SIM CARD REGISTRATION & DATA PROTECTION ACT, 2019

Listers, I am not sure if I am being paranoid but the SIM card re-registration order ostensibly by CA (Communications Authority) and which has mobile operators asking us to te-register our SIM cards by April or risk being deregistered, seems like regulatory overreach. CA says under the SIM Registrations regulations of 2015, MNOs are required to update their registers with details including ID documents and photo IDs. The reason given, ostensibly, is that many had their SIM details registered before that law came into place. Speaking of laws coming into operation, the Data Protection Act, itself came into effect in 2019. Significantly long after the said regulations. In seeking to protect privacy and personal data, the DPA requires Data Minimisation where personal data collected should be: "adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed (‘data minimisation’);" Sec. 25(d) DPA, 2019 This means that data that the controller does not really need to achieve a specific purpose, should not be collected. Biometric information such as Passport Photos that the Operators will take and store,for example, are in my opinion, surplus to requirements. The identification of the subscriber can be done without collection of intrusive biometric data for example by using national IDs. CA explicitly asks that the operators verify details with the Integrated Personnel Registry System. so collection of biometric data to me is disproportionate and cannot meet the threshold of lawful basis. Being the later law, and by the Huduma Number case precedent, the data minimisation provisions of the DPA, 2019 in my opinion hold primacy and in fact impliedly, repeal or render unlawful, the requirements for photo taking for SIM registration in the 2015 regulations. 2. Data Protection Impact Assessment. Another question I would have for the CA, the Data Commissioner and mobile operators, is if, as per the precedent sent by Justice Ngaah in the Katiba Institute v. MoICT & others regarding the need for the conduct of a Data Processing Impact Assessment, has been carried out in this instance when CA proposes to have collected the data of more than 30 million subscribers including biometric data. I think this is a plain case of flouting judicial guidance viz a viz when DPIAs should be carried out and CA should have had this carried out first before issuing the said directive. Good day Ali, You stated M-Pesa is a bank but I digress. Let's wait and see what tomorrow brings on the fuel crisis with GOK having outstanding payments of KES ~14.5B to OMCs and most likely sharp price increases from the scrap of the subsidy all together. In addition, why do they need CBA which became NCBA for m-shwari(A deposits and loan facility)? Also with KCB and the former for Fuliza(An overdraft facility)? Lastly, why does #Saf operate under a special licence from the CBK unlike the rest who have banking sector charters? The surprise is how this moat has been built under the noses of traditional banks. The unbanked will be now banked and I don't see a reason for the CBK to refuse such a proposition for financial inclusion and better visibility to what is commonly phrased as "Kenya's hidden economy". Kenya plans to double tax on foreign tech giants like Amazon, Netflix, Twitter and PayPal which use the internet to market and sell products, a signal that Nairobi is hardening its stance against the US-backed global minimum rate on multinationals. Good day all, There is something remiss and I see it unravelling rather quickly and badly. The CA is a gov't commission, essentially a creature of GoK. What's the purpose of Huduma namba while one still pays a facilitation fee of 1,050/= for numerous services in ecitizen only for them to collect the same data they did for the mass registration of huduma namba(fingerprints, photo and I even think an e signature was part of it too)? A Déjà vu to the Huduma Namba exercise where the gov't was simply unable to communicate that were upgrading our IDs from biographic to biometrics? Why waste productive capacity and man hours to duplicate data multiple times? Are your fingerprints & birth certificate changing? And even in aspects that do like your area of residence, contact details, marital status, assets etc. if there are 2 or more institutions requiring such info will you continue to trudge across all of them to update your details? I do believe the CA has technical people and in IT we know you can design an IDP or SSO-like system where you centralize(Just like the Huduma namba's aka "single source of truth") storage and management of your user's digital identities. Key to note, he said the ICT sector is key as it has the potential to accelerate economic recovery and improve livelihood. As a result, the ICT sector was allocated KES 15.6 billion. Any response/details from *Safaricom* on this? It's been ~2 months now. Here are a couple more from last month: - https://twitter.com/GMONEYizME/status/1505956691304763392?s=20&t=jYXxOcC4h9… and, - https://twitter.com/XZBeats/status/1506118402410225664?s=20&t=jYXxOcC4h9L_6… As we have established and conceded that a phone number is important for authentication especially for gov't services and thus, the real world stakes have grown bigger. Borrowing from the Internet, why shouldn't all the telcos adopt a Domain Name like System (DNS) for purchasing a mobile line? A model like Extended Validation (EV) SSL certificates may also be incorporated to thoroughly assure operational and physical existence. I don't know if The ODPC has been pronounced on this matter but they should as subscribers are getting access to information without consent that may be personally identifiable (PII) and it's also not theirs. Under Chapter 4 - The Bill of Rights, Article 31 articulates every person has the right to privacy relating to their family or private affairs and also their communications. A relatively small fee would be needed for each year(or minimum period to be determined by the telco?). I recognise a similar problem to IPv4 addresses as telcos have fixed prefixes(fixed resources) assigned to them but it's an even bigger challenge as we don't want the reuse of these numbers. I foresee a cascade of protocols and rules that would need to be implemented e.g an individual can only have 1 line, a business 3-5 ..etc. I have cautiously avoided the leased lines route as they are blatantly exorbitant. Even though I pose this challenge to #Safaricom, I don't believe it's their sole responsibility to effect such changes. A conversation starter that will include the CA in their responsibility of managing numbering resources? I hope it does so. I wonder why #Safaricom supports *eSims* but you have to visit a physical store to activate it. With The CBK pushing for a *CBDC* and competition for *m-pesa *to be more *interoperable *I no longer see a mobile line being a shackle to use services aka *high switching costs*. Why does one need to visit a shop *physically* to activate an eSim unlike other jurisdictions where it's not the case? Yes there will be a rise of risks such as *sim swaps *as evidenced in other jurisdictions where a user exercises controls of their mobile line subscriptions via web platform or app. However, this presents a learning & improvement opportunity from their pitfalls to forge a better path. For* Safaricom *customers who have swapped/ported to eSims any negative experiences such as signal loss, call drops and/or issues with* m-pesa*? Lastly, @Stephen Chege for 3 months (Since January) why have my folks been getting *monthly *messages from #Safaricom to recharge a line or else they lose it. Kenya gets sixth 16 Terabytes per second submarine fibre cable

