Touré. The U.S. government has hammered away at Touré and the ITU all this year, accusing the international telecom body of using the upcoming World Conference on International Telecommunications (WCIT-12) talks in Dubai as a forum to wrest key internet governance functions away from the private sector (and the U.S. government). The accusations clearly rankled Touré, who spoke at length about what WCIT is and is not about. WCIT 'Internet Governance' Hype Distracts Attention From Serious Issues, ITU Head Says By David McAuley The World Conference on International Telecommunications (WCIT-12) “has nothing to do with [internet] Governance,” International Telecommunication Union Secretary-General Dr. Hamadoun I. Touré told BNA Sept. 5 during email and telephone interviews. Touré reiterated and expanded upon previously voiced criticisms of what he called “over-dramatic” characterizations of the WCIT-12 process as a push by some governments to wrest control over the internet and place it in the ITU. Touré also took the opportunity to try to refocus the debate surrounding WCIT-12 onto what he argued were serious issues that require urgent attention by ITU member states--such as data security and exorbitant roaming charges. WCIT Draws Near The ITU, the United Nations's agency for information and communication technologies, is hosting WCIT-12 in Dubai, United Arab Emirates, from Dec. 3-14. The aim of the event is to revise the “International Telecommunication Regulations,” established by treaty in 1988 and widely credited with liberalizing the international telecom market, and enabling the growth that followed. The ITRs did not address the internet, however, which did not generate such a huge global impact until years later. WCIT-12 has garnered increasing criticism on substantive claims that it involves overreach by implicating the internet (17 ECLR 805, 5/2/12), and on transparency claims that the process is shrouded in secrecy. Touré has challenged the notion that either the United Nations or the ITU has designs on internet control, and has attempted, with some limited success, to pry the WCIT-12 process open for all stakeholders rather than just for ITU members. Serious Issues on Agenda Touré told BNA, “Internet Governance as we know it today” is about “Domain Names and addresses.” Internet governance, according to Touré, consists of: • the Internet Assigned Numbers Authority (IANA) functions; • the Internet Corporation for Assigned Names and Numbers (ICANN) functions; and • the ICANN-Verisign Corp. agreement on the root zone file and domain names. “These are issues that we're not talking about at all,” he said. “We're not pushing that, we don't need to.” Discussions on those internet governance topics are addressed by the Internet Governance Forum and the World Summit on the Information Society, Touré said. “WCIT is not going to duplicate this.” Touré stressed that the concern over internet governance should not drown out the opportunity for WCIT to take on matters of real import. “Why don't we talk about security, you cannot have freedom or privacy without security. If anyone can steal your identity you are not a free person.” There's so much on our plate. Why [would] I have to take over internet governance? Hamadoun I. Touré, Secretary General, International Telecommunication Union Roaming, the application of sometimes steep charges to maintain mobile device network-connectivity while the user travels from one country to another, is another WCIT topic that he said needs attention, calling it a very real issue for developing countries. There are others, he added, “We cannot talk about energy efficiency, we cannot talk about accessibility, we cannot talk about security for children?” “These are real issues we are talking about,” Touré said. “There's so much on our plate. Why [would] I have to take over internet governance?” Impact of Definitional Changes ITR Article 3 deals with international telecommunications networks. A summary of the existing proposals made public by the ITU, known as the “Draft of the Future ITRs,” shows a number of proposals for a new Article 3.5 that would touch upon naming, numbering, addressing, and identification. Touré disagreed with the suggestion that numerous proposals to add a new section 3.5 to the ITRs might have the effect of expanding the treaty to internet governance. “That is telecommunication numbering,” he said, something that preceded the internet. Some people, Touré added, will hijack a country code and open a phone line for pornography. “These are the types of things we are talking about, and they came before the internet.” Some have argued that proposals to revise certain treaty definitions might nevertheless have the effect of bringing internet naming and numbering into treaty coverage. For example, there are proposals to change the term “Telecommunication” to “Telecommunication/ICT,” and to change the definition of that term from covering “Any transmission, emission, or reception” of signals of any nature, to covering “Any transmission, emission, or reception, including processing” of such signals. Touré, in an email to BNA, challenged the idea that the proposed changes made a difference: It is important to note that transmission and reception of communications over IP-based networks is included in the present ITU definition of “telecommunications,” in the view of a number of ITU Member States. In fact, although there have been many discussions in the past regarding whether to change the formal wording of the definition, an argument advanced in favour of not doing so was precisely because technologies such as the Internet are already included, so there is no reason to change the definition. Touré, expanding on his emailed remarks, told BNA that the proposals that appear to involve the ITU in internet numbering and addressing were preliminary and subject to change. “These