That is why there is a need for a Europe-wide strategy to provide a comprehensive response to address the specific requirements of security in cyberspace, she said in Brussels. Internet security is not a problem that is going to go away, but a safer internet can be achieved with an approach that is built on the single market, gives the right incentives to the private sector, invests in supply, and has an international outlook, said Kroes. The strategy will "enable a step-change in how we ensure internet security. It will be embedded in our principles for internet governance," she said. The Commission is due to present its plan for a "European strategy for internet security" in the third quarter of this year, which will ask EU member states to guarantee minimum capabilities to respond adequately to threats and share critical information in a secure and confidential manner. Member states will be required to establish competent authorities to centralize information to enable the creation of a regional forum for collaboration with the private sector, support a European cyber incident contingency plan, and exchange best practices. Kroes also wants to expand data breach notification obligations from the telecoms sector to other sectors that rely on critical information infrastructure, such as energy, water, finance and transport. "Prompt reporting means competent national authorities can react quickly to incidents and minimize their impact," she said. The Jackal News sources said they understood that, besides the ''UK document'' issue, his detention is also part of police investigation into the claims by the ICC prosecutor that some witnesses in the case against four Kenyans had been threatened. Itumbi was arrested by the Criminal Investigations Department officers in Embu Thursday evening and brought to Nairobi for questioning, several sources told Jackal News. He is being held at the Muthaiga Police Station, where he spoke to reporters who visited him early this morning (Friday). It was not immediately clear the nature of evidence that police may have against him over the document tabled in parliament on March 8. Speculation on Twitter suggested that police had been arrested him for having access to ‘‘classified documents’’, whatever that means. His arrest came amid a move by the journalst last week that he had given a notice to sue a blogger who allegedly linked him to the writing of the document, which also claimed that the British government was seeking the detention, by ICC of MPs William Ruto and Uhuru Kenyatta. ‘‘Media freedom is under threat in this country. The new constitution, even if it was voted on overwhelmingly is not working,’’ Itumbu told reporters from Muthaiga Police station early Friday. ‘‘No matter the nature of intimidation, I will not reveal the sources of the information I have. It is suicidal. I will die for it,’’ he said, suggesting that police may be seeking to question him about what he knows about the controversial document. A friend, Martin Gitau, posted on Twitter overnight: ‘‘Intimidation as blogger Dennis Itumbi arrested by CID officers in Embu.’’ The police had not issued any statement by 2am Friday. Last week, Itumbi, through his lawyer, issued a formal complaint against Robert Alai, asking him to apologize for allegedly linking him to the ‘‘British government’’ document or, failure to which, he would institute legal proceedings. Itumbi has said he is not the source of the document in question. Meanwhile, Attorney General Githu Muigai has ordered police to investigate claims by the ICC prosecutor, Luis Moreno-Ocampo, of email hacking and intimidation of witnesses. The ISPs, including AT&T, Comcast, Time Warner Cable and Verizon Communications, committed Thursday to implement measures to fight botnets, domain name fraud and Internet route hijacking. The FCC's Communications, Security, Reliability, and Interoperability Council (CSRIC) adopted the recommendations for voluntary action by ISPs the same day. Eight wired and wireless ISPs, representing about 80 percent of the broadband subscribers in the U.S., are members of CSRIC<http://transition.fcc.gov/pshs/advisory/csric/members.html>and signed on to the recommendations. "These actions will have a significant positive impact on Internet security," FCC Chairman Julius Genachowski said. "If you own a PC, you'll be significantly better protected against your computer [being] taken over by a bad actor, who could destroy your private files or steal your personal information. If you shop or bank online, you'll be significantly better protected against being directed to an illegitimate website and having your credit card number stolen." The recommendations preserve the open architecture of the Internet and protect Internet users' privacy, Genachowski said. The CSRIC recommendations embraced by the ISPs include an antibot code of conduct. ISPs agreed to educate customers about botnets and to take steps to identify botnet activity on their networks. ISPs will also warn customers about botnet infections on their computers and offer assistance to customers with compromised computers, under the code of conduct. The ISPs also committed to implement a set of best practices to secure the Internet's Domain Name System by implementing DNSSEC, a set of secure protocol extensions designed to prevent DNS spoofing. CSRIC also recommended that the Internet industry develop an Internet Protocol-route highjacking framework, including new technologies and practices to limit the