Participate in the Internet Freedom Festival

Listers, The Internet Freedom Festival (IFF) just opened its call for proposals. As someone who has attended this event in the past, I think you would really love the IFF experience. You get to meet amazing, passionate people from around the world and learn important skills. Also, through their Diversity and Inclusion Fund, they will fund presenters from the Global South and underrepresented regions can receive travel funding. You can apply to be a speaker and request for travel assistance here: https://platform.internetfreedomfestival.org A bit of background: The IFF takes place every year in Valencia, Spain. It is considered one of the largest and most diverse inclusive gatherings in the Internet Freedom space. It brings together over 1000 people from +100 countries, to join forces against online censorship and surveillance. People in attendance includes activists, technologists, digital security trainers, journalists, designers, policy advocates, and much more. The goal of this one-of-a-kind gathering is to allow people to share knowledge and resources, and collectively improve the services, strategies, and tools offered to individuals on the frontlines. When I'm traveling, to keep a usable connection, I turn off JS to avoid extra overhead, which is how I first accessed the site. As is, a lot of places are not reachable from the homepage without JavaScript, which makes it a somewhat, disappointing experience. With JavaScript finally turned on (when I got back to Nairobi and it's environs), the site exposes more content. Maybe it's just me, but I think the content should be available, with or without JavaScript on. This also caters for the scenario where for some reason the JavaScript fails to load, or is broken - it shouldn't break the site's functionality. That's my 2 cents.

I hate turning public stuff private! It gets personal, which is not good. In that year, a combined University of California, San Diego and Facebook research team led by James Fowler published a study in *Nature* <https://www.nature.com/articles/nature11421.epdf?referrer_access_token=3hEG…>, which argued that Facebook’s “I Voted” button had driven a small but measurable increase in turnout, primarily among young people. Rebecca Rosen’s 2012 story, “Did Facebook Give Democrats the Upper Hand? <https://www.theatlantic.com/technology/archive/2012/11/did-facebook-give-de…>” relied on new research from Fowler, et al., about the presidential election that year. Again, the conclusion of their work was that Facebook’s get-out-the-vote message could have driven a substantial chunk of the increase in youth voter participation in the 2012 general election. Fowler told Rosen that it was “even possible that Facebook is completely responsible” for the youth voter increase. And because a higher proportion of young people vote Democratic than the general population, the net effect of Facebook’s GOTV effort would have been to help the Dems. The research showed that a small design change by Facebook could have electoral repercussions, especially with America’s electoral-college format in which a few hotly contested states have a disproportionate impact on the national outcome. This would happen even with the US being able to successfully manage many front groups globally in the Internet space to do its PR. Not every country will be able to develop its own digital security architecture, but one can well see all non dominant countries moving within the "sphere if influence" of the few dominant one, US, China, and to some extent, Russia. That would be an unfortunate thing, but that is what we are clearly headed towards. Paragraph 258: "not scanning all Forms 34A and simultaneously transmitting them to the NTC" Paragraph 260 (b) Whether all the Forms 34A had been electronically transmitted from the polling stations to the National Tallying Centre. Paragraphs 262-266 - further emphasizing of electronic transmission, no sane person is bound to ignore. Not sure how the Supreme Court complied with Article 159(2)(d) of the Constitution, but it seems like FOUR Supreme Court judges chose to focus on the procedural technicalities.. the scanning + electronic transmission of *ALL* form 34a's to the National Tallying Centre, before the announcement of results. Dear all A few months ago KICTANet embarked on putting together a Policy Brief for Blockchain Technology in Kenya. Please find attached the document that is a result of your interactions and a validation meeting that took place which involved various stakeholders from the private sector and government. I would like to thank everyone who took part in this exercise. I would be remiss if I didn't also single out the CS for ICT, Mr. Joe Mucheru who mobilized his team to contribute vigorously to this exercise. Thank you all. We consider this a live document and hence will be updating it every quarter as required as developments in the Blockchain space continue to evolve rapidly. For example since we met and published this document a number of events have taken place. To mention just a few:- 1. Irish High Court Justice Caroline Costello in a highly anticipated ruling <http://www.europe-v-facebook.org/sh2/HCJ.pdf> said the Irish Data Protection Commissioner had raised "well-founded concerns" about whether U.S. surveillance practices deny EU citizens fundamental rights once their data is transferred to the U.S. Costello's decision tees up yet another case at the Court of Justice for the European Union (CJEU) in Luxembourg—the EU's highest court—to determine the validity of "Standard Contractual Clauses," a key legal tool companies use to transfer EU citizens' personal data outside the bloc. A final decision is likely still years away. "Standard Contract Clauses provide critical safeguards to ensure that Europeans' data is protected once transferred to companies that operate in the U.S. or elsewhere around the globe, and are used by thousands of companies to do business," Facebook said in a statement. "They are essential to companies of all sizes, and upholding them is critical to ensuring the economy can continue to grow without disruption." How the EU's highest court will rule will be influenced in part by how Costello frames her formal question of what is to be decided. The justice still has yet to determine that, and both Facebook and Ireland's Data Protection Commissioner are expected to weigh in beforehand. The immediate practical impact of the ruling is hard to assess because the EU high court's decision is unlikely to come for years and because of the shifting legal landscape <http://www.law.com/sites/almstaff/2017/06/13/podcast-what-you-need-to-know-…> in Europe around data privacy. The EU's new General Data Protection Regulation, which takes effect in 2018, would require substantial updates to standard contractual clauses (SCCs) anyway. But the referral of the case to the CJEU creates the possibility that the EU's highest court will find that those