Facebook needs far stricter regulation, with tough and urgent action necessary to end the spread of disinformation on its platform, UK MPs have said. A Commons committee has concluded that the firm's founder Mark Zuckerberg failed to show "leadership or personal responsibility" over fake news. Facebook welcomed the digital select committee's report and said it would be open to "meaningful regulation". The Parliamentary report called for: - a compulsory code of ethics for tech companies, overseen by an independent regulator - the regulator to be given powers to launch legal action if companies breach the code - the government to reform current electoral laws and rules on overseas involvement in UK elections social media companies to be forced to take down known sources of harmful content, including proven sources of disinformation - tech companies operating in the UK to be taxed to help fund the work for the Information Commissioner's Office and any new regulator set up to oversee them. Kenya Government mandates DNA-linked national ID, without data protection law

The rebranded, National Integrated Identity Management System (NIIMS) now requires all Kenyans, immigrants, and refugees to turn over their DNA, GPS coordinates of their residential address, retina scans, iris pattern, voice waves, and earlobe geometry before being issued critical identification documents. NIIMS will consolidate information contained in other government agency databases and generate a unique identification number known as Huduma Namba. It is hard to see how this system comports with the right to privacy articulated in Article 31 of the Kenyan Constitution. It is deeply troubling that these amendments passed without public debate, and were approved even as a data protection bill which would designate DNA and biometrics as sensitive data is pending. Before these amendments, in order to issue the National ID Card (ID), the government only required name, date and place of birth, place of residence, and postal address. The ID card is a critical document that impacts everyday life, without it, an individual cannot vote, purchase property, access higher education, obtain employment, access credit, or public health, among other fundamental rights. Mozilla strongly believes that that no digital ID system should be implemented without strong privacy and data protection legislation. The proposed Data Protection Bill of 2018 which Parliament is likely to consider next month, is a strong and thorough framework that contains provisions relating to data minimization as well as collection and purpose limitation. If NIIMS is implemented, it will be in conflict with these provisions, and more importantly in conflict with Article 31 of the Constitution, which specifically protects the right to privacy. Proponents of NIIMS claim that the system provides a number of benefits, such as accurate delivery of government services. These arguments also seem to conflate legal and digital identity. Legal ID used to certify one’s identity through basic data about one’s personhood (such as your name and the date and place of your birth) is a commendable goal. It is one of the United Nations Sustainable Development Goals 16.9 that aims “to provide legal identity for all, including birth registration by 2030”. However, it is important to remember this objective can be met in several ways. “Digital ID” systems, and especially those that involve sensitive biometrics or DNA, are not a necessary means of verifying identity, and in practice raise significant privacy and security concerns. The choice of whether to opt for a digital ID let alone a biometric ID therefore should be closely scrutinized by governments in light of these risks, rather than uncritically accepted as beneficial. Security Concerns: The centralized nature of NIIMS creates massive security vulnerabilities. It could become a honeypot for malicious actors and identity thieves who can exploit other identifying information linked to stolen biometric data. The amendment is unclear on how the government will establish and institute strong security measures required for the protection of such a sensitive database. If there’s a breach, it’s not as if your DNA or retina can be reset like a password or token. Surveillance Concerns: By centralizing a tremendous amount of sensitive data in a government database, NIIMS creates an opportunity for mass surveillance by the State. Not only is the collection of biometrics incredibly invasive, but gathering this data combined with transaction logs of where ID is used could substantially reduce anonymity. This is all the more worrying considering Kenya’s history of extralegal surveillance and intelligence sharing. Ethnic Discrimination Concerns: The collection of DNA is particularly concerning as this information can be used to identify an individual’s ethnic identity. Given Kenya’s history of politicization of ethnic identity, collecting this data in a centralized database like NIIMS could reproduce and exacerbate patterns of discrimination. The process was not constitutional Kenya’s constitution requires public input before any new law can be adopted. No public discussions were conducted for this amendment. It was offered for parliamentary debate under “Miscellaneous” amendments, which exempted it from procedures and scrutiny that would have required introduction as a substantive bill and corresponding public debate. The Kenyan government must not implement this system without sufficient public debate and meaningful engagement to determine how such a system should be implemented if at all. The proposed law does not provide people with the opportunity to opt in or out of giving their sensitive and precise data. The Constitution requires that all Kenyans be granted identification. However, if an individual were to refuse to turn over their DNA or other sensitive information to the State, as they should have the right to do, they could risk not being issued their identity or citizenship documents. Such a denial would contravene Articles 12, 13, and 14 of the Constitution. Opting out of this system should not be used to discriminate or exclude any individual from accessing essential public services and exercising their fundamental rights. Individuals must be in full control of their digital identities with the right to object to processing and use and withdraw consent. These aspects of control and choice are essential to empowering individuals in the deployment of their digital identities. Therefore policy and technical decisions must take into account systems that allow individuals to identify themselves rather than the system identifying them. Mozilla urges the government of Kenya to suspend the implementation of NIIMS and we hope Kenyan members of parliament will act swiftly to pass the Data Protection Bill of 2018.

