Ms Kroes will make clear European views on ICANN's capacity to reform. In particular, Ms Kroes will raise ICANN's responsiveness to governments raising public policy concerns in the ICANN Governmental Advisory Council [Committee] (GAC) , the transparency and accountability of ICANN's internal corporate governance and the handling of country-code Top Level Domains for its most concerned public authorities. In April, Kroes asked Strickling's boss, Commerce Secretary Gary Locke, to put a hold <http://domainincite.com/europe-did-ask-the-us-to-delay-xxx/> on the addition of .xxx to the domain name system root until the GAC had chance to discuss it further. Strickling declined <http://domainincite.com/did-europe-ask-america-to-block-xxx/>, saying that for the US to take unilateral action over the root would provide ammunition to its critics in the international community. The US and EC are two of the most active and vocal participants in the GAC -- at least in public. Whatever conclusions Strickling and Kroes come to tomorrow are likely to form the basis of the GAC's short-term strategy as negotiations about new TLDs continue. ICANN's board is scheduled to meet with the GAC on May 20, for an attempt to come to some final conclusions about the new gTLD program, particularly in relation to trademark protection. ICANN wants to approve the program's Applicant Guidebook on June 20, but is likely to face resistance from governments, especially the US. Arusha to host continental conference on cyber crime By Lusekelo Philemon 9th May 2011 Arusha is set to host the second Africa forensic conference to be held from May 24 to 26 this year with a special focus on efforts being made to curb the problem in the East African region. Organisers of the forum have said that the meeting would address cyber-related crimes by providing forensic accounting skills to corporate officials, anti-corruption watchdogs, police auditors, accountants and high-ranked officials. Briefing reporters here on Saturday, International Coordinator and Representative for Africa of the Forensic Certified Public Accountants Sosthenes Bichanga said the forum would be convened in response to increasing on-line crimes in the continent. He said that in recent years, Africa experienced unprecedented growth of science and technology; as a result unscrupulous people apply new technology in stealing money from public or private institutions. He explained that cases of fraud and cyber-crime had been costing East African countries billions of dollars, but the rackets remain shrouded in secrecy because the affected companies prefer to suffer in silence, 'safeguarding' their reputations. “With improving security measures, racketeers no longer use weapons or other physical means to conduct their transgressions. The trend now is shifting from this form of tangible crime to brain-driven or virtual ones,” he said. According to the expert, Nigeria is a leading country for initiating cyber-crime schemes that had been causing huge monetary losses from local companies, corporate institutions, banks and individuals in especially the East African region. “Our recent research estimates that over 6 per cent of the total annual income and revenue collection by an organisation which does not take the fight against fraud, cyber-crime or corruption is lost. Some of these institutions make billions of money,” he said, adding that the combined loss suffered by the East African member states may add up to 30 per cent of their total losses which spells economic disaster for the region. The related virtual crimes include online schemes as carried out mostly by Nigerians, dubious accounting computer and internet anchored cyber-crime through automatic teller machines (ATM). Bichanga further disclosed that in Kenya alone it has been discovered that a single bank would lose Ksh 25 million (about 350 million/-) per year, just through ATM fraudsters. The expert added that a similar case applies to other financial institutions around East Africa, but they all keep mum trying to safeguard their reputations. “Every day there seems to be another major headline about fraudulent schemes, scandals, corruption schemes, civil litigation, disputes in divorce and corporate turmoil. As a result, there’s never been a bigger demand for forensic accounting skills,” said James Anyoka, coordinator of the forthcoming forum. My ISP has issues with their IP ranges more because of having a wide open smtp server, what recourse do I have with them when they do not resolve the issue? Something for the *real* "consumer" to celebrate ;-) .... --------------- By MARK OKUTTAH 27 April, 2011 Safaricom and Telkom Kenya have lost their bid to stop the reduction of mobile telephony interconnection charges in June, setting the stage for a further fall in calling rates. Interconnection charge —which operators pay rival networks for handling their calls—is set to drop from Sh2.21 per minute to Sh1.44 in July and Sh1.25 in July 2012, giving the operators room to further reduce their per minute voice charges. In February, Telkom Kenya and Safaricom asked the government to put on hold for two years the annual reduction of interconnection charges that started in 2006, arguing that it would intensify the ongoing price war and hurt the operators’ profits, jeopardise job security and slow new investments