Blessed Thursday! Greetings Sidney! I refer to your last para on existence of this community as the multistakeholder platform. I concur by saying it HAS GOT the potential, however it is not yet/not doing it; 1. Look at the contributions to the ICT Policy. If we consider this policy would be the gameplan and Kenya's gamechanger for the next couple of years - probably about 20pax, 40pax... lent their voice through this medium. Well perhaps others had other avenues Come the Practitioners Bill, and we have a good flood across all social media. Well this may be viewed to hit directly right at the bread and butter and the innovative future. 2. For the ICT Practitioners Bill circulated to have reached as far as it is now in its current state even if it were not from practitioners then "where was this community of practitioners"? This is a BIG question as this community has great Techies. Or it points to a disconnect with policy and policy making and as such something to work on. 3. Who is/are behind the Practitioners Bill? Every paper has a face of persons to it and the spirit behind it. That has not been raised here so as to interrogate/engage with them whether they are part of this community or not. I suspect we have barely had a scratch of the ICT potentials to jerk our country's development. I say again, yes the potential is there and this community would offer great service to the nation. Comments on the statement by CS Mucheru on the ICT Practitioners Bill

I welcome the statement by CS Mucheru, clarifying the Ministry's, and the government's position that this private member's bill, introduced by Aden Duale, is at odds with ICT policy. What is not clear is whether the Ministry's intention is to kill this bill, or to subject it to modification. Let's be clear - this bill is an abhorrence to our hard-won freedoms, and should not go forward in any form. I would like to propose that KICTANET be formalised, with kictanet's original founders as the initial board, and be registered as a society with paying members. I'm sure others on this list, better qualified in such matters than I, can draw up an appropriate memorandum for such a society. If the membership fee is nominal - say, 500 or 1000 bob per annum - I think many 'ICT Practitioners' will join. Cheers, Tony -- Tony White

Hey Alex, Bwana Walu seems to have ducked "under" on this one, though my sentiment would be that, his oped at the time seemed to lean more on how to give the ICT fraternity a voice through representation at the national stage than what we seeing now with the proposed bill that seems to weigh in more on regulatory policing. Given the multifaceted nature of the ICT space, the worst the proponents can do is to sneak in such proposed regulatory frameworks without as much as subjecting the same to wide multistakeholder input. This could be counter productive, and in fact threatens to stifle the very space that opened up, got liberalized and has thrived for almost 14years and which, has been a catalyst and testament to some of the amazing innovative achievements and growth to date in this sector. So again, just like the wifi surveillance bill who initiated this..? Where was the consultative engagement..? This is sheer madness! We already have legislation (unconstitutional at that) requiring licensing of any kind of research (Science, Technology and Innovation Act of 2015, Article 12). Was this new dispensation aimed at regulating every liberty we have even those that are natural? Regulation always opens the door for bureaucratic abuse. This stinks of the same colonial attitude that prevented indigenous people from growing cash crops. Whoever came up with this bill was of the mindset 'if you can't innovate then ride in their coat tails'! Please can someone stop this madness?! There is a great opportunity for Techies to take their rightful place as professionals and be invited to give valued contributions to the nation building table. As I said earlier, non-Techs will be there. Perhaps another classification within the broader "ICT Professional". *ICT Practitioners - sounds like a very broad term to attempt to compact and create shared guidelines/standards. On the said ICT Practitioners Bill - it seems that part of the issue is with regard to who is/are behind it. All in all, to have gotten a hearing, it means this is an organised group. Which is perhaps what this community might seek to engage with and build together before "shooting the innovator". Blessed day. Blessed day! I do not think the national ICT Policy and practitioners are related. Said "ICT Practitioners" would not be the "only" persons with interest or affected by the national policy direction. I am yet to read the Practitioners Bill shared. What I know is that professions have "practice " Marketers,and Lawyers, HR Practitioners, Electricians are registered against certain standards which include academic and professional development. At the same time, more often than not, the "expert" Electrician when cables fall of is normally streetwise and may not be registered - gets job done. On the ICT practitioners end, a shared definition on ICT Practitioner is required so as to have a coherent discussion. Otherwise kila mmoja anachangia mada yake, kwani hatushikilii maana moja. And if ICT Practitioner has no definition, perhaps the drivers of the bill may have been attempting to give it a face. Blessed day. To capitalise on the value of ICT, we may position as an enabler so that all sectors may be more efficient and in turn more productive to the national economy. "A prosperous Kenya"...leave to Vision 2030 which is already using this appropriately in its messaging. "A productive ICT-enabled Kenyan Society." Thus very clearly measures of the value of productiveness may come out of this. The "competitive"...perhaps seek the global positioning Kenya wants....versus use of the generic word. "A productive ICT-enabled Kenyan Society; making Kenya a (the) global innovator." Something in the league of hotbed of innovation. Since ICT is in continuous evolution. Why would anyone want to subject all these youth, together with those graduating from colleges and universities to one more hurdle before they can start working? Can't we leave it to the market to separate the very good practitioners from the average ones? I do not understand the Kenyan obsession with ever regulating professions. What I know is that it is expensive for parents to perpetually pay fees before their (overgrown) children can finally get employment. It is also an additional cost to businesses as they have to foot the cost of compliance for the various professionals they employ or outsource. Finally, what are our legislative priorities in this sector? I would have thought the Data Protection framework is more urgent and maybe a Cyber Security one. While I did not intend to comment on the contents of the Bill, I can't help but notice that one ICT Association of Kenya will have the arduous task of appointing five (out of nine) people to the Council that will regulate professionals (Section 4). Kivuva +1, I think ICT in itself is a very disruptive phenomenon and also an environment that rapidly goes through incredible changes within a short period. I also think most people then can be regarded as ICT practitioners by virtue of daily use of computers, smart devices etc. As much as people