Listers, Good morning, I'm reading this story on Daily Nation, www.nation.co.ke/News/Blogger+denies+abusing+Mutua/-/1056/1485226/-/10imd12…, and accorind to the charges, Alai violated the Communication Licencing Act. My questions: 1. What exactly did he violate in the Act? 2. Where can one get (a soft copy of) the said Act? 3. Is this law same as the Kenya Communication (Amendment) Act? Thanks

Dear Listers, Since inception, KENIC has continued to facilitate the growth of the dot KE Registry, enhanced the stability and resilience of the local Internet, promoted regional corporation among other Country Code Top Level domains (ccTLD) managers and hosted regional capacity building workshops. These achievements have contributed to the recognition of KeNIC by the African Top Level Domain (AfTLD), and other regional and international Internet management bodies, as a successful registry model worth emulating. To ensure that we continue carrying out our mandate effectively and with full participation of stakeholders, we are pleased to invite you to witness KENIC's ninth Annual General Meeting (AGM) to be held on Friday 24th August 2012 at Sarova Panafric Hotel from 0800hrs. Hi All, Yet another nail in the Konza coffin with the imminent departure of Craft Silicon to Singapore as a result of the finance bill which gave tax incentives to imported software and no corresponding incentives for local developers. http://www.nation.co.ke/Tech/ICT+firms+shun+Kenya/-/1017288/1483212/-/1sy89… At this rate Nokia will relocate Virtual City to Denmark or Singapore if we continue to allow our laws to favour foreign firms at the expense of developing local capacity. This development pours cold water on the recent establishment of a research lab by IBM as those who acquire the skills will not be able to be competitive locally. More disappointing is a statement by Huawei Kenya representative, Wind Li, that such incentives to foreign software developers will challenge locals to be more creative yet we all know that China shutdown it borders to foreign participation for over 50 years which resulted in their current positive growth. He added insult to injury by saying that removal of trade barriers is always good for a country's business development, this statement sounds a lot like what the western governments kept preaching to us during the height of the structural adjustment program. The U.S. government said in a statement on July 1, 2005 that its Commerce Department would continue to support the work of Internet Corporation for Assigned Names and Numbers (ICANN), and indefinitely retain oversight of the Internet’s 13 root servers. This indicated the U.S. decision to retain ultimate control over the global Internet, which enabled it to unilaterally close the Internet of another country. A suddenly paralyzed Internet would definitely cause huge social and economic losses to the country. More and more countries are beginning to question the U.S. control over the world’s Internet as the international resource should be managed and supervised by all countries together. However, the United States has conducted a pre-emptive strike, and refused to give up control over the Internet in the name of protecting the resource. The refusal reflects its hegemonic mentality and double standards. The United States controls and owns all cyberspaces in the world, and other countries can only lease Internet addresses and domain names from the United States, leading to the U.S. hegemonic monopoly over the world’s Internet. During the Iraq War, the U.S. government in 2003 asked ICANN to terminate services relating to Iraq’s top-level domain name “.iq” and then all websites with the domain name “.iq” disappeared overnight. The United States has taken advantage of its control over the Internet to launch an invisible war against disobedient countries and to intimidate and threaten other countries. The United States have repeatedly called for “protecting Internet freedom.”In fact, it is only protecting its own “Internet freedom” even at the expense of other countries. Ten of the global Internet’s 13 root servers are located in the United States, and the U.S. government can supervise the Internet for national security reasons according to the U.S. law. By doing so, the United States actually gains access to all information transmitted online, while other countries can do nothing about it. Ultimate control over the Internet has been an important tool for the United States to promote its power politics and hegemony worldwide, and any other country may fall victim to this. As a big country on the Internet, China opposes the U.S. unreasonable and unilateral management of the Internet, and seeks to work with the international community to build a new international Internet governance system.

