Listers We are entering a new dangerous phase of threats to Internet Freedoms and privacy due in part to the rise in Terror and Governments increasing ineptitude to safeguard its citizens. We are often faced with options of either:- 1. Surrender your privacy and freedoms online OR 2. Risk terror attacks. The big question we all ask today is this:- Can Governments worldwide safeguard freedoms and privacy while at the same time fight terrorism effectively ? Excerpts form this interesting New York Times article:- By then it was clear that tools for digital burglary had spread well beyond the hands of regular police officers. Comey (FBI DIrector) had argued for weaker safes; Vincenzetti (CEO of Hacker Team) was selling longer crowbars. They could be used to chase Jimmy Page, arrest Chapo Guzman, fight crime, smear a political opponent or just keep tabs on someone, anyone. To be hidden is to be a terrorist (emphasis mine) — this was the heart of his pitch. Emmanuel Good points. I'm sure the banking sector has considered this. Fact is this:- The money circulating in the banking sector is less than 30% of liquidity in Africa. I believe the regulator needs to relook at its mandate and focus on the bigger picture.. Besides, I'm sure the banks have considered that risk and found it worth it.. Bwana PS Kyalo The above refers. Could you kindly update us on the way forward regarding the 2016 ICT Policy? We would like to know how the community can help further and when the Policy will be become a 'live' document so we can be able to delve into it and extract the gems that lie therein. We would also like to know how the multi-stakeholder engagement benefited the development of the Policy, what was added, removed and the criteria used to do so. Of course we are also keen to see the final document. Thank you and looking forward to your response. Kudos for this. We (ICT practitioners) were certainly being turned into some laughing stock for some of the sentiments that were expressed ostensibly by ICT experts, including our own CS (my friend Joe) who to say the least either for lack of clarity or otherwise chose to express himself unfaithful to his calling and training. Washington Odhiambo was spot-on in his comments a couple of days ago. Some of us submitted memoranda to the elections ICT working group and expressed very similar sentiments. Like I said last time as a postmortem to the last general elections; Technology didn't fail us, it is people who failed us......enough said. An excerpt from the story in the Business Daily:- The Business Daily has learned that KBA member banks submitted their product and system proposals to the CBK in July ahead of the planned August launch date, seeking approvals. Such authorisations, which are ordinarily issued after a maximum of one month, are however yet to be issued, delaying the launch of a product that promises to revolutionise the financial services sector. Again, once entered, this data should be hashed. If the polling station has network connectivity, the results should immediately be sent together with the hash. IEBC then verify the hash with the data received and if they match, they approve the results. If the polling station lacks network connectivity, the “hard disk” should be physically and securely transported to the nearest point with network connectivity for transmission from there. All along, I have keenly considered this matter that seems to have divided the country down the middle: *Manual Backup* during the 2017 voting process. From the Jubilee/govt side this is a do or die and so it must be there. This govt side seems hell-bent on confusing the masses, as well as the experts like the ICT Community. From the Opposition side, the agenda seems to be very clear - that of ensuring integrity of the Voters Register and stopping 'ghost voters' from ever casting their votes. That brings us to the famous acronyms - BVI (Biometric Voter Register) / BVI (Biometric Voter Identification). Having been to a Voter Registration Centre (later to become a Polling Station) to register as a voter, I did look at the equipment in use for the registration process. I saw the laptop which was fitted with a camera and fingerprints scanner. All these require power to run. I did not dwell on how they were powered, but probably there was a battery backup somewhere (besides the electricity) given that they needed to run for a whole day for several days during the voter registration process. When it comes to the Elections, they only need to run for about 11 hours. My point here is that of *Backup Power* should it be that there's electricity blackout and the built-in batteries can't last the whole day. That backup is very important. However, I did not see any piece of equipment which could suggest that the equipment in use required any form of connectivity back to some central server in order to function! Which now brings me to the currently national debate - Manual Backup during the Poll Day. What is it? Was the CS honest with his presentation before the Senate/Amos Wako committee yesterday? Does the CS himself really believe in the content of his presentation? I am asking that because I watched him and I don't believe him. I actually think he mislead the committee, and hence the nation at large. Someone please prove me wrong. I am at that point where I believe that the BVR/BVI does NOT require any form of connectivity and so this Manual Backup being touted by the ruling coalition side, strongly supported by the ICT CS is a big lie. WHY? My very first answer: Simply put, *when there was no requirement for a manual backup during voter registration, it goes without saying that there is NO NEED for on the polling day.