Day 8: Policy and Regulatory Framework on Privacy and Data Protection- Key issues

Dear listers, During the discussion on the draft data protection policy and bill, a summary of issues includes: - Listers recommended that the policy be expanded to look not only into data privacy but also issues to enable a privacy respecting data economy such as skills gap, standards, public funded data, data centers etc. - L isters appreciated the principles for data protection as provided for in the bill and called for ways of translating them into privacy promoting practices within the data economy. For example, there was advocacy for inculcation of data minimisation. - Concerns were raised that if proper mechanisms were not put in place, there was a risk of small data holders such as MSMEs not being able to comply and the bill being a risk to innovation and growth. - Data subject rights as provided for in the bill were viewed as progressive. While there was debate on whether the right to be forgotten should be absolute, listers recommended for this right with regard to research data as well as data about children. - While discussing data processors and controllers, listers debated on data sovereignty and data residency and gave input on how Kenya could be better facilitative of a local data economy. Listers also mused on decisions made through automated means and how developments in artificial intelligence impacted on personal privacy. - On offences, some listers thought that they were not reflective of data economy activities and that while they may be punitive to small players, they were lenient for larger ones. Hence they recommended graduated penalties. Listers also recommended for civil remedies to injured persons under this law. Further, areas that did not have specified penalties, for example not notifying a data subject in case of a breach, were flagged out. - The proposed institutional framework- office of the DPC came with concerns on financing the office, powers of the DPC as well as independence of the office. - Finally, on exemptions, there was a recommendation for more specificity to avoid eating into privacy of data subjects. We shall translate these points, together with those shared during the face to face forum at Strathmore University into submissions to the Task Force. We appreciate all those who gave input, asked questions and followed the discussion to learn. Day 7: Policy and Regulatory Framework on Privacy and Data Protection- Exemptions

Good morning listers, Today we look at other issues in the draft bill that we missed during the discussions. One is the question of exemptions, which are provided for in part vii. The grounds listed for exemption from the provisions of the Act are: national security and public order concerns, lawful disclosure, prevention of crimes, apprehension or prosecution of an offender and assessment or collection of tax. Interestingly, the draft empowers the cabinet secretary to determine national security and public order concerns. (clause 47(3)) Journalism, literature and the arts are also exempted from the principles of data protection. Where a publication is in public interest, the publisher is only required to comply with the relevant code of ethics. Processing and further processing for research, history and statistical purposes is also exempted from the principle of collecting data for a specified purpose. Although the proposed law gives a safeguard through the principle that data must eventually be destroyed, it does not give guidelines on time periods - it states that research data may not be kept indefinitely. Again, the CS is empowered to prescribe further instances when data may be exempted from provisions of the law (clause 50) Finally listers, there are general exemptions in clause 2 of the bill. The law will not apply to sharing of information among government departments/ public sector agencies or to processing by an individual for purely personal business (this is the personal phonebook exemption) Part of public reaction to this draft was that the bill gives with one hand and takes away with the other. Is this an exaggerated view and if so, how can this be cured in the draft? Are there other ways of dealing with the concerns raised in the exemptions (eg national security) without taking away data subject rights? Ultimately, should any data processor/controller be exempt from protecting data? Also, are there other useful exemptions that we are missing? Day 6: Policy and Regulatory Framework on Privacy and Data Protection- Institutional Framework

Good morning listers, The office of the data protection commissioner (DPC) is established as a state office and is expected to be independent. The DPC will however be appointed by the Cabinet Secretary, ICT. To qualify for the office, one needs to have extensive knowledge in data science, law, IT and related fields and meet requirements on leadership and integrity(Chapter six of the Katiba) The functions of the DPC include: oversight and enforcement of the Act; registration of data processors and controllers; control over data processing activities; promotion of self regulation of actors; investigation of complaints; creation of awareness on the Act; ensure compliance with international obligations; research and related functions from other laws. Powers of the DPC include: investigations; obtain professional assistance if need be; facilitate alternative dispute resolution; issue witness summons; request for information from persons governed by the bill. Further, the DPC may request for data audits (clause 20); appointment of guardian for child online services (clause 29) Apart from the usual sources of funds (allocation by Parliament, donations, grants etc) the bill also states that the office of DPC may be funded by funds accrued in performance of its functions. Some public fears on creation of yet another public body are based on concerns about funding the body, an expectation that registration will mean paying for licences and that there is not sufficient capacity in the country to oversee data protection. The bill however only proposes that DPC issues certificates and does not mention registration fees. To guide our discussion today, questions include: 1. Are the functions and powers of the DPC adequate to implement the law? Are there any overboard provisions? 