the world over:- Don’t be like the Ostrich. :-) Oh, and I would have expected the Central Bank to have asked the court to enjoin them in the Lipisha/Bitpesa vs Safaricom case as Amicus Curiae. The UN General Assembly reviewed the progress made over the past decade and negotiated a text that addresses a number of global Internet governance issues. 2015 is also the 10th anniversary of a multistakeholder experiment that helped bring the WSIS to a successful conclusion: the Working Group on Internet Governance (WGIG). Convened in 2004, the WGIG assembled 40 representatives of governments and stakeholders who engaged in months of intensive peer-level dialogue and collective analysis.
