Hi, I believe my cooling out session is over for instigating for Dr. Ndemo to give is a presentation and my failing to attend Being an astute planner I had taken into account the possibility of not being able to attend the session which is why I proposed that this historic presentation for recorded for posterity and to use against Dr. Ndemo if he ever decided to run for higher office. My suggestion that we contribute a token amount, 500/-, towards the hosting was short down and a free model was adopted all because of our entitlement mentality and over reliance on donors. This resulted in those who did not make it to the session miss the opportunity to listen to what was articulated as the "free" recording seems to have come to naught. There is a saying that goes "there is nothing like a free lunch", I hope the next time we shall avoid the free model. It's not that I haven't had a gas of a good time on the Internet. I've met great people and even caught a hacker or two. But today, I'm uneasy about this most trendy and oversold community. Visionaries see a future of telecommuting workers, interactive libraries and multimedia classrooms. They speak of electronic town meetings and virtual communities. Commerce and business will shift from offices and malls to networks and modems. And the freedom of digital networks will make government more democratic. Baloney. Do our computer pundits lack all common sense? The truth in no online database will replace your daily newspaper, no CD-ROM can take the place of a competent teacher and no computer network will change the way government works. Consider today's online world. The Usenet, a worldwide bulletin board, allows anyone to post messages across the nation. Your word gets out, leapfrogging editors and publishers. Every voice can be heard cheaply and instantly. The result? Every voice is heard. The cacophany more closely resembles citizens band radio, complete with handles, harrasment, and anonymous threats. When most everyone shouts, few listen. How about electronic publishing? Try reading a book on disc. At best, it's an unpleasant chore: the myopic glow of a clunky computer replaces the friendly pages of a book. And you can't tote that laptop to the beach. Yet Nicholas Negroponte, director of the MIT Media Lab, predicts that we'll soon buy books and newspapers straight over the Intenet. Uh, sure. What the Internet hucksters won't tell you is tht the Internet is one big ocean of unedited data, without any pretense of completeness. Lacking editors, reviewers or critics, the Internet has become a wasteland of unfiltered data. You don't know what to ignore and what's worth reading. Logged onto the World Wide Web, I hunt for the date of the Battle of Trafalgar. Hundreds of files show up, and it takes 15 minutes to unravel them--one's a biography written by an eighth grader, the second is a computer game that doesn't work and the third is an image of a London monument. None answers my question, and my search is periodically interrupted by messages like, "Too many connectios, try again later." Won't the Internet be useful in governing? Internet addicts clamor for government reports. But when Andy Spano ran for county executive in Westchester County, N.Y., he put every press release and position paper onto a bulletin board. In that affluent county, with plenty of computer companies, how many voters logged in? Fewer than 30. Not a good omen. Point and click: Then there are those pushing computers into schools. We're told that multimedia will make schoolwork easy and fun. Students will happily learn from animated characters while taught by expertly tailored software.Who needs teachers when you've got computer-aided education? Bah. These expensive toys are difficult to use in classrooms and require extensive teacher training. Sure, kids love videogames--but think of your own experience: can you recall even one educational filmstrip of decades past? I'll bet you remember the two or three great teachers who made a difference in your life. Then there's cyberbusiness. We're promised instant catalog shopping--just point and click for great deals. We'll order airline tickets over the network, make restaurant reservations and negotiate sales contracts. Stores will become obselete. So how come my local mall does more business in an afternoon than the entire Internet handles in a month? Even if there were a trustworthy way to send money over the Internet--which there isn't--the network is missing a most essential ingredient of capitalism: salespeople. What's missing from this electronic wonderland? Human contact. Discount the fawning techno-burble about virtual communities. Computers and networks isolate us from one another. A network chat line is a limp substitute for meeting friends over coffee. No interactive multimedia display comes close to the excitement of a live concert. And who'd prefer cybersex to the real thing? While the Internet beckons brightly, seductively flashing an icon of knowledge-as-power, this nonplace lures us to surrender our time on earth. A poor substitute it is, this virtual reality where frustration is legion and where--in the holy names of Education and Progress--important aspects of human interactions are relentlessly devalued. During the first phase, the economists will survey published studies and resources that describe the potential impacts of new gTLD introduction; examine theoretical arguments about benefits and costs of increased gTLDs; consider and propose empirical studies to identify areas where additional work can serve to assess costs and benefits. The EASSy has landed! Landing partner Telkom's ring around Africa