2. Considering that the government is a major data processor and controller, is the office of the DPC as structured in the bill sufficiently independent? Offences are public in nature and their prosecution and sentencing is carried out through the criminal justice system. Remedies on the other hand may be considered from a civil lens and examples include damages, restitution, coercive (injunctions) and declaratory remedies. They are personal and their aim is to give justice to the injured person. A trend with newer laws is the provision of both offences and remedies. In the copyright law for example, in addition to criminal offences, one can recover profits from pirated material. Back to our bill, the following offences are created: *Offence * *Penalty * Knowingly supplying false information to the data commissioner during registration as a data controller or processor ( clause 15 (3)) General penalty under clause 59: 5 million shillings fine or 5 years imprisonment or both plus possible forfeiture of equipment and prohibition order Data controller or processor failing to notify the data commissioner about a change in particulars (clause 16 (7)) General penalty unlawful processing of personal data (clause 27) 5 million shillings fine or 5 years imprisonment Unlawful processing of sensitive personal data (part v) 5 million shillings fine or 5 years imprisonment Refusing to comply with a notice from the data commissioner or knowingly furnishing the commissioner with false information during investigations (clause 52(3)) General penalty Disclosure of personal data by controller against specified purpose (clause 58 (1)) General penalty Disclosure of personal data by processor without authority of controller (clause 58 (2)) General penalty Obtaining personal data without prior authority of controller or processor (clause 58 (3)(a)) General penalty Disclosure to a third party (clause 58 (3) (b)) General penalty Offer (advertisement) to sell personal data obtained through unlawful disclosure ((clause 58 (4)) General penalty The bill has taken the criminal law track and has not provided remedies targeting persons injured by contravention of the bill. It does however create a complaints mechanism where the public can lodge complaints with the data commissioner. The powers of the commissioner in addressing such complaints are limited to issuing notices.(and we shall be discussing more about the office powers of the data commissioner in due course) Our discussion today is on the question of choosing the offences route as opposed or in addition to the civil route. What are our thoughts on this? Should we have borrowed the pro-rated model of the GDPR where controllers/processors are charged administrative fines according to their revenue? And when we come to offences, are they adequate? Should the magnitude of the offence be measured against the size of the data processor or are all sins equal despite might of the transgressor? Day 2- Rights of Data Subjects Good morning Listers, Day 1 we commented on the principles of data protection mentioned in the draft policy and bill. Today, we will look at the rights of data subjects. For demonstration purpose, when you fill in your details at a mobile money agent’s shop– You- data subject The mobile money agent- data processor The data subject is the person to whom the data concerns. Here are the rights as listed in Clause 23 of the Bill. I have added comments underneath to help us visualise what these rights would mean in the future. 1. The right to be informed of the use to which the personal data is to be put Eg. When we leave our details at the entrance to buildings, I expect that they will explain what the data will be used for. 2. Right to access their personal data in custody of data controller Will we be able to demand from our mobile network operators to see our account details and transactional history? 3. Object to the collection or processing of all or part of their personal data Will we be able to opt out of the biometric ID registration proposed by the Ministry of ICT here <https://www.businessdailyafrica.com/economy/Biometric-IDs-listing-set-for-t…>? 4. Correction and deletion of false or misleading data Are we ready for a right to be forgotten? Should it be absolute? What do we think of these Listers? Day 4: Policy and Regulatory Framework on Privacy and Data Protection- Data Controllers and Processors

