folks, quite a few things can be said about the new broadcasting regulations but the tendency on this forum to pooh pooh the media, as if it is the greatest sinner, is quite frankly discouraging. any one who is cheering the govt for the new regulations is urged to employ some skepticism.because sooner rather than later, they will begin to absorb the implications. it is quite clear that regulations are needed, but the devil is in the letter. the day you have the cck, which is yet to demonstrate its independence from political dictation, determining what is aired or not, and what constitutes a variety of views or objectivity, then you will reaslise what the apprehension is all about. i hesitate to get into specs and refer you to our (Kenya Editors Guild) (http://www.eastafricapress.net/) position, as well as my comments on the regulations when they were first published (http://www.eastafricapress.net/index.php?option=com_content&view=article&id…) more later. makali _______________ "If my doctor told me I had only six minutes to live, I wouldn't brood. Listers, After the first ICT Talk, my thinking is every month {via KICTANET} we can invite personalities to come and chat/present/explain what they are working on, policy etc etc These would be sessions during which we as industry people can give input, shape and I guess engage in what government and other organisations are doing in ICT On this chain, I would like people to name personalities, government officials, companies etc etc that they would like to hear from ...and the topics for example ..... My wish list - Paul Kukubo {CEO ICT Board} - On Outsourcing, Strategy to market Kenya, Initiatives .... Viz a Viz the ICT Board - Someone from eGovernment ... about strategy, whats up and how Kenyan companies can participate Can we name some people / organisations who we would like to hear from them we can invite and hopefully they come and we learn :)

(From Balancing Act) Regulator penalises leading mobile companies for QoS issues by shortening their licence period In an unexpected move, Niger’s regulator ARM has shortened the licence period for two of the country’s pan-continental mobile operators over Quality of Service (Qos) issues. QoS may become a battleground issue across the continent this year as regulators realise they have the power to insist that agreed standards are met and things improve. For operators, getting network capacity in harmony with demand is full of headaches. Russell Southwood feels their pain. Last week Niger’s regulator Autorite de Regulation Multisectorielle (ARM announced that it had reduced the length of two mobile operators' licences in a row over quality of service, according to a Reuters report. The culprits are two of West Africa’s leading mobile operators, Zain and Moov (owned by Etisalat). The 15-year concession awarded to Kuwait-based telecoms firm Zain in 2000 was reduced by five years, according to ARM, until a return to the stated levels of service quality is achieved. Meanwhile, a 15-year licence awarded to Moov, the brand name of West African company Atlantique Telecom, also in 2000, has been cut by three years. ARM is one of francophone West Africa’s most effective regulators and it has worked hard to liberalise Niger’s telecoms market over the last three years. The tactic of shortening the licence concession period is an interesting one. For although the operator’s do not have to pay a cent, they risk seeing their asset being devalued if they do not address the QoS issues. Other regulators who have addressed QoS issues over the last three years include Senegal’s ARTP, Ghana’s NCA and Nigeria’s NCC. In both Nigeria and Senegal, quality of service (particularly network congestion and outages) has been a national debate. Some have been more successful in calling operators to order, whilst others have talked tough but made little impact. Contrast Nigeria where NCC lead a very public campaign to improve quality followed by fines with Ghana where NCA talked tough about fines but never followed through. In the case of the latter, talking to operators behind closed doors has had little impact on the country’s chronic congestion, particularly on the MTN network. Five years ago a senior manager of a mobile operator explained to me how investment tended to follow increases in customers rather than the other way round. Whilst things have undoubtedly changed since that point, 2010 is a tight year for raising CAPEX. MTN’s promotion aimed at encouraging users to make less use of congested cell sites was innovative but is no substitute for having enough capacity. But if only it was as simple as spending enough money to put in capacity to meet peak voice demand. With operators now seeking to become Internet operators with 3G and all the other acronyms above it, they are taking narrow pipe networks that were never designed for data and trying to retrofit them to deliver. Globally mobile operators both want to encourage data use to combat falling ARPUs but ration it so that their underpowered networks are not overwhelmed. African mobile operators are not so different but they have adopted different strategies. Operators like Safaricom and MTN have sought to separate out their data flows by creating separate Wi-MAX networks for data. The solution being discussed in Europe is femtocells where the equivalent of a mini-base station is put in the user’s house. However, another relatively costly CPE is likely to play less well in cash-tight African markets. So here’s the dilemma for the mobile operators: do they really want to become both voice and data operators, offering bandwidth heavy applications like Triple Play? Or is data just a tactical side-bet they’ve been forced into to stay ahead? Many of the major operators are building large fibre networks in their major markets which mirror their competitors’ investments. Not everyone can be a winner out of this game if national backbone charges come down under pressure from new low international fibre charges which arrived in East Africa in 2009 and will come to West Africa this year. Whilst 3G modems are undoubtedly better than many of Africa’s over-contended Wi-Fi hot-spots, Africa’s mobile operators have yet to prove that they can create reliable Internet access with good QoS. Without this guarantee, mobile Internet runs the risk of becoming the substitute alternative rather than the service of choice. Unfortunately, with honourable exceptions, Africa’s mobile operators have yet to demonstrate that they can deliver increasingly improving services for both voice and data. Correction: Issue 486: Former Rwandatel CEO Wanted Over Missing Funds Rwandatel Management has no case against former CEO. On Tuesday December 22 2009, The New Times published an article entitled “Former Rwandatel CEO wanted over missing funds”. The article was written by Ignatius SSUNA and Eugene MUTARA and claimed that Rwandatel, Rwanda National Police and Interpol are all tight lipped about this case. The Management of Rwandatel SA would like to refute these baseless claims alleging that the company has presented a case to court against Mr. Kariningufu regarding an amount of money that has gone missing. Rwandatel SA would like to bring to your attention and to your readers that while it is factual that Mr. Kariningufu Patrick is no longer an employee of Lap Green, neither Lap Green nor its Rwandan telecom company, Rwandatel SA, of which he was first Chief Technical Officer and later Chief Executive Officer for years has brought any case against him in the courts of law in Rwanda or beyond. Management has not given any details “of the case” simply because there is no case. We would like to recommend that going forward answers to all pertinent questions or clarifications surrounding any story be sought before any article is published. We would appreciate if all our media partners doing their research would contact Rwandatel officials or other competent authorities for comment before going out with such defamatory stories. We take this opportunity to recognize all members of the press corps who continue to respect the duties entrusted to them by the public and continue to go out of their way to establish the truth.