number of times that Internet traffic is misdirected= . T-Mobile USA, one of the ISPs signing on to the recommendations, called cybersecurity an "extremely important issue." The company supports voluntary, industrywide deployment of DNSSEC, T-Mobile said in a statement. ISPs will need help from other Internet companies to implement the security measures, said Bob Quinn, AT&T's senior vice president for federal regulatory affairs. Evelyn spent many hours lobbying for the ICT sector within the government an effort that has come to nought as we, yet again, scatter off into our various selfish corners. If all those tributes we kept sending around after she past away were genuine then lets honour her by continuing from where she left off instead of going off in a tangent. It was suggested by Dr. Ndemo and echoed by Mr. Kokubo that a team be formed to prepare a white paper on the issues that arose during the session, it was suggested that this would be best handled through the ICT Sector of KEPSA just for one of the panel to wrongly imply that KEPSA was an association for manufacturers (that organisation is called KAM who are also members of KEPSA). Dan Awendo of Investeq indicated that what is ailing us as an industry is the one man show syndrome and the leopard hunting mentality. If we can not within us form a body that can speak in one voice then all the efforts are a waste of time and resources. I will repeat what I raised a while back when I was not able to get a platform from which to take over the governorship of the ICT sector at KEPSA from Evelyn because the Computer Society of Kenya who I assumed would propose me had lapsed their membership. Unless we as an industry can speak in one voice and become a constituency then we shall continue to wallow in the miasma of deceit that was the session we had today, together we stand divided we fall. Twitter town hall meetings will not resolve what ails the industry it is only if we learn to come together that we can make an impact. KEPSA swings a sledge hammer on behalf of any of its sectors, it recommends who seats on government committees that require private sector participation and finally it has the machinery to draft and push through legislation. Forming small little talk shops will not make any progress and I read an ulterior motive to the proposal by Mr. Kokubo to form an "independent" group to prepare the white paper. He is very well aware that such a group will never see the day of light but if it was under the umbrella of KEPSA well that will be another issue. The askari at your gate is a personal choice and can be defined as the implementation of a concept called "Defense in depth" which basically means that you opt not to rely on one security measure alone. This concept is optional and discretionary, for example, I don't have an askari at my gate because I am generally happy about the other measures that have been put in place by Govt, municipality and the neighborhood committee. National security (the sole premise of Government) in this day and age guards against a myriad of actors such as violent non-state actors (this category includes terrorists), narcotic cartels, multinational corporations (believe it or not) and like it or not, non-governmental organisations. My take on the CCK "spying" saga: A small step for Government but a leap for Kenya http://zinjlog.blogspot.com/2012/03/small-step-for-government-but-leap-for.… Today a story broken by the Daily Nation had the sensational headline "CCK Sparks Row with Fresh Bid to Spy on Internet Users<http://www.businessdailyafrica.com/Corporate+News/CCK+sparks+row+with+fresh…>". The story has triggered a very lively debate both in conventional broadcast as well as online media. While many feel threatened about the alleged invasion of their privacy, some of the more clued up are welcoming this development. The 'row' alluded to by the author the DN article seems to be attributed to some telecoms service providers reactions towards letters received from the CCK requiring them to cooperate in the installation of internet traffic monitoring equipment which the article refers to as "Network Early Warning System (NEWS)". Apparently CCK has clearly stated that the system will support the country's ability to detect and facilitate response to possible cyber threats. Kenya as a country has had her fair share of threats, both online or in the form of cyber-threats as well as in real life. The most significant of these was the bombing of the US embassy in Nairobi which took place on August 8th 1998 (a day before my wedding!) and resulted in the deaths of hundreds of people. The bombing, which took place simultaneously with a similar attack in Dar es Salaam, Tanzania was attributed to Al-Qaeda, the fundamentalist terrorist group associated with Osama bin Laden. The 1998 incident cast a spotlight on Kenya's low level of preparedness to deal with major disasters and also raised a lot of questions about our ability as a country to gather intelligence and act on it. Part of the high tech gear involved in this operation allowed the security officers to track and monitor "patterns" of online communication that allowed them to close in on the terrorists. In this incident and a few other similar ones it has always been reported that the "Kenyan authorities used information provided by" [foreign nation], why can't we have our own capability to gather such information? Especially when it seems that the terrorists use online technologies for much of their