New US E-PARASITE Act Worrying

By putting out this kind of legislation (especially if it ever passes into law), the US could loose the moral authority to speak against similar legislation being proposed in emerging markets. PROTECT IP Renamed E-PARASITES Act; Would Create The Great Firewall Of Americafrom the *censorship-galore* dept As was unfortunately expected<http://www.techdirt.com/articles/20111025/08343716500/house-trying-to-rush-…>, the House version of PROTECT IP has been released (embedded below) and it's *ridiculously bad*. Despite promises from Rep. Goodlatte, there has been no serious effort to fix the problems of the Senate bill, and it's clear that absolutely no attention was paid to the significant concerns of the tech industry, legal professionals, investors and entrepreneurs. There are no two ways around this simple fact: this is an attempt to build the Great Firewall of America. The bill would require service providers to block access to certain websites, very much contrary to US official positions on censorship and internet freedom, and almost certainly in violation of the First Amendment. Oh, and because PROTECT IP wasn't enough of a misleading and idiotic name, the House has upped the ante. The new bill is called: "the Enforcing and Protecting American Rights Against Sites Intent on Theft and Exploitation Act" or the E-PARASITE Act (though, they also say you can call it the "Stopping Online Piracy Act"). The bill is big, and has a bunch of problems. First off, it *massively* expands the sites that will be covered by the law. The Senate version at least tried to limit the targets of the law (but not the impact of the law) on sites that were "dedicated to infringing activities" with no other significant purposes (already ridiculously broad), the new one just targets "foreign infringing sites" and "has only limited purpose or use other than" infringement. They're also including an "inducement" claim not found elsewhere in US regulations -- and which greatly expands what is meant by inducement. The bill effectively takes what the entertainment industry * wanted* the Supreme Court to say in Grokster (which it did not say) and puts it into US law. In other words, any foreign site declared by the Attorney General to be "inducing" infringement, with a very broad definition of inducing, can now be censored by the US. With no adversarial hearing. Hello, Great Firewall of America. And while defenders of this bill will insist it's only designed to target truly infringing sites, let's just recall a small list of sites and technologies the industry has insisted were all about infringement in the past: the player piano, the radio, the television, the photocopier, the phonograph, cable tv, the vcr, the mp3 player, the DVR, online video hosting sites like YouTube and more. All of these things turned out to be huge boons for the industry. And yet, with a law like this in place, the old industry gets to kill off technologies they don't understand. Scary stuff. And it's not just foreign sites impacted by this law (despite what supporters would have you believe). It appears to expand who would have to take on the entire burdens of enforcing this blacklist -- broadly naming "service providers" as defined in the DMCA. That's significant, because a big part of this bill is to undermine and strip away the safe harbors of the DMCA. The DMCA set up an important balance that gave online service providers freedom from liability if they pulled down content upon notification. This new bill provides a massive and ridiculous burden: allowing the Attorney General to create an internet blacklist that all service providers will need to block access to: *A service provider shall take technically feasible and reasonable measures designed to prevent access by its subscribers located within the United States to the foreign infringing site (or portion thereof) that is subject to the order, including measures designed to prevent the domain name of the foreign infringing site (or portion thereof) from resolving to that domain name’s Internet Protocol address. Such actions shall be taken as expeditiously as possible, but in any case within 5 days after being served with a copy of the order, or within such time as the court may order.* On top of that, the bill says any attempt to get around such blocks can lead to liability. Would this put liability on things like MAFIAAfire? It sure sounds like it: *To ensure compliance with orders issued pursuant to this section, the Attorney General may bring an action for injunctive relief.... against any entity that knowingly and willfully provides or offers to provide a product or service designed or marketed for the circumvention or bypassing of measures described in paragraph (2) and taken in response to a court order issued pursuant to this subsection, to enjoin such entity from interfering with the order by continuing to provide or offer to provide such product or service.* While the text of the bill insists that nothing in it takes away the DMCA's safe harbors, once again this is a claim without the facts to back it up. A large part of the bill is an effective attempt to strip away the DMCA's safe harbors. The only *extraordinarily minor* change against the interests of the entertainment industry is that the bill ever so slightly changes the "private right to action," which allows individual copyright holders to take action under this bill. This was a big problem in the old bill, and the only requirement here is that prior to making use of this private right to action, copyright holders have to provide "notice" to payment processors and ad providers. But then those service providers are expected to take action anyway, or face liability. So all this really does is take the court out of the process, and make it even easier for copyright holders to effectively kill off sites they don't like. Think about this for a second: think how many bogus DMCA takedown notices are sent by copyright holders to take down content they don't like. With this new bill, should it become law, those same copyright holders will be able to cut off advertising and payment processing to such sites. Without court review. And... because this bill wasn't already ridiculously bad enough, it *also* lumps in a House version of the felony streaming bill<http://www.techdirt.com/search.php?q=s.978&eid=&tid=&aid=&searchin=stories> that will make huge swaths of Americans felons for streaming content online. This bill is an abomination and an insult to the Constitution. It's