Listers Reading WIRED’s indepth story of Facebook’s nightmarish two years when it was embroiled in a deep soul search of what it was reminds me of how Brands today miss out on one of the most fundamental concepts of how Brands evolve. Roger McNamee an early Facebook investor and Mentor to the CEO couldn’t have put it better:- “You can assert till you’re blue in the face that you’re a platform, but if your users take a different point of view, it doesn’t matter what you assert.” There in lies one of the biggest conundrums in #ModernMarketing. It is particularly ironic that the mother of all #SocialMedia platforms missed this basic fact of how Brands evolve in the age of Social Media. It doesn’t matter a rat’s ass how you position yourself as a Brand when you are out of touch with your core customer base and how they perceive you. It’s abit of an oxymoron because Savvy Marketers would know that to get positioning right you might want to understand your customer. :-) So the problem with Facebook and other social media platforms is this:- Are they a News Operation or are they a neutral platform that exists to give voice to anyone who wants to use the platform #FakeNews be damned. I fully agree with the sentiments here. I understand Bwana Mutua is a lister so if he's lurking somewhere let him come out and address some of these issues raised here. For me I have one thing to say to him - Soft Power is ALWAYS more effective than HARD POWER..Especially when you think you have the HARD POWER but you don't necessarily have it. The Case Against Google and other Tech Titans

Listers Here’s an interesting long read on the implications of Technology enabled Monopolies. The argument for and against the thesis that only market forces can check the monopolistic behaviors of the Tech Giants is well articulated in this NY Times article. The argument goes like:- A combination of Activists (Listers, I hope you are listening and reading 😀), Anti-Trust Busters, Competitors and the cautious actions of so called Monopolists when the spotlight hits them, is largely responsible for ensuring that consumers and the markets operate honestly, responsibly and with the profit motive in mind. Couldn’t help me thinking whether this combination is partly responsible for the New Safaricom we are seeing today. A company that is arguably larger than life in Kenya and who in the recent past has been accused of the same behaviors that the Tech Giants are allegedly guilty of. Safaricom is definitely a better company than it was just a few years before. They have embraced the ecosystem, released M-Pesa APIs on Github (Yes!), funds startups in the Tech Ecosystem through its Spark Fund and is generally easier to work with. Rachel Statistics are an interesting conundrum. What most Kenyans experience when they are out in the counties belies this report. For example when I'm my home counties of Kilifi and Lamu I simply CANNOT get connectivity of maana 6 kms from the County Headquarters. In Lamu, the County HQ is on intermittent bundles from Safaricom. Honestly, as Kenyans we are super tired of being strung along with non-existent statistics. We simply need to get our act together. I'm also keen to understand the difference between land based and population based statistics/connectivity.. Let's dispense with semantics please.. Considering that most government services are now online how do we propose someone in Pokot, Wajir or Marsabit to use these services if someone in Nairobi is finding it a major challenge to access the ecitizen portal? The Universal Service Fund is a huge programme whose activities are guided by detailed research. A lot has been achieved so far in line with the mandate given to CA by the Law. As a reminder, the Kenya Information Communications Amendment Act of 2009 (KICA 2009) created the Universal Service Fund (USF) whose objective is to support widespread access to ICTs including related human capacity building and technological innovations in the ICT sector. The Act mandates the Communication Authority of Kenya (CA) with the administrative and management responsibility of promoting universal access and services with respect to the provision of communication services in Kenya. The USF is expected to provide incentives for infrastructure roll-out in unserved and underserved areas. To support the foregoing, the Authority in May 2016 concluded a Study on ICTs Access Gaps which established that population coverage in Kenya for 2G and 3G stands at 94.4% and 78% respectively, while the land coverage for 2G and 3G is at 45% and 17% respectively for all the three Mobile Network Operators i.e Safaricom (K) Limited, Airtel (K) Limited and Telkom Kenya Limited. To close the identified gaps in the different service areas, Authority has developed a 5-year USF Implemetation Strategy to guide the activities of the Fund for the next five years FY 2017/18 to FY2022/23. Can the Law Make Online Spaces Safer?