Landing partner Telkom's ring around Africa The East African Submarine Cable System (EASSy) - one of the nine undersea telecommunications cables that will connect various parts of Sub-Saharan Africa to the rest of the world by 2011 - will land at Mtunzini, on the northern KwaZulu-Natal coastline, tomorrow. Telkom is the South African landing partner for EASSy. In all, there are nine EASSy landing stations in Sudan, Djibouti, Somalia, Kenya, Tanzania, Comoros, Madagascar, Mozambique and South Africa, with shore-end landings already having occurred in Mozambique and Sudan. "EASSy is one of the elements of Telkom's cable investment strategy and is a key step towards the process of establishing a Telkom fibre ring capability around Africa," said Alphonzo Samuels, Telkom's Managing Executive for Wholesale Services. He added: "EASSy further increases the robustness of Telkom's international bandwidth offerings and portfolio. Together with other undersea cables and/or land based fibre routes, EASSy creates redundant fibre access prospects into East Africa." EASSy is a 10 000 km undersea cable system currently being constructed along the east African coastline. Its 1.4 Tbps system design capacity, coupled with its two fibre-pair configuration, equips EASSy with the highest capacity of all undersea cable systems along the east coast of Africa. Interconnection with various other undersea international cable systems will enable traffic on EASSy to seamlessly connect to Europe, North and South America, the Middle East and Asia, thereby enhancing the east coast of Africa's connectivity into the global telecommunications network. "EASSy is routed from South Africa to Sudan, linking the coastal countries of East Africa. An extensive backhaul system linking landlocked countries to the coastal countries has been developed and is at various stages of completion," stated Samuels, adding that EASSy is scheduled to be ready for commercial service from August this year. Samuels explained that submarine cables held many benefits such as superior transmission quality, considerably lesser delays compared to satellite, high transmission capacity, access to the global optical fibre network, lower unit costs (compared to satellite), no electromagnetic interference and higher resistance against adverse weather conditions. "However, activities such as fishing and anchoring, ocean drilling, fish bites and earthquakes constituted some of the commonly known submarine cable hazards," cautioned Samuels. Various initiatives were nevertheless undertaken to protect submarine cables. These included conducting ocean bed surveys to select the safest undersea routes; burying cable in sand where possible, especially at the shallow end; avoiding heavy shipping lanes when approaching landing points; selecting safe beaches, bearing in mind that later beach erosion could expose cables; designing the shortest land cable route for maximum security; and, manufacturing cables to exceed the 25 year design life of the cable system. "Redundancy, protection and - where necessary - restoration are also key considerations," said Samuels. He explained: "Redundancy means that we have duplicated equipment at the cable stations, duplicated power converters, generators, etc. Therefore, if a single piece of equipment should fail, we have another piece of equipment standing by to take its place." Protection ensures that a fully duplicated amount of capacity is available to re-route traffic on the same cable in the event of an internal failure impacting only one path or fibre. Protection therefore implies that for everything that is duplicated, automated switching takes place. Samuels added that restoration required traffic to be routed onto other cable systems via completely different traffic paths and even different routes. "This usually happens when a complete failure of a cable system occurs, usually via an external influence such as a ship's anchor breaking a cable, to the extent that 'in-system' protection on the same system is not possible." He also explained that customers have a choice between the regular international private lease circuits that includes restoration for their bandwidth or a product that excludes restoration, which would be termed non-restorable bandwidth or traffic. "It must be emphasised, though, that in the event of submarine cable service interruptions, every attempt is always made to expedite customer services," emphasised