Dear all, (apologies for the length of this email) I feel compelled, by most of the recent commentary regarding KENIC as well a by my involvement from day 0 of the process to set up a registry for .KE, to add my voice to the discussion currently ensuing. First of all, a bit of history - at the beginning of the process to have a Kenyan registry for .KE there were two major contenders. The two were the ISP community represented by TESPOK (with Richard Bell and myself responsible) and CCK (with Michael Katundu responsible) acting on behalf of government. Both parties started out pursuing different paths towards the same goal but quickly realized that the process needed teamwork and a joint effort. The then CCK director general, Sam Chepkonga, called for a meeting of the various interested parties at the time, including CCK, TESPOK, Telkom Kenya's Jambonet, KENET and others. At this meeting it became evident that CCK had originally misunderstood the correct process and procedures for engagement with ICANN related to the .ke cctld, since I had been part of the consultative group that drew up ICANN's ICP-1 guidelines for CCTLD management, I shared what the correct procedure was. As a result, CCK and TESPOK decided to join forces and work closely for the redelegation of .ke and the steering committe that led to the establishment of KENIC was formed. 13 months later we had a fully operational registry, running under a non-profit organization called Kenya Network Information Centre (KENIC). The legal form of the organization was as a company limited by guarantee, the guarantors being CCK and TESPOK. These are what the law calls the "members" of the company who ultimately are responsible for all issues related to the company. As with any other limited company - the members are free to decide whom to appoint as directors of the company for corporate governance - strategy, policy and direction. This therefore means that from a purely legal standpoint, only TESPOK and CCK get to decide who the directors of the company are. It was decided from the outset, however, that the board of directors would be constituted by identifying representatives of the "Local Internet Community" and soliciting nomination of a candidate for directorship from them. It was also agreed that government representative would never chair the organization, but Govt would have a "Golden Vote" or power to veto any board decision that was felt as not being in national interests. The original groups identified included CCK, Min of Finance (GITS), E-Gov Directorate, TESPOK, DRAKE (domain registrars association) and KENET. Over the years, other groups have emerged from which candidates for directorship have been identified, these have included KIMA, KICTANET among others. Before we start rocking the boat and end up with what I call "management by harambee" with every tom, dick and harry claiming their legitimate right to be on the board of KENIC I think we need to remember what a board of directors is supposed to be and do as per the 14 principles for corporate governance as defined by the Institute of Directors ( http://www.iod.com/MainWebsite/Resources/Document/corp_gov_guidance_and_pri…) I would like to specifically highlight these principles in particular: - Shareholders should establish an appropriate constitutional and governance framework for the company. - Every company should strive to establish an effective board, which is collectively responsible for the long-term success of the company, including the definition of the corporate strategy. However, an interim step on the road to an effective (and independent) board may be the creation of an advisory board. - The size and composition of the board should reflect the scale and complexity of the company’s activities. - The board should meet sufficiently regularly to discharge its duties, and be supplied in a timely manner with appropriate information. - Levels of remuneration should be sufficient to attract, retain, and motivate executives and non-executives of the quality required to run the company successfully. - The board is responsible for risk oversight and should maintain a sound system of internal control to safeguard shareholders’ investment and the company’s assets. - There should be a dialogue between the board and the shareholders based on a mutual understanding of objectives. The board as a whole has responsibility for ensuring that a satisfactory dialogue with shareholders takes place. The board should not forget that all shareholders have to be treated equally. - All directors should receive induction on joining the board and should regularly update and refresh their skills and knowledge. - There should be a clear division of responsibilities at the head of the company between the running of the board and the running of the company’s business. No one individual should have unfettered powers of decision. - All boards should contain directors with a sufficient mix of competencies and experiences. No single person (or small group of individuals) should dominate the board’s decision-making. - The board should establish appropriate board committees in order to allow a more effective discharge of its duties. - The board should undertake a periodic appraisal of its own performance and that