Governors: Treasury to blame for lack of public participation in key county decisions

Dear Listers, Recently, a certain governor accurately but still mercilessly noted, there is no law against favoring traders over farmers in the purchase of cereals. The statement revealed why certain laws are required to judge (penalize) non performance. After IFMIS access points (= computers or networks) in the counties are sabotaged, the Treasury is not obliged by law to engage "Data Controllers to ensure access to data" as County CIO positions + functions are yet to be defined in our laws. Note: county expenditure on travel, conferences, seminars, etc, can more than fund CRMs to enhance public participation. Marcus Hutchins, WannaCry-killer, hit with four new charges by the FBI

Marcus Hutchins <https://thehackernews.com/2017/08/malwaretech-marcus-hutchins.html>, the British malware analyst who helped stop global Wannacry menace <https://thehackernews.com/2017/05/how-to-wannacry-ransomware.html>, is now facing four new charges related to malware he allegedly created and promoted it online to steal financial information. Hutchins, the 24-year-old better known as MalwareTech, was arrested by the FBI <https://thehackernews.com/2017/08/marcus-hutchins-arrested-fbi.html> last year as he was headed home to England from the DefCon conference in Las Vegas for his alleged role in creating and distributing Kronos between 2014 and 2015. Kronos is a Banking Trojan designed to steal banking credentials and personal information from victims' computers, which was sold for $7,000 on Russian online forums, and the FBI accused Hutchins of writing and promoting it online, including via YouTube. Hutchins pleaded not guilty <https://thehackernews.com/2017/08/malwaretech-marcus-hutchins.html> at a court hearing in August 2017 in Milwaukee and release on $30,000 bail. However, a revised superseding indictment was filed with the Wisconsin Eastern District Court, under which Hutchins faces four new charges along with the six prior counts filed against him by the FBI a month before his arrest. Marcus Accused of Creating and Selling Another Malware According to the new indictment, Hutchins created a second piece of malware, known as "*UPAS Kit*," and also lied to the Federal Bureau of Investigations (FBI) when he was arrested and questioned last year in Las Vegas. As described by prosecutors, UPAS Kit is Spybot virus that "allowed for the unauthorized exfiltration of information from protected computers" and "used a form grabber and web injects to intercept and collect personal information," including credit card details. UPAS Kit advertised to "install silently and not alert antivirus engines," for prices ranged above $1,000 back in 2012. According to the indictment, Hutchins created UPAS Kit in 2012, when he was just 18, and sold it online to another unnamed co-defendant identified as "VinnyK" (aka Aurora123), who was also involved in promoting Kronos. VinnyK then sold UPAS Kit to another person in Wisconsin in 2012, who allegedly used the malware to attack computers in the United States. Two other charges relate to Hutchins "aiding and abetting" the distribution of invasive code in an attempt to damage "10 or more protected computers," and helping others to hack computers for financial gain. Marcus Appealed to his Followers for Donations to Cover Legal Costs As the news on the revised indictment broke, Hutchins, who has repeatedly denied any illegal activity, called the charges "bullshit" and appealed to his Twitter followers for donations to cover legal costs. "Spend months and $100k+ fighting this case, then they go and reset the clock by adding even more bullshit charges like 'lying to the FBI,'" Hutchins wrote <https://twitter.com/MalwareTechBlog/status/1004420585869332480?ref_src=twsr…> on his Twitter, calling for donations by adding a quote from Starcraft video game: "We require more minerals." Hutchins' lawyer Brian Klein called the charges "meritless" and said he expects his client to be cleared of all charges. "[We] are disappointed the govt has filed this superseding indictment, which is meritless," Klein tweeted. "It only serves to highlight the prosecution's serious flaws. We expect [Hutchins] to be vindicated and then he can return to keeping us all safe from malicious software." Hutchins, who is living in Los Angeles on bail, is unable to leave the United States since last year due to his pending criminal charges. Those who will be selected will also be invited to participate in the Kenya IGF scheduled for Thursday, July 19, 2018. This is a three day face to face introductory training whose aim is to: * Get participants to understand internet governance, and * To equip participants with skills to effectively participate in internet governance discussions and forums. Grace I took the liberty to ask a senior manager at a leading Educational Publisher his thoughts about NEMIS. What he told me worries me. I’m copying his email below verbatim but protecting his identity. The Ministry of Education is capturing data of every learner and putting in this NEMIS system.That is why you have been reading parents are spending nights at Registration centres looking for Birth Certificates of their children which is a main requirement of NEMIS. On the service it looks good but for a student of Information Science, this is a dangerous exercise that is done in a vacuum. Kenya does not have a clear policy and data protection law(s). That should be what is put