go to school to learn it as a profession, most have earned skills through daily use of the technology and may not necessarily have a certificate to show. Therefore this bill therefore may not be well advised. Traditionally, the key governance actors have been the ICT Parliamentary Committees, the ICT Ministry, the National Communication Secretariate (NCS), the ICT regulator, the ICT Authority, the ICT (Multimedia) Appeals Tribunal,etc. The market players have been the Operators, Postal Agency, Courier Services, Application Service Providers. Have these entities worked well for us or do we want to delete, add or restructures some of them? Is there a need to define and bring in specific roles for Professional bodies, Civil Society and others within the ICT space? What are the legal & regulatory gaps we find moving forward? If we put our empathy thinking caps on and make ourselves "government/legislature, what might be the need/concerns. - Whom would the governments be running after - How to arrest situations for overall national interests - How to determine that an online entry/discussion might birth or build situations that may increase " vital information leaks, tensions, unrest etc" - ?Many morr I believe just as with other government related inquisitions on policy, it is good to engage directly with the government agencies to know their way of thinking. Here perhaps agencies in the Ministry of Foreign Affairs. You will note that in this case opinion leading nations were for amendments. This may also indicate that there may have been many other nations who were silent for their foreign policy and public image interests yet anyway when the situation arises they would not hesitate to switch off. May we be open to hear, may the IGF take consideration to have voices from foreign policy with a balance of NSA and Government end. Blessed day. Greetings Listers Today I am truly happy to hear so much open dialogue about blockchain, bitcoin and digital currencies in Kenya. When we founded BitPesa in Nairobi in October 2013, we were at the start of a long, slow uphill climb with a brand-new technology. There was a lack of knowledge, a lot of rumors, and an unwillingness to hear that the future might look very very different from the past. Yesterday, Citi Global Research featured BitPesa as an exceptional business case for blockchain technology. (Report attached). This is a proud moment for a start-up begun in Nairobi in 2013. It is not easy to build a company with technology that nobody has heard of - but we have continued to press forward, growing our customers, obtaining a license from the UK FCA, expanding to Nigeria, Tanzania, Uganda, the DRC and soon Senegal - and increasing transaction volumes every month, averaging over 30% MOM growth. We remain the largest company in Africa that uses blockchain technology. I would be happy to meet with any team or company that is interested in learning more. We have presented to six Central Banks across Africa and have been readily welcomed in five of them. We have shown that digital currency technology can be used in many different ways -- in itself it is not a business. Companies will use this technology in different ways - and Central Banks and the Private Sector should learn to differentiate the different types of businesses that use this technology to make their business models more efficient. The application is amazing in humanitarian/disaster services. The biggest competitors of dinosaur banks is not from other dinosaur banks but the gap between them (their products) and the consumers and this is where it gets exciting from a FINTECH perspective. The thread is still open, we also encourage listers to edit the policy directly on the Jadili platform (http://jadili.ictpolicy.org/docs/kenya-ict-policy) Today we focus on the following areas: *Online Citizen Safety, *Child Protection *Privacy issues *Security business transactions (Info-Security) *Security & Reliability of Critical ICT infrastructure The Background: The more we automate and rely on digital services, the more vulnerable we become as a society to cybercrime and other threats facing the digital society. The regulator has a Computer Emergency Response Team (CERT), the industry (TESPOK) also has a CERT, the Department of Criminal Investigation & National Intelligence also have CERT. What is not clear is whether there is a framework to have these teams working together and their capacity to counter a full-blown cyber attack against our digital national assets. Additionally, the tension between citizen privacy and national security, citizen privacy and business (profit) concerns remain perhaps due to lack of Data Protection, eTransaction and other laws. Dear Listers, I can attest that there is an inter-agency team working on a Computer and Cybercrime Bill, 2016. I joined the team after we analysed a draft that was developed by the ODPP. While a Zero draft is yet to be finalised. I know that we agreed that it will not address itself to hate speech issues. I was therefore taken aback by the CS Mucheru position yesterday which seemed to make references to the 2014 Draft Bill developed by the ODPP other than the one being developed by the Inter-agency committee. On today's important topic how to enhance Cybersecurity, i will zero in on the awareness of the end user. Most of the time the end user may not know that they are a subject of an attack and that boils down to the need for basic knowledge sharing on what constitutes a cyber attack and how to secure your own system from viruses, malware and lately ransomware among other attacks. I believe many users need a constant reminder to update their system protections and also know what and where not to click, this could help a lot. On the issue of privacy, i did a paper sometimes back on social media and privacy, and from my small survey, i discovered not many users of these platforms had read or knew about what their rights as regards privacy, personal data among other key implements. Therefore again I call for constant efforts for awareness. Google, could have a record of everything you have said around it for years, and you can listen to it yourself. The company quietly records many of the conversations that people have around its products. The feature works as a way of letting people search with their voice, and storing those recordings presumably lets Google improve its language recognition tools as well as the results that it gives to people. Dear Listers, Thank you for these moving inputs. On today's important topic how to enhance Cybersecurity, i will zero in on the awareness of the end user. Most of the time the end user may not know that they are a subject of an attack and that boils down to the need for basic knowledge sharing on what constitutes a cyber attack and how to secure your own system from viruses, malware and lately ransomware among other attacks. I believe many users need a constant reminder to update their system protections and also know what and where not to click, this could help a lot. On the issue of privacy, i did a paper sometimes back on social media and privacy, and from my small survey, i discovered not many users of these platforms had read or knew about what their rights as regards privacy, personal data among other key implements. Therefore again I call for constant efforts for awareness.
