Does anyone know if there is a policy in Kenya on the use of freephone numbers (0800 etc) in Kenya? Are these services banned? Freephone numbers allow callers to phone the subscriber free of charge with the subscriber paying the bill. Recently I was on an international conference call where the other participants had been provided with freephone numbers for their countries but none for Kenya. When I enquired I was informed that there is a problem with freephone services in Kenya, "apparently with local telecom services". Waudo

Hi all: just wondering: would it make more sense for safaricom to just 'sambaza' airtime amounts equivalent to the dividend payments for those with less than say 2,000 shares (which translates to a dividend of khss 200), as i believe this would save them (shareholders) from having to incur the MPESA transaction fees of Kshs 30? what do others think? thanks. Hi, I finally got a chance to look through the presentation you sent me concerning the marine cable issue, which was comprehensive. My suggestion is that you call all the ISPs and give them this presentation so that they can stop, once and for all, passing the buck for failing the Nation and keeping us in the stone age of connectivity. From the presentation it is clear that the marine cable on its own was not the panacea for high internet charges and slow connectivity, we did not understand that the model for Internet access in the US cannot be applied in countries outside that continent as the bulk of the content is resident in the US. For a long time, over 12 years ago when I wrote an article for an IT magazine that was called Micro Computer Guide, I was called the village madman for advocating about the need to develop local content. I was incensed by the action by the then Karisa Communications (Makatiani & Ngeno) later AfricaOnline to shut down their bulleting board based service to provide us with the so called Internet connection yet we where on the right track as we created local content out of necessity. Today I believe I stand exonerated as ISP’s finally confirm that the marine cable is not going to bring down the cost of Internet access, you wonder why we have wasted the past 3 years singing its praises. I say PS Ndemo, in his personal capacity and on behalf of all the agencies under his ministry (ICT board, e-government, CCK & other), owes the country an apology for taking us on a wild goose chase. PS Ndemo the creation of local content falls smack in your docket and I have said this before all the government has to do is digitize all those reports in their possession beginning with the constitution, sessional papers, census, exam results, list of village polytechnics and the presidents diary then we can all move from their. Robert, I am glad you liked the predictions I made last year about internet service costs. I am sure you might also like my suggested price-reduction mechanisms I am making this year @ http://www.strathmore.edu/pdf/ict09/affordable_ict.pdf Unfortunately nobody listens to Academicians in these parts of the world - no wonder most lecturers abandon classroom to become politicians...so that someone can listen to them ;-). What's more I get worried when I look at some of the approaches and strategies the regulator CCK has proposed as a way of containing Tariffs (including internet pricing?) from Operators (Licensees). But since I am not an Operator, I will leave it for the Operators to present their case...but they will be hard-pressed to explain whey they should not be considered biased...cant wait for that stakeholders meeting. As for the PS to apologise...he is of age to decide for himself. But he could learn from that Politician who had promised us a Constitution in 100days. He didnt deny it - he just clarified that the days were not consecutive days ;-). And so it is the same with the internet costs. Prices will indeed come down as promised. I agree with P.S Ndemo. We need to not only make reference to the draft/proposed regulations but also in this case the specific consumer provisions. But while, the draft regulations have specific consumer provisions, technological developments and convergence provide some challenges that may not necessarily be fully addressed by the specific consumer provision, so would offer to suggest that we look at all of the regulations including e-transactions, etc. I also think we may need to think about additional laws and regulations that are focused on consumer protection matters generally and not only the in the ICT sector. Hi All, just to let you know that I have just been sorted(6.15pm)....it is indeed very sad if it has to take the 'big guy' to cough for issues to be sorted...what of those who do not have any way of reaching him? in the recently concluded EA-IGF.... consumer issues were numerous...from wrong biling, to skewed marketing to lack of well informed CC.... however two things stood out; consumers are ignorant(barely know their rights) and service providers DO NOT share their complaints data....hence making it very difficult for anyone to know the type of complaints and whether they have been attended to. for things to change we all have a role to play....find yours and play it... thanx to all who felt me :-) and those who made phone calls behind the scene,coz someone surely did. Kai, That was and remains a smart strategy. The truth is we can never get rid of satelite technology, we can only reduce its reliance as it will stil continue to serve the maginalised areas where it might take ages to roll out fibre. So my question is; What would have motivated some operators to sign contract with satelite companies for such a long duration, taking into account the fast changing glogal trends? I may be wrong, but such arrangements could have been intentional and personalised, hence should be scrutinised by the regulator. PS Ndemo the creation of local content falls smack in your docket and I have said this before all the government has to do is digitize all those reports in their possession beginning with the constitution, sessional papers, census, exam results, list of village polytechnics and the presidents diary then we can all move from their. Anyone lost their Orange bundle?