* 1. For the issue that is in contention - BVR (used for BVI during polling) - this is a database that can be (and should be) statically stored on the equipment for each polling station. We are not supposed to rely on the Mobile Network to access this voters database. And every polling station can have two/three laptops/Biometrics scanner/Backup batteries to ensure that the voter identification doesn't fail. Some excuse has been fronted about some voters being mechanics, such that their fingerprints wouldn't be recognized by the BVI systems hence need for manual identification. My take on that is that every voter must carry their voter's card on that day. The clerks can check that card number against the electronic system - enter it, and it will bring the person's picture, ID number, etc and let him cast his ballot. 2. For electronics results transmission (ERT), this is not even necessary in the first place. We can have the results collated/announced at the tallying centres after being certified - forms 36A, and such. However, if the ERT must be done, the data footprint is so tiny that a 2G network can be used. Besides, it can be an SMS based system, which doesn't require 3G or VSAT. The results data isn't that large - it can't be in Megabytes to be sincere. Well, VSAT can be used if they MUST, but this is after the voting process itself is complete, has nothing to do with BVI. The ERT and the BVR/BVI are two distinct systems. That is what I want to believe. The ERT gets feedback from a manual process - of voters casting their vote, clerks/agents counting, verifying, and certifying, filling requisite forms then communicating the same via some customized phones which are programmed to communicate to a backend system. Am I right on that?? Now the big question here is, where do we need this much touted manual backup where network connectivity is being used as the major reason??? (a) Citing terrorism and the possibility of Al Shabaab knocking off base stations seems like well thought out lie meant to cover our eyes! If they attacked an area, I doubt there will be voting in the 1st place. And even so, the network connectivity is not required for BVI so there is no disenfranchising anyone if there is no manual backup (whatever that is). (b) Citing hacking is neither here nor there for a BVR/BVI system because it's not being accessed live during the voting. It's a static database, unique to the polling station, resident on the laptop used by the clerks. The only hacking that can be done then can only be by an "insider". Quoting Victor Kapiyo from Social Media, "*I guess it's a question of trust. Trust in systems and in trustworthy people to do the right thing. For M-Pesa, or KCSE results, we trust both. For IEBC, I guess the jury is still out*." The main issue is not allowing the dead voters to rise again to vote in the presidential vote, then disappear. So the important component here is the BVR/BVI, the credibility of the register and hence the vote. At what point does the BVI system require this connectivity they are talking about, which then necessitates the so called "manual backup"? Did the CS ICT lie to the Senate?? Did the CAK lie to the Senate in supporting the lie from the CS?? Apparently it is wrong that IFES is registered as a limited company, for it to appear to undertake public benefit kind of activities. Social enterprises by definition aim to achieve a social mission while applying commercial practices. Many tech entrepreneurs are attracted to this model especially where there are deep rooted social problems of concern to them. Still focussing on the technicalities rather than the electoral year context, does it make sense to force a commercial business to become an NGO once they are seen to undertake activities yielding public benefit? Thank you Odhiambo Washington, I have the same concerns myself. I reached the conclusion that it would be nice if "ICT Experts" could lay their hands on a BVI machine as well as a and show the rest of us what the problem really is. The ERT issue is a red herring. It has worked flawlessly in the bi-elections that have happened ever since. With PKI and 2 factor authentication, this can be solved for election day. I am sure Victor Kyalo and Joseph Mucheru could make this possible. Call it a "Kenyans as ICT stakeholders" meeting. All Listers with time will begin to be asked by their family or neighbours, what the issue really is. I, for one, do not want to echo the CS's words. I think the CS and the PS should help us help them. Otherwise they will be on their own when the political vultures come calling. Dear Listers, In my understanding, the use of electronic means to identify voters and to transmit results is more about