Privacy International has published a very important report on fintech and data privacy mainly focusing on Kenya and India. Fintech: Privacy and Identity in the New Data-intensive Financial Sector shows how everyday habits and data points are used by fintech companies to create profiles and social classes of who can get loan facilities. The amount of surveillance individuals are subjected to for the sake of ‘qualifying’ for a loan is dehumanizing, to say the least. The report features Tala, branch and M-Kopa operations to illustrate the tradeoffs Kenyans are making between Privacy and credit access. “As the examples in this chapter show, this [calls and text] is amongst the key data sources used for alternative credit scoring in Kenya. This data is being used by lenders like Tala and Branch, without the protections that might be expected for this data. There are also other concerns: the scope of what falls within the concept of financial identity. More and more aspects of people’s lives are falling within the scope of what that is; more is being observed, analysed, and affecting an individual’s financial standing. Dear listers, The conversation on the subject was interesting, sorry to take you back. It was all Greek to me so I consulted with a player in the field who shared what I have reproduced below. As a small scale investor, I have faced several challenges trading from Kenya due to strict controls. Often, the discussion on Internet Shutdowns is with a focus on the impact on human rights with little emphasis on the impact on the economy. KICTANet’s Joash Moitui; Yolanda Mlonzi (Internet Society- Gauteng Chapter, SA) and Aicha Jeridi (African Civil Society on Information Society, MENA) will conduct a workshop titled, “Internet Shutdowns Taking a Toll on Africa’s Internet Economy” at the 2017 UN Internet Governance Forum (IGF) taking place from 18-21 December 2017, at the United Nations Office at Geneva (UNOG). The hackers then blackmailed Uber for $100,000 in exchange for deleting the data and keeping quiet. But what did Uber think this would achieve? The organisation had no way of knowing whether the hackers would keep their word. The information hasn’t surfaced yet, but given that these are criminals who had the audacity to steal from and then blackmail a large company, there’s every chance that they either still have the information or have sold it on the dark web. This is not unique to Kenya. Its a global thing. The thing about Kenya that we have that is going for us is this:- 1. Almost always those in government understand the positive effects of innovation especially in Technology and normally stay clear away and let things move forward with least resistance. Research by organisations like Cambridge Analytica states that today in Kenya you could conduct a very successful marketing/political campaign using only Digital Platforms. CA orders ignored

Nation Media Group reported on Friday (17 Nov) of orders from the sector regulator, Communication Authority (CA), to desist from broadcasting live political activities. One does not need sophisticated analysis to see how it coincided with NASA’’s planned reception of Raila Odinga back into the country. This would have extended to online platforms as well, since most of these media companies livestream online, especially YouTube and Facebook. Nation Media ignored the order since it did not provide any legal provisions to justify its execution. I think this is the kind of pushback intermediaries should be engaging in when censorship orders are made. -Moses