unfortunate that Rep. Lamar Smith thinks this is worth introducing in its current state, and anyone who signs on to co-sponsor is effectively supporting mass censorship of the internet in the US, as well as the criminalization of huge numbers of Americans -- while putting a huge burden on the one part of the economy that actually is creating jobs. Dear listers, Our organization invested in fixed wireless lines as part of a recent office move. We have been struggling to have Telkom convert the lines from pre to post paid and despite having paid the requisite fees - Kshs 10,000 per line, we are still struggling to have this done, almost a month later. They claim they have done it but we have protested it has not been done, since we are the users of the services - a contest of sort of their word against ours. All the contacts we have had, have stopped answering our calls and responding to our emails. Is there anyone from Telkom/Orange on list who would care to respond and have this fixed for us? German high court establishes online libel rules Federal Court of Justice The Federal Court of Justice has ruled that foreign companies can be held liable for content that appears on German websites. It has also set out steps online services need to follow when it comes to libel accusations. The German Federal Court of Justice in Karlsruhe ruled on Tuesday that German law applies in an online libel case involving German-language content posted to Blogspot, a blogging service owned by Google. The court also remanded the question of Google's liability with respect to the libel allegations back to the state court in Hamburg. The decision could have wide-reaching implications for online service providers that operate in Germany. The same court last year ruled the American newspaper The New York Times can be sued in Germany over statements on the newspaper's website if there is a strong connection to the country in an article. In late September, the Karlsruhe court, which is the country's highest criminal court, heard a case argued between an anonymous plaintiff and Google. A German man sued Google over a Blogspot blog entry claiming that he used a business credit card to pay for "sex club bills." The blog was generally about life on the Spanish island of Mallorca, where the plaintiff resided. "Google is pleased that the decision from the Federal Court specified the standards [of] how hosting providers deal with future complaints," wrote Arnd Haller, Google's general counsel for Germany, in a German-language statement sent to Deutsche Welle by e-mail. "The court has confirmed that neutral services like Google are not obligated to pre-check the legality of content stored with a hosting service. There is also not an obligation on the part of Google to be 'on call' for people who feel their rights have been infringed upon to remove statements of fact. In this regard, Google was concerned that such an obligation would be dangerous to freedom of expression and information on the Internet." The Federal Court of Justice has remanded the second part of the case - whether Google is liable for these potentially libelous statements - back to the high court in Hamburg to see if Google followed this procedure. Hi Was hoping someone might be able to help. As some of you on the Kictanet mailing list may know, I am a PhD student at the University of Leeds doing my thesis on the Role of the media in ICT and communications policy processes in Kenya. The problem is that having travelled to Kenya last year, I now realise that I need to conduct further content analysis of The Standard newspaper. While I was there I was able to search through their archive for the dates I had selecteed (2008 and 2009), but now am hoping to search through the archive for 2007 without travelling to Kenya! Does anyone know of any UK based organisations that may keep such an archive? I have tried all the UK libraries, but none of them keep the archive for that year, so am hoping that you might know of another organisation which would keep such copies that I could search through. However, very briefly, let us appreciate that knoledge goes from data to information, then to records, then to knowledge and in some cases to wisdom. This should answer the question as ti weather information can ultimately be converted to knowledge. Secondlly, is the question fir standards. Yes, there are well established standards for records managemenr, irrespective of the formats on is thinking of and also for data conversion and data interchange. So let us not reinvent the wheel. Lastly, records are critical to FOI and so as a country we shall be cheating ourselves ti think that FOI can work wthout RM. And finally finally, whereas information and knowledge are important for various reasons, value is added if the records that evolve out of these are captured into sound RM systems for continuing usabily as evidence as well as both institutional and societal memory. Standards for records management are key to ensuring people DON'T keep records in whatever format they wish!!! What constitutes international best practice standards for records keeping? Does Kenya have this in place? What are the gaps? If Wamukoya and his team could point out the main gaps for the case of Kenya - we can then begin to make progress towards rectifying the situation. I agree with Harry for suggesting a structure face to face with clear action plan for moving forward to correct the problems. Gaitho, "proactive disclosure" may be the way to go for some of these important pieces of information - that may not be classified as "in the interest of national security". For e.g. Canada has proactive disclosure on 1) the travel and hospitality expenses of senior government officials and the legislation requires that these are published on the websites of the corporations; 2) contracts entered into by the Government for amounts over $10,000 (with only limited exceptions such as national security); 3) position reclassifications etc etc. According to Lit, the main areas to consider when dealing with FOI include: * FOI response process/system * Costs of compliance * Time spent processing requests and backlogs * FOI training and awareness for public authorities * Senior management's role * Recordkeeping as key to FOI's success Records management again is KEY! The librarians and archivists and registry clerks will store their records in whatever formats they find most suitable. That is maybe a technical challenge. Some of us are more concerned about Freedom of Information as a basic