the integrity of the election than efficiency of the process. Therefore, when we say we need a fall back system, we should look at a solution that not only safeguards fulfilment of the bill of rights as regards the right to vote. The solution should also have in itself a fallback mechanism that safeguards the integrity of the electoral process as envisaged by the notion of "electronic means". Simply reverting to "manual" appears a little too simplistic. This is because the spirit behind the law's insistence on "electronic" is that of safeguarding the voter identification process by way of biometric technology for instance. As technologists we will easily have consensus that biometric person identification is much more fool proof as regards positive identification than its manual alternatives (therefore not letting in the so called ghosts. Likewise, the spirit behind electronic transmission of presidential vote tallies from the polling station is to safeguard the integrity of the tallying and aggregation process. This ostensibly reduces chances of crooks tampering with signed tally forms (form 34s and form 36s) later on, after the tallies have been announced at the polling stations. Therefore as we consider the matter of "what if the system fails?", it may be that to maintain the spirit and intention of safeguarding the integrity of the vote, a fall back process needs to ensure that the integrity of the vote is not compromised. For instance, why would we insist on a manual back up when both the primary system and the redundant system could be electronic. As it may have been said, in the case of presidential tally transmission, GSM technology could constitute the primary system. Then in areas where GSM connectivity is absent or doubtful, a small deployment of vsat or satellite phones could provide redundancy. It could even be a temporary Wimax arrangement in specific geographical locations. It could also be that a extra government supported investment in GSM for areas of doubt between now and June 2017 is possible. Of course commercial viability is an issue but the bill of rights argument also appears to invoke the essence of the Universal Access Fund. As one may argue, the general election is one of the crucial activities where every citizen can exercises article 1 and article two of the constitution, and it happens once every five years. Arguably there might be no better use of the Universal Access Fund than for facilitating the exercise of article 1 and article 2 of the constitution. As regards voter identification (for EVIDs), there is people with very sweaty fingers. Others may have had accidents in the period preceding the election, causing amputation of the fingers linking them to the biometric register. Therefore such identification failure is plausible. Notwithstanding the possibility of EVID failure, if incidences of such failure exceed 5% or say a certain threshold in a polling station, then something would be amiss and should raise a red flag. It could either be a cultural / environmental challenge in the geography of that polling station, or it could be a case of power issues with the gadgets, or as some would say, it might be "artificial" failure to facilitate "ghost" voters. Regardless of the cause of EVID failure, and in the spirit of safeguarding the integrity of the election, it will help that every EVID failure instance triggers a sequence of well documented steps that can guarantee verifiability of a positive "manual" identification of the voter. The easy one of EVID failures to solve is the instance of power (battery) failure. It should not be impossible to eliminate this through better training of IEBC staff and pre-charging devices. More so, increased rural electrification in the last 4 years might contribute more to alleviation of this challenge. In conclusion, it seems important for those dealing with the Election Law Amendment to separate the two issues (1) The bill of rights and the right of every Kenyan (who has registered as a voter) to vote. (2) Safeguarding the integrity of the vote through ensuring we have up non corruptible, verifiable and auditable electoral systems. More specifically, voter identification and presidential tally transmission appear to be areas of enhancement. That's my 2016 five cent opinion on this electoral law matter. Happy 2017 everyone!.. This is patched in PHPMailer 5.2.18 which will be included with Joomla! 3.7. After analysis, the JSST has determined that through correct use of the JMail class, there are additional validations in place which make executing this vulnerability impractical within the Joomla environment. As well, the vulnerability requires being able to pass user input to a message’s “from” address; all places in the core Joomla API which send mail use the sender address set in the global configuration and does not allow for user input to be set elsewhere. However, extensions which bundle a separate version of PHPMailer or do not use the Joomla API to send email may be vulnerable to this issue. Generally, the Joomla project does not issue advisories regarding third party libraries, however given the severity of this issue we felt it important to advise our users that we