in the local telecom arena. This prompted the Prime Minister’s office to form a task force that will determine whether to hold off revising the charges or let the revisal run as earlier set by the Communications Commission of Kenya (CCK). The taskforce returned a verdict that charges should run their course. “*Nothing has changed and mobile termination rates were done through consultation and they shall remain as such,*” said Charles Njoroge, Director-General, CCK. He added that the downward fall in the connection charges does imply that calling rates will fall adding that tariffs are mainly influenced by market forces. The government’s verdict is a blow to Telkom Kenya—the operators of the Orange network—and Safaricom who, unlike their rivals Airtel and Essar, have criticised the free fall in airtime prices, made possible by the fall in interconnection charges. The charges dropped to Sh2.21 in July from Sh4.42 in July 2009, giving Airtel room to set off a vicious price war in Kenya’s voice market that has seen tariffs fall by more than 50 per cent since August, cutting subscribers’ monthly budget for airtime by half. The interconnection charge has come down from Sh6.28 in July 2007 to Sh2.21 last July and was set to drop to Sh1.44 this year and Sh0.99 in 2013. The reduction of the interconnection fee was informed by the need to reduce the cost of calls across networks, which had remained as high as Sh25 in 2007, compared to Sh12 for calls within the same network. A total of 37 applicants have been approved. For this first round, the 37 applicants represent 37 constituencies and 24 counties across Kenya. Family Bank received 689 applications out of a total of 800 inquiries made. The 37 approved applicants have demonstrated various business ideas within their proposed Pasha centres ranging from; youth training, e-library services, website development, government services facilitation, teacher training, KCPE and KCSE online registrations, software development to name a few. The revolving fund will be disbursed as a loan by Family Bank, repayable over a three (3) year periodwith a 3 months grace period, but will have a flexible repayment period and below-market rate of interest – to a maximum of 10.5%. The loan applicant will be required to finance at least 10% of the business while the revolving fund will finance a maximum of 90% of the investment. The breakdown of the successful applicants is as follows: •Less than Kshs 1 M, 13 applicants •Between Kshs 1 and less than 2M, 16 applicants •From Kshs 2M – 3 M 8 applicants The objective of these loans is to enable prospective entrepreneurs to obtain access to credit which might not be available to them via existing micro–credit systems. The Pasha project falls under the Kenya ICT Board’s digital inclusion pillar which aims to increase access to ICTs by citizens across Kenya. It complements the other Kenya ICT Board agenda to stimulate job and wealth creation in ICT through entrepreneurship and is in line with Kenya’s Vision 2030. *Africa-Europe research collaboration to be transformed by EC-funded research infrastructure* *Boost for African research as European Commission injects €14.75M into regional research and education connectivity* * * *Gaborone, Botswana, and Cambridge, UK, 11 May 2011:* DANTE, the international research network operator, and the European Commission’s EuropeAid Cooperation Office today announce the signature of a €14.75M contract for support to a sub-Saharan African intra-regional research networking infrastructure which is already interconnected to the pan-European research network, GÉANT. Eighty percent of the project’s funding will come from the European Commission’s EuropeAid Co-operation Office, and the remainder will be contributed by the African partners in the project. The contract represents a significant injection of capital to develop research networking infrastructure across sub-Saharan Africa and with Europe. The initiative will dramatically accelerate the development of the Information Society in Africa, providing advanced data communications infrastructure and enabling African researchers to collaborate more easily in advanced international research projects. Within the framework of the Africa Caribbean Pacific Islands (ACP) programme, the AfricaConnect project will establish a high-capacity Internet network for research and education in Southern and Eastern Africa to provide the region with a gateway to global research collaboration, the objective of which is to overcome the current limitations of international research collaboration within sub-Saharan Africa and towards Europe, and to foster research and education collaboration and advancement within and between these regions. The project will be strongly collaborative, so whilst DANTE will coordinate AfricaConnect, they will be partnered by DANTE’s regional counterpart organisations in Africa – UbuntuNet Alliance covering Eastern and Southern Africa, and WACREN covering Western and Central Africa – as well as the Association of African Universities; existing National Research and Education Networks (NRENs) in Africa (DRC, Ethiopia, Kenya, Malawi, Mozambique, Namibia, Rwanda, Somalia, Sudan, South Africa, Tanzania, Uganda and Zambia); and several European NRENs (Germany, Ireland, Italy, the Netherlands, Portugal and the UK). All will work