right. If, for instance, I wanted records from the Communications Commission of Kenya on idle broadcast licenses and frequencies hoarded by briefcase operators, or information from the Dept of Defense on corrupt contract establishing Project Nexus, I should not turned away on ground that I am too thick to make use of the information. I need to verify what KPLC or City Council bill me. I need to compare what my physician charges me. I need the hospital to itemise their billing. This is where we shall have a problem since most of these organization have no idea what the impact of access to information is all a bout. Soon on open data we post school performaces and qualification of teachers. This will help provide better analtics on why some schools or students perform better than others. We simply have to have all the information in digital format. It will be easier to manage the databases and create more software development jobs. Friends Standards that allow data interchange should be a core component of this discussion. On freedom of information and how it is applied in the western world, the basis is that citizens have right of access to information, especially information used to reach decisions that impact the citizenry. It is rooted in the need for transparency and used as a weapon against those that may take advantage of their positions for the benefits of specific interests. Indeed, implied in this is inherent suspicion of government that can become wayward (Nixon in the white house or rogue experiments like Tuskegee, etc) and hence should be held in check. While confidentiality of information is a necessity, especially in matters of national security, courts in the west have been used to strike the balance between a right to know and national interest/security/privacy/etc. One last comment: I read recently an article where the author talks of about factors that would have a competitive edge in the future for nations. The author's conclusion (I cannot find it now) is that those that are able to transform data to knowledge which then informs decisions will be ahead. We have yet to see the commoditization of knowledge as (say) manufacturing and I am not sure we will ever get there; and for reasons that what we infer from a data set is purely based on our own prior knowledge, and the filters we apply to the data. We are on the right cause when we challenge policy and decision makers to ground their work in knowledge derived from experiences and realities. Kenyan Diaspora Conference - a mini report

I had sought some input from the list on what I would raise in my panel whose focus was on the state of ICT in Kenya and associated opportunities of the Diaspora. It was full house given we had 5 people to share one hour, we didn't do much justice to the presenters. We have sent feedback to the organizers (the Kenyan Embassy in Washington DC) to better structure such events in the future. Indeed, it is unfair for people to travel across the Atlantic prepared to speak for one+ hours only to get 5 mins, exactly what happened in all sessions. This conference was, realistically a 4~5 day affair. That said, the event was attended by more than 500 people with close to 200 turned away because of failure to register in time. (And contrary to media reports, President Obama wasn't in the invited list; the embassy had requested presence of the First Lady but her calendar was fully booked, a matter she communicated in time.) The conference was a great networking event; and the energy in the place was palpable! The attendance was higher than we have come to expect of Kenyan conferences and expectations were even higher. Sessions (plenary and breakout) were packed as attendees sought information, ideas, issues, etc on how to get engaged in the country's affairs. And the speakers did superbly. Vision 2030 was at the centre of the presentation and director, Mugo Kibati gave a good update on where the process is at the moment. I must say that many in the Diaspora weren't even aware of such projects as Konza City, the Northern Corridor infrastructure project, the Urban Commuter Rail project in Greater Nairobi, and more. There were update on the reform process, dual citizenship, national integration, and more. Discussions also centred on collaboration (business, academia, etc) between the Diaspora and going beyond remittances (estimated to be $1.7 billion last year) and some companies, notably CIS offering products targeted at the Diaspora market. The scope of companies presenting ranged from ICT, financing, and more. We also had a chance to honour the late Wangari Maathai (RIP); the tributes were moving and if only dead people could speak, she would choose to stay alive and enjoy the glory and adoration accorded her. We heard of success cases spearheaded by the Diaspora, e.g.. the gentleman that influenced GE to locate its headquarters in Nairobi. As indicated, I chaired the ICT panel where, among others Eunice Kariuki represented the ICT Board. Despite time constraints she gave a superb report on what is happening in this sphere and especially the exciting Konza City! (Here presentation is attached). Of interest from the same panel is a presentation (also attached) by Akumu of Intelsat on use of vsat technology to penetrate rural Kenya. In my opening remarks I talked about the $196 billion "unclaimed" BPO market, really a tip of the iceberg of the size of the market, which is approx $500 billion. I have also seen reports that the Kenyan ICT market is approx $700 million annually! And my challenge was to the Diaspora to help ensure this duly benefits the nation. And they can contribute as investors, managers (given all the skills they have acquired), researchers and more. I also cited challenges with our Kenyan market: corruption (the cost of doing business?), infrastructure (remember those traffic jams), unreliable power (what with blackouts), corporate taxes (33%), business registration that takes longer than in many countries, compliance and reporting procedures (too many!); and lengthy dispute resolution. All these act as disincentives to investment and need keen attention from authorities. Finally, my reading is that the Kenyan Renaissance is underway; we position ourselves well and we will take off; we fail to do so and we may not recover. Quality of Tech Support with Kenyan Telcos

