Yesterday, at the BlockChain Conference at Strathmore, we had the good fortune to be addressed by a Mr. Nyimbi Odero, an Advisor, Innovation & Digitization Ecosystem at the MOICT. We were impressed by the address on how the Ministry is collaborating within the Government to ensure that Innovation and Digitization permeates the whole government ecosystem. As a player in the Fintech space in this country I would humbly request the Ministry to look at what the Central Bank of the Netherlands is doing to nurture innovation in the Dutch Financial Sector. These guys have gone beyond the Regulatory Mandate to further the needs of the country in the New Normal. The word 'quack' is largely used the medical fraternity for people who look like doctors, act like doctors and talk like doctors. We have had of a few of these cases in this country. So we can also agree that quacks are not done away with boards or bills that are set up to make sure only certified practitioners were in the field. Question: What mechanisms are going to be used to ascertain that a person meets the requirements of 15(d)? My question is based on the possibility is that the Council could decide to arbitrarily choose any one to be a practitioner based on any criteria chosen by the Council. We would be led to believe that the people sitting in the council are of "good moral character and a fit and proper" to pass fair judgement. In Kenya, what does that statement mean? Thus, personal obsession should not form a basis for castigating the views or initiatives of others regardless of how unsound one perceives them to be from their own perspective. Listers must also be wary of people who will never approve anything as long as it has not passed through their own hands. As long as we are in a constitutional democracy, individual citizens wield a right to lawfully pursue any agenda of choice. All the same, I have full confidence that the Energy and ICT Committee will sift the issues as requested jointly by stakeholders and make drastic recommendations on the Bill to eliminate any possibility of negative disruption to the Kenyan ICT growth trajectory. Thus, personal obsession should not form a basis for castigating the views or initiatives of others regardless of how unsound one perceives them to be from their own perspective. Listers must also be wary of people who will never approve anything as long as it has not passed through their own hands. As long as we are in a constitutional democracy, individual citizens wield a right to lawfully pursue any agenda of choice. Nothing for instance would prevent anyone from forwarding a "Nyama Choma Practitioners Bill" to Parliament for Consideration. My humble understanding is that KICTANet is a serious platform where listers are at liberty to exchange ideas that are supportive of ICT sectoral progress. To this end wisdom should flow unfettered. This imposes a responsibility to ensure that information supplied is factual, evidence based and not merely driven by a passion for online flamboyance. UPDATE ON KICTANET ENGAGEMENT WITH VARIOUS STAKEHOLDERS ON THE ICT PRACTITIONERS BILL

Dear all Further to our formal update on this matter on 17th August 2016. As we had earlier informed you, KICTANet is working in a consortium comprising of ourselves, the Kenya Private Sector Alliance (KEPSA), the Technology Service Providers of Kenya (TESPOK), Kenya Information Technology and Outsourcing Services (KITOS), Bloggers Association of Kenya (BAKE) and the iHub. The consortium after presenting a memorandum opposing the Bill was told that this was not among the options available to the National Assembly Energy and ICT Committee as the role of the committee was to consider the Bill and report back to the House. The Committee advised that we single out clauses that we would like amended and propose amendments. In considering amendments, the consortium was guided by the following: a) ICTs are novel and cross-cutting and therefore, many people in various professions may be defined as ICT practitioners if the term was to be broadly interpreted. The law should not target people whose primary occupation is not ICT or people who use ICT as an enabler to their primary occupation. b) There are many especially young people using ICTs to develop solutions to everyday challenges through experimental approaches. The law should not be crafted as a hindrance to innovation. c) After listening to the concerns of the sponsor of the Bill, where he cited quacks as a problem in the ICT sector, the consortium proposed that there could be a database of ICT practitioners but without accompanying encumbrances such as annual licensing, tests and mandatory training. d) Other issues were the need for a governing organ that was representative of the sector and the overarching principle that government/governance should be more of facilitative than a hindrance to people's freedom to achieve their destiny. We would just like to assure the network that we participated in proposing amendments as this was the only avenue provided by the Committee to receive our memorandum. We have always reiterated our position that we are opposed to this Bill in toto. We are awaiting the report of the Committee which will then be tabled in Parliament for subsequent parliamentary procedures. We are cognisant of the fact that the Bill is sponsored by the Member for Garissa Town who is also the Leader of Majority in the National Assembly. We had written to him expressing our opposition to the Bill and praying that Parliament help this sector by