Good morning listers! Welcome to data protection bill/policy discussions. Last week, we went through the principles of data protection and rights of data subjects. We covered the right to privacy in its different forms including the right to be forgotten and consent. Today, we shift gears a bit and consider the issue of data protection from the point of the *processor and controller*. The bill defines a controller as one who designs data processing and the processor as one who collects, stores, retrieves , discloses, erases etc on behalf of a controller. General obligations for controllers and processors are listed in part IV and they include upholding the principles of data protection, protecting the rights of the data subject, duty to notify the subject about processing and breaches, acquisition of consent and security safeguards as regards personal data. It would be interesting to hear from data controllers and processors, views on: 1. restrictions on processing personal data (clause 30) where processors may not process data objected by the data subject or which has legal claims.What are the practical implications of restrictions? For example, if one company or government agency received a large number of objections in one period? 2. the protection of data subjects from profiling (clause 31). While we have seen negative effects of profiling during the political season, are there positives of profiling that could benefit the data subject and does this bill adequately balance both ends? 3. the bill makes it mandatory to notify data subjects in case of breach. How will this change sectors such as banking where issues of data breaches are never discussed with customers or the public in order to protect the confidence of the industry? 4. Finally, on the issue of sensitive personal data, which is subject to higher protection. Sensitive personal data includes person’s race, health status, ethnic social origin, political opinion, belief, personal preferences, location, genetic data, biometrics, sex life or sexual orientation. What are the practical implications for existing data sets held by for instance the registrar of persons, universities, schools, insurance companies etc? Is the list proposed by the bill exhaustive? The Senate bill for example defines categories such as trade union membership as sensitive data. Welcome to the discussion. Dear listers, Kenya’s Mr. John Omo has today been elected the new Secretary General of the African Telecommunications Union (ATU). Out of the 26 votes, Mr.Omo garnered 23 beating his sole challenge, Burundi’s Mr. Constaque Hakizimana who managed two (2) votes at elections held today during the 5th Ordinary Session of the ATU Plenipotentiary Conference in Nairobi. One vote was spoilt. Attached is the press release on the same as well as the Nairobi Declaration by the African menus states at the end of the ATU Plenipotentiary Conference today. Attached too are images of Mr.Omo giving his acceptance speech and receiving the instruments of office from the outgoing Secretary general Mr.Abdoulkarim Soumaila We thank you for your continued support. In South Africa there is an efficient, creative (primarily white) minority population which does not undermine (deceive) itself as much as we do. To conclude, last year, a well spoken, well presented employer/investor (former high school mate of mine 25+ years ago) was shocked by Kenyans in their early twenties. He conducted a research for one of his clients and 24 out of 26 lied in their submissions. That is all.

Every business is a technology business and staying ahead of the curve requires that executives at the helm of every organization must make effort to update themselves and remain relevant in what is a fast paced and every changing business and competitive landscape. For many career paths, core learning seemingly stops after the undergraduate degree and entry into the job market with post graduate courses and certifications viewed as embellishments with some even questioning the value of others such as the MBA. I say this not to discredit or negate the pursuit of post graduate papers but to lend more weight to the pursuit of critical knowledge that would future proof ones place in the workforce while allowing for better mid to long term strategy outlays that are cognizant of what is coming and also what is possible. Hi all Last year Huawei sponsored a short 1-month basic IT training course for disadvantaged form 4 leavers, known as Digital Skills for Life, which was 50% soft/life skills along with the IT course (and also mentors, study trips etc). It is more than "how to use a computer/internet" and must give some skills that could lead to employment (from secretarial/office jobs to self-employment, hardware repair/sales etc). This year, before we start the next phase of the project, we're trying to better understand the general issue and market, i.e. barriers holding back such students from attending such courses, what kind of courses are out there, whether they meet identified job needs, and whether such graduates can get jobs/be entrepreneurs or not etc. As part of this research we are talking to various training institutes/centers (initially around Nairobi), including government-backed ones. We're not right now selecting any partners, just trying to better understand the issues, challenges and possible interventions. Can anyone recommend any others (beyond the below list) that we should talk to?.. criteria is fairly simple: should offer short courses (1-3 months) and should be open to those without any ICT skills at all, and without any/very limited academic qualifications. I am concerned for two reasons– (a) Transparency (b) Public participation. There is no denying the place of technology and how far we could go if we adapted the most recent tech in governance. However, the very sensitive nature of this type of data places a bigger responsibility on GoK. First to develop a data protection framework but beyond that get the public buy in. To add, our current governance framework calls for transparency and public participation. There is no going around those two prerequisites. Have we not learnt anything from Communication Authority and DMS woes?