Apologies in advance for cross-posting. I'm somehow very appalled at the level of technical support we get from our Telcos. What surprises me is the fact they they have some of the best brains in the market, yet they simply cannot get these brains to address the consumer problems. A simple problem can take you ages to get solved -- unless you go behind the scenes and contact these techies at a personal level. I've come to the point of thinking that either there is too much bureaucracy introduced between the people we talk to (the CSEs) and the engineers who work in the background or the escalation process simply isn't streamlined. The process of getting a solution from the engineers can take ages (to me, a week is ages!). Then again, the Customer-facing teams simply seem to be robots who don't want to try and reason out. Is thinking out of the box not acceptable for CSEs working in these Telcos?? Take one such problem that I'm facing currently with one these Telcos - ORANGE: I bought their much touted 21Mbps modem. The issue at hand is that I need to share the Internet connectivity with other residents of my house via a WiFi router. My router, a D-Link DIR-825, has a USB port that supports a 3G modem. There is one obstacle that I must overcome with the ZTE modem for me to be able to use it with my D-Link router -- I must find a way to disable the virtual CDROM and card reader from the USB stick/modem. The problem is no technician at ORANGE knows how to do this. Probably there is a technician (I have a feeling Orange must have gotten ZTE to train some technicians, or in the daftest form, ZTE must have seconded some techies to Orange!) but it's not possible to reach him/her/them! My router already works with the Safaricom's Huawei E1820, because I was able to go-ogle and find the AT Command to use to disable the virtual CDROM (AT^U2DIAG=0 does the disabling; AT^U2DIAG=1 re-enables it if I need to), which then enabled my router to recognize the USB modem. Fortunately, after installing the drivers on a computer, I really do not require the virtual CDROM interface anymore. I have not been able to find an equivalent command for ZTE-MF192 USB stick and has called Orange Customer Support (Data+Internet) so many times and they simply don't have a clue as to what I am asking for. I'd have thought they are trained to know that some clients are more demanding than others and as such they are allowed to go the extra mile and reason outside the box to help such customers. I am not sure if I am expecting too much, but because I paid money to get this modem, I'd expect Orange to help me in any way that I'd like to use the modem. They still make their money by allowing me to use it. What I don't seem to be able to wrap my head around is why there is no technician at Orange (whether native or Chinese) who can help me with this problem? Aren't we supposed to expect a better quality support from these Telcos than we are getting now?? I started by generalizing on "Telcos". I have only detailed my problem with Orange, but such problems are not exclusive to Orange. Harry The right is worded in a way that guarantees every citizen access to information held by the state - in most cases it is the state that holds certan infromation like on census or statistics. The State has a monopoly in some cases - for example commissions and Inquiries - which historically in Kenya, the state has at times witheld the findings of such commissions. The right extends to getting information held by another person, which is useful for a person to exercise his/her fundamental rights and freedoms. I am sure there are other views out there. Washington, you make an important point about freedom of expression/speech not being absolute, and Cleophas affirms your point. Thanks Kerubo for the definitions. Yes, freedom of information simply means the freedom to get certain basic information held by the state, which can enable one to for example bring a case of human rights violation or any other cause. Freedom of expression can mean many things, say freedom to air your ideas, take a stand, artistic creativity--simply freedom to express how you feel. And of course as Washington and Cleophas rightly point out, all these freedoms are subject to limitations and therefore not carte blanche. When we were there a man came and introduced himself as mwaura just after we had finalised the deal and advised us instead of putting the alarms we should instead install a tracking device on the vehicle. He further advised us that we should not go to the well established offices that they would charge high prices for the tracking device. We took his number and told him that we would get back to him as he was offering to install a tracking device at only 12,000/= shillings. He even gave us directions to where we can get him at Ngara. We decided to shop other companies to find out the truth and found out they charge 25000/= to 35000/= for the tracking device. We decided that since these companies were expensive we should go for Mwauras tracking devices as they offer more features. My husband called Mwaura the following day and decided to install a tracking device from him although he had no office and i guess no papers to do the work. We reached at Ngara where he installed a tracking device and showed my husband how to track using his phone he even accepted 6000/= as down payment the rest were to pay in 30 days. We were satisfied knowing that our car was safe and knew we had gotten the best bargain....ok back to our story we reached juja farm around 5.30 pm as we had stopped at a club called By pass in for some meat. We started viewing our land interviewing people to know the current value of our land. We were so happy as we had bought the land for 30,000/= in 2002 and now the land was valued at 350,000/=. We hadn't been here for some time so we stayed for some time. As we were viewing other pieces of land in the area my husband told me that some men who passed us looked familiar but we ignored. We finished our business and decided to head back home as it was getting late. We started our journey back home and as we were going thru that dirty road so as to join the high way our car suddenly stopped. We wondered why it happened as it was quarter tank and the car had been serviced. When it stopped my husband opened the bonnet to check what was wrong. On opening the bonnet the car with three men stopped besides us and pointed the gun to my husband. I was about to scream when all over sudden the second man pointed a knife at me. I kept quite and the two men ordered as in the car. One man used his phone to start the car and all of us drove off. I guess someone with the codes stopped the car. At the time i just held my baby