TfL has ruled it will not renew Uber's private hire operator licence after it expires on Saturday 30 September.The body, which operates London's public transport network and regulates taxis in the capital, said Uber was "not fit and proper" to hold the licence. Essentially, how long is a piece of string," he added. Is there a loophole? Could passengers in London still legally book an Uber even if the firm lost its TfL operating licence? In theory, yes.In England and Wales, passengers can book a private hire vehicle from anywhere they like - just so long as the driver, the vehicle and the operator are all licensed by the same authority, and the booking is processed in that authority's area.That doesn't need to be the same place the passenger wants to be picked up or dropped off. Uber has lots of licences outside London, and app-based services like Uber can process bookings almost anywhere they like.TfL aren't happy with this state of affairs and say they're lobbying the government to tighten up the rules.But for the time being, even if Uber lost their London licence, a passenger in the capital could book an Uber licensed in, say, Brighton - and it would be completely above board. Can Uber's rivals capitalise? Hasn't Uber hit trouble elsewhere in the world? Yes. Uber left the Texas city of Austin last year after it lost a referendum requiring strict background checks on its drivers.The company has since returned after making some changes, and the same could happen in London, predicts BBC North American tech correspondent Dave Lee.Uber has also run into trouble in major European cities, including in Paris, Brussels and Madrid.In June 2014, taxi drivers across Europe went on strike in protest at what they regarded as a lack of regulation of the mobile taxi-booking service.In September that same year, a court in Frankfurt, Germany, ruled that the firm lacked the necessary legal permits to operate under German law. Uber later withdrew its services from Frankfurt, Hamburg and Dusseldorf after its business was hampered by regulations.New laws for drivers introduced in Denmark in 2016, including mandatory meters, also saw the company pulling out after less than three years of service in the country. The firm said in a statement that "regulations need to change" in order for it to operate.Uber was banned in Italy earlier this year after a court in Rome upheld a complaint by taxi unions that the firm represented unfair competition for traditional taxis. The ban was later annulled following an appeal by the firm.

Dear Listeners, Researchers have spent decades trying to understand how such misinformation (fake news) spreads and, now, a review of their work offers new guidance for the journalists, fact-checkers and others working to find, and defend, the truth. In a report published last week <http://journals.sagepub.com/doi/full/10.1177/0956797617714579> in Psychological Science, a team of academics reviewed two decades of research to better understand how to effectively debunk misinformation. In the end, they found eight worthwhile studies, with more than 6,800 participants. Listers As a follow up to my post last night here's another article this time from the New York Times on Facebook's complicated dance with Regulators across the world, its avowed defense of the principle of the Internet without borders and fight against Balkanization and its continued focus to add more and more users. I've taken the liberty to extract a particularly interesting part that focuses on Kenya. The Play for Kenya Blocked in China and troubled by regulators in Europe, Facebook is trying to become “the internet” in Africa. Helping get people online, subsidizing access, and trying to launch satellites to beam the internet down to the markets it covets, Facebook has become a dominant force on a continent rapidly getting online. But that has given it a power that has made some in Africa uncomfortable. Some countries have blocked access, and outsiders have complained Facebook could squelch rival online business initiatives. Its competition with other internet companies from the United States and China has drawn comparisons to a bygone era of colonialism. For years some of us have made suggestions, which if heeded to, would make things much easier for IEBC & Kenyans. (i) No foreign firm should be issued a major technology contract without local partners - Firms owned by Kenyans, well known to be passionate about technology. Training also works best with people who can relate well to each other. We should use competitions, awarding up to KES 100 million to winning teams.