Dear All, I thought to share this and stop suffering alone, coz someone may be on the same boat....... on friday night, I had 157MB of bundle on internet everywhere modem......33minutes of processing email, it disconnects...checking my balance,i have 7.17MB of bundle... and of course the same story...were looking into it....were looking into it....we will call you....... so by Sunday nigh....I got to do some stuff so I load with 870 to buy 250 bundles and I had 16.50 ksh remaining.....this was at 11.03pm. at 11.15pm it disconnects and what happens I have 6.75MB. so on monday am to call........talked to everyone.....some supervisor by the name Lou...very rude guy........besides the point...by Monday evening nothing had been done,no phone call....nothing! Tuesday, I was at GPO 2nd floor at 11am...left at 3pm.......what did I leave with there? Some Manager by the name of Mark...assuring me that it will be sorted before 5'oclock...there system had a problem between friday night and sunday night....so they are rebating as guys report......so I took his number and left. Wednesday, I call Mark at 10am..".what is happening"? "I am not in the office let me call you when I get there".................so I call him at 3pm...24hrs later after I was in his office...... "I have forwarded your complain,with the others.....so I will call you...when I get a response".......Sir youre talking like am in your office....its 24hrs later....you have forwarded? so I call Mark 5mins to 5...he does not pick his phone...for obvious reasons.....the whole day thursday...he is not answering his phone....I do not have my bundles................what a frustration! I havent seen this on the media.......which is very unfortunate.........because I was hoping that they could have apologised to their consumers.....our systems were down.so if you lost bundles,then get in touch. nothing ! my conclusions; either someone is completely incompetent or this is the way to thiefery....hoping that you will be exhausted calling and following up...and they call it a day! In all, there are over 50 areas of change, clearly indicated in the "redline" version of the Guidebook. In addition to specific trademark protections (described below) the new Guidebook includes: •Measures to prevent or mitigate potential for malicious conduct including a proposal to create high-security zones; •Enhanced stability / security measures, requiring DNSSEC deployment and prohibiting use of wildcards; •Protecting registrants by taking step to ensure registry viability: defining a financial instrument that will ensure ongoing registry operations in the event of failure, and specifying certain pre-delegation registry tests; and •Enhanced contractual tools through the development of post-delegation dispute procedures including one to ensure that community-based TLDs adhere to their self-described purpose. Like all previous versions, this draft is posted for public comment. It has been released prior to the ICANN meeting to be held in Seoul from October 25-30. During the Seoul meeting ICANN will conduct several sessions to facilitate discussion of this version of the Applicant Guidebook and finding solutions to the outstanding issues. Trademark Protection Measures – Where to next? http://www.icann.org/en/topics/new-gtlds/gnso-consultations-repor ts-en.htm Specific trademark protection mechanisms are still to be decided upon by the Board. After receiving trademark protection recommendations from the Implementation Recommendation Team and others, taking extensive comment and conducting consultation with the broad community, ICANN has drafted a set of implementation recommendations related to intellectual property protections for the new gTLD program. Additional rights protection included in the Guidebook are the: •requirement to maintain a "thick" Whois database, and •specification of a post-delegation dispute procedure so that trademark holders can lodge complaints of abusive behavior against registries when merited. For other proposed rights protection mechanisms, the Board is providing the Generic Names Supporting Organization (the policy organization that developed the new gTLDs policy) with the opportunity to offer focused input on this specific area of the proposed implementation plan that is being published now. Those proposed rights protection mechanisms are: •The creation of an IP Clearinghouse, which is a database of validated trademarks to be utilized by new gTLD registry operators in implementing either an IP Claims service or Sunrise process during TLD launch; and •The creation of a Uniform Rapid Suspension process for use in clear-cut, blatant cases of trademark infringement. The community at-large may also comment on these specific issues, and of course, any other new gTLD issues through comment fora found on the new gTLD pages. TEAMS and Open ended circuit