close to me as one man was busy molesting me. My husband had been bundled in the boot. We drove for what seemed to be eternity to a secluded place where the thieves stopped. The thieves opened the bonnet and removed a tracking device right in front of my face. It's like they had all the information on the tracking gadget. They stripped us and one of the thugs tied us together and they went with our baby. This was after they raped me for a few minutes. We were left there for some time .my husband was unconscious by then as they had beaten him. We stayed there the whole night and in the morning a passerby rescued us. We were rushed to thika district hospital after which we ended up in Kenyatta as my husband had major injuries. I was the first to be discharged and started looking for our baby. Fortunately we found her at a police station abandoned having been brought by a Good Samaritan. My husband was discharged two weeks later, we are now recuperating. We went to the police station and on trying to reach mwaura his mteja all this time we have never found our car despite reporting to the police. The investigation are ongoing and cant divulge a lot of info now but What i have been told is that there is a cartel of thugs installing tracking devices in ngara and hurlingam, ngong road e.t.c. . What i can't understand is who is licensing people to start tracking as the other day my friend told me a colleague where she work buys tracking devices and install in people cars. I thought this is a security issue and the government should vet tracking companies. I was told they are supposed to be vetted by cck but who goes around checking. MWAURAS COMPANY WAS CALLED SIMBA TRACK does cck know of such a company or any security agency If any tom dick hurry can order units from china and install in our car how safe are we . This is a security issue and should be treated with the seriousness it deserves I BLAME THE GOVERMENT FOR NOT PROTECTING ME . I BLAME THE GOVERMENT FOR RAPING ME AND I BLAME THE GOVERMENT FOR LETTING THUGS DUISGUSE THEMSELF AND STEAL FROM US. Does it mean security business are not vetted and all this individuals should be known i.e banks HOPE NOBODY EVER SUFFER THIS FATE JUST BE CAREFUL WHICH COMPANY INSTALLS THE TRACKING UNITS OR OFFERS SECURIITY THEY MAY BE THE THIEVES I want answers and Kenyans need protection -- May the Living God prosper Hundred Fold SHG in this world and finally grant us to live with Him for eternity.

Urban farming under irrigation

Hi, Walking in Westlands yesterday I came across an ingenious person who was taping storm water to irrigate his patch of vegetables on the road side. Lead poisoning apart., its an industrious Kenyan. This reminded me of a project in Brazil where the poor living in highrise dwellings where encouraged to put up window ledge planters in which they planted tomatoes utilising the households waste water. The project reduced the the diseases caused by lack of vitamin C. The farming going on on this road side and the one recently publicised in the media in Ruai are a clear sign that Kenyans have the will and the drive all they need is to be enabled. Regards

On the contrary Daktari. I am speaking from experience having taught, and then worked, with editing graduates. It is possible to work very very hard on something you are not sure about, or not comfortable with, and get the same result. I do agree that there are some jobs that if you work very hard and with the right attitude and achieve phenomenal results. However, Daktari it is not the same with editing. I have worked with a very studious young editor but he just did not have an eye for copy-editing as hard as he worked. I finally found the best position for him within the company where he wrote the initial articles (he did a great job by the way though mixed his tenses quite a bit& misused punctuation a lot). MJ had passion for what he did combined with hard work. This young man had the same but he just could not 'sing' (edit) like MJ even with a lot of practice. He tried so hard but he could not be the last eye in the editorial process. In the long run, everyone was happy. There is room for different levels of editors in the editorial process but we have to be careful in the hiring process to get those with the potential/capacity to fit in this process. Dear Listers The review of the Tandaa Digital Content Grant is now over. We are proud to announce the shortlisted candidates. We received excellent projects this year and the consensus of the reviewers is that there is no shortage of good ideas in Kenya. We know that many applicants to the Tandaa Digital Content Grant will be disappointed when they do not see their name on the shortlist. We received over 700 proposals and had to narrow them down to just 150. It was a very difficult task for the reviewers. Listers, Many of us may have missed the front page news in the nation newspapers yesterday given the flurry of activities at the IGF. This idea poses many questions - is this the way to go? What are the implications? etc etc. Coming at the time when Kenya is hosting the IGF begs for a debate and deep reflection as a country. Can we have a public debate on this and inform the draft bill? The public hardly has the opportunity to debate bills that make their way to parliament (despite the new constitution enshrining this as a requirement - or is it a right?). I indeed hope this time it will be different given the over 20 million mobile users in Kenya - they have a stake in this. Look forward to reactions. Edith

On Declining English grammar in our Newsprint