of each individual director. - The board should present a balanced and understandable assessment of the company’s position and prospects for external stakeholders, and establish a suitable programme of stakeholder engagement. I have served (in my personal capacity) on the KENIC board as a director and have huge respect for the other directors, all of whom I believe have tried their best to serve the organization's interests. It is true that from time to time individual members might have forgotten their fiduciary obligation and put either their own interests or those of the the organization they represent first, but there has been a reasonable balance due to the diversity of the members of the board. In conclusion I would like to add that I have complete confidence in the current board, that they will see the organization through this "rite of passage" which I believe is very important for the growth and stability of the organization. Mbugua, interesting analysis... i have inteacted with both Wangusi and Omo and am sure either of them can do the job. Not had a chance with Kiptiness but cant rule him out. Right now whoever gets the job will be based on which politician you know and more so on how politcally aligned they are to our Hon. Minister Pogisho. Going forward, i think the DG job is very serious and am dissapointed that it never made it to the level where the applicants are vetted by Parliament and the holder made to understand that they owe allegiance to the people of kenya - rather than the minister in charge..(no offense meant to cuurent holder :-). The Interim Independent Electoral Commission (IIEC) will hold a two-day conference and exhibition on election technology at the KICC grounds in Nairobi on 22nd- 23rd Sept., 2012. Over 40 firms dealing with election technology, both local and foreign, have been invited to showcase their innovations to the Commission and the public. Electoral management bodies from East African Community (EAC), professionals in electoral technology, political parties and other interested parties have also been invited to the open forum on election technology. Participants will be expected to interrogate and evaluate the solutions offered by the various vendors and share their findings with IIEC. The aim of the open day is to expose voters to election technology and give them an opportunity to try out some of the solution on offer. In looking for the appropriate technology, the electoral management body would like to make informed decision based not only on expert advice but also the user experiences. It is apparent that the expanded 2012 general elections, which will require voters to vote for six elective positions in a single session instead of the traditional three, will require a fast and reliable solution. The appropriate application of technology should increase administrative efficiency, reduce long-term costs and enhance political transparency.Since technology is always designed to solve problems, and elections are not short of problems, technology is therefore first port of call by the Commission. Friends I hope Dr Ndemo has taken the sound advice offered in this forum, especially the "right to reply aspect" and the means to do so: oped piece, press conference, etc. My behind the scenes consultations suggest the same, i.e. the PS is best placed to respond because, unlike most of us, he is most intimate with the issue at hand. He has the facts with which to counter the issue and understands the process of government procurement better than most of us with little or no experience in government. As an industry and fans of the work the PS has been doing, we can lend support; and in doing so seek complete transparency in the manner the authorities treat the matter. And that no siasa, no vendetta, etc drive the matter. Indeed, as a country with new laws and one aspiring to strengthen the rule of law, due process is a requirement for every one. We can ask that of the investigators from KACC. This Athlete Julius Yego presents an interesting twist to the role of ICT in everyday life. His story if i got it correctly has an interesting mix of ICT and sports. Lacking a coach, he used youtube videos to learn how to throw the javelling correctly, and there he is, at the tail end of the javelling in london 2012 but still wearing a proud Kenyan flag in the list. He gets an A for guts, A for creative use of Technology and an A for determination. Software Freedom Day 2012* - 1st September 2012 *Open Source Developers Challenge *- 31st August 2012 Strathmore University, Nairobi* Theme:* “An Innovative, Open Future for Sustainable Socio-Economic Development”* The success of the Free and Open Source Software (FOSS) development model has made immeasurable contributions to the development of information and communication technology (ICT). FOSS is software that gives the user the freedom to use, to alter and to share it. Since the software source code is readily available, the users are able to make changes to suit their requirements. FOSS therefore has very many benefits compared to the proprietary and closed source alternatives. This openness means that FOSS is the embodiment of innovation and collaboration. This leads to better software, and ease of access to technology. The end