are aware of this issue and we have determined that the additional validations in our API prevent triggering this vulnerability. Happy Holidays! http://www.medianama.com/2016/12/223-year-end-rant-2016-technology-has-neve… Year end rant 2016: Technology has never been this political in India Nikhil Pahwa•December 23, 2016 There’s something deeply worrying with where we’re going with digital, when the founder of India’s (self-proclaimed) largest fintech company stands up on a stage and, in a manner that resembles a rallying cry and all the passion that comes with it, calls it his company’s “pious mission” to make India cashless. The religiosity of that phrase – “pious” – invariably invokes thoughts of “white man’s burden”, imperialism and conversion that comes with it. Let’s call it “digital man’s burden”, for the lack of a better phrase. What we’ve seen over the last few of years is this concerted push to convert people to digital: the visible aspect of it has been incentives: cashbacks, cheaper products, cheaper cab rides, free calling. The growth in commerce leads to growth in content, leads to growth in usage of the Internet. It’s all good, because at least for the time being, it gives consumers choice. The growth that is now coming in, and is set to come in, is not through incentives but enforcement: people aren’t being given a choice. We’re seeing this “digital conversion” manifest itself in two ways, both related: firstly, the way Aadhaar is being made mandatory despite how its execution is impacting the poor, in violation of Supreme Court orders. Second, is the way delegitimisation of 86% of the currency in circulation is forcing people to switch to digital currency, despite it being more expensive for citizens, and our infrastructure being incapable of dealing with it. There’s a remarkable lack of empathy – from both the state and the opportunistic founders of companies, or their religious leaders seeding this “pious mission” – when the pain it causes people is being looked at as an “inconvenience”, a period of disruption. There is this bizarre, tech-startup mindset, that the government (or the RBI. Is there a difference?) is being agile with its notifications: that it’s put a plan out there, and based on quick feedback, is iterating. Unfortunately for them, economies aren’t software or products. People don’t starve when Facebook doesn’t upgrade its newsfeed. That entire move-fast-and-break-things philosophy cannot apply to the real world, when it’s people that can get hurt, and lives that get impacted. People have died. We’ve gone from technology giving people choice to technology robbing people of choice: the way technology is being implemented by our government today is an attack on freedom and choice. * Have you heard this phrase “digital colonisation”? The other side of this crusade is this demand for protection against competition for the same businesses, and it has come from the same sources: the fear of digital colonisation in case of Net Neutrality (not a rationale I was comfortable with, by the way), digital colonisation in Ola versus Uber, and in case of Software Patents. There aren’t many places where the phrase “digital colonisation” turns up online in the Indian context, but if you’re in conversation with an iSpirt executive, the phrase invariably does come up, and it goes something like this: In a few years, our authentication will be using fingerprints on Google (Android) and Apple, and to retain India’s sovereignty, we have to ensure that that authentication is ours. Colonisation is an emotional subject for us in this country, but when you point out that Google and Apple authentication are choices (not mandatory) and the citizen has little protection against the might of the sovereign state (as evidenced by demonetization, by the way), none against the theft or misuse of data, there isn’t a cogent response. The protectionist angle also came up when it was used to seek government support, as Flipkart’s Sachin Bansal said: “I think what we need to do is what at some level China did: [tell foreign players that] we need your capital, but we don’t need your companies”. Ola’s Bhavish Aggarwal followed it up by asking for protection against “capital dumping”. Both these companies benefited from having raised more capital than others, and did their own capital dumping, allowing their competition to bleed. Now that both are faced with competition which deeper pockets, they want protection. Lets not forget that Flipkart wanted FDI in inventory based ecommerce until they became a marketplace. Now they speak against it, in order to prevent Amazon from bringing its core business to India. There’s a reason why Paytm founder Vijay Shekhar Sharma can say that “The Uber of India is Uber. The Google of India is Google. I can sign it on a wall that the PayPal of India will not be PayPal.” It’s because the company, which has a Payments Banks license, has a regulatory moat which not only protects it from Paypal, but also most of local competition. Payments Banks have another regulatory advantage: they can integrate UPI for payments while wallets are barred. They can raise money while wallets (for the time being), can’t. Their regulatory