And our new mapping tool will make it easier to ensure that federal funding is directed to the areas of greatest need. This will make it easier for carriers to use federal resources to expand service in rural areas. [links and book suggestions at the bottom] The idea of MNC CSR (whether direct or via special purpose vehicles like charity "foundations" or "initiatives") is increasingly coming under scrutiny because it has been observed to have the net effect of capturing power away from governments and society to private (often majority foreign-owned) corporations, with regard to local social impact issues, social accountability, government priorities and policies. When private sector sets the social impact agenda, they change the narrative from "large multinational corporations should be accountable for their long and short term impact on the indigenous society - at both micro and macro levels - and must not do intentional evil" to something more broad and ambiguous like "do well by doing good". The second phrase might look like a concise version of the same thing, but it isn't. New insights reveal that what MNC CSR really does is: 1. Diverts attention (and more importantly, accountability) away from the much more costly and widely spread out social harm (or undesirable effects) of private sector multinational companies (e.g. pollution, exploitative products / pricing, physically or mentally harmful products/services, poverty-sustaining labor practices, aggressive tax avoidance, resource diversion / extraction, macro-economic destabilization or damage etc.) 2. MNC use CSR to sanitize their harmful activities: "our technology is designed to turn millions of your children to mentally unstable addicts and narcissists but, hey look over there, our foundation is building a school / dispensary in the slums for 100 students, or offering free Wi-Fi in rural areas, so we can't be that bad". It's amazing that policy makers and the public actually fall for this chicanery... which is one reason why our education system needs a closer re-look.. is the core curriculum designed to stifle critical thought? 3. Enables back-door lobbying and rent seeking by allowing corporate entities to indirectly influence policies through their "charitable" foundations (indirect rent seeking). These policies make it easier for their sister MNCs: i. to unfairly take control, win government tenders or dominate the targeted sectors; ii. it dissuades government officials from taking meaningful action against the harmful activities (or responding to public outcry with sustainable solutions); iii. it also helps the MNC's country of origin entrench its geopolitical influence (or activities) over the country - e.g. to facilitate resource extraction; among other undesirable / negative effects. 4. The "charity" cover allows MNCs to mine indigenous data (with minimal government oversight) for numerous commercial purposes (e.g. behavior manipulation to boost product consumption - without regard to long term effects) as well as, in some case, non-commercial (or possibly unethical / illegal) purposes (including industrial / economic espionage or political subversion) with less risk of suspicion from governments and/or society. Because they have global reach, they can steal indigenous intellectual property on one continent and make millions from it in another continent (or their home country) with subdued risks of PR blowback. 5. The charity cover also enables them to unethically brainwash young innovators in poor countries to freely hand over their intellectual property "to charity" (or more accurately, to them / their affiliated entities) - in exchange for "hope" - yet these same companies (and their close affiliates) have *thousands* of patents and other IP which they defend vigorously and consistently. Several reputable authors like Anand Giridharas and Linsey McGoey have robustly challenged the motives behind privatized philanthropy and posited that if the parent companies of these MNC (or MNC founder) owned foundations did less (or no) evil / exploitation /harm to society, they would have less (or no) need for CSR and would achieve a positive net-impact within the societies in which they operate. For example, sector or niche-dominant companies (price setters) could: 1. Deliberately structure the profit margin of their products or services to try match their quarterly gross profits as closely as possible to the median gross profit of a basket of at least ten of the largest indigenous corporations in the country of operation. This is possible with modern-day real-time pricing and analytics technology which many (if not all) of these companies already have. This is how you make ethical profits. 2. Increase wages to stimulate economic growth directly, boost the economic growth headroom (growing a robust middle class) and a have net-positive economic and social impact. The idea that people in poor countries deserve to struggle (or are "used" to low quality lifestyles - so they should not be uplifted) is racist and abhorrent. 