prioritising other crucial Bills such as the Data Protection Act. We call upon members of this network to join us in sensitizing Members of Parliament on our rationale for opposing this law. Women online (and child safety) have formed key discussions in the overall Internet Governance discussions. “online abuse and gender based violence can, among other things, limit women’s ability to take advantage of the opportunities that ICTs provide for the full realisation of women's human rights, act as a barrier to access that can exacerbate the gender digital gap, often violate women’s human rights, and reaffirm and reproduce gender stereotypes”. Thus, countering online abuse and gender-based violence is essential for both inclusivity and sustainability. With the Kenyan elections 2017 around the corner, women aspirants online is one area where we experience the lifting of physical abuse into the online space with no recourse (or just brushed off). I recall Fadzai Madzingira of Facebook mentions that this is an area of FB focus. Fadzai may also kindly add to the discussion shedding light on what we expect to see (or is happening) specifically for "protection" of women aspirants online (and female voters) or safeguarding their online rights and equity or good practices elsewhere. With all due respect to declarations and statements, I think non-binding norms and principles are very limited in preventing technical decisions in domestic places. Much more needs to be done on the technical front to make Internet shutdowns as expensive as possible to governments. If a significant number of people are able to circumvent a partial shutdown, governments would reconsider their decisions since they lose economically with no political ends attained - in this case preventing people to assemble and organize online. Listers, Internet shutdowns are almost becoming a part of African elections and reports indicate that Gambia has taken this step ahead of elections tomorrow. With an added twist- calls also seem to be blocked. A few months ago we discussed the Ugandan shutdown where we went at length into the techniques employed, including electricity blackouts. With our own elections round the corner, a few questions: Is anyone concerned that Kenya may also have a shutdown come elections? In the (hopefully hypothetical) case that we had a shutdown, who would effect it? ISPs? MNOs? Kenya Power? And who would give the orders? The Government? The Regulator? Proposal: an ICT practitioners registry.

Dear all, First, apologies for cross posting. I needed this to go through to both lists (and if you can, share it widely). As a pre emptive attempt to keep rent seekers at bay in the name of regulation, I propose a portal, named "ICT practitioners registry", a free to join, free to leave online registry. It shall be a self regulating Web portal where anyone who considers themselves a practitioner shall fill a Web form (to meet the "registration" bit) and shall be assigned a registration number. We can even have the system generate pdf membership cards for those that wish to have them printed and certificates generated for printing for those that wish to print them. We shall then have a separate list where quacks (not alleged quacks) who have gone through the judicial process and found guilty of being quacks can either be listed separately as quacks, or temporarily or permanently suspended. In doing this we will have left the burden of proof on to the "prosecution" and not the "defence" to prove who is and who is not a ICT professional.

Dear Grace, Thank you for working with my rope analogy and by qualifying that what I was talking about is the “knowledge of machines”. As you can see, we now have two ropes to weave and untangle here. The rope I alluded to, the ‘Knowledge of machines’,starts somewhere in the 19th century with analogue computers, through the silicon revolution, the Mainframe, the Minicomputer, the PC, the mobile phone and the tablet. As for the networks, we have come from wired electrical networks to digital signals of Ethernet, wired as well as wireless communications all combining into an amorphous “Cloud” where everything is defined in software and can be offered as a service. This rope is ever so quickly building on what came before that the “software engineer” has to continuously update his/her skills or else … The rope you are alluding to is where ICT meets established structures, especially in education. The Internet in particular has unlocked learning in such a grand scale that ivy league universities can only sell their brand and the alumni network to attract top minds. A lot of that knowledge is in ICT, both software and hardware. Anyone can now challenge an industry by unleashing ICT on it. Finance especially banking and payments, transportation, hospitality, medical diagnosis and practice, law; all these “industries” are suffering since the scarcity, a lot of it artificial, is being done away with, lowering the cost of doing that particular business. It is interesting that my rope, “practice” is extremely hard if not impossible at the moment to regulate with examination and certification. Cloud computing courses are barely 2 years old at Masters level and they are building on Distributed Systems knowledge. These have yet to trickle down to Undergrad, though I see PaaS, IaaS and SaaS are being introduced at this level. However I stand to be corrected on this. And all these are behind the cutting edge that revolves around passion and self-learning. No one can regulate that. Your