It would fry power grids, stop trains, silence cellphones and overwhelm the internet. In the worst-case scenarios, food and water would begin to run out; hospitals would turn people away. Separated from their electronics, and thus their connections, Americans would panic, or turn against one another. The Pentagon is planning for this scenario because it knows many of its own war plans open with similarly paralyzing cyber-attacks against our adversaries, reflecting new strategies to try to win wars before a shot is fired. Glimpses of what this would look like have leaked out in recent years, partly thanks to Edward JSnowden, partly because a mysterious group called the Shadow Brokers – suspected of close links to Russian intelligence – obtained terabytes of data containing many of the “tools” that the National Security Agency used to breach foreign computer networks. It didn’t take long for some of those stolen cyberweapons to be shot back at America and its allies, in attacks whose bizarre-sounding names, like WannaCry, suddenly appeared in the headlines every week. Yet the secrecy surrounding these programs obscures most public debate about the wisdom of using them, or the risks inherent in losing control of them. The government’s silence about America’s new arsenal, and its implications, poses a sharp contrast to the first decades of the nuclear era. Sign up to receive the latest US opinion pieces every weekday The horrific scenes of destruction at Hiroshima and Nagasaki not only seared the national psyche, but they made America’s destructive capabilities – and soon Russia’s and China’s – obvious and undeniable. Yet even while the government kept the details classified – how to build atomic weapons, where they are stored, and who has the authority to order their launch – America engaged in a decades-long political debate about when to threaten to use the bomb and whether to ban it. Those arguments ended up in a very different place from where they began: in the 1950s the United States talked casually about dropping atomic weapons to end the Korean war; by the 80s there was a national consensus that the US would reach for nuclear weapons only if our national survival was at stake. So far, there has been no equivalent debate about using cyberweapons, even as their destructive power becomes more evident each year. The weapons remain invisible, the attacks deniable, the results uncertain. Naturally secretive, intelligence officials and their military counterparts refuse to discuss the scope of America’s cyber capabilities for fear of diminishing whatever narrow advantage the country retains over its adversaries. The result is that the United States makes use of this incredibly powerful new weapon largely in secret, on a case-by-case basis, before we fully understand its consequences. Acts that the United States calls “cyber network exploitations” when conducted by American forces are often called “cyber-attacks” when American citizens are the target. That word has come to encompass everything from disabling the grid, to manipulating an election, to worrying about that letter arriving in the mail warning that someone – maybe criminals, maybe the Chinese – just grabbed our credit cards, social security numbers and medical histories, for the second or third time. During the cold war, national leaders understood that nuclear weapons had fundamentally changed the dynamics of national security, even if they disagreed on how to respond to the threat. Yet in the age of digital conflict, few have a handle on how this new revolution is reshaping global power. During his raucous 2016 presidential campaign, Trump told me in an interview that America was “so obsolete in cyber”, ignoring, if he was aware of it, that the United States and Israel had deployed the most sophisticated cyberweapon in history against Iran. More concerning was the fact that he showed little understanding of the dynamics of the grinding, daily cyber conflict now under way – the short-of-war attacks that have become the new normal. His refusal to acknowledge Russia’s pernicious role in the 2016 election, for fear it would undercut his political legitimacy, only exacerbates the problem of formulating a national strategy. But the problem goes far beyond the Trump White House. After a decade of hearings in Congress, there is still little agreement on whether and when cyberstrikes constitute an act of war, an act of terrorism, mere espionage or cyber-enabled vandalism. Technological change wildly outpaces the ability of politicians – and the citizens who have become the collateral damage in the daily combat of cyberspace – to understand what was happening, much less to devise a national response. Making matters worse, when Russia used social media to increase America’s polarization in the 2016 election, the animus between tech companies and the US government – ignited by Snowden’s disclosures four years earlier – only deepened. Silicon Valley and Washington are now the equivalent of a divorced couple living on opposite coasts, exchanging snippy text messages. Great powers and once-great powers, like China and Russia, are already thinking forward to a new era in which cyber is used to win conflicts before they appear to start. They look at quantum computers and see a technology that could break any form of encryption and perhaps get into the command-and-control systems of America’s nuclear arsenal. They look at bots that could not only replicate real people on Twitter but paralyze early-warning satellites. >From the NSA headquarters at Fort Meade to the national laboratories that once created the atomic bomb, American scientists and engineers are struggling to maintain a lead. The challenge is to think about how to defend a civilian infrastructure that the United States government does not control, and private networks where companies and American citizens often don’t want their government lurking – even for the purpose of defending them. What’s missing in these debates, at least so far, is any serious effort to design a geopolitical solution in addition to a technological one. In my national security reporting for the New York Times, I’ve often been struck by the absence of the kind of grand strategic debates surrounding cyber that dominated the first nuclear age. Partly that is because there are so many more players than there were during the cold war. Partly it is because the United States is so politically divided. Partly it is because cyberweapons were created by the US intelligence apparatus, instinctively secretive institutions that always err on the side of overclassification and often argue that public discussion of how we might want to use or control these weapons imperils their utility. <https://www.theguardian.com/commentisfree/2018/jul/28/cyberwar-age-citizens…> Some of that secrecy is understandable. Vulnerabilities in computers and networks – the kind that allowed the United States to slow Iran’s nuclear progress, peer inside North Korea, and trace Russia’s role in the 2016 election – are fleeting. But there is a price for secrecy, and the United States has begun to pay that price. It is impossible to begin to negotiate norms of behavior in cyberspace until we too are willing to declare our capabilities and live within some limits. The United States, for example, would never support rules that banned cyber espionage. But it has also resisted rules prohibiting the placement of “implants” in foreign computer networks, which we also use in case the United States needs a way to bring those networks down.