Hi, Now that the country has gone digital broadcast and there are additional free frequencies its time we considered a dedicated technology channel. In the interim we can also take advantage of the operationalised Media Bill that requires that all content on the airwaves must contain 60% local content which means that the media houses will soon be shopping for locally produced programming. Therefore if we produced a local show covering ICT issues we should be able to have a mouth piece for the industry. In addition sessions like the one on the ICTPark by Dr. Ndemo could have been easily aired live and therefore reach all without the need for them to travel. Lets think about this. Hi, The death of the City Council of Nairobi Councilor might have been averted if we had a better managed emergency service 999 or 911. It seems the police on patrol where told that the car had been stolen but they where not informed if the owner had been taken hostage. We need to have the control room manned by well trained personnel and a logging system implemented so that when such cases are being investigated it is easier to know where the information breakdown occurred. Reminds me of a game we used to play in primary school called "broken telephone". I can walk into a bank in Westlands, and be served yet my account is held in Bondo. I am not saying that the sector is perfect, but there are lessons we can take. The same should be happening with government services. The government should take services to the people. This will spur development in areas far from Nairobi, all over the country. Back to the question at hand, i believe an ICT park is one of those things that dont need to be in Nairobi. We cant have everything in Nairobi. The more things we locate in Nairobi, the more people come to Nairobi, the more congested the city becomes. Nairobi is not Kenya. Regards, Tito.