planning. It is therefore my opinion that the move by Kenya to improve her ability to detect and facilitate response to cyber-threats is a small step for the Government but a huge leap for the country. Washington, I hope CCK is not so stuck on following the ITU that they forget that Technology evolves at the speed of light, and even as we discuss there are standards such as the IEEE 802.22 which will enable the sharing of spectrum between those who already have the frequencies and for commercial use to allow for penetration into those rural hard to reach areas. This also means that Safaricom should also not focus solely on the 700 MHz but they could also go after White space which is the unused spectrum that sits between TV channels. The 300MHz to 400MHz of unused spectrum is considered prime spectrum for offering wireless broadband services because it can travel long distances and penetrate through walls. Meaning CCK has lots of homework to do in regards to management of shared spectrum. IEEE 802.22 is a standard for Wireless Regional Area Network (WRAN) using white spaces in the TV frequency spectrum.[1] The development of the IEEE 802.22 WRAN standard is aimed at using cognitive radio (CR) techniques to allow sharing of geographically unused spectrum allocated to the Television Broadcast Service, on a non-interfering basis, to bring broadband access to hard-to-reach, low population density areas, typical of rural environments, and is therefore timely and has the potential for a wide applicability worldwide. It is the first worldwide effort to define a standardized air interface based on CR techniques for the opportunistic use of TV bands on a non-interfering basis. Impracticable and ill-timed proposition Surrender of frequencies in the 700MHz band currently in use for broadcasting services would be ill-timed and impracticable. This is because the transition to digital broadcasting is being implemented in the same frequency band that is used for analogue TV broadcasting. The digital signal is at the moment only available in Nairobi, which means that the rest of the country is still dependent on analogue TV transmissions. Thus the existing analogue TV broadcasters cannot switch off their services without disconnecting a sizeable proportion of consumers. This explains why the country is on a simulcast period where both digital and analogue TV signals are on air. The switch-off of the analogue TV signals will only be done when the Government is satisfied that digital signal coverage is available nationwide. 4. Statutory mandate over frequency spectrum management The responsibility of managing frequency spectrum in Kenya is vested in CCK by law (that is by the Kenya Information and Communications Act, CAP 411A). In addition, CCK is the designated Government representative to the ITU, where international treaties/agreements and international regulations on frequency spectrum management and other ICT issues are made. Therefore only the CCK has the statutory mandate to assign spectrum (to broadcasters, mobile operators and other assignees) and to recall frequencies, where necessary, in line with the provisions of international agreements and regulations as well as national law. 5. Orderly planning of freed up spectrum Owing to the vast investments in the existing analogue infrastructure for TV broadcasting, the migration to digital TV broadcasting shall be done in an orderly way and freed up spectrum shall be surrendered to CCK for re-planning and re-assignment. The re-planning exercise shall involve deciding on the modalities of re-assignment, including use of market-based allocation methodologies such as spectrum auction. Re-assignment shall take due consideration of the various competing radio-communication services that require access to this vital spectrum. In view of the foregoing, it is premature to agitate for re-allocation of spectrum that is not even available in the first place. In any case, the World Radiocommunications Conference 2012 held in Geneva, Switzerland, early this year resolved that the implementation date for assignment of spectrum in the frequency band 694-790MHz to mobile services would be 2015, subject to results of studies conducted between now and then on the feasibility of implementing mobile services in part or in the entire 694-790MHz frequency range. Spectrum on this band is currently allocated to broadcasting services. Thus, it is the said studies that will effectively determine the amount of digital dividends (or freed up spectrum) that will emerge from the 694-790MHz frequency range for use in deployment of non-broadcasting services (including superfast mobile broadband/internet and other services). As a public body, CCK remains open to receive representations and comments on any regulatory issue touching on the ICT sector. Such representations should, however, be done within the framework of the law, without causing public confusion and exerting unwarranted pressure on the duly licensed players in the broadcasting industry. This explains why the country is on a simulcast period where both digital and analogue TV signals are on air. The switch-off of the analogue TV signals will only be done when the Government is satisfied that digital signal coverage is available nationwide. 