Privacy and Email Providers

Don't know if this makes sense, but if you try sending an email on gmail, with the word "attached" in your email body, gmail will always hold on sending and propose that you consider whether you want to attach a file. This seems a bit unsettling, does this mean email providers actually peruse the content of the emails prior / during sending? Hi Tomslin, Please read the following statement (ToS of 74 registrars who manage 90% of all domains.) In that case , the statement should be rephrased to specify that focus is on generic Top Level domains as opposed to all domains. Be that as it may , i was reading the domain wire global TLD report which had the following statistics. At the end of Q4 (2016) there were 309.4 million domain names across all TLDs. Out of this ccTLDs were 123.9 Million. From the statistics you can see that ccTLDs have significant registrations which may lend credence to the hypothesis i made. After one of the most highly contentious electioneering periods in Kenya’s history some hard questions need to be asked. 1. Is Ezekiel Mutua after all a visionary in his assertions about Social Media? 2. Have we allowed ourselves to be further divided by these platforms instead of using them to bring us closer together? 3, Have we allowed politicians and other influencers to literally take our freedoms to do what’s right? 4, Shouldn’t the whole world - State and Non-State Players - have taken Internet Governance (especially the Third Party Liability conversation) more seriously? 5. Is it too late to redeem ourselves? These and more are important issues to ponder. Barrack Not at all! In fact the printing press and other 'mass media' are becoming almost irrelevant in the scheme of things...Think of the 'Twitter Diplomacy' that is now the Hallmark of the Trump Presidency. My concerns are simply that by us (and I mean Kenya in particular and Africa in general) ignoring to put in place solid policies on how to engage in this new era we are living ourselves vulnerable to the vagaries of the Internet. On one hand we have positive influencers and the other negative influencers and in between you have governments that at best are incompetent to handle the *New Normal* and at worst reactionary and unleashing a hammer where a surgeon's scalpel would have been more appropriate. The Work Track will be structured to encourage broad and balanced participation from different parts of the community, and includes joint community Work Track leadership from ALAC, GAC, ccNSO and GNSO. As with the other Work Tracks, WT5 leadership will be coordinated by the PDP WG co-chairs. How to Participate There are two ways to volunteer: * Members – anyone interested can volunteer to join the Work Track as a member, regardless of whether they are members of the ICANN community. Members are expected to actively contribute to mailing list conversations as well as meetings – it is anticipated that the Work Track will meet on a weekly basis via teleconference. Members are expected to provide essential input to the process, orally or through written input. Members will be required to provide a Statement of Interests (SOI[community.icann.org]<https://urldefense.proofpoint.com/v2/url?u=https-3A__community.icann.org_di…>). * Mailing list observers – for those who are merely interested in monitoring the Work Track's conversations, there is the possibility to sign up as a mailing list "observer" which offers read-only access to the mailing list. Mailing list observers will not be permitted to post, will not receive invitations to the various meetings or calls of the Work Track and will not have to complete a Statement of Interest. At any point in time, a mailing list observer can join the Work Track as a member simply by informing the GNSO Secretariat. In addition, there may be opportunities to provide input through public consultations and public comment processes. Note, joining Work Track 5 as a member or mailing list observer does not require joining or participating in the full Working Group, though it is encouraged. Next Steps The call for volunteers will be circulated as widely as possible in order to ensure broad representation and participation in Work Track 5. This initial call will remain open until 20 November. Volunteers are also welcome to join the Work Track at any time after 20 November. Members who join the Work Track after work has begun will be responsible for reviewing all Work Track deliberations, agreements, and documents so that they are prepared to participate fully. Regular online meetings will be scheduled in accordance with the Work Track's work plan, which it is expected to develop as one of its first tasks. Drafting of WT5 Terms of Reference is currently underway with the WT leadership and will be finalized in the near future. Background In 2005, the Generic Names Supporting Organization (GNSO) began a Policy Development Process (PDP) to consider the introduction of new gTLDs. The two-year PDP process resulted in a set of 19 GNSO policy recommendations for implementing new gTLDs. In order to implement the policy recommendations of the GNSO, a number of draft Applicant Guidebooks (AGBs) were developed by ICANN staff in consultation with the community. In June 2011, ICANN's Board of Directors approved the final AGB and authorized the launch of the New gTLD Program. The New gTLD Program application window opened on 12 January 2012 and a total of 1930 complete applications were received. The first set of Initial Evaluation results were released on 22 March 2013, followed by the first set of new gTLD delegations on 21 October 2013. All applications have now completed the evaluation process and as of mid October 2017, there are over 1,200 gTLDs delegated. Although the 2012 round is ongoing, efforts to examine the round have already begun, which included the initiation of the GNSO's PDP on New gTLD Subsequent Procedures in early 2016. On Artificial intelligence, "A robot named Sophia was a panelist at a United Nations meeting Wednesday to demonstrate how artificial intelligence could help the organization move faster in facilitating progress and development across the globe". On taxation; France's President Emmanuel Macron made progress on his push to make companies like Amazon pay taxes where they make profits, and not in tax havens as European Union leaders said on Thursday they looked forward to seeing proposals on taxing online giants by early 2018. On cybersecurity, North Korea has dominated the headlines in recent weeks, as international tension climbs over the country’s nuclear aspirations and capabilities. Furthemore, Security researchers Mathy Vanhoef and Frank Piessens have detected a major vulnerability in the WPA2 protocol that secures all protected Wi-Fi networks. On digital rights, dozens of influential civil rights groups have called on EU decision-makers to abandon proposals for compulsory proactive copyright filters.