I am wondering whether there isn't a deeper problem of which shoddy editing work is a symptom. Can't we say the same of many other sectors? Dr Ndemo mentioned hiring practices and I wonder whether this isn't practiced almost across the board, including ICT. Our roads crumble almost as soon as they are built; and we have been training engineers since independence. Look at collapsing buildings. At least a misspelled word may not mean life and death. I could name many, many others like these. Yet we tolerate it; we still but newspapers with shoddy language; and the companies make money. What's the incentive for them to improve? Why pay costly editing services when you are making money anyway? And those roads: we still drive along them, mumbling and life goes on; and (indeed) we may even cheer those shoddy workers with loot coming from their short cuts! Kijana wa fulani ametengeneza pesa! As long as consumers tolerate shoddy work, shoddy work will be the order of the day. And the more this happens the lower our standards go! MJ had passion for what he did combined with hard work. This young man had the same but he just could not 'sing' (edit) like MJ even with a lot of practice. He tried so hard but he could not be the last eye in the editorial process. In the long run, everyone was happy. There is room for different levels of editors in the editorial process but we have to be careful in the hiring process to get those with the potential/capacity to fit in this process. On the contrary Daktari. I am speaking from experience having taught, and then worked, with editing graduates. It is possible to work very very hard on something you are not sure about, or not comfortable with, and get the same result. I do agree that there are some jobs that if you work very hard and with the right attitude and achieve phenomenal results. However, Daktari it is not the same with editing. I have worked with a very studious young editor but he just did not have an eye for copy-editing as hard as he worked. Gaitho, I also agree that some of those who grumble may not have the requisite qualifications. Some are also afraid to apply for jobs. He does not know what his peers, young Kenyans, are doing developing programmes and applications and creating jobs? These must be the kind of fellows who forever grumble about discrimination and corruption in the job market, but show no initiative on how they can apply their training and skills to create their own jobs. The decline of the quality of print journalism has been on a downward decline for the last couple of years. But the current free fall in terms of grammar and quality of stories is worrying. In my opinion there are several causes but the major one is the management. When the IT sector experienced the dot.com bubble bust in late 90s and early 2000, it did not compromise on the quality but instead it raised the standards and the results are the fruits we are reaping. The same applies to print media, poor quality journalism will kill it. The social media has eroded the advertising base of the news papers leading to downsizing and reorganization of the print industry. This means there are very few journalist and even fewer copy editors. Interns are given important beats without adequate supervision resulting to invasion of privacy, libel and plagiarism. Not all interns are do this but it is better to be cautious when giving them assignments. The issue of cronysim and tribalism is rampant in media recruitment and promotion. Due to this practice some senior editors who are supposed to be gate keepers are merely gate watchers because they do not have the skills to filter out the chaff before the copy is printed. Other times the pull of the advertsers' shilling is stronger than ethical consideration and PR materials are passed on as business news. The remedy for this may be what KICTAnet is doing-providing a fora to discuss the performance of the print media.But there is need to name and shame specific dailies like Makali's Bulletin does giving fortnightly assessment of media performance. May be the Media council could consider setting up an office of ombudsman to help the media in Kenya to engage with the audience constructively. It can be set within the media complaints committee and may be each media house can nominate a member. Chaacha Mwita's book, ,Citizen Power: A Different Kind of Politics, A Different Kind of Journalism, in my opinion aptly captures the point when the rain started beating on the bare back of the print media

An African-led initiative is pushing for a .africa suffix aimed at breaking down the dominance of foreign hosting sites. Around 90% of African websites are registered as .com, says DotConnectAfrica's Sophia Bekele. When it costs $19 to register a .com site versus around $50 for a .co.ke in Kenya, the choice is obvious, but it is not helping to populate the African web. With an eye on its future profits, Google is investing millions to enable an army of tech-savvy young Africans to build the web from the bottom up and put their continent on the global information map. "The problem with Africa is that there isn't enough information," Carlo D'Asaro Biondo, one of Google's vice presidents for the region, told the crowd. In front of him, laptop screens flickered in the dimly lit lecture hall as rows of young Senegalese techies tapped away at their keyboards. On stage, large breeze blocks in bright primary colours lay piled up in pre-planned abandon. One event in the US tech giant's G-Africa series, the G-Senegal meeting in late February brought together more than 600 web developers and HTML-literate IT students at Université Cheikh Anta Diop. They are all part of Google's plan to create an African army to help it build the web from the bottom up. Google has Africa firmly in its sights. As new fibreoptic cables bring down the cost of bandwidth, and manufacturers race to bring out affordable smartphones - the most basic of which still costs about $100 - the internet is going mobile in Africa. Already 40% of Google searches on the continent come from internet users on mobile phones. Google expects user numbers in Africa to grow from 14 million in 2010 to 800 million by 2015. Mobile information has been the midwife to the uprisings across the Arab world. Videos, photos and comments posted on Facebook, Twitter and Google-owned YouTube fanned the flames of revolt. Seen from the Googleplex back in California, Africa remains a big, perplexing blank, an obstacle in the way of Google's brazen goal to organise the world's information. But it has seen the future - one that will hold 43 million middle-class Africans by 2030, according to the World Bank. By investing now into Africa's internet ecosystem, Google hopes to hardwire it with tools that will make people click through to its websites. While there is an average of one web domain for every 94 people in the world, there is only one for every 10,000 Africans. An empty web with less local and relevant content means fewer reasons to go online and a dearth of revenue for Google, which principally earns money by selling targeted advertising on its search engine. It is also embedding itself in the internet's evolving geopolitics. As authoritarians tighten their media-monitoring screws, buying military-calibre cyber surveillance software, Google will be monitoring them. Since 2010, Google has been publishing statistics on the requests it receives from governments to remove information from its websites. During Egypt's February