Good evening Listers, Let me share this Paper prepared by the UK House of Commons Library last year as a brief on desirable legislative approaches in tackling the vices of our day i.e. online harassment, cyber-enabled violence against women, virtual mobbing, attacks on reputation, publishing personal information, revenge pornography, online identity theft, fake news etc. The paper among other things highlights the pros and cons of employing a purely criminalisation approach and delves into platform responsibility which we can no longer overlook. I find this timely and informative for our case. The Computer and Cyber Crimes Bill currently under consideration by the National Assembly intends to criminalise some of these vices eg fake news, cyber bullying etc. I think this calls for dialogue amongst different stakeholders to discuss the efficacy of some of these proposals. We must be careful not to end up with laws that cannot be implemented, or worse, that are prone to abuse. We also have to be honest on whether our police service is properly equipped (in terms of capacity and resources) to handle the proposed crimes. I am glad that the National Assembly is currently conducting hearings with different stakeholders (including KICTANet) on the Bill. Looking forward to the final product.

Two petitioners have sued Safaricom over the charges it imposes on Okoa Jahazi airtime services, claiming that they are illegal. Mr Ashford Koome and Eric Kithinji, claim that Safaricom is not licensed to carry out banking services, hence the interest it charges on the airtime advanced to the subscribers is illegal. Safaricom has however disputed the claims arguing that the charges have been approved by the Communications Authority of Kenya, and that they are not interest but a service charge. The comments have to be submitted by Tuesday, February 13, 2018. KICTANet's working group on cybersecurity has been working on this proposed bill and already identified some areas considered needing attention. And due to time constraint, Victor Kapiyo will share it shortly. The idea is to improve the submission to include aspects of CIRTs for counties and any additional changes that may have resulted since the bill was released. Victor, over to you on how we proceed. Registering a CO.KE domain from down south

Hello people, I'm sure someone can help me here. I'm a Registrar - just not for KE domains. I want on behalf of a customer, to buy two CO.KE domains for his business - which whilst South African based - is also selling in Kenya. I already run a dozen or so of his domains. As non-Kenyans can not yet be Registrars in Kenya:- a) I need a friendly Kenyan Registrar, b) I want to pay by Credit Card, c) supply just the Nameservers (I'll run the DNS and other services on my own systems) d) and as a bonus - I'd like to supply the DS records for DNSSEC provisioning. As soon as non-Kenyan Registrars are allowed - I'll bring all this home to me. Who should I choose? Flavia Main purpose of the job APC is looking for a person to join its communications team as content curator and writer for APC-managed platforms and projects, with a focus on capacity-building materials. Talk to the Senate- 2017/2022 Priorities

Dear Listers Greetings! Kindly allow me to t briefly interrupt you from the turning off of TV signals debate, to make a short announcement. As you are aware, the role of the Senate is to represent the counties, serve, and protect the interests of the counties and their governments. The Senate Committee is currently developing its agenda and is keen on interacting with various players in the ICT community. Of interest to the Committee, is what needs to be done or prioritised in relation to ICT and the counties. This can range from issues of infrastructure, problem with implementation of legislation, acts that need revision, resources etc. In light of this, KICTANet recently called on the the Senate Committee on ICT leadership. To this end, we are honoured to have Sen. Abshiro Halake, the vice-chair of the Committee on the list. Therefore, we propose to hold a structured discussion over three(3) days on this list, starting on (Monday February 5th to Wednesday February 7th February 2018- next week). The aim will be to propose priorities that the ICT Senate Committee should include in their agenda to spur economic and social growth. Mercy Mutemi will moderate the discussion. The questions for discussionwill fall under the following broad thematic areas: a) What are the key ICT issues(challenges and opportunities) in the Counties that require the attention of the Senate? b) What are the ICT issues that need legislative intervention by the Senate Committee (E.g. proposals for a new law or a law that needs amendment)? c) What can the SenateCommittee do to strengthen its engagement with the ICT community on ICT law and policy? A report will be prepared from the suggestions given here on the list and shared with the Senate ICT Committee. We will also agree with Senator Abshiro on a future date for a face to face meeting. KICTANet has been at theforefront in pushing for effective public participation in policy making. Now that we have the opportunity to speak to legislators, we must heed the call and participate!