Samuels. Although EASSy will not be commercially active by the time this year's 2010 FIFA World Cup(tm) kicks off in June, Samuels stated that "Telkom's undersea capacity has been significantly upgraded". "For example, by end-October last year, SAT-3 and SAFE were upgraded to at least three times their former capacity." He added that SAT3 provided the shortest route to Europe while SAFE was the shortest link to Asia. From an undersea capacity perspective, therefore, "it's all systems go for the World Cup," emphasised Samuels. As it's investment in EASSy highlighted, Samuels said that Telkom had a robust strategy with regard to undersea cable investments. The Company's cable investments included COLUMBUS3, SEA-ME-WE3 (South East Asia-Middle East-Western Europe), SAT3/WASC/SAFE (South Atlantic Telecommunications / West Africa Submarine Cable /South Africa Far East), EASSy, EIG (Europe India Gateway) and WACS (West Africa Cable System). "Our investments are geared by the participation of other operators and we firmly believe that investment sharing translates to better unit costs and improved customer prices," he added. The Nairobi meeting is scheduled to run from 7-12 March. The biggest issue on the table is a crucial stage in the addition of new top level domains; the vote by the Board on how to handle expressions of interest. But in the last 24 hours, ICANN’s COO, Doug Brent, has published a security warning <http://nbo.icann.org/meetings/security-information-11feb10-en.htm> that may result in the meeting being cancelled. If this happens, it will be a real blow for the Kenyan Internet community. A previously planned meeting in Nairobi was cancelled because of security concerns prompted by election violence a couple of years ago. I thought this was the wrong call at the time, as election violence tends to die down and our meeting wasn’t till several months later. But I didn’t question and don’t envy the people who have to make that decision. An ICANN meeting brings about 1200 people from around the world to a country chosen from host applications about a year in advance. It’s a mix between a trade show and a party conference, with endless parallel sessions, soap-boxing, hallway deal-making and late night drinking. Probably two thirds One third (thanks, Kieren <http://public.icann.org/meeting-participation-data>) of the participants are regulars, and there’s always a ‘back to school’ feeling on the first day as you greet people you’ve not seen in months with an enthusiasm that wears off in about a nanosecond. The dominance of the regulars causes ongoing criticism that the whole travelling circus doesn’t work to get more and different people to take part, and should halt its global peregrinations and stay put in L.A., Frankfurt or Singapore. It’s expensive to take part in person, but however much resources are put into it, the number of remote participants is always disappointing. The in-person meetings have an uneasy mix of lobbyists, volunteers (many of whom are self-styled volunteers and in fact make their living from ICANN activities), beleagured staff members, G-men, NGO types, ccTLD reps, techies, salesmen, and confused-looking locals. Like it or loathe it, the travelling ICANN meeting is a big deal for the local hosts and the Internet community of the country and region it’s in. It’s their moment to come together as a group and strut their stuff on the global stage. The latest security warning about Nairobi concerns a known threat, the possibility of a terrorist attack by Al-Shabaab, a Somalia based Islamist insurgency group. The group has said it will attack if Kenya supports the Somali Transitional Federal Government. The UK Foreign & Commonwealth Office put out a warning <http://www.fco.gov.uk/en/travel-and-living-abroad/travel-advice-by-country/…> in December 2009 that terrorist attacks throughout Kenya remain a high risk, but that only non-essential travel to near the Somali border is to be avoided. Like London, New York or Washington DC, Nairobi functions admirably despite a constant threat of terrorism. However, the US State Department has just issued a specific warning about possible suicide attacks on the Kenyatta Conference Centre where the meeting will be held. It says the individuals planning on carrying out attacks have been living in Somali communities within Kenya since early February. Although the Board just voted a couple of weeks ago to go ahead with the Nairobi meeting despite the more general security concerns, the latest warning has re-opened this tough question. Ultimately, ICANN’s CEO and Chairman must weigh up the risk of bringing over a thousand people to a potential terrorist target. Their decision isn’t simple as that sounds. Chances are, no attacks will happen and the meeting will be a success. But I suspect the maxim ‘if we cancel it, the terrorists have already won’ has a lot more rhetorical than practical weight if you’re the person on whose conscience the safety of hundreds of people will sit. The Nairobi meeting is hugely important to the people