revolution, the tracker clearly showed when the country's internet was cut. As part of its response, Google put to use a start-up called SayNow that it had acquired just a few weeks before to create a 'speak-to-tweet' service. It allowed Egyptians to leave voicemail messages that were posted on Twitter as audio files. The company has won fans - and sceptics - for its 'don't be evil' motto. It got burnt in China and its reputation suffered after it agreed to censor search results. It will not be doing that again in a hurry. But by shining a light on censorship, Google has helped democracy activists expose politicians who meddle with the freedom of information. In late May, an Egyptian court charged the ousted President Hosni Mubarak and two of his ministers $90m for cutting telecoms services. During the revolution, Egyptian activists were fearful of what US multinationals might do with their private information. "Anyone who holds this amount of information needs to be very careful with it," says Nadine Wahab, an Egyptian activist behind the "We are all Khaled Said" Facebook group. But when Google's property is attacked, it will make noise. In June, the company pointed the finger at the Chinese government after disrupting attacks on Gmail users, including US government officials and Chinese political activists. Google's play on the continent is seductive and transformative. It has launched dozens of projects in Africa. Its search engine is now available in 31 African languages, including Ewe, Sesotho, Wolof and Amharic. A $1.25m project will digitise Nelson Mandela's documentary archives. Another pilot in Nigeria - the Get African Business Online project - is helping small businesses to build websites. Google runs mapping projects to help chart unmapped areas (see box page 22). It is also forging relationships with Africa's more tech-savvy administrations. A web facility tailor-made for Kenya's treasury is helping constituents monitor the implementation of infrastructure, education and health projects launched under the government's Economic Stimulus Programme. Google's assault on Africa is coming at a time when the company is facing growing hostilities elsewhere. In late March, its plan to monetise 15m digitally scanned books for the Google Book Project was barred by a New York court. Meanwhile, the European Commission is probing whether Google is abusing its dominant position in online search by prioritising its own services. MISSION: CREATE CONTENT Google's push to create local content is not unique to Africa and it forms a central part of its expansion strategy into emerging markets with low internet penetration. So far, the coast has been relatively clear. While its biggest rival, Microsoft, has an established presence in Africa, Facebook and Twitter have not yet defined strategies for the continent. Yahoo email addresses are still commonplace across both anglophone and francophone Africa, but Google has pretty much won the battle for African search. Back in Silicon Valley, it used to be hard to get attention for African projects. Now, it is a different story. "If you do something that's involved in Africa, it's a very feel-good thing around Google," says Steven Levy, author of a new book on Google called In the Plex. Google, which is famed for employee perks such as free gourmet food and onsite medical care, allows its engineers to use 20% of their time on other projects. "What Google is doing in Africa is very sexy," says the firm's Senegal representative, Tidjane Deme. Off the back of a successful final quarter of 2010 - which brought in profits of $2.5bn - Google is in the midst of an Africa recruitment drive, with more than 30 posts open across the continent. Its staff in Africa has grown from 10 in 2006 to 65 today. In December, it secured a huge coup by poaching Kenyan Ory Okolloh - founder of web platform Ushahidi and a prominent blogger and activist - as its first policy manager for Africa. The usually ebullient Okolloh has remained tight-lipped since she started, and declined to give an interview to The Africa Report. WE COULD BE HEROES African googlers have begun to get themselves noticed. At first, Google was unsure how to react to the swell of admiration for its marketing executive Wael Ghonim, held aloft as a hero of the Egyptian revolution after his detention at the hands of the security services. "They were conscious, as a global corporation, of the implications of this," says Levy. But they realised soon enough the value of his profile-raising. On 12 February, five days after his release, Google's official Twitter account said: "We're incredibly proud of you @Ghonim & of course will welcome you back when you're ready." Others are going on to great things. Kenyan Nyimbi Odero, Google's former lead for West Africa, told The Africa Report he saved the Nigerian Electoral Commission around $100m in procurement costs with in-house voter registration software he and his team developed for 2011's elections. Spreading its tentacles further and deeper into the world's internet is a fundamental part of Google's business plan. In the year to end December 2010, 41%, or $11.9bn, of its $29.3bn in revenue came from outside the US and the UK, up from 37% in 2008. Despite its push for global information-sharing and transparency, Google will not reveal how much it is investing in Africa, although it admits that it is not yet making a profit. "Our business model works only when you have enough advertisements and a lot of users online, and that's the environment we are trying to create in Africa," explains Nelson Mattos, Google's vice president of product management and engineering for Europe, the Middle East and Africa (EMEA). "Right now the goal is not to be profitable. We are not focusing on sales except for South Africa, where you already have an environment of enough users online, enough traffic online and enough advertisers who want to take advantage of that. In the rest of Africa, it's about bringing people online and making sure that they take advantage of internet services first." With a platform like Baraza - an online question-and-answer site that Google launched in October 2010 after success with similar pilots in China and the Middle East - users are persuaded to create content on a Google platform. "It has become extremely successful and we are starting to see a lot of the content that got created through the Q & A to surface in the Google search," says Mattos. Another beta project, Google Trader, launched in Uganda and Ghana, acts as a web and