Dr Ndemo, The following is an excerpt for a paper I wrote on the impact of the arrival of sub-marine fibre in East Africa(http://www.gg.rhul.ac.uk/ict4d/workingpapers/Gathero.doc). In it I suggest we adopt consultant Booz Allen Hamilton's six levers for successful development of an ICT park strategy for Kenya. ______________________ ICT Parks Kenya's BPO sector cannot succeed without a critical mass of companies at least a handful of which must be of significant size (000s of employees). The Government can fast-track an environment conducive to ICT sector growth by fostering ICT parks - one or more buildings in which there is a full range of services including reliable electrical power, high speed lines, cabling, physical security and so on. GoK has undertaken the creation of one such park in Athi River. Building is expected to commence in July. The park will occupy about 5000 acres of land and is expected to employ over 10,000 people. While a positive undertaking, the park should be considered as part of an overall strategy. Consultant firm Booz Allen Hamilton has reviewed the learning from global experiences and suggests six main levers for the successful development of ICT parks:[1] <outbind://20/#_ftn1> * Purpose - This element must be articulated up front as it directly impacts the physical environment, regulatory and legal context, economic focus, level of integration to the national economy, etc. To illustrate, parks can focus on objectives dealing with ICT sector development, attraction of foreign investments and/or retention of domestic investments, and incubation of new business. The purpose of the Athi River Park should be clearly articulated. * Value Proposition - Central to the success of an ICT park is the definition and enactment of a legal and regulatory framework, provision of adequate infrastructure and facilities, availability of support services, overall quality of life, and location, to name a few. Importantly, the offering of communication-related services such as voice and data telecommunications, managed data services, and media broadcast all play a key role in shaping the value proposition. It would be good to get a blueprint of the park widely circulated showing advantages of businesses being housed there. The government can also make it easy for local or foreign firms to set up operations for example by giving tax incentives to companies, domestic and foreign operating in the park. * Location - The efficiency, effectiveness, and resulting lifestyle in these parks are important attributes. As a result, ICT parks tend to be located in dedicated areas outside the main city and within a short driving distance. They also tend to be located within a short driving distance from the airport as well as prominent universities. This clearly suits Athi River as a choice location with its distance from Nairobi, Daystar University and Jomo Kenyatta International Airport. Last but not least, Booz Allen suggests the park dedicates 30%-50% of their space to green areas with the objective to create a distinctive and attractive environment. * Partnership - ICT parks require close links to academic institutions, real estate developers, venture capitals and financial institutions, investment promotion agencies, and national government agencies involved in the ICT sector. To illustrate, and building on the learning of the broader experience of technology parks, nearly 50% of such developments are pursued within university-related premises. It would be prudent for the government to initiate such partnerships in this early stage. * Funding - ICT parks can be funded primarily through the private sector (e.g., real estate developers, private investors/placement) and government agencies if required. They are self-sustainable financially and can generate attractive returns. In this regard GoK should seek to enter Private Public Partnerships to ensure that there is private sector buy-in. * Competitive Positioning - ICT parks can define their competitive positioning along three dimensions. Firstly, they need a differentiated positioning vis-à-vis other comparable developments within the same region (e.g., within the Arabian Peninsula, such as the Dubai Media city). Secondly, they need to offer distinctive benefits at a national level, in particular when considering that 50% of the tenants could represent already established institutions. Thirdly, ICT parks can be defined as part of a regional network of parks. Such a 'constellation' of parks aims to create cross-border synergies and complementary products, services, and strengths. The concept of 'constellation' is already into play at a national level with developments such as the Smart Villages in Egypt having planned presences in Giza (Cairo), Mansoura (Cairo), and Alexandria. The Athi River Park should therefore not be seen in isolation but as part of a constellation of parks. Is Kenya Really Going Digital and Open?

Bwana Ndemo, I trust this finds you well in the new year. Today, I patriotically sent someone to the Ministry of Tourism to pick a promotional DVD, Video or other digital products on Kenya for use in an event that will include foreigners so as to portray Kenya in good light thinking I'm being the good Kenyan that we should all be. The librarian asked to speak to me and told me that I must first "write a letter" to the Ministry formally requesting the materials!, then it has to be discussed with the boss and a formal approval given before I can get a copy, which she has. I could not believe my ears! Are we back to the snail mail era where you receive no reply? What will become of your efforts on local content? how about access to information (which in this case is surely far from secret!). They proudly pay CNN millions of dollars to advertise Kenya, while Kenyans making an effort to promote their country, for free, have no access to the materials!! Could you advice me how best I can access the materials I need! Edith