result is that better and affordable solutions become available to enhance the quality of life of people from all over the world. This is is even more evident in poor countries where the large masses of unemployed youth can easily arm themselves with technology tools that can give them an opportunity to earn a living and improve their quality of life. Today, open source runs most of the technologies that we use. More than half of all mobile devices being sold run the open source Android operating system. More than a 3rd of worlds Domain Name Server (DNS), run on BIND, literally the glue that keeps the Internet together, which is open source. Over 70% of the web pages on the Internet are hosted on the open source Apache web server, while about 95% of the world's super computers run on Linux, arguably the most successful open source project. Nearly all the popular social media applications like Facebook, Twitter, Google, LinkedIn, YouTube etc, are built on open source tools. The Internet would probably not be as pervasive as we know it today if it was not for free and open source software. Today we have a future that promises openness. The Kenya Government is only the first country in sub-Saharan Africa to launch Open Data. The Open Educational Resources and Open Learning are becoming important resources. The Wikipedia (built on open source) is a blazing success in Open Content development and collaboration. *The Software Freedom Day 2012 (1st September 2012) *The Software Freedom day is a concept that was started by the Software Freedom Foundation and is aimed to celebrate the FOSS movement and community. It is also meant to educate the public about the benefits of using FOSS. SFD is held every 3rd Saturday of September and organized by local FOSS communities. However, a team organizing an SFD event in their locality are free to alter the date to suit the local requirements and circumstances. LPA-Kenya last organized the SFD in 2007. We are now planning this event to be a yearly celebration in line with our strategic plan. The conference will also be preceded by various training workshops which are aimed at imparting practical skills in the leading open source tools, which will be facilitated by some of the leading open source experts in Kenya. This year´s SFD Kenya will be graced by Jon ¨maddog¨ Hall, the Director of Linux International. Mr Hall, or maddog as he is widely known, is a globally renowned Open Source advocate, having supported the early development of Linux. This involvement brought him to a very close working relationship with Linus Torvalds, the creator of Linux. He has worked for Western Electric Corporation, Aetna Life and Casualty, Bell Laboratories, Digital Equipment Corporation, VA Linux Systems, and SGI. It was during his time with Digital that he initially became interested in Linux, and was instrumental in obtaining equipment and resources for Linus Torvalds to accomplish his first port, to Digital's Alpha platform. The ITR treaty was adopted in 1988 and since then, no updates have been made until now. However, it’s emerging that some member states believe that the treaty should be expounded to include internet regulation. There have been proposals related to IP addressing, cyber security (giving states more control over access over content and access to networks), spam, interconnection, Quality of Service (QoS), etc . Therefore, decisions made at this conference could redefine the international regulatory environment for the internet and telecoms in the 21st century. *Press Release* * * *Kenya becomes the first African beneficiary of IBM research lab* *August 13, 2012, Nairobi, Kenya – *The government today announced the opening of the first IBM research lab in Kenya. This makes Nairobi the premier location for IBM research in the African continent.** The lab, a collaboration between Kenya and IBM East Africa, will see the partners each contribute $10 million dollars (Ksh830 million), over a period of five years. Earlier today, President Mwai Kibaki and IBM Global Chief Executive Officer, Ginni Rometty signed a memorandum of understanding to officially flag-off the setting up of the lab. “Kenya vision is to become the top ICT hub in the continent. IBM’s commitment to undertake the proposed research agenda will contribute greatly to our national priorities as part of Kenya’s Vision 2030 agenda,” said His Excellency Honorable Mwai Kibaki, President of Kenya. “We look forward to delivering world-class research and innovation through the partnership and playing an important role as an IT leader on the African continent.” It is projected that the lab will not only drive innovation but help market Kenya as a leading modern services economy. The research agendas will be defined by both parties and will have a strong emphasis on solving home-based and African problems. The project will greatly benefit the momentum already established in cutting-edge mobile money technology, contribute to the creation of high-value jobs, and bring significant prestige for Kenya. “IBM continues to expand its operations in key growth markets and we plan to lead the way by bringing Africa into our global network of IBM Research laboratories,” said Dr. John E. Kelly III, IBM senior vice president and director of