For a while I wondered why the TEAMS cable has not gone hot yet it landed over 2 weeks ago, yesterday I got the answer. The headline in the newpaper story indicated that Jamii, a partner in the TEAMS project had finally connected to Europe from Fujaira, which sounded a little strange. Where did the fibre cable terminate to when it got to Fujaira? What this statement would suggest is that the termination in Fujaira does not actually connect into the Internet backbone but is actually an "open end" from where the providers must find a carrier, read IPOP, to get them onto the Internet. Maybe I do not understand this Internet connectivity issue, but taking an analogy that if Kenya Power connect electricity to my house (before which hopefully I had already wired the inside of the house for lights, sockets and cookers) the minute then the minute I flick a switch a light will come on (subject to power rationing schedule and having bought and installed an energy saving bulb). To the best of my knowledge Kenya Power Transmission Company does not need to be notified to connect my house to the grid and by extension Kengen do not require to be notified to connect me to a generating station whether geothermal, hydro or thermal. Can someone out there familiar with fibre optic cable termination shade some light on this issue for my benefit and also many others out there. Hi, I have been monitoring the growth of MPesa and I am getting concerned that we shall soon be held ransom if its growth is not monitored and their none competitive activities stopped. We are more concerned about number portability yet this will only benefit a few foreign investors yet mpesa has become so pervasive yet the tax consuming regulators do nothing to protect the consumer. The success of safaricoms mpesa has been so meteoric that it has scollen their heads to the point that there officers have become more powerful than the dreaded mungiki. They determine who can open an outlet where and which outlet will be shutdown. On the other extreme is the terms that the agents are giving such as they cannot provide the services of a competing provider. Imagine if KCC or Elliots wher giving the power to determine who can ot cannot sell their products and also require that you do not sell a competing product where would the milk and bread industry be today. If even KBL realised that a retailer must be free to decide which products to sell and not be bullied into selling the products of a particular brewer. Competition is about a level playing field of which the money transfer business it not, why should a grandmother in Budalangi or Kangaita who has a Zaine line be denied the opportunity to receive funds from her grand children because the only shop keeper within a 5 KM radius of her home is not allowed to offer multiple money transfer products, yet he can sell Tuzo, Brookside, Fresha, Haifa or any other brand of milk. We are regressing very first and unless the regulators do what they are paid to do with our hard earned taxes then we soon shall be be cornered. This keeps looking like the mark of the demon that is quoted in the bible. Somebody stop this madness. Brian --Judge Orders Google to Deactivate Account (September 24 & 28, 2009) A US District Court Judge in California has ordered Google to deactivate the Gmail account of a user who was accidentally sent confidential bank information. An employee of Wyoming-based Rocky Mountain Bank sent the data to the account in error; the data include names, Social Security Numbers (SSNs) and loan information of more than 1,300 bank customers. Upon recognizing the mistake, the bank sent another email to the same address, requesting that the recipient destroy the previous email and contact Rocky Mountain Bank. After receiving no reply, the bank asked Google for information about the account holder. Google said that it would not surrender any information without a court order. The judge's order is controversial because it appears to violate the account holder's First Amendment rights. Previous agreements gave the US close oversight of Icann - drawing criticism from other countries. Earlier this year, the EU called on the US to relinquish its control and Icann to become "universally accountable". "The US government is the only body to have had formal oversight of Icann's policies and activities since its inception in 1998," it said. "The Commission believes that Icann should become universally accountable, not just to one government but to the global internet community. "This is particularly relevant given that the next billion of internet users will mainly come from the developing world." The current agreement between the Internet Corporation for Assigned Names and Numbers (Icann) and the US Commerce Department's National Telecommunications and Information Administration is due to expire on Thursday. *'Formal relationship'* Icann is a not-for-profit private sector corporation - set up by the US government - which oversees critical parts of the internet, such as the top-level domain (TLD) name system. Top level domains include .com and .uk. The body recently voted to relax the strict rules on TLDs, meaning companies could turn brands into web addresses, while individuals could use their names. Icann also agreed to introduce domain names written in Asian, Arabic or other scripts. The regulator has not yet released details of the new agreement with the US. However, a report - described as "accurate" by people familiar with Icann - in the Economist magazine says the new deal does not have a fixed term. It identifies a number of groups, including representatives of foreign governments, which will conduct regular reviews of Icann's work. The panels would specifically focus on competition among generic domain names, how domain-name registrants' data are handled, network security and transparency, and accountability and the public interest - the only panel on which the US will reportedly retain a permanent seat. A formal announcement about the deal is expected on Wednesday. However, it is unlikely that the new agreement will sever the links between the US government and Icann entirely. Rod Beckstrom, president and chief of the organisation, said in a letter to Congress last week that it would seek to maintain a "long term, formal relationship with the United States Government". The body also has a separate agreement with the US - to run the Internet Assigned Numbers Authority (IANA) - that expires in 2011. The IANA oversees the net's addressing system.