4. Statutory mandate over frequency spectrum management The responsibility of managing frequency spectrum in Kenya is vested in CCK by law (that is by the Kenya Information and Communications Act, CAP 411A). In addition, CCK is the designated Government representative to the ITU, where international treaties/agreements and international regulations on frequency spectrum management and other ICT issues are made. Therefore only the CCK has the statutory mandate to assign spectrum (to broadcasters, mobile operators and other assignees) and to recall frequencies, where necessary, in line with the provisions of international agreements and regulations as well as national law. 5. Orderly planning of freed up spectrum Owing to the vast investments in the existing analogue infrastructure for TV broadcasting, the migration to digital TV broadcasting shall be done in an orderly way and freed up spectrum shall be surrendered to CCK for re-planning and re-assignment. The re-planning exercise shall involve deciding on the modalities of re-assignment, including use of market-based allocation methodologies such as spectrum auction. Re-assignment shall take due consideration of the various competing radio-communication services that require access to this vital spectrum. In view of the foregoing, it is premature to agitate for re-allocation of spectrum that is not even available in the first place. In any case, the World Radiocommunications Conference 2012 held in Geneva, Switzerland, early this year resolved that the implementation date for assignment of spectrum in the frequency band 694-790MHz to mobile services would be 2015, subject to results of studies conducted between now and then on the feasibility of implementing mobile services in part or in the entire 694-790MHz frequency range. Spectrum on this band is currently allocated to broadcasting services. Thus, it is the said studies that will effectively determine the amount of digital dividends (or freed up spectrum) that will emerge from the 694-790MHz frequency range for use in deployment of non-broadcasting services (including superfast mobile broadband/internet and other services). As a public body, CCK remains open to receive representations and comments on any regulatory issue touching on the ICT sector. Such representations should, however, be done within the framework of the law, without causing public confusion and exerting unwarranted pressure on the duly licensed players in the broadcasting industry. PRESS RELEASE 16th March 2012 Listers, CCK's response to agitation for surrender of broadcasting frequencies The attention of the Communications Commission of Kenya (CCK) has been drawn to media reports attributed to one of the mobile operators in the country calling for the surrender of assigned broadcasting frequencies on the 700MHz band to mobile operators and other service providers for use in the deployment of 4G services (i.e. superfast mobile broadband/Internet services). The CCK wishes to respond to the agitation as follows: 1. The spectrum in question The spectrum/frequencies in question here (i.e. 700MHz band) will only become available for re-assignment for use in deployment of non-broadcasting services after the successful migration from analogue to digital TV broadcasting. According to an international agreement reached at the International Telecommunication Union (ITU) in 2006, member countries party to the agreement (including states in Africa, Europe, Russia and the Middle East) set 17th June 2015 as the global deadline for the switch-off of analogue TV broadcasting. The ITU is a specialized UN agency in the field of ICTs to which Kenya is affiliated. As a member of the ITU, Kenya is bound by the provisions of this agreement. 2. Transition to digital TV broadcasting To prepare the country for smooth and timely transition to digital TV broadcasting, the Government of Kenya constituted the Digital Television Committee (DTC) to oversee the migration process. The DTC recommended an early transition deadline of 2012 to enable the country to have the flexibility and time to address any difficulties that may arise before the multi-laterally agreed deadline of 2015. The demand for broadcasters to surrender frequencies in the 700 MHz band immediately to mobile operators, therefore, cannot be justified at this point. In any case, even the 2012 national deadline for migration to the digital TV broadcasting is not cast in stone. As has happened in other countries, the deadline could be postponed if there are challenges in achieving it. 3. Impracticable and ill-timed proposition Surrender of frequencies in the 700MHz band currently in use for broadcasting services would be ill-timed and impracticable. This is because the transition to digital broadcasting is being implemented in the same frequency band that is used for analogue TV broadcasting. The digital signal is at the moment only available in Nairobi, which means that the rest of the country is still dependent on analogue TV transmissions. Thus the existing analogue TV broadcasters cannot switch off their services without disconnecting a sizeable proportion of consumers. Domain seizures for copyright infringement likely to go global Law enforement officials urge ICANN to take steps to ensure compliance with international agreements By Rebecca Wanjiku | Computerworld Kenya | 14 March 12 Efforts to take down websites for copyright infringement are likely to move beyond U.S.