3. Pay people according to the job - not according to passport/origin. This is racial nepotism and ought to be called out for what it is. 4. Actively reject technology that is purposely designed to divert public attention in an addictive way from meaningful economic (or learning) activity due to the long term macro-level dangers and exponentially high macro-economic costs which cannot be justified in any way (a great area of research for indigenous policy makers and current graduate students in African Universities). 5. Reject transfer pricing arrangements, incorporate locally to show full commitment, hire local staff for responsible and key roles, avoid tax havens, stop lobbying for rent deals or undeserved concessions when you already have so much financial power and resources at your disposal (instead lobby for indigenous empowerment), and diligently pay taxes in host countries. 6. Practice and promote conscious capitalism as a core philosophy and policy (instead of CSR). There are many more ideas if you think in terms of "doing less evil" because that perspective shifts the power of setting the agenda / policies away from the private corporations and back to the people (society). Dear listers, I have come across this article in Wired... I would like to hear your thoughts on the same and the viability of such a regulatory approach. The article reads in part : On Thursday, Germany’s Federal Cartel Office, the country’s antitrust regulator, ruled <https://www.bundeskartellamt.de/SharedDocs/Meldung/EN/Pressemitteilungen/20…> that Facebook was exploiting consumers by requiring them to agree to this kind of data collection in order to have an account, and has prohibited the practice going forward. “Facebook will no longer be allowed to force its users to agree to the practically unrestricted collection and assigning of non-Facebook data to their Facebook user accounts,” FCO president Andreas Mundt said in a statement announcing the decision. “We disagree with their conclusions and intend to appeal so that people in Germany continue to benefit fully from all our services,” Facebook wrote in a blog post responding <https://newsroom.fb.com/news/2019/02/bundeskartellamt-order/> to the ruling. The company has one month to appeal. If it fails, Facebook would have to change how it processes data internally for German users, and could only combine the data into a single profile for a Facebook account with that user's explicit consent.... “The FCO’s theory is that Facebook’s dominance is what allows it to impose on users contractual terms that require them to allow Facebook to track them all over,” Khan says. “When there is a lack of competition, users accepting terms of service are often not truly consenting. The most dangerous form of quackery is institutionalized quackery. This happens when the following practices become pervasive: 1. Grades for sale / barter; 2. A culture of academic cheating / plagiarism / cronyism; 3. Academic Sophistry (using twisted sentences, jargon and fallacies to obfuscate useless garbage in fake dissertations); 4. Disconnect between choice of research topics (or academic focus) v/s the real-world needs of the country; 5. A pervasive belief that a certificate (not real-world practice) is the indisputable authority on level of competence and/or ability; 6. Due to 5, a pervasive belief in academia, and society, that the main goal of education is to "get the papers"; 7. The likelihood that thesis supervisors themselves are products of a broken system - thus (un)wittingly spreading institutionalized quackery;8. Lack of commitment to solving real-world problems which are perceived as lacking "academic flavor";9. Mindless pedantry. Visit KIPI and check the number of approved patents - then compare against the number of claimed inventions in our universities. Our universities don't seem capable of challenging ridiculous claims of novelty (despite the implications on institutional credibility) and this has led to a total mockery of words like "invention" and/or "innovation". One may argue that perhaps the universities don't want to patent their inventions in favor of academic progress - but that would be a major indictment on their real-world judgment/reasoning - given their well publicized cash strapped condition and heavy dependency on taxpayer subsidies. There are many types of conditional releases that allow for realization of IP revenues without stifling academic research. If our universities have a real IP resource, why are they not monetizing it???? This is intellectual madness. Contrast with Stanford, for example, which earns > Ksh, 4.5 Billion annually from licensing royalties (>800 patents). Their Alumini have helped created high value global companies - which have transformed the world and achieved staggering valuations (e.g. Google, Linkedin, eBay, Cisco, Dolby, HP, Instagram, NVIDIA, Sun, Yahoo! etc - with a cumulative value in excess of Ksh. 1,000 Trillion (yes, Ksh. 1 Sextillon) - enough value to run our country tax free on >Ksh 6 Trillion budget for ~150 years!). Intellectual Property can generate more value (while being far easier to commercialize) than oil / gas / minerals. Why is our government not obsessed with commercializing indigenous IP? The people in charge of Kenya's tertiary education don't seem to have an idea of the scale of economic potential that they are sitting on (and how to unlock it). Observe the ongoing US v/s China technology dominance "war" for example - these countries understand the link between indigenous