Firstly, unfortunately as mentioned earlier, Fake News is nothing more than Propaganda. And Propaganda is a tool best used by State Players or Players seeking to be State Players. So first let's address this issue. Let's look at the biggest & baddest Fake News Purveyors in the world:- 1. Donald Trump. 2. Putin. Need I say more? As the NCIC threatens small bit players, I would like them to tell us how they have dealt with State Players or Players seeking to be State Players. Unfortunately their record here leaves alot to be desired. There is enough within the legal framework to prosecute those who deliberately seek to mislead us and derail nation building. *(b) The NCIC (National Cohesion and Integration Commission) and the CA (Communications Authority); do these agencies have the sufficient mandate to combat Fake News?* I believe they do. The question is how willing they are to prosecute culprits and how impartial they can be and should be. *(c) Is it time we regulated social media use? Kenyan Election and the Alleged Hacking

Hello KICTANET. On 9th August, a day after Kenyans voted in the 2017 General Election, opposition presidential candidate Raila Odinga alleged that the Independent Electoral and Boundaries Commission (IEBC) database had been hacked and an algorithm set to ensure an 11% difference in favour of incumbent President, Uhuru Kenyatta at all levels of results transmission. To back up the claims, Mr. Odinga’s political party National Super Alliance (NASA) presented a log file apparently showing the details of the hack. These claims have been repeatedly denied by the electoral commission. On 11th August, the IEBC declared Uhuru Kenyatta as the winner of the election with 54.27% of votes cast with Raila Odinga coming in second with 44.74%. In an attempt to respond to the hacking claims, CIPIT in collaboration with HERMES audits the logs as evidence within the context of Kenyan elections ecosystem and asks three questions: How is technology used in Kenyan elections? Was the log file presented evidence of an attack that changed the outcome of the election? How could this file have been obtained? Our preliminary analysis rules out hacking based on the evidence presented. Considering that absence of evidence does not necessarily imply evidence of absence, this should not be taken to mean the IEBC may not have been hacked. When focused on Trump, major substantive issues, primarily immigration, were prominent. We find that the structure and composition of media on the right and left are quite different. The leading media on the right and left are rooted in different traditions and journalistic practices. On the conservative side, more attention was paid to pro-Trump, highly partisan media outlets. On the liberal side, by contrast, the center of gravity was made up largely of long-standing media organizations steeped in the traditions and practices of objective journalism. Our data supports lines of research on polarization in American politics that focus on the asymmetric patterns between the left and the right, rather than studies that see polarization as a general historical phenomenon, driven by technology or other mechanisms that apply across the partisan divide. Hello Listers, Since all those who voted in the just ended election were identified positively by the KIEMS kit, it should be possible to make a next step beyond publishing the register of voters to producing a list of people who voted or did not vote per polling station. This not only helps with the verifiability of the election results. It also helps to clean up the register of voters by zeroing on ID numbers that did not vote as more likely people who have passed on. Wananchi can help flag such entries if the list is presented in the same way as the voter register prior to elections. Thinking this is doable out of goodwill and transparency by IEBC, or can be incorporated as a requirement in improved election laws. Times have since changed as we have now witnessed numerous 'Fake News' posts which go viral within minutes. Following the election results, posts on alleged instances of violence and of government action in parts of the country have dominated social media platforms. On several occasions, government officials, media houses and diligent citizens have come forward to denounce these posts as 'Fake News'. Photos that were first presented as true accounts of the situation on the ground were later discovered to be old photos of past events. At the same time, there have been instances where posts were quickly dismissed as 'Fake News' even when there was evidence later on that they were indeed factual reports. There is therefore a need for us to navigate through this issue carefully. Just for the record, it was agreed previously that the definition we are working with is Fake News refers to disinformation which GG aptly put as: *fabricated news that has no basis in fact, but is presented as being factually accurate. * With this in mind, I invite you to engage on the questions below: *(a) Why is there an increase in the prevalence of Fake News recently?* *(b) What is the role of different categories of users in combating Fake News?* *(c) Have Kenyans given up or are there good practices in combating Fake News?* *(d) Is Fake News a manifestation of deeper societal issues and if so, are there ways of combating it other than resolving the societal issues?* *(e) We have Bloggers who are seen as influencers. Listers Interesting development. Is the term "google" too generic and therefore unworthy of its trademark protection? That's the question before the US Supreme Court. Words like teleprompter, thermos, hoover, aspirin, and videotape were once trademarked. They lost the status after their names became too generic and fell victim to what is known as "genericide." What's before the Supreme Court is a trademark lawsuit that Google already defeated in a lower court. The lawsuit claims that Google should no longer be trademarked because the word "google" is synonymous to the public with the term "search the Internet."