-based registries, with ICANN (the Internet Corporation for Assigned Names and Numbers) promising to more closely cooperate with global law enforcement agencies and governments. Cooperation to combat copyright infringement has been a hot topic this week at ICANN's international meeting in San José, Costa Rica. There are 22 registries and over 700 registrars accredited by ICANN. Registries contain domain names registered in a top-level domain, while registrars sell domains. Any domain under a U.S. registry must follow U.S. laws regardless of where the servers are, according to agreements currently in place. The seizure of domains deemed to infringe on copyrights was first carried out by Verisign, the operator of the registry for .net and .com. During an open session with the Government Advisory Committee (GAC), the ICANN board confirmed that it will enforce its contracts with registrars more effectively in order to meet expectations from governments and law enforcement authorities. The expectations were contained in a 12- page document submitted by the GAC, which also includes representatives from national law enforcement agencies as well as Interpol. "There has been some agreement on 11 of the 12 recommendations made by law enforcement authorities to the registrar accreditation agreement; we will work to ensure agreement meets expectations and give registrars the incentive to accept recommendations right away," said Kurt Pritz, ICANN senior vice president in charge of stakeholder relations. Representatives from governments, Interpol and the U.S. Federal Bureau of Investigation said they felt that ICANN's failure to enforce its own contractual agreements was damaging to Domain Name System users as well as end users. Some of the 12 recommendations relating to registrar agreements was inclusion of a clause that holds registrars responsible through negligence for registering domains engaging in criminal activity. Another recommendation is for registrars to maintain detailed information of domain buyers, including their source IP addresses and transaction information, and validate the contact information given by domain buyers. Law enforcement officials have also urged ICANN to review registrars' compliance record with enforcement agreements prior to renewing their contracts. "Complaints on compliance started coming in the last six to nine months, a team of 12 is now in place and will improve the quality of service," said Rod Beckstrom, ICANN CEO and president.

Hi, Does anyone out there know how I can get in touch with Webhost Kenya - the leading .ke registrar? I registered a domain with them a few days ago which they did and immediately sent me an invoice, I had prepared their cheque just to notice that there is only a P O Box number (and you keep saying postal is dead) on all their correspondents, email sent to the the email address from which the invoice was sent keeps bouncing. At one point I was tempted to actually send the payment via the post office but since I had received a final warning that the registration would be reversed I had to act quickly. In frustration I changed the payment method to mpesa and made the remittance but I am still receiving messages indicating that I have an outstanding bill. And KBC may never be the same again. The Bulletin salutes the workers for their successful strike that ended last week. Folks, that was fantastic!When a wave of strikes swept the country last year, indistinct murmurs of discontent were heard at Broadcasting House on Harry Thuku Road, Nairobi. Nothing unusual. Nobody, not even The Bulletin in its not-so-grey-haired wisdom, thought much of the grumbling.The woeful tale of how the public broadcaster is run like a tea-and-mandazi kiosk in Muthurwa by its managers and other interested elements outside Broadcasting House is common knowledge.The KBC board has often been peopled by characters, currently including a pastor and a former school head, who have no idea what running a public broadcaster is all about.We have had occasion to wonder on these pages how any serious organisation would hire a clown of no known managerial acumen to run about 20 radio stations. And without training in mass media or communication or journalism; whatever you will call it.People have been working at KBC for years without a contract. Morale is always at an “all-time” low. Mystery surrounds hiring and promotions. The corporation pays the bulk of its workers peanuts, while the top guns enjoy good salaries and benefits.Facilities at KBC belong in the last century. Who built those timber prefabs, by the way, and why? Were they not supposed to be temporary?KBC news is still for all intents and purposes controlled by powerful individuals outside the corporation, not the editors.Independent TV producers who sell local programmes to the broadcaster are owed millions of shillings.Things hit rock bottom when the corporation’s immediate former MD and the legal secretary were sacked last year and charged with fraud.But the longsuffering KBC staff surprised everyone. They channelled their grievances to Parliament and even spoke to their media colleagues about their plight. That was exemplary courage, given the very sorry state of industrial organisation in the media sector in Kenya.Media people often waste no time exposing the suffering of workers in other sectors, but not their own. Within the industry, everyone fights for themselves – by talking nicely to the boss, getting oneself a tribal godfather, agreeing to some funny demands, or fleeing to greener pastures elsewhere.At KBC the bosses were alarmed by the turn of events. They tried to contain the situation through manipulation and vague pledges. Around Christmas, with a strike threat looming, the management laid on a huge end-of-year bash to try