*Facts Regarding the African Union Commission (.Africa) application * ** 1.The African Union Commission's (AUC) involvement in the dotAfrica (.Africa) Top Level Domain (TLD) process has been mandated by African Heads of State (OR Tambo Declaration) and African Minister's in charge of ICT (Abuja Declaration). 2.In fulfilling its mandate the AUC has, in accordance with an open and transparent Request for Proposal (RFP) process, officially endorsed UniForum SA t/a the ZA Central Registry (ZACR) to apply for and launch the dotAfrica (.Africa) TLD. 3.The AUC/ZACR, in accordance with the procedures and standards prescribed by the Internet Corporation for Assigned Names and Numbers (ICANN), has officially lodged an application with ICANN for the delegation of the (.Africa), under reference number: 1-1243-89583. This application constitutes the official AUC endorsed application for the dotAfrica (.Africa) Top Level Domain. Further details of this official application is available at:http://gtldresult.icann.org/application-result/applicationstatus/applica… 4.There is a competing private application, for a confusingly similar string, lodged by DotConnectAfrica Trust. The application for the dotdotAfrica (.dotAfrica) TLD string, under reference number 1-1165-42560. 5.The AUC/ZACR's application meets and exceeds, the minimum evaluation criteria set by ICANN for application of Geographic strings. 6.The AUC/ZACR's application, is correctly designated as a geographic application in accordance with the criteria and processes outlined in ICANN's Applicant Guidebook. In particular:/Africa (and therefore .Africa) is a clearly designated geographic area as defined in the UNESCO "Composition of macro geographical (continental) regions, geographical sub-regions, and selected economic and other groupings" list (http://unstats.un.org/unsd/methods/m49/m49regin.htm)./Therefore the designation of the official dotAfrica (.Africa) TLD string application, as a geographic name, is technically and procedurally correct. @lordmwesh, 1st to say it sounds like a bad dream for KENIC if this is true. Remember KENIC is in the global ^guiness^ book of IT as a model top level country code organisation. It is therefore necessary that we work to ensure that it does remain so. Kenya must continue to provide leadership in the region and am not sure this sounds lke something to export. But since the Chair -our very own Alice - promisd an AGM this month, guess we can give her the month and see then decided on the extra ordinary if necessary. Tribute to Eng. Ochola

Just read in the paper on the death of Eng. Atieno Ochola (Tieni) of CCK. This was one of those hardworking people in Kenyan ICT who has rendered many years of service quietly. I will remember her as someone who was ever smiling. Tieni was an "A" student throughout her academic life which took her through Alliance Girls and the University of Nairobi where she was the only girl in the Electrical Engineering class. Friends This is a great loss to many, many of us that interacted with the late Tieni over a long period of time. And a great loss to the ICT sector in Kenya. I have known this dynamic lady for many years since our days at the U of Nairobi. She was one of the few women that studied engineering when it was not fashionable for women to do so. Indeed, it was common to find one woman in a class of 30 which usually elicited various (I must add not so friendly) reactions. To survive in such environment for a women meant being tough, fending of stereotypes from both men and women, students, faculty and staff. I hope she kept good diaries (if not an autobiography) from which her story could be gleaned as an inspiration to younger generations. Dear Listers, It is indeed true that our copper fixed line continues to be affected due to vandalism and sabotage. But we continuosly make efforts to not only repair the lines as quickly as possible but also to put in place new measures to reduce the impact using fibre rings and other wireless solutions. Its our sincere hope that now the legal framework is in place to have stiffer penalties for convicted vandals that the incidences will minimise. As Lordmwesh indicates below we also offer redundancy through wireless at no extra cost for all post paid customers. More details on this can be obtained from your account manager or at any of our shops. On the issue of waiting lists this ordinarily shouldn't be the case for areas with infrastructure you can get a landline in 5 working days including the survey. Listers, I have been observing various initiatives that have been established under the multistakeholder approach and i must admit that we have a problem there are lots of murmurs suggesting flaws in communication or decision making structures, i i have also noticed that there is a lot of emphasis on personalities and groupings of like minded people as opposed to institutions which appears really harmful at the beginning but is characterised by strained relationships which stifflle synergies that can be achieved through knowledge and information sharing based on experiences. If I already have access to a local exchange and the EAIXP is in another country, why would I send my traffic via that route? Cybercriminals in developing nations targeted Cybercriminals in developing nations are being targeted in a new effort to combat the illegal activity. The International Cyber Security Protection Alliance has launched a research project to identify how attacks are likely to evolve over the next eight years. It said that faster links to the net in parts of Africa, Asia and Eastern Europe were likely to create problems. The ICSPA will advise governments and local authorities on how best to react. The organisation is a coalition of law agencies, security companies and businesses, including Visa Europe and the defence firm EADS. "It's not just about putting a black mark against a particular nation because many of these countries are the unwilling hosts to cybercriminal networks," John Lyons, the organisation's chief executive, told the BBC. "We know the countries that provide 'organised cybercrime' with the ability and the hosting capability to attack the West in terms of its business and customers. "So, what the ICSPA is looking to do is to work with those nations to provide support to help them improve the cyber-resilience of their national infrastructure, to aid their own economies, and to help their law enforcement groups tackle cybercriminals who work out of their country." Advising Africa Although the research project has only just got underway, the group has already started to co-ordinate action. Members of the UK's Serious Organised Crime Agency (Soca) began work with the Ghanaian government in February to help it take technical steps to prevent cybercrime, and ensure offenders are prosecuted. Mr Lyons said Nigeria, Botswana, Uganda and Rwanda were among nations likely to be targeted by the