to ensure that the project benefits all of sub-Saharan Africa. “We are delighted to see this project underway,” said Cathrin Stöver, DANTE’s International Relations Manager. “DANTE has a strong history of supporting regional connectivity including actions in South America and Asia, and we will build on this experience to support African research and education networks as together they transform the research environment in Africa. Listers, I've been breaking in my new Safcom IDEOS phone and just found that I can't download/install Skype on it, due to Safcom blocking it! I understand they don't want to lose voice revenue to Skype (now Microsoft apparently), but won't they make money on the data charges if I am passing VOIP packets across their network? Anyway, I think it rude that they sell me "Internet access", but then don't give me access to the full internet!! Has anybody gotten around this restriction by using another providers SIM? During a hearing before Judiciary’s Intellectual Property, Competition, and the Internet Subcommittee, the Internet Corporation for Assigned Names and Numbers (better known as ICANN) said its proposal would pave the way for hundreds or even thousands of additional suffixes, resulting in more choices and innovation. But critics suggest that ICANN, a non-profit based in California, would reap a financial windfall at the expense of companies and non-profits that would be forced to “defensively” register their websites with the new suffixes to protect their trademarks. “I would ask that we balance the costs and benefits of this proposal before a final decision is made to go forward,” said Subcommittee Chairman *Bob Goodlatte*, R-Va., who joined members from both parties in urging ICANN to delay final implementation until concerns about trademark infringement, identity theft, and increased business sector costs can be adequately resolved. While he doesn’t oppose a limited expansion of Internet suffixes, the specifics of ICANN’s approach are troubling to him, he said.** With Goodlatte and other hearing participants projecting that ICANN could earn tens of millions of dollars in additional fees, Rep. *Maxine Waters*, D-Calif., asked: “Where will all this new money end up?*”* Kurt Pritz, senior VP of stakeholder relations at ICANN, said strong safeguards would be in place to protect trademarks, including the ability of parties to object to the adoption of new suffixes. He said ICANN would constantly evolve its plan in an effort to respond to concerns that might arise. But Goodlatte challenged him on those points, noting that ICANN has not taken any preemptive steps to ensure that “legitimate businesses” and non-profits such as the Red Cross and the U.S. Olympic Committee would not be victimized as a result of the changes. @Andrea, in a sense it would be "nice to know" - nice to know to avoid Ngong Road at 6pm because of errant cops....nice to know that I just need abt half a mil to get a murder charge dropped :-) No but seriously....even if there is no action...at least there will be growing indications of how big the problem is....and if Kenyans can be sensitised about this...then the action can start with them...to avoid the pitfalls, to start taking pictures and recordings knowing that there IS a place to take this - even if KACC or the police do nothing, it puts to shame those doing it. @Norman - that site, yes, based on Ushahidi - but the premise I think was wrong and its mainly traffic and road related. And most of the info it collects is overt (except the police bribes) - the rest of the issues we either know about or are not really measurably relevant (eg reckless driving can be on a short stretch of Mpaka Road (electric avenue) at 3am...or it can be from Kangemi all the way to Westlands by a bus... - how does knowing that help? Shared Services Masterplan Finalized

Listers The Kenya ICT Board would like to announce the finalization and handover of the Shared Services Masterplan for government of Kenya. Indeed Ministry of Finance has already commenced the re-engineering and redeployment of the Integrated Financial Management System (IFMIS). The 6 volume masterplana documents were handed over to PS Ndemo, Permanent Secretary Ministry of Information and Communications and Sam Mwale, Principal Administrative Secretary Cabinet Office, by Accenture's Jessica Long and Victor Kyalo Director of Infrastructure and Projects Kenya ICT Board. The handover took place in the presence of a private and public sector guests at Panafaric Hotel on May 3rd 2011. The lead consultants Accenture Development Partners have worked with the Kenya ICT Board, and Egovernment Directorate for over a year on this project. The eventual aim is to create a world class government back-end system for Human Resources, Financial Management, IT Collaboration and email. Directorate of egovernment and the respective shared services agencies now move into the execution phase. KRA & Postal