innovation and economic progress and it is no surprise that they are world's top two economies. Instead of Academic PhDs Kenya should issue Honorary PhDs for real-world achievements in advancing the nation - and the prestige of such doctorates should be higher than that of academic PhDs. This will help shift mindsets from abstract academic activity to real world solutions. Meanwhile, the government should suspend academic PhDs to allow for reallocation of scarce resources more productive areas e.g. developing market structures for rapid commercialization of indigenous innovations. For the PhDs have already been issued, there needs to be a mechanism for revocation when:1. the holder repeatedly fails to demonstrate reasoning skills in public discussions (especially around their field of expertise) that justify a doctorate status2. the holder's track record of achievement in the real world is no different than (or far surpassed by) an undergrad or college dropout (not personal achievement - but value addition to the country or society) 3. the holder lacks self awareness and does not seem to know the bounds of his/her competence (heavily relies on "academic rank" to support unsound claims or reject rebuttals) If we don't urgently contextualize our tertiary education system to focus on local real world challenges (i.e. how to grow a tiny, low income African nation that is plagued by poverty, corruption and incompetence - despite having a "highly educated" population) we will continue to be plagued by the same repeating problems for yet another generation and this article (among others) will be proof, for our children and their descendants, that we neglected our duty willingly - in full knowledge of the consequences. SH7.2M REPAIRS Mr Karanja said the company wants to be paid Sh7.2 million to repair the cameras and hand over the project to the county government. “We had pledged to pay before the contractor could resume maintenance works and subsequent handover of the project to us but we are yet to settle the bill and that is why the contractor has not resumed the project maintenance,” said Mr Karanja. But the PAC Chairman Wilfred Odalo faulted the City Hall for assuming responsibility for damages they did not cause. In response, Mr Karanja said the pledge was made because of security is a priority given recent terror attack in the city at the Dusit hotel complex. In May 2018, it was revealed that 26 of the CCTV cameras — installed in major roads such as Moi Avenue, Uhuru Highway, Kenyatta Avenue and Tom Mboya Street — were not working. Those installed along University Way and at Lusaka Roundabout have also stopped working after they were damaged by students and a contractor respectively. The committee resolved to invite the contractor in its next sitting to shed more light on the issue.

There's a funny corporate culture that I have observed in Kenya that could shed some light on why local IT systems appear so vulnerable: TALENT COMMODITIZATION. Take the banking industry for example, I recall a while back seeing some chatter on twitter about how big brands UNDERPAY key IT staff (I.e. the hands on technical staff like sysadmins / app admins / dbadmins & devs) in order to "save" on manpower costs. In this day and age that is not an intelligent thing to do. Others assume that outsourcing to India will magically solve for costs, quality and security. I have worked on projects with "world-class" offshore teams and what I saw was a minefield of HIDDEN COSTS if you don't have your own savvy supervisory / QC team. Then there is the "contract fixes everything" fanatics. Contracts mean nothing if you can't detect shoddy work - and if going to court after the fact is almost impossible given risks of PR blowback (in image sensitive industries). In many cases such contracts are just for CYA (avoiding blame or passing audit reviews). Some tradition-heavy institutions still put IT under Finance directors / VPs or GMs instead of having IT representation at board level. This makes it hard for IT to push back on top-down "spreadsheet inspired" directives. You don't increase shareholder value by setting up your critical functions for downstream failure (or putting the entire org or at risk just to hit annual growth targets). Beefing up the Infosec unit is pointless if the underlying architecture is full of holes. There is only so much duct taping that can be done. Worse if that team is underpaid as well. It's also interesting that many local companies don't have a "specialist path" for technical talent advancement. This limits the political/decision making clout for technical talent as well as limiting their personal growth. Hopping / side hustling / track switching (e.g. to management) is the end result. These mistakes have cost the financial industry (for example) a whopping 17BILLION in potentially avoidable losses (and still counting). So much for HR "cost savings". :-/ I think the Infosec crisis in Kenya is just a SYMPTOM of bigger "organisation and culture" issues - and short term thinking is right at the heart of it. Since 2014 ARTICLE 19 has been a pioneer in the technical governance and evolution of the global Internet, bridging the knowledge gap within the technical and human rights communities. In doing so, ARTICLE 19 has carved out