Traffic Management using helicopters

Hi, It is interesting how the Nairobi PPO feels that the solution to the traffic problems can be resolved by having a police helicopter circulating to get a bigger picture on the traffic. Again another half baked idea, can we push for KDN to be given the contract to provide cameras and a monitoring center for the traffic police instead of having us depreciate a multi-million helicopter. Here is yet another opportunity to develop the local ICT industry, lets make sure we do not loose this chance. We missed the NSE and CDSC board but at least we got the CBK project. I had Prof Ongeri say that there will be a stakeholders meeting at KIE soon when he was announcing KCPE results and that the forum would be used to air such views, i guess this would form a nice memorandum, Akich you should be present this in that meeting how i wish Musau Ndunda (hope i spelt the name right was on this list). We have e-learning experts in this country and it is a question of tapping their expertise, the major stumbling bloc is the willingness and priority of our leadership to prioritise the matter, Hon Engineer Rege, maybe the Parliamentary commitee can help out here, what do you say? The Centre for Development Informatics at the University of Manchester is seeking high-quality PhD and DBA candidates to research topics on ICTs/information systems and socio-economic development. Listers, I was going through an article in the East African standard with the above mentioned title by the CEO of KIXP published on Sunday Dec 2009 in the East African Standard, am wondering is there a business case other than the security considerations highlighted that justifies the GIXP and if we could be allowed to access it or is it classified info?, in addition the writer has mentioned the Strengths of KIXP however i would also appreciate to know the weaknesses since they might justify the need for GIXP bearing in mind the fact that we are just coming out of the woods in so far as monopolies are concerned as i try to digest the article in any case having gone through http://www.bgp4.as/internet-exchanges it is evident there are a few developed countries with more that one Exchange point eg South Africa , the US, Sweden, Singapore, Russia and the UK, somebody educate me. Listers, Looking at the daily Nation on Page 6, i can see the IIEC has embarked on an e-voting project. Having studied the subject, i learnt that the US failed miserably in the 2000 election which it tried to conduct the electronic way, the election was marred by many irregularities, and as a matter of fact some results were nullified by the courts. The only countries that have succeeded in evoting to an extent are Brazil and India and this is because a Multi stakeholder approach was used to ensure there was voter trust and willingness to use the system, already one of the bidders is crying foul at tendering stage,is this an indicator of more trouble to come. What are your thoughts, this is a matter of National importance if the events of 2007 are anything to go by? -- Barrack O. Distinguished listers, I have read through the comments and still feel it is not yet time to celebrate, what we have simply done in the year 2009 is to build buses (Policies, Infrastructure , Strategies) however Kenyans are still walking on foot and hurting their toes as a result since they havent seen the difference this buses will make in their lives. Many gains have been made but they still don't resonate with the common man for instance *why are accidents still maiming Kenyans whereas we can use ICT's to curb them significantly through* CCTV's and other technologies (refer to Kwa Zulu Natal SA), *why is the corruption index still high whereas we can use ICT's to significantly reduce* *corruption*, *why is access to treatment a challenge whereas telemedicine is a reality,* *why is education expensive whereas e-learning is a reality* we continue to witness Petty fights among stakeholders whereas there are *REAL* issues that must be addressed we need to shun this culture and cooperate if we are to achieve more, if ICT cannot contribute to Socio-economic liberation, *then it is not worth it,* for those who were hitting hard continue with the same spirit mediocrity should not be tolerated, for the Peacemakers, be blessed in the year 2010 and continue with that spirit. -- Barrack O. customer service commitments from service providers

After the announcement of KCPE results on 29th , I and I believe many other Kenyans sent sms's through 2228 to get the results without success . for each sums I sent I discharged my obligation and was charged ksh20 to get service. After 5hrs I got responses from 2 sms's but for all the other sms, I never got a response and I have not been refunded the money deducted . Some customer service issues arise; - 1) when is a service deemed to have been rendered by a service provider? Can a service provider delay a response for 5 hrs and claim to have provided a service? - 2)my contract for cellular service is to Safaricom who charged me for all the sms I sent, when I called the customer service I was told the failure belonged to a service provider contracted by KNEC and could I call them. I declined to call them because I have no contractual relations with them. What is the obligation of the cellular operator when they charge on behalf of a third party who does not provide the service? - 3) Examination results by there scale provide the best platform to show that the ICT system have come of age. KCPE was a great platform, KCSE is just round the corner , what went wrong and what strategies are being put in place to avoid such terrible failures in future? Cheers Muriuki Mureithi

The solutions exists. I briefly listened to a panel on KTN/NTV the morning the results were being released and they seemed to have the solutions. The panel was composed of education experts and people who have researched (and written papers) in the problems plaguing our educational system. The panel said the issue is implementation. If we start going into this implementation issue we will open a can of worms. @ 2010 ICT Hall of Fame