future is certain, while that of wallets is not. Of course, this is possibly not of their choosing, but they’re making the most of this opportunity. * Technology has never been this political in India before, and the dog-eat-dog competition in tech becomes a battle between a beast and a pup when politics enters it. In an interview a year ago, Nandan Nilekani said, India is going through a period of disruption, and “it is up to individual players to take advantage”. There is a window of a digital opportunity in India right now, to make multi-billion dollar businesses. When that opportunity goes to a chosen few who appear on stage on “Startup India, Standup India”, it’s reminiscent of when Russia privatised its factories, and the oligarchs took ownership of key industries to and built multi-billion dollar businesses out of it. At a private meeting in Bangalore in earlier this year, a key member of a think tank shouted me down when I raised the issues of lack of privacy protection in the (then draft) Aadhaar Bill: “You can’t do anything about the Act. It will be passed before you know it, and nobody will be able to do anything about it.” A couple of weeks later, that’s what happened. They knew. It’s discomfiting how close the technology industry and government have gotten this year. Lets take iSpirt as an example: unlike most organisations, iSpirt benefits from proximity to TRAI Chairman RS Sharma – the Chairman served along with many iSpirt volunteers in Aadhaar, including Nandan Nilekani. They got early access to Ravi Shankar Prasad, who was pitched to for support for Indian product startup shortly after he became IT Minister in 2014, and Jayant Sinha, current Minister of State for Civil Aviation (previously, Finance), appears to be a regular at iSpirt events. They get meetings at the PMO. Flipkart’s payments application was the first to use IndiaStack, which has been set up by iSpirt, and is being used by the National Payments Council of India for enabling UPI payments, but in a manner that is closed to others. As a think tank, iSpirt is doing an exceptional job of pitching to the government and non-government bodies such as the NPCI, which impacts payments. * It was something to celebrate when this government came into power, because it promised support for growth and “Digital India”. What I’m worried about is that the direction being chosen doesn’t appear to have been decided in a manner that is open and participatory, and there’s a distinct attempt to ignore concerns of those who represent how it impacts people. That the government speaks against a right as fundamental as privacy, to protect a project that is a privacy nightmare, is worrying. That people are dying in queues, or are being deprived of their pensions because of authentication failure, is distressing. These are not inconveniences. We’re heading down the wrong path if we’re compromising on rights in exchange for the growth. This is a country low on resources, high on demand, always jostling for space. Life here is often like trying to get into a train at Mumbai’s Dadar Station at peak times: you get sucked in and have no control over whether you’ll get in. Unfortunately, I’m idealistic, and I want there to be openness in the way that technology gets deployed; not in a manner that it is an attack on choice. The first meeting of this group will take place in Geneva on February 9-10. The Members of the ITU Council <https://www.itu.int/en/council/Pages/members.aspx> called for this review in Council Resolution 1379 (attached) based on guidance from 2014 Plenipotentiary Conference, Resolution 146 on the Periodic review and revision of the ITRs. The review will begin in 2017 and will take into account new trends in telecommunications/ICT, emerging issues and obstacles that may arise from the implementation of the 2012 ITRs and WCIT-12 Resolutions and Recommendations. Key aspects of the EG-ITR: the EG-ITR is open to Member States and Sector Members and contributions will be accepted from both groups including from the Directors of the three Bureaus by January 25th; the EG-ITR will be chaired by Fernando Borjn (Mexico), the Chairman of ITU Plenipotentiary 2010 and 6 Vice Chairs <https://www.itu.int/en/council/Pages/proposed-VC.aspx>, one from each region; the Terms of Reference (ToR) for the EG-ITR are defined by Council Resolution 1379 on EG-ITRs (see attachment).The ToR state that the review should include among others: a). an examination of the 2012 ITRs to determine its applicability in a rapidly evolving international telecommunication environment, taking into account technology, services and existing multilateral and international legal obligations as well as changes in the scope of domestic regulatory regimes; b). Legal analyses of the 2012 ITRs; c). Analyses of any potential conflicts between the obligations of signatories to the 2012 ITRs and signatories to the 1988 ITRs with respect to implementation of the provisions of the 1988 and the 2012 ITRs. the EG-ITR will submit a progress report to the 2017 Session of ITU Council and a final report to the 2018 Session of ITU Council (18-27 April 2018). Following Councils examination, the final EG-ITR report will be submitted with any