a key platform for civil society engagement in these bodies; however, there remains the need for greater, more diverse, and more sustainable civil society participation. In its third year, the Internet of Rights Fellowship will equip a diverse community of civil society organizations and their representatives with the tools they need to carry out long-term, influential engagement in the bodies setting the technical policies and standards that uphold the global Internet architecture. Fellows will be expected to have some working knowledge and experience with the technical and policy discussions across the Internet governance landscape. Under the guidance of their assigned mentors, they will develop a deeper knowledge of their target issue area and the skills necessary to meaningfully contribute to discussions in order to further human rights considerations in Internet governance bodies. By the end of the program, fellows will be well equipped to continue developing a robust approach to human rights within these technical communities beyond the life of the program. # The Fellowship The Internet of Rights Fellowship program is designed to be flexible and dynamic to account for each individual’s skills, interests, and experience. Prospective fellows are encouraged to be creative in their approach. Upon selection, fellows will work with ARTICLE 19 Team Digital to elaborate upon their work plan, develop a schedule, and identify potential deliverables. Beyond lending structure to the fellowship, this exercise is intended to give our team insights into how we may best support each individual. The 2019 Internet of Rights Fellowship will start in March and last for one year, during which time fellows will work closely with their mentor—a designated member of our team—on one of the following priority areas: * Algorithmic decision making: This is a technical track on which fellows will complement our policy work on algorithms, artificial intelligence and machine learning to address how algorithmic decision-making can be guided by international human rights law. Algorithms fellows may work on developing research, and/or work in both established and emerging spaces, like the Institute of Electrical and Electronics Engineers (IEEE) and the Partnership on AI (PAI). * Public Interest Internet Standards: This is a technical and policy development track on which fellows will contribute to Article 19's work at the Human Rights in Protocols Considerations Research Group of the Internet Research Task Force (IRTF), or in developing novel technical methods for measuring human rights aspects of existing Internet Engineering Task Force (IETF) standards. * Radio Network Hardware: This is a technical or humanities track in which the fellow will complement our policy work by studying specific standardization projects ongoing in either the IEEE 802 LAN/MAN Standards Committee (LMSC) or the Third Generation Partnership Project (3GPP). The fellowship has the goal of uncovering hidden effects on human rights of technical choices at the lowest layer of Internet architecture: hardware. Fellows may be given the task to assist ARTICLE 19 representatives with things like Letter Ballots, technical reviews and attend standardization meetings. Each Fellow will be expected to participate in three Internet governance-related meetings over the course of the year. Costs incurred during participation in meetings and conferences as part of this program will be covered by the Fellowship. Fellows will also receive a monthly honorarium of USD 300 over the duration of their fellowship. # The Fellows Fellows are expected to commit to an average of eight hours per week engaging in forum-specific discussions, participating in working groups, and completing projects. I never saw any particular firm plans the Government has for ICT so I thought it best to bring this to your attention, albeit a little later than I should have. I could be wrong, though. Maybe I had high expectations owing to the exposure I get from you all. What I love about this group is there are so many diverse opinions on various issues. I think it would be great to let the Government hear all these well - considered opinions on its ICT plans. The deadline for institutions to put in their comments was on Friday, which means Kictanet might not be able to, but as individuals you would be able to participate. The plan is to shape and take forward a global digital justice agenda, working together as a network. This is also meant to further develop and strengthen the Just Net Coalition . The workshop is titled*"Equity and Social Justice in a Digital World: An Inter Sectoral/ Movements Dialogue for a Digital Justice Agenda". * Participants will come from (1) organisations that are already engaged with digital issues and (2) traditional civil society groups that have begun to feel the digital impact and pressure on their work, and would like to understand the digital better, from a progressive point of view, and collaborate in developing a global digital justice agenda. With a digital justice agenda we mean working equally on civil and political rights side as on social, economic and cultural rights. A datafied state is a major threat, but so is data discrimination by the private sector and a big corporation