mobile marketplace for everything from rice-milling equipment to used Hondas. Such crowd-sourcing is central to Google's global strategy. It stems from founders Larry Page and Sergey Brin's belief in an open-source internet model, where tools are made freely available to developers. It is the driving principle behind its Android smartphone platform, which now has over 150,000 apps, but - like its African investments - has yet to bring in billions in revenue. Since mid-2009, Google has been busy moulding a new generation of bright, tech-savvy Africans who are incentivised to evangelise. Part of a growing young elite with the money to buy laptops, internet data bundles and smartphones, these geeks will rule Africa's online universe. But while Dakar's Google Technology User Group (GTUG) - a 50-strong network of young developers that receives a stipend each month from Google to host meetings - may know how to work the tools, they have little financial support to create new applications. Ibrahima Dieng, one of GTUG's leaders, says: "People come and try things out, but they don't publish." Many are students, without the credit cards needed to buy space online. LEARNING TO ADAPT Senegalese web engineer Hovi Kokuvi Amen Hovi says he is earning €11 a day from AdSense adverts hosted on two news-based websites he operates. He has been lucky - he can get at the money via a French bank account. Funds earned through AdSense used to be sent with a Citibank cheque in US dollars, a system not well adapted to serve developers in largely unbanked economies. In May, Google agreed to make payments via Western Union in Senegal. Google has not yet made the biggest commitment it could to Africa - to build a data centre, the beeping heart of its web operations. However, it has set up several dozen caches with African mobile operators and internet service providers. So, when somebody wants to watch a YouTube video or access Google Maps, the request does not travel all the way to a European data centre, but is accessible via a local store. Back in 2008, Google provided an undisclosed part of a $410m investment in O3b, a series of low-orbit satellites that would bring fibre-speed broadband to the developing world from 2013. Google also recently opened a point of presence (POP) in Nigeria to serve West Africa, effectively an entry point to its global network of data centres. There is already an active POP in South Africa, and Google plans to build one in Kenya to keep local traffic within Africa. Just how Google plans to recoup such investments remains unclear. Some of its products could become lucrative if they reach critical mass. One is Gmail SMS, which allows Gmail users in certain countries to send 50 free text messages from their emails. When users receive an SMS to their inbox, they get another five free messages. "They're sowing now so they can reap the advertising funds down the line," says Banky Ojutalayo, a former senior manager for value-added services at Glo Mobile Ghana. He suggests that once the service had built up a large enough user base, Google would consider selling short adverts at the end of each message - a potential goldmine. African mobile operators' eagerness to team up with Google shows the power of its global brand. But sometimes the company falls foul of the higher standards it sets for itself. It was criticised last year for exercising loopholes to pay an overseas tax rate of just 2.4% in the US, cutting its tax bill by $3.1bn. Google insists that it "complies with tax law in every country in which it operates," including seven countries in Africa. As the influence of companies like Google grows, the continent's techies are aware of the urgency to stake their own territorial claim. An African-led initiative is pushing for a .africa suffix aimed at breaking down the dominance of foreign hosting sites. Around 90% of African websites are registered as .com, says DotConnectAfrica's Sophia Bekele. When it costs $19 to register a .com site versus around $50 for a .co.ke in Kenya, the choice is obvious, but it is not helping to populate the African web. Nigerian developer Saheed Adepoju, who launched his own version of Apple's iPad tablet called Inye last year, says some of his peers are worried Google is trying to take over their market. Adepoju tells them that they should not worry. "We know the local system better than they do. It's not going to be hard to compete with them." Whatever its profit projections, Google's African advance is a long play. It sees that the continent is getting richer and more connected. Africa's sparsely populated internet is a money-making opportunity for Google and the army of African developers it is training to help fill in the gaps. Africa's future is an online and a mobile one, and Google has raised its flag first. Hi, I had mentioned in a previous post that during the visit by members of NASCOM to Nairobi last month an issue was raised on why Kenyans seem to glorify degrees to the point of a all a nothing attitude. It was made clear that his could have a major impact on our ability to attract outsourcing business as graduates look at jobs in areas like call centres as stop gap measures and stepping stones to something better which then results on very high turnover and thus reduced expertise. An article in the media recently, http://allafrica.com/stories/201107260844.html, brings out the effects of upgrading tertiary colleges to universities and the effect on the building sector. We might assume that this does not affect the technology industry which would be a mistake on our part. Some of us who are involved in structured cabling are already experiencing problems in getting good technicians who can lay and terminate UTP and STP cable with zero failures, our teams of diploma holders are being snatched by organisations such as the UN. The crisis of collapsing buildings is coming our way in form of substandard cabling. Afew more reasons: - the pressure to get articles/news/etc out in a speedy manner; be the first to "break the news". What with the 24-hour news cycle? - the lax attitude and declining of standards plus "tolerance" of the same by "consumers. As book publishers, we have consistently seen the latter attitude from our Kenyan-based editors compared to those in Canada, Jamaica, Middle East, etc. I once complained about shoddy work we were being asked to pay for and asked that the work be redone. The impatient editor retorted: what's with a few mistakes which can fixed on the following release! End of dealing with the person!