campaign. The countries were starting to benefit from improved internet access, but would struggle to "suppress the criminality that will come with that connectivity," he said. Other countries on his group's watch list included Bulgaria, Romania, India, the Philippines and parts of Latin America. October report The ICSPA wants companies based in developing nations to contribute to the costs of its efforts. However, Mr Lyons acknowledged that the richer nations also needed to do more to combat internet crime. I understand that the East African Communications Organisation in partnership with regional IXPs is setting up a task force to establish the East Africaninternet Exchange Point (EAIXP). The National IXPs (KIXP, UIXP etc) in East africa are already a success, so the introduction the the EAIXP just stamps that governments are taking the internet seriously and hence egovernance is the way to go. I also understand from some insider sources that the East African Communications Organisation (EACO) is to spearhead this process. I expected these to be the issues discussed at the just concluded EAIGF. Did it ever make it into the agenda? Mueller When U.S. politicians and businesses tell us that the revision of the International Telecommunication Regulations could lead to a takeover of the Internet or global censorship, I think of Saddam Hussein. Why Hussein? The invasion of Iraq was based on the claim that the Iraqi dictator held weapons of mass destruction, and thus posed a clear and present danger to this country and the world. Those who wanted a war played up the threats to manufacture political support. We now know that there were no WMD; we were rushed into war under false pretenses. The result, most agree, was disastrous. Here's the lesson I hope we all learned: a false diagnosis, inflated to provoke extreme, hasty action, leads to bad outcomes. Something very similar to the WMD claims seems to characterize our approach to the World Conference of International Telecommunications (or WCIT, pronounced "wicket"). Maybe the stakes seem lower. No one thinks millions of people are going to die because of an International Telecommunications Union meeting in Dubai. But from another perspective the stakes are much higher. The linkage of powerful information technology to free, open, global communications makes gigantic contributions to civilization and commerce. And it was the Internet - the ability to network computers across borders, free from nation-state controls and permissions - that opened up this new world for us. If that is truly threatened by WCIT, it is indeed something to rise up about. But the claim that the revision of the International Telecommunication Regulations constitutes a mortal threat to the future of the Internet is absurd. It is even less plausible than the claim that Hussein was harboring WMD. The simple fact is that the WCIT cannot possibly undo the Internet revolution unless all the governments involved, including the United States, agree to do so. The International Telecommunications Union has no police force, no army. It cannot make any state do something it doesn't want to do. It cannot even fine or tax corporations. There is no Internet-WMD hidden in its stately offices in Geneva. Hello Harry, Thanks for your email. The problem that was affecting the main cables serving Loita Street was compounded by burst sewers underground due to the flooding of previous months. We had to get City Council to sort out the sewers and shut down the services from Saturday June 23rd pm to Monday June 25th 8am after which services resumed in the area. Daniel Jury (Judge?) still out on whether ATU/ITU need greater influence on internet governance. I think that the ecosystem that has worked pretty well to a large extent needs to be expanded to include these players and not necessarily giving any one or two player greater control... Having said that can the conveners please circulate the final discussion points and way forward of the last day of the EAIGF? The Center for Intellectual Property and Information Technology (CIPIT) will be hosting a seminar and training workshop focusing on protecting Intellectual Property (IP) in the ICT sector. The seminar/workshop will be at Strathmore University, and is co-hosted by iBizAfrica. On Aug. 14, the topic will be computer software patents. We will explore many issues both local and international, in an effort to answer two questions: (1) Is software patentable in Kenya? and (2) Should software be patentable in Kenya? On Aug. 15, we will answer the question: "how can people in the ICT industry protect their intellectual property?" This will be a highly practical (i.e., not academic and not theoretical) session and will cover many issues of IP. Dear Good people I have completed reading the first section (he calls them ''books'') of Miguna's book - the part about his childhood, school and university. I am appalled that the man could so shamelessly write lies on himself and other students. Now, Miguna was my classmates at the University of Nairobi.We shared philosophy and literature classes. I totally disagree with the image he tries to paint of himself, but the most disgusting thing is that the man had the cheek to publish such despicable lies on fellow student leaders. True, the Sonu leadership that his team replaced was composed of pro-government stooges imposed by the university administration. The chairman was a man called Nduma Nderi, Nderi was not popular with students; which meant he could not address rallies with confidence. But for Miguma to claim that the man would wet his pants while addressing Kamukunjis is simply cruel. To describe this as a bare-faced lie is to understate it. I attended all rallies addressed by Nderi at the Great Court; I never saw the man wet his pants. Nderi was appointed judge of the Industrial Court the other day. I am sure he has children. He must have accumulated respect over the years. I just wonder what this does to his reputation. Then there is Wafula Buke, who was elected as chairman when students rejected Nderi.This was the election that also brought in Miguna as secretary for finance. According to Miguna in his book, Buke was not only an unkempt leader, but he also drunk a lot.Now, Buke was (and is still not) the best dressed man, but I have never seen him unkempt in all the years I have known him. Like most students of that time, he liked to wear jeans. As for drinking, I never saw him drunk on campus and neither did I ever met him in any of the drinking places frequented by students. Buke has been consistent as fighter for a more just society. What does Miguna aim to achieve by describing him thus? I could go on and on, but let me conclude by saying that I am not sure I can believe anything else this man writes in the subsequent pages. I can stand for a writer who exposes corruption, but not one whose aim is to injure reputations so as to appear better than everybody.