driven data economy that further concentrates wealth and power, within and across societies. Social and economic justice is a key part of this effort, which need to be brought to the centre stage of digital activism. This is also attempt to built bridges between digital activism in the geo-political South and North. Participants will mainly be groups that are already engaged in or with the Just Net Coalition in various ways. But we are eager to also include groups and people that we may not yet be in contact or engaged with, but who are eager to work on social and economic justice issues in a digital context. Such a commitment should be central to such groups/ people's work for them to fruitfully work with JNC and its various partners. The technologies described in the article are real and could be used to radicalize ignorant youth or to spark chaos e.g. during political transition events. These are REAL RISKS I believe that need to be addressed PROACTIVELY - before we get into the election (or even referendum cycle). "A well-timed and thoughtfully scripted deepfake or series of deepfakes could tip an election, spark violence in a city primed for civil unrest, bolster insurgent narratives about an enemy's supposed atrocities, or exacerbate political divisions in a society. With believable fake videos in circulation, people can choose to believe whatever version or narrative that they want, and that's a real concern." - Professors Danielle Citron - University of Maryland and Robert Chesney - University of Texas Scientists are working on technologies to detect deep fakes - but it may not be reliable (or available in Africa). This follows President Uhuru Kenyatta’s approval of amendments to the Registration of Persons Act that has included the two to the list of requirements needed at the national people’s registry. Adults applying for documents such as IDs will be required to provide additional information about their location, including land reference number, plot number or house number. The ministry is also seeking to introduce Global Positioning System (GPS) coordinates in the registration of persons, enabling the tracking of their location via satellite. Role of social media in fighting corruption

In the Anti corruption conference hotelld this week in Nairobi, the role of social media was discussed at length by the Chief Justice, and the President. What caught my tuition was President Uhuru's call for the general public to "use tools of social media to identify, stigmatize, and report all instances of corruption that come to their knowledge". He also acknowledged that Kenya has a very vibrant social media landscape. This is a very interesting observation, and I am wondering what is the role of social media in fighting corruption, and also admissibility of evidence, given that some corrupt people are so brazen, they don't care about stigma. What tools are out there to capture corruption instances as they happen? I know Facebook Live is a very good tool, and it has been used extensively in US by the public who fear police brutality. Kisumu turns to WhatsApp for better services

Kisumu county is testing a county 'digital assistant' to provide information relating to different functions. I think its a good initiative by the county. See story below. Are there any innovative implementations of such or similar systems being implemented in other counties that listers may be aware of? I think it's a useful start, and they are taking in feedback and suggestions to improve the service. Hopefully, some of you might want to try it out and see what gives. I wouldn't mind having a similar Chatbots for eCitizen or iTax, whose numbers sometimes hardly go through. ____________ This week, the county has been testing an interactive WhatsApp platform that allows residents to get information promptly. All that one needs to do is to send the word “hello” from a WhatsApp account to +254 756 742 421. That message prompts the county digital assistant to release a drop-down menu that asks the user to select a code representing their area of interest. France fines Google nearly $57 million for first major violation of new European privacy regime

(Mike Segar/Reuters) By Tony Romm January 21 at 10:30 AM Google has been fined nearly $57 million by French regulators for violating Europe’s tough new data-privacy rules, marking the first major penalty brought against a U.S. technology giant since the region-wide regulations took effect last year. France’s top data-privacy agency, known as the CNIL, said Monday that Google failed to fully disclose to users how their personal information is collected and what happens to it. Google also did not properly obtain users’ consent for the purpose of showing them personalized ads, the watchdog agency said. French regulators said Google’s business practices had run afoul of Europe's new General Data Protection Regulation. Implemented in 2018, the sweeping privacy rules commonly referred to as GDPR have set a global standard that has forced Google and its tech peers in Silicon Valley to rethink their data-collection practices or risk sky-high fines. The United States lacks a similar, overarching federal consumer privacy law, a deficiency in the eyes of privacy hawks that has elevated Europe as the world’s de facto