Hi, Yesterday I went to the post office to clear a parcel that had been sent from the US, after inspection by the KRA officer the charges due to KRA where calculated at Kes. 1,130/-. I promptly dipped into my pocket and retrieved the cash but alas I was informed that payment could only be made at a Co-Op or National Bank branch. Well, off I went to the bank, cutting a short story shorter one and a half hours later I was back at the post office to collect the parcel. What is so difficult with KRA having the cash collected at the post office or even better why can't they make it possible for one to pay them using mobile money? This seems a lot like another of those salient schemes to have politically correct organisations make money at the expense of convenience. If KPLC and many other organisations are comfortable with Postal collecting cash for them why does KRA not have the same level of confidence. I hope someone out there will forward my sentiments to the powers that be to resolve this issue. Liko, this might be a good opportunity for PesaPal to expand its reach. Hi, I was reading through the CIO May issue and came across and interesting article on the roll out of metro fibre optic cable in South Africa. i3 Africa is rolling out their national fibre optic cable through the sewerage system, this should increase the cost of hiring vandals to sabotage the competitors network, this could be a new revenue stream for our local authorities. Alice you raise a critical issue about digital disparity while Bwana Ndemo points to convergence of all ICT medium to allow all to participate including via sms which can help reduce this disparity. The greatest challenge is to converge all media and also incorporate multilingual capability...people must be able to express themselves in the langauge they are comfortable in. So I join Bwana Ndemo in challenging the techies to come up with a fully converged mulitlingual platform that will mobilize ALL Kenyans to fight graft! and demand for governance reforms and monitor implementation of Agenda 4. As social media enables participation access, collaboration and even transparency and has great potential to enhance governance processes by way of facilitating participation from broad based stakeholders/constituencies. Some of the features can be used/applied to many aspects of governance, including feedback on anti corruption initiatives, maintaining participation, direct involvement in policy processes, deliberations, etc. However, there are some fundamental limitations we must keep in mind and deal with. To begin with, the disparity in internet access with social media services still reflects an education and/or class bias. Additionally, folks tend to join most networks as a means to an end, for example joining some lists knowing that they are more likely to get the ear of the service provider and/or government and this over reliance would in the long run ends up undermining efforts that require commitment and follow through, for those who have been members of this list will bear witness to this particularly when it comes to policy processes. So are social networks the magic bullet to participation? I also tend to think that social media sites have not really been developed for governance in the way we may be thinking, for example face book has a person cap, further, most of these sites were designed in ways to encourage participation to serve advertising revenue so perhaps we would need our very talented developers/skunks etc to begin to think about developing Social media platforms suited to our governance, anti corruption etc needs. We already have some companies (e.g. www.gotissuez.com<http://www.gotissuez.com>) who report on such matters (corruption, poor service etc). We additionally have social media monitoring platforms that would be able to get random information on twitter about certain topics (e.g. you can monitor what people say about brand X or brand Y), many companies are already this sort of thing in place as it offers feedback on both the negative and positive aspects (many times, what is being done right is ignored). Additionally, consistent feedback that there is a problem in a particular area will point the anti corruption agencies in the right direction. Many companies use this information to monitor brand equity and customer complaints. It's just an issue of doing the same thing for the government... FOR IMMEDIATE RELEASETUESDAY MAY 3RD 2011 PRESS STATEMENT BY SAFARICOM ON MOBILE NUMBER PORTABILITY It has been about one month since the Kenyan mobile telephony market started implementing Mobile Number Portability (MNP) and as we embark on the second month of implementing this important process, we as telecom industry leaders wish to make a number of pertinent observations. 1. We wish to thank industry regulator Communications Commission of Kenya (CCK) for its patience and professionalism in handling the implementation of MNP thus far. Even where there have been teething problems, as was widely expected, the CCK has shown leadership through its consultative approach to seeking solutions. A good example of this is the regular troubleshooting meetings held between the CCK, industry players and Porting Access who are the administrators of the process. In addition and following publicized complaints about the technical hitches affecting the uptake of MNP, the CCK initiated an audit process between Safaricom, Bharti-Airtel and Porting Access to establish the cause of SMS failures to the Porting Access data base. We appeal to the CCK to resist all attempts by some operators to derail the on-going audit process by engaging in media side-shows and to complete this crucial exercise and to make its findings public. 