South Africa's Telkom snaps up Kenyan Internet service provider Sep 29, 2009 The local Internet scene could be headed for major realignments as South Africa's largest fixed-line phone operator, Telkom, silently sneaks into a territory it has long been yearning for. A complex web of share-purchase transactions among telecom operators in Africa's richest nation, has ended up with the acquisition of a local satellite data transmission services company, Afsat Communications Limited. After failing to secure a 51 per cent stake in Telkom Kenya late 2007, Telkom SA Ltd opted to court an Internet Service Provider, MWEB Africa, a subsidiary of South African media and communications conglomerate Naspers for a take-over bid. Interestingly, the deal was successfully concluded in April this year, with the firm paying a massive 63m US dollars (4.7bn shillings) for 100 per cent and 75 per cent shareholding in MWEB and MWEB Namibia respectively. The value of the transaction, which ostensibly excluded the South Africa's MWEB unit, has since been kept underwraps. Incidentally, MWEB, the Internet solutions arm of Naspers - the company that also owns Multichoice Africa and popular magazine arm Media 24 - had bought Afsat Communications, including its subsidiaries in Kenya, Uganda, Tanzania, Nigeria and Zambia in October 2007. This implies the local Internet firm, Afsat Communications, is now part and parcel of Telkom South Africa. "AFSAT is now fully part of Telkom South Africa," Mr Job Ndege, General Manager, Afsat Services Ltd told The Financial Journal Last week. "This is an implied acquisition," he said. So far, South African Telkom owns Nigeria's Multi-Links and Kenya's Africa Online, with plans to aggressively fund both units. The latest acquisition is part of the company's strategy aimed at reducing dependence on domestic revenues, while expanding further into Africa to offset dwindling profits at home. It is widely argued that the acquisition, together with the company's investment in Africa Online will increase the value proposition of its product and service offerings to all customer segments in Sub-Saharan Africa. The acquisition gives Telkom South Africa a foothold in 28 African countries, making it the biggest satellite-based ISP on the African continent. "We think our value preposition is so powerful that the current terrestrial services cannot match," says Ndege. He says the value prepositions of the company's products and services include reliability, consistency, speed, availability, cost effectiveness and strong support. Afsat Communications offers direct satellite access services to its clients by utilizing all communications requirements such as backbone access, backhole access and last mile access. In Kenya, Afsat is known for its satellite Internet connectivity solutions to residential and business customers. It also supplies corporate and state owned customers with reliable and secure corporate data network solutions. This service is provided through VSAT connectivity using the popular iWay brand, which has its regional headquarters in Nairobi. "The response in the market for our products has been very good. We have had an unprecedented growth," says Ndege. Amongst the company's main competitors and who are hoping to utilise the fibre optic cables to provide international Internet connectivity include Access Kenya Ltd, Kenya Data Network and UUNET Kenya. "The fibre optic will provide much capacity. The demand for capacity is growing, but there have not been enough satellite capacity to provide international connectivity," says Ndege. Kenya's average Internet usage grew by 230 per cent to 700MB last year from the previous years 304 MB. The fibre optic networks are expected to supplement satellite in boosting the capacity, since satellite bandwidth demand in Africa far outstrips the supply from the highly consolidated satellite fleet operator industry. Indeed, Afsat Communications has announced a five-year (2010-2014) strategic pan aimed at improving and expanding its infrastructure within East Africa, with a view of ensuring steady and reliable supply of its products and services. The next phase of the company's growth will involve setting up additional hub infrastructure to cover the region of the Sub-Saharan Africa between 2011 and 2015. Already, the company has built five satellite hubs in Africa. Afsat serves Kenya through a distributor network of ISP's such as Callkey Networks and Virtualsat, by providing last mile connectivity to remote locations such as Lokichoggio, Mandera, Lamu, Homa