rope, “industry” is completely in flux especially as you noted, with the rise of Artificial Intelligence. The innovation is in bringing ICT in most part, to disrupt established modes of business by bringing speed, accuracy and efficiency to bear. And there is iteration on the disruption as the ICT practice itself evolves and is replaced by newer technology. the “home” as well as the “shared economy” are changing lifestyles as we watch, with the collapse of malls begins in the US of A and is bound to spread across the world as online consumerism takes over. Who can regulate that? Whew! Fellow Listers, The proposal by the ICT Authority to rein on quacks is actually overdue if ICTA's legal mandate is anything to go by. On the basis of Legal Notice 183 of 2013 and Legal Notice 198 of 2013, the functions of ICTA are as set out below: I have listed all and boldly highlighted the ones that are most significant in light of the current conversation. (a) *set and enforce ICT standards & guidelines for human resource, infrastructure, processes, systems and technology for the public office and public service* and; (b) deploy and manage all ICT staff in the public service; (c) *facilitate and regulate the design, implementation and use of ICTs in the public service;* (d) promote ICT literacy and capacity; (e) promote e-Government services; (f) facilitate optimal electronic, electronic form, electronic record and equipment use in the public service; promote ICT innovation and enterprise; (h) *establish, develop and maintain secure ICT infrastructure and systems* (i) *supervise the design, development and implementation of critical ICT Projects across the public service.* (j) implement and manage the Kenya National Spatial Data Initiative As long as the ICT Authority operates within its lawful mandate and adopts a consultative approach, we owe them some measure of support rather than castigation. Fellow Listers, (Please read through until the end before reacting.) It is unfortunate that this issue has arisen before the dust from the ICT Practioners Bill has settled. There are a lot of pent up emotions (and rightly so) associated with confronting policy corruption. This has not only affected ICT but other fields (I seem to be the only one angered by some of the sections of the Science, Technology and Innovation Act). It is also unfortunate that that the subject of this thread is misleading or incomplete at best and that the journalist who penned this piece did not take the time to dissect the issues. For example, there is no explicit statement that this applies only to government expenditure and the reference at the end is vague (“…that the government has an interest in.”) Nevertheless, government agencies have a duty to protect the public’s interests in delivering service to the people. In this case, the issue is the use of public funds (not private capital) in procuring government contracts and the ICTA is proposing regulation to this end. Please remember that the mandate of ICTA is to serve the government and not the private sector. “The Authority is tasked with rationalising and streamlining the management of all Government of Kenya ICT functions.” (from http://www.icta.go.ke/ict-authority/ <http://www.icta.go.ke/ict-authority/>). To the best of my understanding (and the functions of the ICTA) the statement by the CEO have no bearing on private procurement and application of ICT to private business. This is not a move to regulate the ICT sector but to secure the procurement of ICT services in government functions. In other words, quacks are those who are stealing public funds by masquerading as ICT professionals. Now, who would be opposed to that? Wow Andrew, It seems that is everyone's journey here until "recently" when Computer Science became a course in our universities. I am a "quack" as much as you are. I loved the story and all the best. So, Listers, this is my take. The problem is that the government has allowed tenderpreneurs to flourish in every sector, and the experts in the government, who ought to supervise, are compromised for various reasons. We are just feeling the heat now because we are in the way of the rent seekers. Look at our mechanical engineering sector and see the chaos caused by "regulation". Hmmm, There is no contention on the need for hard working, innovative "ICT practitioners" passionate about their craft. What is in contention is whether this is the right time to bring in regulation to the industry, not regulation of the practice. What we don't have, because the ingredients forming the industry are still changing rapidly is an ICT profession. Will there ever be an all-round ICT "professional"? Looking at human medicine, the human body is not changing, so one can standardise the medical profession, with known practices and various specialisations once the basic learning is done. It that it? We need to accept that ICT is in everything now. And it is entering mission-critical, life dependant places. And for a doctor who wants to carry out a remote surgical operation, the ICT professional helping him set up the equipment on local and remote site better be qualified in something beyond passion and innovation. Those don’t cut it at that point. The Wright brothers had no flying license. The pilots today do. I liken it to weaving a rope. At some points all the strands have to come together and form the rope. Are we looking at the quality of the strand or the strength of the rope? If it is both, then there are two different mechanisms at play. We need to separate those.