2. We remind the public that MNP was implemented in Kenya after a single week of technical testing. This is against a global benchmark of at least 6 to 8 weeks of testing time necessary to guarantee the robustness of all inter-linking systems and dependencies. Naturally, the numerous teething problems we are seeing now were to be expected. As late as this morning, we have received communication from Porting Access BV that they were having technical challenges based on what they cite to be unstable connectivity from their end, which challenges are affecting the ability of ALL operators in the Kenyan space to successfully implement some of the day to day actions related to the MNP process. 3. We are disturbed by a certain emerging trend in the implementation of MNP in Kenya so far, which we feel constrained to bring to the public attention. While it was always understood that the successful implementation of MNP greatly hinges upon the goodwill and mutual co-operation of all operators, the regulator and Porting Access, it is emerging that the actual experience is quite different. Safaricom is inclined to believe, based on available evidence, that Porting Access, which acts as the custodian of the porting database, has abdicated its role as a neutral clearing house for the MNP process in Kenya by actively batting from the corner of a single operator: Bharti-Airtel completely against the letter and spirit of the multi-lateral contract signed between the operators. We strongly object to the impression created, by Bharti-Airtel and indeed by some commission-hunters, that the single measure of the success or otherwise of MNP in Kenya, ishow many subscribers port from other operators to Bharti-Airtel. Anecdotal evidence, which we have gathered and shared with CCK, points to an active collaboration between Bharti-Airtel and Porting Access on the timing and intensity of their attacks against Safaricom. The content and tonality of their messaging since this process began shares more than coincidental similarity. As recently as last week, we are privy to information that on Thursday 28th April both entities used a single venue for separate press conferences within minutes of each other while only one of the parties paid in full for the venue. 4. Safaricom takes great exception to the content of the message which has consistently been published by Porting Access and a certain Mr. Patrick Musimba, who has been speaking on its behalf. Mr. Musimba has taken to making a slew of unsubstantiated allegations against Safaricom and its officials regarding the implementation of MNP, and in the process upending and circumventing the audit process that was agreed to on 26th April 2011 by CCK, Safaricom, Bharti-Airtel and Porting Access. 5. Contrary to the impression that Porting Access are trying to create Safaricom is a Kenyan company, supporting a huge local stakeholder base and social economic ecosystem that includes over 740,000 individual Kenyan shareholders and the Government of Kenya (by extension all Kenyans), it employs over 3,000 direct employees, thousands of dealers and M-PESA agents. We shall do all in our power to protect their interests and the overall reputation of Safaricom which has been painstakingly built over the years. Consequently, Safaricom has today instructed its lawyers to institute legal proceedings against Porting Access and the person of Mr. Musimba for what we believe are acts of defamation and the tort of economic sabotage against Safaricom Limited, this legal action will be vigorously pursued to its logical end. We have also appealed to the CCK to urgently review the role of Porting XS BV of Netherlands and specifically its local partner Porting Access in the administration of MNP as we believe they have lost the moral and legal legitimacy to position themselves as an honest and impartial broker of the porting process. Think HIV is more of a danger to us than churches in Kenya are. Serious churches (and very many do) require HIV tests before marrying people. This started in the 90's when Church Leaders found their members were getting together with others who did not disclose they were HIV infected. In less corrupt churches, HIV Tests became one of the conditions to be fulfilled before performing wedding ceremonies. So it is hard to see how an institution that helps check the spread of HIV can be a danger to Kenyan society. It is easier to hound Sheep instead of Political Wolves who steal Billions from the Kenyan public to finance their election campaigns and to support their close associates/mistresses. Am sure most Churches would cooperate with the Central and County Govts in building databases that would help check a major cause of turmoil in Kenya. Andries Tatane, a community activist and father of two children, was then seen looking down at an apparent rubber bullet wound on his bare chest before collapsing to the ground. He died shortly afterwards. The incident has sparked widespread public outrage and a national debate about the level of force being used by the South African Police Service (SAPS), particularly in the wake of another fatal shooting of an unarmed woman by an officer outside a Johannesburg police station on 26 April. A spokesperson for National Police Commissioner General Bheki Cele told a local radio station that the cases should be treated as "isolated