of Councils comments to Plenipotentiary 2018 where ITU Members will determine whether or not an update or revision is needed to the 2012 ITRs. ISOCs role/perspectives: A key question surrounding the ITR review is whether it will re-open some of the debates on the expansion of the treaty to include regulations of the Internet. The Internet Societys perspective is that the ITRs should help facilitate global telecommunications and should not interfere with the continued innovation and evolution of telecommunications networks and the Internet. And so it is worth considering whether stirring up some of the controversial issues is a desirable trajectory for a treaty where consensus will be important. As a Sector Member of the ITU, we plan to be engaged in and follow this process to review the existing ITRs. ITU Resolution 146 (Rev. Busan 2014) and Council Resolution 1379 both set out clear guidelines on the scope and mandate of the EG-ITR; it will be important that the work of this group remain within these boundaries. Furthermore, the openness and transparency in this process is crucial for the legitimacy of the outcome. We hope that the review process is open and transparent and that it fosters dialogue and collaboration in order to find common solutions and share best practices. About the ITRs: The ITRs are a binding treaty that was adopted at the 1988 World Administrative Telegraph and Telephone Conference (WATTC-88) and came into force in 1990. The ITRs set out the rules for the exchange of telecommunications traffic across borders with the goal of promoting international interconnection and interoperability. A revision to the 1988 ITRs occurred in 2012 at the World Conference on International Telecommunication (WCIT) in Dubai. Some of the amendments that were perceived by some Member States as expanding the ITUs role in Internet governance were not accepted by those states, with the result that 89 of the 114 Member States <https://www.itu.int/osg/wcit-12/highlights/signatories.html> present signed the ITRs and 55 Member States refused to sign. Depending on inputs from the ITU membership, the ITR review process might also consider some of the limitations that may motivate non-signatories not to accede to the 2012 ITRs as well as those that motivated Member States not to sign. In (what I suppose to be) the spirit of Christmas, The Tor Project has published a set of principles that I think could guide policy on the technologies that we talk about here. They are designed in the same mindset as Larry Lessig's four principles of regulation ( https://en.wikipedia.org/wiki/Code_and_Other_Laws_of_Cyberspace) Here they are: 1. Do not rely on the law to protect systems or users. 2. Prepare policy commentary for quick response to crisis. 3. Only keep the user data that you currently need. 4. Give users full control over their data. 5. Allow pseudonymity and anonymity. 6. Encrypt data in transit and at rest. 7. Invest in cryptographic R&D to replace non-cryptographic systems. 8. Eliminate single points of security failure, even against coercion. 9. Favor open source and enable user freedom. 10. It analyses the compatibility of the terms of service of 50 of the most popular online platforms with international human rights standards. It also includes the Recommendations on Terms of Service and Human Rights, <http://www.intgovforum.org/cms/documents/igf-meeting/igf-2016/830-dcpr-2015…> one of the IGF 2015 outcomes, developed by the IGF Dynamic Coalition on Platform Responsibility <https://igf2016.sched.org/event/8huv/dc-on-platform-responsibility>, last year. - *Net Neutrality Reloaded. Zero Rating, Specialised Services, Ad Bloking and Traffic Management*. The book explores the most recent net neutrality trands. 7 out of 10 chapters are dedicated to the various aspects of zero rating practices, a very prominent issue, particularly in developing counties. Building the Internet from Scratch.* The book explores alternative models to expand connectivity in a sustainable fashion. Mapping the cyber policy landscape in Chile, India, Indonesia, and Kenya

Rgds GG Mapping the cyber policy landscape in Chile, India, Indonesia, and Kenya 02/12/2016 GPD today launches a new series of mapping resources to help civil society actors navigate the cyber policy landscape in four countries: Chile, India, Indonesia, and Kenya The series, entitled Mapping the Cyber Policy Landscape, identifies the key cyber actors, institutions, legislation and processes in each country, analysing local trends and factors and highlighting challenges and potential opportunities. Its aim is to serve as a tool and reference point for civil society actors who want to engage in cyber policymaking processes in the four countries covered. Each mapping report was independently created by local civil society experts, with support from GPD's Cyber Capacity Building Programme<http://www.gp-digital.org/gpd-launches-new-global-programme-to-foster-more-…>. Alongside these resources, we're also launching a podcast series, Cyber Policy on the Ground, which will give the authors space to go deeper into the issues and questions raised by their mappings, in conversation with GPD's Lead Strategist, Matthew Shears.