Bay, Garissa, Dadaab, Wajir and Namanga. The company also has a large number of VSATs in Nairobi. There are over 485 iWay VSAT terminals in Kenya. iWay services are available in 28 countries in Africa, and its partnership network consists of 32 distributors, with four subsidiaries in East Africa and Nigeria. Afsat Communications was formed in 1992 to offer communication solutions to corporates in East Africa. In 2001, the company changed its focus with the re-launch of iWay Brand targeting the whole Sub-Saharan Africa. Telkom SA Limited aims to become a Pan-African integrated service provider that offers international communications and Internet connectivity, hosting and managed data services, as well as wireless voice and mobile broadband solutions. Over the long term, it plan to provide international data connectivity to major cities in Africa through regional hubs. It also seek to position Telkom as a wholesale facilities and infrastructure enabler for regional incumbents. With regards to existing subsidiaries, Telkom SA is focusing on achieving strong growth through both organic and acquisitive business development strategies, as well as by leveraging synergies across the Group. For Africa Online, this includes leveraging its available international capacity to deploy satellite based Internet access, and using Africa Online as the main vehicle in which Telkom will deliver Internet services outside of South Africa. - Facebook monthly electricity bill = 1 Million USD , and adds new servers every few days because users appetites for adding photos keeps growing. - Youtube monthly bandwidth consumption= 25PetaBytes ( 1000 Terabytes ) I don't have the excat amounts but the above is a harsh reality of operating such services. Though their financial standings show as mighty, I wonder how long can they sustain just running just on large adverts? Rgds.

Hi Am sure the MOIC the convenor has developed a wonderful programme taking advantage of the process of regulations 2001, policy in 2005 and many other stakeholders engagements in the past. Based on this wealth of experience, I suspect the MOIC will have a framework like the following to make best use of the two day engagement i.e. Thurs morning - preliminaries , opening statements , high level presentation positioning the regulations in the policy regulatory terrain , principles undergirding the regulations and of course taking into account a changing market scenario over the life of incoming regulations for the coming decade to 2019 and linkage to vision 2030. A discussion of the structure of the stakeholder workshop - perhaps establish workgroups to review in -depth the various regulations, the capacity of the stakeholder workshop , and finally the tors of the workgroups. High level issues may be addressed in this session Next session could be breakout sessions which will address details at these sessions which may run the rest of the day and perhaps early the following day Friday sessions may be dominated by plenary to receive comments from workout sessions and address cross cutting issues . a final issue may be to establish a small team to help polish the comments into cohesive regulations The structure worked in the past , and most likely will Cheers Muriuki From: Eng. It made its pledge in a letter Tuesday, a week before the expiration of an agreement between the Internet Corporation for Assigned Names and Numbers and National Telecommunications and Information Administration. ICANN CEO Rod Beckstrom told House Judiciary ranking member Lamar Smith and House Judiciary Courts and Competition Subcommittee ranking member Howard Coble, R-N.C., in the letter that he is working with NTIA to set guidelines under which ICANN would promise to remain a U.S.-based nonprofit and continue its focus on transparency and accountability. The letter from Beckstrom, a Silicon Valley entrepreneur who had served as director of the Homeland Security Department's National Cybersecurity Center, mirrored written testimony by ICANN Chief Operating Officer Doug Brent, who appeared at a House Judiciary Courts and Competition Subcommittee hearing today to vouch for the organization's planned expansion of top-level domains such as .biz, .info and .us. ICANN has faced scrutiny on Capitol Hill and among industry stakeholders as it seeks more independence from federal oversight, as well as the ability to bring potentially hundreds of new domain names to market. Beckstrom's predecessor, Paul Twomey, weathered a hostile House Energy and Commerce Communications Subcommittee hearing this summer.