clauses, no matter how they are constructed, are invalid because of U.S. surveillance practices. In other words, even if companies spend the next year making SCCs compliant under the new regulation, there is risk that they could be wiped away. The case may also invite a repeat of the EU high court's 2015 ruling on a separate legal tool for transatlantic data transfers, then known as "Safe Harbor." After being struck down by the high court—in a case that also started with a complaint by Schrems to the Irish data protection commissioners—the U.S. and EU negotiated a new framework called "Privacy Shield." But in her ruling, Costello attacked some of the new features of the Privacy Shield arrangement as deficient. Specifically, she noted that its creation of a privacy "Ombudsman" at the U.S. State Department to field concerns about how EU citizens' data are handled "will neither confirm nor deny whether the individual has been the target of surveillance nor will the Ombudsperson confirm the specific remedy that was applied." Facebook, whose lead U.S. counsel in the case is Joshua Lipshutz of Gibson, Dunn & Crutcher, had tried to convince Justice Costello that the U.S. surveillance practices are reigned in by substantial oversight and laws that prevent abuse of privacy, consistent with EU law. Former White House privacy expert and Alston & Bird attorney Peter Swire and Stephen Vladeck of the University of Texas School of Law also offered testimony for Facebook. But Costello was not persuaded. "Quite clearly there are extensive rules to ensure that data is obtained in accordance with law and data, once obtained, is not misused. This is not the same as providing a remedy where the rules are broken and data is unlawfully collected or otherwise misused," she wrote in her ruling. (The justice underscored that she was not passing a value judgment on the U.S. legal regime but only assessing whether there was a real question of whether it meets the standards of EU privacy law.) She cited U.S. Supreme Court decisions that she said had made it more difficult for plaintiffs to establish standing in challenging surveillance practices, including* Clapper v. Amnesty International USA*. That case—which divided the court 5-4—sought to challenge Section 702 of the Foreign Intelligence Surveillance Act, which created new procedures for authorizing electronic surveillance of non-U.S. persons abroad. Schrems, in a statement <http://www.europe-v-facebook.org/sh2/PA.pdf>, welcomed the Irish High Court's decision. "It is important that a neutral court outside of the U.S. has summarized the facts on US surveillance in a judgment, after diving through more than 45,000 pages of documents in a five-week hearing," he said. Personally I'd love to have ICTA organize an open day to update industry players and Kenyans in General on their initiatives and how things ICT are moving forward. It is imperative that they communicate better than they are currently doing. Our annual Connected event which takes place over 3 days in April is where we discuss in depth what ICTA is doing as well as a review of the National ICT Masterplan by caucus teams consisting of public and private sector. In addition we do participate in several other thematic industry events where we update on specific things we are doing eg the Innovation Week held at University of Nairobi or CIO forums. For example:- 1. A quick check of the ICTA website on events in the ICT Sector produced the following result. (See attached screenshot). We shall update. 2. A quick visit to the Apply to be a Mentor page shows that the link to the form doesn't work. (See attached screenshot) We shall update this too. I personally believe ICTA is doing some great work in the background but their lack of communication is coming across like its a ship without a captain. Thanks for the compliment. Regarding Communication, we deliberately went quiet due to the election season. We shall be back fairly loudly when its over, (austerity measures permitting). Can we see a more vigorous ICTA that gives justice to our role in the Development of Technology in Africa? Absolutely. Another issue I have to raise is this:- Looking at the Board composition I'm shocked that there is no representation from the Industry and Consumer groups. 100% of the Board consists of Government Operatives. Surely there is something wrong with that?? Unless of course the website hasn't been updated. Board appointments are not complete. I'm sure the appointing authority will address this at the appropriate time. Muraya Great questions on ICTA. Personally I'd love to have ICTA organize an open day to update industry players and Kenyans in General on their initiatives and how things ICT are moving forward. It is imperative that they communicate better than they are currently doing. For example:- 1. A quick check of the ICTA website on events in the ICT Sector produced the following result. (See attached screenshot). 2. A quick visit to the Apply to be a Mentor page shows that the link to the form doesn't work. (See attached screenshot) I personally believe ICTA is doing some great work in the background but their lack of communication is coming across like its a ship without a captain. Can we see a more vigorous ICTA that gives justice to our role in the Development of Technology in Africa? Another issue I have to raise is this:- Looking at the Board composition I'm shocked that there is no representation from the Industry and Consumer groups. 100% of the Board consists of Government Operatives. Surely there is something wrong with that?? Unless of course the website hasn't been updated. We encourage individuals from Africa in the academic (early career), NGO, technology, and public policy sectors to apply. Prospective applicants should have a particular area of interest related to internet governance and policymaking, censorship, surveillance, internet access, political engagement online, protection of human rights online, and/or corporate governance in the ICT sector. Applicants will be asked to bring a specific research question to the program to be developed and operationalized through trainings, group projects, and one-on-one mentorship with top researchers and experts from around the world. Listers Interesting read. The Kenya General Elections on 8 August 2017 were not without surprises. In a historic determination, the Supreme Court invalidated the presidential election and ordered a repeat. Unlike many African countries that held elections in the recent past, Kenya did not shut down the Internet during the period. That the Internet remained open may be attributed to many factors. On the one hand, there was concerted advocacy by digital rights groups against a shutdown. On the other, there could have been disruptions that went unreported. But could the Internet have remained open because the government was also using the Internet to its own ends? Will it remain open during the repeat presidential election in October?