directly involved, in a way I’m finding hard to articulate. As well as the official programme, endless meetings and interactions will take place that are very important to the African and indeed the global Internet community. The solidarity and awareness of what it takes to keep the Internet going in different parts of the world grows from talking and sitting side by side for hours in endless technical workshops and council meetings. It can’t be got any other way. Or put it another way, if the meeting gets moved to ICANN’s home base in Los Angeles, lots of people who would have come won’t be able to. Not least because of visa problems. If ICANN Nairobi has to be cancelled, the loss in the Internet community’s regional momentum and global amity will be great. Over the years, I’ve heard a lot of carping – from mostly American community members, I have to admit – about ICANN going to high-crime places like Sao Paolo, Delhi or Mexico City. In my experience, the non-Americans in the Internet community are markedly sanguine about visiting visiting poor and potentially dangerous places. When we cancelled Nairobi last time round, the Kenyans had to more or less button their anger and disappointment to stay in the game. But it’s infuriating to be told by people you work with that they can’t possibly risk themselves in a city you live in year round. However, there is a qualitative difference between visiting a city with a lot of crime against property and one where you may be a live target. As a nonprofit with a public interest mission and a healthy contingency fund, relocating the meeting will hurt ICANN, but not mortally. I’m sure as I write that the meetings team is triggering its contingency plans to hold the meeting elsewhere if needed. It can be done. I just hope it doesn’t have to be, and that more information about the security threat means fore-warned is fore-armed. Already, a couple of companies have pulled their people regardless. That’s their choice. This time it has more bite than the usual xenophobia: the COO has published <http://nbo.icann.org/meetings/security-information-11feb10-en.htm> a US Department of State report that lists the conference centre itself as a specific threat from a Somalian insurgency group, Al-Shabaab <http://en.wikipedia.org/wiki/Harakat_al-Shabaab_Mujahideen>. In response, a number of Internet companies have already announced they are pulling their people. The Kenya conference was cancelled last year following election violence, and the meeting this year has been under a constant review – with the Board finally deciding the bite the bullet at a meeting <http://www.icann.org/en/minutes/minutes-22jan10-en.htm> on 22 January (my heart, incidentally, goes out to my former colleagues in the meetings team who have a near-impossible job of preparing for over 1,000 attendees at short notice). Now there is fresh discussion about whether to go ahead with the meeting – due to start on 7 March. Maria Farrell has written an interesting post <http://crookedtimber.org/2010/02/12/14645/> giving some background (although, I feel the need to point out that the attendees at ICANN meetings are: one third regulars; one third occasional; one third entirely new – my analysis online here <http://public.icann.org/meeting-participation-data>). So I thought I’d write a post pointing out how this bad news can be turned around to be positive for the organization. *If the meeting goes ahead…* It is a terrific opportunity for ICANN to really work on remote participation since large numbers of ICANNers will not be physically attending. This fact has not been missed (thank god) by the Board’s Public Participation Committee <http://www.icann.org/en/committees/participation/>, which has been pushing for participation guides at its past <http://www.icann.org/en/minutes/minutes-ppc-27jan10-en.htm> two <http://www.icann.org/en/minutes/minutes-ppc-13jan10-en.htm> meetings. I am delighted to see this approach, especially since it was a main recommendation <http://kierenmccarthy.com/2009/12/01/public-participation-my-icann-leaving-…> of mine in my leaving report <http://kierenmccarthy.com/2009/12/01/public-participation-my-icann-leaving-…> as general manager of public participation. Most of the tools for effective remote participation are already in place. What is missing are the cultural and procedural guidelines to make the most of them. With lots of people unlikely to attend, this is an ideal opportunity for ICANN to step up a notch and start making remote participation a functional reality. *If the meeting is cancelled…* Then I sincerely hope that the Board decides to simply cancel the event and reinvest the $2 million it costs to run an ICANN meeting (or as much as it can recoup) into events that focus people’s attention on the issues that need to be tackled. There are only really two things of importance that the Nairobi meeting is going to cover: the Expressions of Interest model for new Internet extensions (whether people have to pre-apply for their gTLD); and the registry/registrar