incidents", but many commentators point out that the use of lethal force by the police has risen dramatically in recent years. Figures from the Independent Complaints Directorate (ICD), which is charged with investigating all deaths resulting from police action, show that 568 people were shot dead by the police in 2008/09, more than double the number just three years earlier, and the highest number since the ICD was established in 1997. "The only thing that was an aberration [in Tatane's killing] was that it was captured on national television," said Gareth Newham, head of the Crime and Justice Programme at the Institute for Security Studies, a South Africa-based think-tank. Lack of training In the apartheid era police routinely used violence to quell protests, but with the transition to democracy in 1994, and the incorporation of various human rights in the constitution, police heavy handedness was discouraged. Most demonstrations post-1994 were peaceful and many units specializing in public order policing were closed down, with a resultant loss of skills in dealing with protests, Newham said. In recent years, mounting frustration among the high numbers of black South Africans who continue to live in relative poverty has often erupted in the form of service delivery protests like the one in Meqheleng. Newham noted that police handling of such protests tended to escalate conflict rather than neutralize it. "They think their job is to squash protest, and anyone taking part is seen as the enemy," he told IRIN. "Often they fire tear gas and rubber bullets before there's any real reason to." Sam Motseare, chairperson of Meqheleng Concerned Citizens group, of which Tatane was also a member, was among those who witnessed how quickly relations between protesters and police can disintegrate. "On that fateful day there was lots of police - we were shocked there were so many," he said. The protesters, whose main complaint was that parts of the township had been without running water for several years, had obtained permission to march and proceeded to the municipal offices without incident. "Somebody started throwing stones from the roof of the offices - that's when things starting getting out of control," said Motseare, who said the police did not seem to have appropriate training to deal with the situation. He told IRIN that he heard the police officer in charge give the order to shoot Tatane. "It has broken our trust in the police," he said. "We're afraid to call for another march." Damaging rhetoric Newham and others argue that the escalation in the use of force by the SAPS goes beyond the issue of training. Statements by political and SAPS leaders in recent years urging police to make use of their weapons to deal with criminals have been heard by the ranks. "The subliminal message that has been conveyed to members of the police service... seemed to encourage a gloves-off approach," said David Bruce, a senior researcher at the Centre for the Study of Violence and Reconciliation. "A lot of police management... believe that excessive force is necessary in order to get the job done, which often means turning a blind eye to how force is used." South Africa's high rates of violent crime also mean that many people welcome a tougher stance by the police. Norman Mampane, spokesman of the Police and Prisons Civil Rights Union (POPCRU), criticized a decision in April 2010 to introduce military-style ranks to the SAPS, describing it as "the re-militarization of the police service". "Communities have a right to march and demonstrate," he told IRIN. "The police shouldn't be used to crush the views of protesters and strikers." ICD not part of the solution Within two weeks of Tatane's death eight police officers were arrested on charges of murder and assault, but Newham said it was more common for the police to evade responsibility. The alleged shooting and subsequent death of South African Municipal Workers Union (SAMWU) member Petros Msiza by police during clashes with striking bus workers in Pretoria in March was not captured by cameras and so far no one has been arrested. SAMWU spokesperson Tahir Sema said it was far from the first time union members had experienced violent treatment by police. "We've put together evidence over a number of years," he told IRIN. "We've been calling for some time now for a judicial inquiry, but until we get those in government accepting that levels of police brutality are unacceptable, we won't be able to ensure that police don't clamp down on protesters." Newham supports SAMWU's call for an independent judicial inquiry to investigate the patterns and causes of police using excessive force and make policy recommendations, but doubts it will happen. "It's often seen as politically dangerous to expose findings about the police service to the public, especially in the run-up to elections," he said, referring to municipal elections set for 18 May. Politicians tend to believe it is the ICD's responsibility to deal with police brutality, but the institution lacks either the capacity or the legal clout to do much more than investigate allegations of misconduct, Newham said. Recommendations for disciplinary action were usually ignored. Bruce agreed that the ICD had little power to solve the problem. "Their [the ICD] rate of convictions is almost irrelevant," he told IRIN.