IBM Research. “We will work closely with leading African scientists and engineers from academia, government and industry to address some of their most pressing challenges and greatest opportunities.” The Ministry of Information and Communications through the Kenya ICT board will implement the project, which will see Kenyans also gain in knowledge diffusion. Speaking on the partnership, PS, Ministry of Information and Communications, Dr Bitange Ndemo said: "In today’s world, innovation is the main lever for a competitive national economy, is a source of employment, and has the potential to improve lives. Hi Friends, This is a move towards the right direction indeed, when we have such huge investments that support ICT and Content more specially , it proves that content and data is what drives the day to day business in all facets of our economy, its a moment to be proud of. When Kenyatta Hospital is also undergoing digitization, i believe that its only the beginning of many more to come, and perhaps as we look forward to a ICT City as well . I think its our prerogative to begin to reach out to more and more institutions to also consider digitizing content as well as investing in local content generation, thats is the only way we shall get to redeem culture and preserve our heritage. Road Accidents Everywhere

Anyone know why we no longer care about road accidents? At the moment, a matatu on Mombasa road has been flattened between a trailer and a truck after the trailer rammed into it from behind, flattening it to the size of a seat. Yesterday morning, a trailer fell across the Nyayo roundabout in the morning. Yesterday in late morning, a truck overturned landing partly on a Toyota Harrier along Uhuru Highway. Yesterday evening, at Mlolongo, a truck overturned landing on a saloon car. Has it become normal for trucks to just overturn in this country. Who will issue a quick statement on this and then we are back to life as normal? @Mburu, i would have thought govt stakeholder is already present thro the Regulator and i would hesitate or avoid to add more govt seats in KENIC. I know academics would say regulator and govt are different but in our emerging democracies there is little or no difference in practice. But perhaps CCK the regulator intends to relinquish its role on the Kenic board in line with the fact that they r to regulate the domain space and hence they should step out of running or managing the same space. Over the past three weeks, a number of prominent government officials have been thrown into the limelight over accusations of failing to enforce procurement rules. Officials from the Kenya National Bureau of Statistics, the National Oil Corporation of Kenya, the Ministry of Information and Communication, and the Independent Electoral and Boundaries Commission (IEBC) have had questions to answer. Lucy Good suggestion. I can see that your activist self still burns with fire. Yes, I would like to be involved in action that would help this situation. We need a degree of consensus (a) the needed action as this would be a KICTANET (or at least a good cross section of its members) position and (b) the process for that action. From your note, I get the sense that you are proposing a paid ad/announcement in the paper; words (crafting the opinion once we have the facts) are the easier option. We need enough people to support this both in word and action (payment for the ad). I am wondering how many people are in support of this. NB: Dr Ndemo has indicated that the procurement law may be the issue. That is correct. I also know that unchallenges untruths become "truth", which is what the paid announcement would counter. Bw. Gaitho, With all due respect the messenger does need to be shot if their intentions appear suspect. Nobody questions that the issue is under investigation and from what I re-read it appears that KAAC was sent back to the drawing board since their report from April did not result in any prosecutions so they are investigating some more! What a waste of tax payers money.. The questions raised are why now with investors for the project in town, and what new information made this a "headline" news article while ignoring reporting on the positive impacts of the project aka blackout on VP opening ceremony. I don't know if this shoddy reporting will cost the country a promising project but from the postings here and elsewhere we need to mitigate the harm done by laying out the facts and giving the other side a chance to rebut. Lucy Ps.. I was recently in "Silicon Valley" and I am sure the Mayor would love to hear all about their "warehouses and garages" the Wikipedia has some very nice pictures.... Dear Pierre, The primary reason for AFRICANN's existence is to provide Africans who cannot afford to attend ICANN meetings the opportunity to understand better the various processes, policies and issues that affect them. This linkage is provided by those Africans who are able to attend/participate in ICANN processes. So when someone (anyone) discredits AFRICANN, and especially in such a manner as Ms Bekele has done, I believe that it is only appropriate that the community be informed. The fact that you are able to comment on the issue and share your opinion is a golden example of why AFRICANN exists.