separation issue (the rules surrounding the split between those who sell domains and those who run the Internet registry itself). The Board is going to make the decision regarding the Expressions of Interest. And it has lots of comment <http://forum.icann.org/lists/draft-eoi-model/> from the community following a very active public comment period. I’d like to see the Board meet physically somewhere else (Los Angeles?) for a week and really tackle the issue and do what it needs to do – make a decision. The community has had its say, having another meeting on the issue is only chewing up valuable time. And wrt registry/registrar separation – well, it seems that there is work being done on that by the Board, as made clear in the latest Board minutes (item k) <http://www.icann.org/en/minutes/minutes-04feb10-en.htm#k>. So why not have the staff focus on producing the work the Board has asked for, and then have the Board spend a week discussing and reviewing the issue, coming out with firm recommendations for review – rather than engage in another largely pointless and time-consuming community discussion that is scheduled for Nairobi. The other HUGE advantage to cancelling the whole meeting would be to overcome the status-quo fears of some in the community about moving from three to two international public meetings a year. Over the past four years, first Susan Crawford (ex-Board member and former advisor to President Obama), then Paul Levins (ex-VP of Corporate Affairs and the man who negotiated an end to the Joint Project Agreement), and then the Board Public Participation Committee as well as the Head of Meetings have all argued that ICANN should reduce the number of large international meetings the organization runs each year. Having studied this issue closely myself, I have absolutely no doubt that reducing the number of international public meetings would benefit both ICANN and the community. All it requires is the community to get over its fear of change. And cancelling the whole meeting will cause minds to focus, and provide some funds to think about what meetings do need to happen to move the organization’s work forward. So, possibly, hopefully, this Nairobi problem will end up a blessing in disguise.

I can think of four reasons why cable vandalism would occur: 1. Malicious – cable theft: The thief benefits primarily from reselling the metal (is fibre ever resold/). 2. Malicious – corporate sabotage: The thief’s organization will benefit from the service woes of a competitor. 3. Benign – construction work: Someone digging a foundation, trench or similar inadvertently severs a cable. 4. Benign – accident: An unforeseeable event occurs that damages the cable. I don’t have data about the breakdown of the incidences into these four categories. I believe we need to collect real data first before prescribing a solution. However here are my thoughts about how we should address each of these if the incidence warrants it. 1. Cable theft: This is petty thievery; we already have enough statutes in our books to address the perpetrators. The recent ban on the export of scrap metal may have helped – the decline in copper prices may have helped more but prices have been recovering. 2. Corporate sabotage: We need a level competitive playing field and if there is corporate sanctioned sabotage against competitors then the perpetrating company should have some real sanctions including imprisonment for guilty executives and possibly even the loss of their licenses. Telkom in recent press reports seems to be strongly alluding that this is what is going on. 3. Construction work: In Connecticut, (and many other parts of the US), it is the law to call a hotline 48-hours before digging. A joint effort by all the utilities & municipalities in the state (water, electricity, telecoms, sewerage, gas etc) is responsible for coming out to your site and marking where the underground utilities are buried. (There is a call centre to field the calls!) Failure to do so has real consequences on the contractor if there is damage to utilities. 4. Accidents: Nothing we can do here. I am shaking my head in disbelief at the suggestion that any of these (that does not result in death or injury) may even be construed to be a capital crime. *Erasing our innovation deficit* By Eric Schmidt Tuesday, February 9, 2010; 10:14 AM We can see it reflected in our search trends at Google: Too many people are out of work, and the fear of unemployment is changing the behavior of millions more. In the fall, searches related to back-to-school shopping and holiday travel bookings peaked weeks later than usual, as families put off spending as long as possible. At the same time, queries for payday loans have gone up a third in the past two years. To spur job creation and alleviate the fear of unemployment, the United States will need to tackle what Commerce Secretary Gary Locke has called our "innovation deficit<http://www.commerce.gov/NewsRoom/SecretarySpeeches/PROD01_008778>." We have been world leaders in innovation for generations. It has