Distinguished listers Ladies and Gentlemen Happy New Year ! I woke up this morning singing the National Anthem and i want to imagine it will be a great year for this Nation, in particular the words "May we dwell in Unity Peace and Liberty", really tickled my consience. That aside, i attended last years annual ICT awards organised by the Computer Society of Kenya, during the function , the ICT hall of fame was introduced and Messrs George Okado, Engineer James Rege, Njeri Rionge and the Late Dr Juma Aketch were honored, however i noticed a number of eminent persons in the ICT sector and listers were absent for whatever reasons and as a result this brethren (Permit me to use this terminology because of my faith) were not given due recognition. On another note i saw Mr Atwoli making a declaration on TV that some athletes should be given state commendation and it happened, i was surprised because there are men and women who have transformed this nation through technology and have inspired many yet they have not received this state commendation, i need correction if i am wrong. My request is that by the end of this year we need to see names like Michael Joseph MBS, Njeri Rinoge MBS, George Okado, Alex Gakuru, Dr Ndemo, Walu if this means collecting one million signatures then we should start now. this will inspire many Kenyans who are still in school. Let us put aside all sectarian interests an unite in celebrating our very own achievers as opposed to doing them as sideshows which makes the events look ordinary Blessings -- Barrack O. Friends/Colleagues, On recent comments on the role of government, I have this to say: I think it should be an enabler through creation and enforcement (regulation) of policies intended towards desired outcomes. We also need good laws, a sound justice system (fair and speedy) to deal with disputes; the people need to be aware of their roles, rights and the need to challenge their potential. Our education system has this "pass points" at which the majority fall off and the system forgets about them. Past instances of gutting polytechnics to give way for universities have done great injustice to the education system and many young people in the country. ----- Finally, on the issue of roads and accidents; looks like we take a step forward and several back. Zachary This was the great opportunity for the ict system to prove its value to our society. It failed miserably to just serve less than 1 percent of the population and had to walk to schools. Despite the digitisation of exam results by the Kenya National Examinations Council (KNEC) and the Ministry of Education, the platform doesn't seem to be working. My daughter is one of the candidates who sat KCPE in November 2009. But more than two hours after the release of the results by Education minister Sam Ongeri, the KNEC website from where the candidates are supposed to check their results remains down. Worse still, the 2228 no. to which candidates should text their index numbers to get results is also not working but continues to consume airtime to the tune of Ksh 20 per SMS. I have read through the comments and still feel it is not yet time to celebrate, what we have simply done in the year 2009 is to build buses (Policies, Infrastructure , Strategies) however Kenyans are still walking on foot and hurting their toes as a result since they havent seen the difference this buses will make in their lives. Many gains have been made but they still don't resonate with the common man for instance *why are accidents still maiming Kenyans whereas we can use ICT's to curb them significantly through* CCTV's and other technologies (refer to Kwa Zulu Natal SA), *why is the corruption index still high whereas we can use ICT's to significantly reduce* *corruption*, *why is access to treatment a challenge whereas telemedicine is a reality,* *why is education expensive whereas e-learning is a reality* we continue to witness Petty fights among stakeholders whereas there are *REAL* issues that must be addressed we need to shun this culture and cooperate if we are to achieve more, if ICT cannot contribute to Socio-economic liberation, *then it is not worth it,* for those who were hitting hard continue with the same spirit mediocrity should not be tolerated, for the Peacemakers, be blessed in the year 2010 and continue with that spirit. Hi The year 2009 came in fast and furious - am sure you still remember KCA amendment and the dust it blew on 2nd Jan 2009 ---- Yes the year is going and shortly will be history. In that history - we , the ICT community , and of course the kictanet community has participated in the writing( or is it reading) that history . in 2009 we recognised convergence, brought in electronic transactions framework , more importantly more bandwidth than we know how to use it and took a major step to show Africa the way towards digital broadcasting , coordination efforts in international fora e.g. IGF, ICANN and on and on-----. A lot or this was conceived , discussed , killed , resurrected , critiqued , on the kictanet platform. The greatest value of the list is the perspective of the vigorous participation on the list or off the list . from a very high level government perspective in govt led by PS Dr Ndemo , ICT industry captains led by their CEOs, regulators , techies , policy makers , the media , consultants, the academia, consumer experts, students, development partners , users etc . Once again KICTANET list lived to its promise - a platform to talk /share even if we do not necessary agree. The message coming out is Kenya is on the verge of take-off in 2010- we expect to see more in BPO industry , more activity on local content both in the internet and broadcasting , more effort to bridge the digital divide in our rural areas and of course realisation of the promise of much much cheaper bandwidth to the consumer and of course a very successful ICANN in March 2010 With such activity in 2009 it was only appropriate to close the year with a visit of one Sir Tim Berners-Lee the inventor of the www. We are moving, KICTANET's new year resolution is to bring the inventor of the internet here early in 2010 With that context this is to wish you much love, light and merriment over the festive celebrations ahead! May you thoroughly enjoy yourself, and feel the love, bounty, joy and abundance that is who you are! May you also find time to be at peace with yourself in stillness, and to reflect and experience more of the beauty of your heart.