to mollify restive workers. We reviewed it here.The message from the top guns was the usual baloney: We are family. We greatly value your work. You have put KBC on the national (sorry, world) map. We are human too: We understand your complaints. But you also really ought to be grateful that you have a job at all in these hard times. Things are complicated, but we are going to do something soon…But the workers enjoyed the bash, went home for Christmas and returned unbowed to announce that they would down their tools in a matter of weeks if their grievances were not fully addressed.And that is what happened the other week. Management tried a worm-eaten carrot here and a stick there. The workers stayed put. They paralysed operations at the “leading national broadcaster”.MD Waithaka Waihenya, the former newspaperman who has a passion for fiction writing, had a real crisis on his hands. Workers carried screaming placards and chanted slogans. They spilt the beans on the streets about the ugly skeletons hidden behind that beautiful gate manned by GSU toughies on Harry Thuku Road and announced: ‘the donkey is tired’.The media, as expected, feasted on the strike – with reporters from various media houses pretending they did not have similar problems at their own places of work, or even worse. Anyway, they were doing the story they were assigned.But the Star newspaper came out to condemn the “wildcat strike” in an editorial. KBC management had agreed to some demands and negotiations with union officials were ongoing. The union had distanced itself from the strike. And even that garrulous unionist-in-chief, Francis Atwoli, asked the workers to return to work. Was the Star for real? Was Mr Atwoli genuine or speaking with an eye on his future coverage?Anyone who knows anything about trade unions in Kenya today would be very sceptical when officials and industry captains appear to read from the same page. KBC workers seemed to be alive to this fact. They went ahead full steam.And then came the big one: Information and Communication Minister Samuel Poghisio surfaced, looking quite no-nonsense. He declared the strike illegal and ordered the workers back to work or they would be sacked within hours and their jobs advertised.The workers ignored him… And the rest, as you well know, is history. He ate his words.Last week, KBC workers’ reps appeared before a parliamentary committee and spoke very candidly. Their bosses followed, sweating out details about the state of things at KBC.Wasn’t that a great sight? Management denied all that stuff about “sexually transmitted promotions” and “interviews on the carpet”, which KBC insiders afraid of victimisation alleged to be rife.In other parts of the world, there would be sacking and resignations of managers at the public broadcaster if stuff like that became public. Not in Kenya.There was Walter Mong’are a.k.a Nyambane, the Radio Programmes Manager, his clownish grin wiped off his face, trying to explain that he went to some of the best schools in the country and that as a Kenyan he is entitled to a job. Workers had demanded to know how he got his job and whether he had the required qualifications. Beautiful!Indeed, Kenya was watching, as the Channel One TV slogan goes. KBC will never remain the same again. The momentum the workers have set must be sustained. A new KBC Act is needed urgently, together with other key reforms. The corporation must be turned into a world-class public broadcaster in line with provisions of the Constitution to serve the people of Kenya.The days when KBC was a seedy mess where bosses conduct “ horizontal interviews”, when managers were also the institution’s suppliers, when news content was decided outside the newsroom, when underpaid workers lived in mortal dread of the landlord, etc, must surely belong to the past.And we have the resolve of KBC’s workers to thank for that. Barrack, this looks like a serious development...IANA oversees the global IP address allocation under ICANN through a contract signed with the US Govt. This contract is expiring and so there is need to shop around for proposals (RFP) on the way forward. The NTIA said this hour that it has canceled the RFP for the new IANA contract "because we received no proposals that met the requirements requested by the global community" NTIA thinks that ICANN's bid was unsatisfactory, in other words. The NTIA said: Based on the input received from stakeholders around the world, NTIA added new requirements to the IANA functions' statement of work, including the need for structural separation of policymaking from implementation, a robust companywide conflict of interest policy, provisions reflecting heightened respect for local country laws, and a series of consultation and reporting requirements to increase transparency and accountability to the international community. The government may cancel any solicitation that does not meet the requirements. Accordingly, we are cancelling this RFP because we received no proposals that met the requirements requested by the global community. The Department intends to reissue the RFP at a future date to be determined (TBD) so that the requirements of the global internet community can be served. However, it has extended ICANN's current IANA contract until September 30, 2012. This means ICANN still has its IANA powers over the DNS root zone, at least for another six months. While the NTIA has not yet revealed where ICANN's bid for the contract fell short, it is known that the NTIA and ICANN's