driven our economy, employment growth and our rising prosperity. But much of the cutting-edge research and development in key areas such as renewable energy now takes place outside the United States. There's a real chance that the "green Silicon Valley" will take root in Germany or China. We can't afford to let that happen. Addressing the innovation deficit requires rethinking our innovation model. We can no longer rely on the top-down approach of the 20th century, when big investments in the military and NASA spun off to the wider economy. Now that the Internet has put abundant information and powerful tools in everyone's hands, innovation is often driven from the bottom up. The ideas that power our next generation of growth are just as likely to originate in a coffee shop as in the laboratory of a big corporation. More than ever, innovation is disruptive and messy. It can't be controlled or predicted. The only way to ensure it can flourish is to create the best possible environment -- and then get out of the way. It's a question of learning to live with a mess. First, start-ups and smaller businesses must be able to compete on equal terms with their larger rivals. They don't need favors, just a level playing field. Congress should ensure that every bill it passes promotes competition over protecting the interests of incumbents. Second, encouraging risk-taking means tolerating failure -- provided we learn from it. If we want to be a leader in new industries such as green energy, we have to accept that some of our investments won't pan out. Show me a program with a 100 percent success rate, and I'll show you one with 0 percent innovation. Third, we need to invest more in our knowledge base. The decision by Congress to double science funding last year was a big step in the right direction. Now we need to extend the R&D tax credit so businesses can confidently invest in their future. It might have asserted full U.S. governmental control, or it might have turned over the functions to an international body such as the International Telecommunications Union. Instead, it created a "private-public partnership", incorporated as a California "nonprofit public benefit corporation", with a charter giving the company a dual mission of quasi-governmental functions combined with responsibility for operational stability of the Internet. In all its deliberations, the ICANN Board must maintain a balance in its mission of lessening the burdens of government and promoting the global public interest in the operational stability of the Internet. ICANN has the responsibility to draw the fine line dividing two contrasting areas, one where it should not go, and the other where it risks not doing enough. On the one hand, ICANN cannot become involved in areas such as content control and rule making in areas unrelated to operational stability. On the other hand, ICANN's self image as technical coordinator has at times constrained it from taking action necessary to discharge its public interest obligations, such as, for example, requiring registrars to comply with their contractual obligations. ICANN's recent attempts to find a way to insert new top level domains in the root zone file illustrate the difficulties of achieving this balance. From a purely technical point of view, there is room for many additional new gTLDs in ASCII and in IDN.IDN versions. There are concerns about stress on the root zone, but it appears that this is a manageable risk, and ICANN is taking responsible steps to deal with it. On the other hand, the whole question of how new generic top level domains would serve the public interest has never been openly considered by ICANN. The current proposal for an Expression of Interest proceeding illustrates this. Instead of being a straightforward determination of who might want to apply, the proceeding risks becoming an avenue for well-financed commercial applicants who treat the domain name system as a species of investment opportunity comparable to real estate. This is a far cry from the public interest in making names available to people who want to use them. The proposals for selection of new top level domains present even more serious problems. There will very likely be multiple applicants for some popular strings, and ICANN has the job of selecting from among the competitors. There will also likely be applicants for strings that are obscenities or phrases intended to inflame social or religious conflict. >From the standpoint of ICANN's obligation to serve the "global public interest in the operational stability of the Internet", ICANN cannot allow these into the root. In addition, there is the continuing problem of minimizing trademark infringement opportunities. For better or worse, the United States government demanded in 1998 that ICANN become the enforcer of a global system of trademark rights. This quasi-governmental function, in the form of the UDRP, became part of the otherwise more technical duties assigned to ICANN. The extension of this involvement with trademarks is possibly the most