privacy cop. Despite Google’s changes to its business practices, the CNIL said in a statement that “the infringements observed deprive the users of essential guarantees regarding processing operations that can reveal important parts of their private life since they are based on a huge amount of data, a wide variety of services and almost unlimited possible combinations.” In response, Google said it is “studying the decision to determine our next steps,” adding: “People expect high standards of transparency and control from us. We’re deeply committed to meeting those expectations and the consent requirements of the GDPR. “ French regulators began investigating Google on May 25 -- the day GDPR went into effect -- in response to concerns raised by two groups of privacy activists. They filed additional privacy complaints against Facebook and its subsidiaries, photo-sharing app Instagram and messenger service WhatsApp, in other EU countries. “We are very pleased that for the first time a European data protection authority is using the possibilities of GDPR to punish clear violations of the law," said Max Schrems, the leader of the nonprofit noyb.eu (None of Your Business). "It is important that the authorities make it clear that simply claiming to be complaint is not enough." Under Europe's data privacy law, tech giants including Google must give users a full, clear picture of the data they collect, along with simple, specific tools for users to consent to having their personal information harnessed. In both cases, France said that Google had erred. Full details about what Google does with users' personal information are "excessively disseminated across several documents," according to the CNIL. The lack of transparency is even more jarring to users, the watchdog said, because of the sheer volume of services Google operates -- including its maps service, YouTube and app store. Even though Google users can modify their privacy settings when they create an account, French regulators said it still isn't enough -- partly because the default setting is for Google to display personalized ads to users. Meanwhile, Google requires people who sign up to agree to its terms and conditions in full in order to create their accounts, a form of consent that the CNIL faulted because it requires users to agree to everything -- or not use the service at all. For Google, its fine in France marks only its latest headache in Europe. Regulators throughout the region repeatedly have investigated the search giant for its privacy practices, while EU watchdogs have scrutinized Google on antitrust grounds. An international telecommunications firm that owes Safaricom SCOM • 23.40 ▼ 1.27% Sh120 million cannot be traced after folding up its local operations, the mobile phone company has told the court. Safaricom is now seeking permission to serve court papers on the elusive company through newspaper adverts. The mobile firm says it has learnt that two of Iphone Global systems directors have filed bankruptcy proceedings in British courts. The directors, Steven James Moran and Leslie Thompson, who are British nationals, are said to have left Kenya without Safaricom’s knowledge. Attempts to serve the company with court papers have, however, been futile since November after the firm closed its Nairobi office Safaricom and the UK firm, according to documents filed in court, have a relationship that dates back to 2006 when they entered into an agreement of terminating calls into each other’s networks. Iphone Global is licensed to provide voice over internet protocol (VOIP) services. The firm that terminated more calls into the other’s network was supposed to pay the difference, as per the agreement. Safaricom in the suit papers says the firm has defaulted on paying millions in outstanding bills. “Attempts to serve the defendant at its registered office, Ad Life plaza, 4th Floor, suite No 4E, Ring Road Kilimani, have been to naught as the defendant was not in occupation thereof and was said by the Ad Life plaza Manager to have never occupied any offices therein,” Safaricom told the court. The telecommunications firm further says its attempts to locate the company at Iphone Global Systems’ last address, Carbon House, at Westland’s Office Park, was futile as it was informed they were no longer tenants there. High Court Judge James Makau on Thursday allowed Safaricom to inform the company of the pending suit against it by placing an advertisement in a local daily newspaper. Safaricom pleaded with court for speedy determination of its claim to allow it join the bankruptcy proceedings in British courts. The firm further claims that it has traced property belonging to the two directors in the State of Florida, United States of America and that any delay will see the assets disposed, making it difficult for it to recover its claims. Iphone Global signed an agreement with Safaricom to interconnect their systems. The two firms agreed to every month harmonise the bills for calls that had been terminated across the systems, and the company that had placed more cross-network calls was to pay the difference. Iphone Global had always paid its bill on time until early 2017 when it started defaulting, leading to Safaricom terminating the cross network services in March, 2018.