senior management did not exactly see eye to eye on certain issues. One of the key sticking points is the NTIA's demand that the IANA contractor - ICANN - must document that all new gTLD delegations are in "the global public interest". This demand is a way to prevent another controversy such as the approval of .xxx a year ago, which the Governmental Advisory Committee objected to on the grounds that it was not the "the global public interest". Coupled with newly strengthened Applicant Guidebook powers for the GAC to object to new gTLD application, the IANA language could be described as "if the GAC objects, you must reject". If the GAC were to declare .gay or .catholic "not in the global public interest", it would be pretty tough for ICANN to prove otherwise. But ICANN CEO Rod Beckstrom has previously stated that he believed such rules imposed by the US government would undermine the multistakeholder process. He told the NTIA last June that the draft IANA contract language stood to "rewrite" ICANN's own process when it came to approving new gTLDs. The IANA functions contract should not be used to rewrite the policy and implementation process adopted through the bottom-up decision-making process. Not only would this undermine the very principle of the multi-stakeholder model, it would be inconsistent with the objective of more clearly distinguishing policy development from operational implementation by the IANA functions operator. Since then, language requiring ICANN to prove "consensus" on new gTLD delegations was removed, but language requiring it to demonstrate the "global public interest" remains. The game is bigger than petty squabbling about new gTLDs, however. The US government is worried about International Telecommunications Union treaty talks later this year, which many countries want to use to push for government-led internet governance. A strong GAC, backed by an enforceable IANA contract, is one way to field concerns that ICANN is not responsive enough to government interests. 140Friday. . . and I wept

Hi, I took time to attend the 140Friday session and at the end I wept first because as I sat there I realised that this was yet another talk shop activity in full swing but most importantly was the rubbishing of the late Evelyn Rono's efforts to give the sector a voice through KEPSA. Evelyn spent many hours lobbying for the ICT sector within the government an effort that has come to nought as we, yet again, scatter off into our various selfish corners. If all those tributes we kept sending around after she past away were genuine then lets honour her by continuing from where she left off instead of going off in a tangent. It was suggested by Dr. Ndemo and echoed by Mr. Kokubo that a team be formed to prepare a white paper on the issues that arose during the session, it was suggested that this would be best handled through the ICT Sector of KEPSA just for one of the panel to wrongly imply that KEPSA was an association for manufacturers (that organisation is called KAM who are also members of KEPSA). Dan Awendo of Investeq indicated that what is ailing us as an industry is the one man show syndrome and the leopard hunting mentality. If we can not within us form a body that can speak in one voice then all the efforts are a waste of time and resources. I will repeat what I raised a while back when I was not able to get a platform from which to take over the governorship of the ICT sector at KEPSA from Evelyn because the Computer Society of Kenya who I assumed would propose me had lapsed their membership. Unless we as an industry can speak in one voice and become a constituency then we shall continue to wallow in the miasma of deceit that was the session we had today, together we stand divided we fall. Twitter town hall meetings will not resolve what ails the industry it is only if we learn to come together that we can make an impact. KEPSA swings a sledge hammer on behalf of any of its sectors, it recommends who seats on government committees that require private sector participation and finally it has the machinery to draft and push through legislation. Forming small little talk shops will not make any progress and I read an ulterior motive to the proposal by Mr. Kokubo to form an "independent" group to prepare the white paper. He is very well aware that such a group will never see the day of light but if it was under the umbrella of KEPSA well that will be another issue. Brian That is a good update and an interesting development. A few weeks ago we were on the same subject with friends in the tech sector although many of them are in the Diaspora. We talked of an ICT sector alliance of key players, and toyed with names such as Kenya Technology Alliance (KETA); Kenya Communications Alliance (KECA or KCA); Information Communications Alliance (ICA) and many others that I cannot recall offhand. Formation of such an organization is timely and could see players in this sector shape the future of ICT sector in the country, indeed in the region. It would ensure that sector interests are heard and stakeholder input (as a sector) is incorporated in major decisions taken by government and other players such as Banks, Insurance Companies and the like. I can see the body advocating for policies such as capacity building (not just in infrastructure but skills development across the entire technology spectrum), incentives (e.g. for risk capital), indigenization (sp) of the sector in the same way India and China have done, and many more.