serious test of ICANN's abilities to promote the public interest. ICANN's Draft Application Guidebook (the "DAG") for new gTLDs attempts to find the appropriate mechanisms for taking into account the sometimes conflicting responsibilities described above. The first and second drafts, issued in October 2008 and February 2009, respectively, were not successful in many respects. These drafts demonstrate, all too clearly, ICANN's reluctance to face its public interest responsibilities. ICANN proposes to create a system of independent decision makers to decide such questions as likelihood of confusion between different proposed strings for new gTLDs, alleged infringement of legal rights by a proposed string, and objections based on morality, public order and community objections. Of these, the first and second are probably amenable to objective determinations based on internationally recognized principles of trademark law, although there are serious questions as to how far ICANN should go in creating what amounts to international law. As to the questions of morality, public order and community objections to applications for new gTLDs, these can only be tested against conceptions of the public interest. ICANN apparently believes that getting a third party to do this work relieves ICANN of its responsibilities. There are two problems with this approach. First, there is nothing to indicate that any third party has either the expertise or authority to make these judgments better than ICANN, and second, ICANN's mission to serve the public interest does not allow it to delegate its responsibilities to outsiders. Further, ICANN apparently hopes that its self-serving requirement that all gTLD applicants waive all legal claims against ICANN will insulate it from litigation. ICANN is certainly justified in its fear of litigation. As a creature of California law and subject to US federal law, this risk is always present. However, attempts to pass off to third parties ICANN's obligations to make judgments about the public interest will not lessen this risk, and may in fact increase it. The waiver of legal claims applies only to applicants for new TLDs, not to third parties that may be adversely affected by the process. As another example of ICANN's failure to face up to its responsibilities, ICANN proposes to create independent evaluation panels to choose from among conflicting applicants for the same new gTLD string. The call for expressions of interest states that evaluators must be capable of exercising subjective judgment. ICANN may have a legitimate need to consult with outside experts, but they cannot be allowed to make the final decisions. There are no grounds for a belief that a third party's subjective judgment would give better results than decisions made by ICANN's Board. The Board clearly must face up to its responsibility to make judgments in the public interest, based on the experience and expertise of the Board members. To ICANN's credit, it finally realized that there is a connection between the creation of large numbers of new gTLDs and the public interest in preventing a vast increase in cybersquatting and the spread of fraudulent practices. The first two drafts of the DAG neglected to deal this issue in any serious way, but since then ICANN has taken steps "to develop and propose solutions to the over-arching issue of trademark protection..." It is still an open question whether or not ICANN's current proposals will be adequate to serve the public interest in protection of the legitimate rights of trademark owners. ICANN has not been so successful in dealing with other overarching issues. In October, 2006, ICANN's Board asked that a comprehensive economic study be completed before the introduction of new gTLDs, but it was never made. Instead, ICANN produced economic studies that purport to justify its proposals for a radical change in the policy of separation of registry and registrar functions. Whether or not this change will serve the public interest will apparently be judged by the results of the experiment, and not by a considered weighing of relevant evidence. Even when ICANN grasps the concept of its public interest responsibility, it does not always come up with a reasonable approach to a particular problem. For example, the current proposed base agreement for new registries includes a provision allowing ICANN to amend the agreement unilaterally. While there may be a need from time to time to take account of changing circumstances, this brute force approach can hardly be justified as serving the public interest in a stable relationship between ICANN and the new registries. Despite the concerns outlined here, ICANN has done most of the right things it was created to do and it continues to deserve our support. It is very unlikely that a single government or international organization could better fulfill the obligations undertaken by ICANN. However, a lot of work remains to be done, and ICANN must pay a great deal more attention to its global public interest responsibilities.