At the ongoing EA IGF at Jacaranda Hotel, Brian Longwe pointed out an important issue that relates to Cyber security. He pointed out that there needs to be a sort of a "cyber security police" kind of organization that enforces cyber security among users, knowing that users are the biggest point of weakness when it comes to information security. He is right on. But looking at it from another perspective, knowing that users include or belong to organizations, its important to point out that what Brian was referring to is called Compliance. But one may ask, compliance to what, and who is there to enforce the compliance across the board? One question I always ask participants in our information security trainings is how well they have secured their networks. Very few people are able to answer this question in a satisfactory manner. The thing is, when you secure your information assets, what benchmark do you use, and how can you tell how well you are doing based on that benchmark? Thats called capability maturity. To tie my argument, what is required is a framework that lays down the enforcement of information security within organizations in particular industries, and even down to individuals. Call it data protection, and bring in the issue of the data protection legislation that is being worked on. From my point of view, this data protection bill lacks in depth in specifying this framework which can be used across the industry by all, be it in the private sector or public sector. If we were to compare this to the SOX Act or HIPAA, we will find that ours is quite shallow and still needs a lot of depth so that it can effectively provide this "policing" framework. Touching on what CCK informed regarding the CIRT-CC, I realized that there is no adequate representation there from the private sector, apart from TESPOK which is made up infrastructure owners. It would be good to include professional bodies like ISACA as they do have excellent skills that they can contribute on a policy level. Another important body missing in action is the Kenya Bureau of Standards, which is involved on an international level in making the actual standards that are relied on for information security. Principle of no transborder harm

Dear all, This is a recommendation of the Council of Ministers for Europe but it is very interesting in light of the discussions in the EAIGF today especially on cybersecurity/ cybercrime. See forwarded (inline) message below although the local/East African/African context could provide a good framework for co-operation. But one one has to wonder how this impacts human rights eg if one state requests another to take down content or block content.... ...................... forwarded message In the context of the overall discussions on rights and principles for the Internet, I wanted to call attention to thIs recommendation of the Council of Ministers of the Council of Europe<https://wcd.coe.int/ViewDoc.jsp?id=1835707&Site=CM&BackColorInternet=C3C3C3…>. It established an important notion regarding the responsibility of States to avoid national decisions or actions that would have a transborder impact on access to and use of the Internet. The relevant paragraphs are as follows (emphasis added): *1.1. No harm* *1.1.1. States have the responsibility to ensure, in compliance with the standards recognised in international human rights law and with the principles of international law, that their actions do not have an adverse transboundary impact on access to and use of the Internet.* *1.1.2. This should include, in particular, the responsibility to ensure that their actions within their jurisdictions do not illegitimately interfere with access to content outside their territorial boundaries or negatively impact the transboundary flow of Internet traffic.* *1.2. Co-operation* *States should co-operate in good faith with each other and with relevant stakeholders at all stages of development and implementation of Internet-related public policies to avoid any adverse transboundary impact on access to and use of the Internet.* As you know, governments actions that can be interpreted as implementing an implicit higher norm represent - if repeated - a foundation for recognizing this norm as an emerging international principle. In that regard, the fact that Egypt's shutting down access to the Internet on its territory during the Arab Spring left all the transit traffic untouched points to an emerging principle of "no tampering with transit traffic" that may prove very important in the future in particular for landlocked countries. This was the trigger for the introduction of the above paragraphs in the CoE recommendation and I thought it was useful to call attention to this dimension. As a side note, it is interesting to look at this principle in the context of the rojadirecta and bodog cases. Looking forward to more discussions on this topic in Baku. Hope it helps. -- Grace L.N.