in place before the NEMIS system. The data they are getting is too much. They need both parents details (all from the sub-location) and telephone. What will make some crooks not access that then know XX is a man of means, go for your child, kidnap them them then starting seeking ransom from you? What protects our children from that data being sold to commercial entities for advertisement? What protects the child from their academic performance (it will be part of what NEMIS will be capturing) being used to stigmatize them in future? You can imagine you are vying for an office and someone has all your records. In a sense, we are not assured of privacy and confidentiality. Listers Today I want to remind all of us how important Net Neutrality is. Let’s play part in keeping alive the conversation on Net Neutrality. Net Neutrality. A term most of us, even those who are in the ICT Sector, dismiss or simply don’t take the time to understand. #NetNeutrality is the principle that Internet service providers treat all data on the Internet the same, and not discriminate or charge differently by user, content, website, platform, application, type of attached equipment, or method of communication. For instance, under these principles, internet service providers are unable to intentionally block, slow down or charge money for specific websites and online content. This is sometimes enforced through government mandate. It got me wondering what the system is really about and how children's data is protected. I scoured the internet for any policy/legal document and the one I came across was a user guide. Would anyone, the Ministry, Authority, task force members or contractors please share more information on the purpose of the system as well as how parents and children can access it, how long the data will be kept, who is keeping it etc? The highlight of the school is a practicum in which participants have to tackle an actual internet-related policy challenge and come up with an agreed solution or statement. Who can apply? Applicants who have relevant work experience and/or involvement in internet governance or ICT policy and regulation and who are positioned to make meaningful contributions to strengthening internet governance in Africa, and African voices in internet governance globally. The School will accept applications from current or emerging leaders and professionals from: - Government ministries and departments, national and regional communications regulatory authorities, and public sector information and communications services such as public libraries. - Members of parliament, particularly if they are involved in parliamentary portfolio committees that deal with media, communications and information technology issues. - Service providers and other businesses who form part of the internet industry. - Civil society and non-governmental organisations who interact with or operate in the internet-related information and communications sector. - Human rights institutions dealing with internet issues, such as national or regional human rights commissions. - Community-based information and communications services and the broader community informatics sector. - The judiciary and other members of the legal community working with internet and communications law. - Members of law enforcement agencies who deal with internet issues. - The internet technical community. - Academic and research institutions that deal with internet issues. - Media organisations and outlets that focus on the internet. The website looks good! Good UX/UI, easy to navigate. I hope there is a swahili tab for accessibility considering it's the national language. I understand the challenge in translation of technical terms but people like Bonface Witaba (in the list) have undertaken such projects ona a global level, so possible IMO. Perhaps also, ease of navigation tools for persons with disability. That being said, well in to the CA for being on top in terms of online visibility, very few state agencies have useful websites that would meet the threshold required for access to information. Airtel customer loses Sh3m compensation bid over network disruption

The High Court has dismissed pleas by an Airtel customer who wanted the telco compelled to pay him Sh3 million for his alleged losses after a network disruption. Mr Leonard Onyango accused Airtel of repeated network disruptions in March last year. https://www.businessdailyafrica.com/news/Customer-loses-bid-to-compel-Airte… Looks like the public are now turning to courts for redress over network disruptions. Even as CA revises it's otherwise ok website, can the CA team also guide Consumers on the appropriate procedures for redress under their mandate for such. I think many people get frustrated calling customer numbers that are sometimes generally disfunctional or just intentionally off the hook whenever some service providers have issues with their networks. Twitter is awash with complaints to service providers. I would wish to understand what measures the CA has taken to ensure compliance and service delivery. It would be good to get some statistics too (since these aren't included in the CA Sector reports). Victor

Hi I was shocked to learn that the film classification board has banned an LGBT film, Rafiki. Our Film and Publication Board recently attempted this but it was reversed by the courts. Films are ICTs and we should be discussing this on the list. I am looking forward to the discussion. Kind regards, Alex