Unfortunately, all the efforts to understand the vice focus on the cyber crime against property and against governments. The only other notable effort against the person is against the child. While cyberspace have provided secure tools and spaces where women can enjoy their freedom of expression, information and privacy of communication, the same benefits of anonymity and privacy also extend to those who employ ICTs for criminal activities and use the internet to commit violence against women. The use of mobile phones and internet to stalk, abuse, traffic, intimidate and humiliate women is palpable in developing countries including Kenya. The lack of specific cybercrime/cyber security legislation makes it even more difficult to punish those who use ICTs tools to conduct violence against women. Kenya Communications (Amendment) Act 2009 focused on the cybercrime against property and not the person. Kenya is not alone but that is not a consolation. With increased use of internet in Kenya with the onset of broadband, it is necessary to create the necessary policy / regulatory and the operational framework to reign in the vice. KICTANET and IDRC has launched a study on the vice whose research questions are: 1. What is the prevalence of cybercrime against women in terms of degree, level, quantity, and distribution? 2. How does cyber crime affect women differently? (Demonstrate spiral effect and determine if women are already intimidated by cyber space e.g. mailing lists, how active do women participate in debates? Is the design of the cyber already woman unfriendly?) 3. What are the current measures and gaps (technological, legal, social, and psychological) to address cyber crime against women (local, regional, and global)? Map the efforts (lessons of best practice). 4. What mechanisms are appropriate for addressing cyber crime against women? The initiative builds on work in this area undertaken by APC and its member organizations in the last few years. An important part of building the Action research network is to build stronger relationships with others who are active in the field, to exchange information and build collective knowledge and work towards common actions. To this end, we would be interested to learn about work your organisation is doing in this area. We are particularly interested in initiatives in the following areas, in the context of ICTs & Environmental Sustainability: - policy advocacy - environmentally-sustainable computing practices - use of ICTs for awareness raising and education about ICTS and environmental sustainability - use of ICTs in climate change (CCH) mitigation - e-waste disposal and CCH The outcomes of our research and activities will be made available to all who are interested. If your initiatives cover other areas where ICTs play an important role in environmental sustainability and climate change (or dealing with it), do let us know as well. Another wasted bumper harvest

Hi, Yet again we suffer from a lack of information, farmers are pouring milk because the dairies cannot handle the increased volume and on another front maize is rotting in the shambas because NCPB do not have money to buy the maize due to an unexpected bumper harvest. I could understand the increased milk production as it could have been sudden but how is it that we did not realise, in good time, that there will be a bumper maize harvest. Well, application developers can we get out an application that can help the government and millers be better prepared for a good or bad harvest or are we waiting for 3G connectivity or a 3rd fibre optic cable to land before we can role out such a product. Even Joseph had a prediction system that saved Egypt from extinction yet he did not have a high speed Internet link nor a 3G mobile phone and definitely not an IPAD. Lets apply ourselves to solving this basic issues instead of lamenting about a lack of 3G infrastructure, this is a challenge to the strathmore, IFC and other incubeter initiatives as well. I believe that self- criticism is symptomatic of defeatism, however that which is done in moderation is healthy. In due regard I would urge my colleagues to make do with that which is available to the maximum. Optimal resource utilization would go a long way in rooting out existent problems e.g. improved revenue collection by the city council of Nairobi. More over I would reiterate by borrowing a leaf from a former US statesman who ranted , “do not ask what your country can do for you rather ,what you can do for it” end quote. The Tigers(Malaysia etc) made progress by developing customized local solutions adaptable to their contexts. Thus this case studies serve as a motivation that not all is impossible. Last but not least not all is lost as Obama deftly put it , “YES YOU CAN.”These produce could be sold in the wider COMESA market , all you need to do is provide effective structures and let the laws of demand and supply manifest.