The cable has a designed capacity of 16 Terabytes per second and is expected to last 25 years. The cable is set to improve efficiency and cut internet costs in Kenya. Dubbed Peace Cable, it is connecting Pakistan, Kenya, Egypt, France and countries along the way with an extension to Singapore and South Africa. In preparation for this year's KIGF, KICTANet wishes to invite volunteers from the different stakeholder groups to assist in the preparation of the KIGF2022, which will be held in June 2022. The volunteers will form The Steering Team otherwise known as the Multistakeholder Advisory Group (MAG) whose role is to assist in convening the Kenya IGF by preparing the programme and schedule and to improve the IGF process through community consultations, outreach and stakeholder engagement. MAG members volunteer and serve in their personal capacity, and are expected to have established linkages with their respective stakeholder groups. Dear all, See below for a consultancy gig alert. — The Global Forum on Cyber Expertise (GFCE) is looking an advisor for the program team of the global Conference for Cyber Capacity Building taking place in November 2022. This position is for a period of 10 months. The expected starting date is March 1st 2022. Background To adequately support and secure digital transformation all countries should engage and invest in building cyber capacity. Cyber capacity building (CCB) is a key enabler of sustainable and resilient digital development. Much has been done to promote best practices in CCB but insufficient awareness among key decision-makers and a lack of resources sometimes hinders implementation. There is an urgent need for high-level collaboration. To drive this forward, the Global Forum on Cyber Expertise (GFCE), CyberPeace Institute, World Bank and World Economic Forum have joined forces to organize the Global Conference on Cyber Capacity Building 2022 to advance, operationalize and collaborate on CCB. The Conference will be hosted by World Bank in late November 2022. This conference will bring together high-level decision-makers, senior working-level representatives from government agencies and experts from across the public sector, private sector and civil society to accelerate: · current multi-stakeholder cooperation; · establish a Global Coalition on Cyber Resilience for Development and an international CCB agenda; · raise decision-makers’ awareness of how cybersecurity and CCB support digital, social and economic development. Role The Global Conference on Cyber Capacity Building aims to raise the profile and allocation of resources for cyber capacity building as a core enabler of digital development and prosperity. A key enabler to achieving this ambition is effective coordination and leadership regarding the conference’s organization. As part of the governance structure of the Global Conference, three teams will be formed: the Program team (responsible for conference program), the Communication team and the Event (logistics) team. The program advisor will be part of the program team of this conference, and works with the Communications team and the Event team. Duties and Responsibilities - Help design the program and synthetize inputs from the GFCE community and the event organizers. - Describe the objectives, key questions for the program elements (panels; workshops, etc). - Support with the preparations of key conference outcomes like the chair statement and global agenda. - Support the selection of Conference speakers, moderators and participants. Candidate profile: requirements, qualifications and skills The successful candidate will have: - Graduate or master’s degree in one of the following: (cyber) security studies, international relations, economics or other relevant field; - A minimum of 5 years’ experience in the field of cyber and/or digital capacity building, either at national or international level; - Experience working with international donors across industry, government and the wider international digital and/or cyber sector. - Professional, confident, self-motivated, punctual, flexible, proactive and able to work both independently and as part of a multi-national team. - The ability to think strategically and innovatively; Desirable - Experience in writing, implementing and/or directly advising on the creation of a program for an international conference; - Project advisory role in an International Organization focused on or around telecommunications, digital and/or cyber security. The question came as a result of a Twitter conversation from Ms Wamuyu Kariuki who apparently was out of the country and her SIM card expired. As a result, she was given another Sim card which 'apparently belonged to somebody and she apparently used to receive messages from the SIM card's contacts. *A. "I receive church contributions report every week for a church in Kisumu on the number attached to my Till Number. I know how much they collect every Sunday per district. How safe is this?"* *B. It’s was such an expensive and tedious affair to change my mobile number on all my online subscriptions that require authentication via mobile number for access. eCitizen, NHIF, NSSF, Bank, Email.* *Here is the thread link * https://twitter.com/wamuyunkariuki/status/1493789552217055236?s=20&t=gB7SP3… We understand the KYC process that any telco does when you intend to replace a lost SIM card, but in this scenario, it was a new line being bought once it was returned into circulation. However, the history of what loans, subscriptions and crimes committed if any is not cleared and that follows the new owner. The alleged sustained cutting of prices below that of competitors and below actual costs of services made it hard for Airtel to operate profitably and constituted anti-competitive behaviour, Airtel says. Airtel is among operators who are backing a decision by the CA to cut mobile termination rates (MTR) to Sh0.12 per minute from the current Sh0.99 per minute. Safaricom has been running promotions and special offers that has seen it price its per-minute voice services at a range of between Sh0.2 and Sh1, according to an analysis by the regulator.