are preliminary proposals,” he said, “and I suspect that someone else will bring another counterproposal to this, we will analyze it and say yes, this is going beyond, and we'll stop it.” There is a misunderstanding in the debate, I am trying to refocus it, but some people don't want to listen to it. Hamadoun Touré What is important, Touré said, is that people are bringing up problems and proposing solutions, there is nothing behind the scene beyond that. “At the end of the day, we'll find the solution that is … workable for everybody … in the true tradition of the ITU.” Touré also expressed confidence that the WCIT meeting will successfully resolve controversy around another proposal that might implicate internet governance, this one involving a suggested change to Article 3.3 that would allow a member state to know how its traffic is routed, and to impose routing regulations for purposes of security and countering fraud. “Issues like that may have a real implication [leading possibly to] some impasse on the perception of freedom or privacy,” Touré said. But there will be counterproposals and we will find a middle ground, he said. Broadband Investment What WCIT-12 will do, Touré said, is “open up new opportunities for more investment in Broadband infrastructure to match … exponential growth in Data traffic.” Broadband capability must be made available for every community around the world, he said. That will take investment, and member states will discuss that in good faith and reach creative solutions to enable every person to exercise “his or her right to access, use, create and share information in an affordable and safe manner,” Touré said. The key, he added, will be to do this with “a sound regulatory system that is not heavy handed,” leaving the ICT sector with the right environment to flourish and prosper. Roads and Cars “This is like roads and cars,” Touré said. Traffic is growing exponentially, so governments need to make sure that highway infrastructure keeps pace with increased traffic on the roads. The highway engineer needs to make sure that the roads and bridges are correctly built. The highway engineer should be able to ask for details about the height and weight of cars and trucks without facing an objection that what the engineer really wants is to own the vehicles, Touré said. That makes no sense, Touré said, that is not what the engineer is asking for, and we should all instead work together for sound traffic management. “There is a misunderstanding in the debate, I am trying to refocus it, but some people don't want to listen to it,” Touré said. “When you buy a car you're not buying a road.” Settlement and Funding Touré said that WCIT will also focus on the settlement mechanism for the future of broadband traffic. “The old WCIT was based on simple voice telephony back in 1988 and that set the stage for the information society,” he said. Measurement metrics for international settlements were the time and location of the call, now the traffic is in bits and bytes, and time is irrelevant. There is a need to change the settlement process for combined voice, video, and data today, Touré said. He also said that “the flow of funds for Internet traffic” will be addressed at WCIT-12, but that cannot be considered to be a part of internet governance: There is nothing new about ITU discussing such flow of funds: it has been the topic of much discussion in ITU since 1998 and is the subject of Recommendation ITU-T D.50, which has been unanimously approved by all ITU Member States. … The Recommendation says that the value of traffic flow is one element, among others, to be taken into account in bilateral commercial arrangements by parties that provide international Internet connections. One suggestion for tackling funding has been put forward by the European Telecommunications Network Operators' Association (ETNO), a Brussels-based group representing companies in 35 countries. It calls for “fair compensation for carried traffic,” and floated the idea of “the principle of sending party network pays”. “It is easy to criticize, but ETNO has the merit of putting its view on the table,” Touré said. Others should come up with counter proposals, debate will ensue, he added. “I am convinced we will find a common ground.” Participation, Consensus, and Transparency Details about how WCIT is arranged and who will participate are available on the ITU's WCIT Background Briefs website, Touré told BNA. Basically, he said, it will be members states that participate as WCIT is a treaty-making conference. Sector members, whom Touré described as “mainly private companies in the industry and other relevant organizations,” can participate as observers, and may be invited to speak. He said it is a common practice among member states to include individuals from sector members and private companies in their WCIT delegations. Each member state will have one vote, Touré said. But a vote is unlikely, he quickly added. “I believe it is not necessary, this is not what our Members want, it can and should be avoided in the true tradition of ITU.” ITU member states have come through two world wars and a cold war without a vote, and WCIT-12 should be no exception, Touré said. The organization has been particularly adept at achieving consensus, he said. Touré said that no decision has yet been made regarding press coverage of WCIT. The decision regarding press attendance will be formally made by the WCIT conference itself at the opening, which is normal ITU practice, he added. Touré appeared to support greater press access to the WCIT talks. “By giving opportunity to Press to attend and report we will improve understanding and reduce speculation.” By David McAuley --

I am conducting my dissertation research on the East Africa Internet Governance Forum (EAIGF). Does anyone know how I may locate the transcripts for the 2012 EAIGF in Kenya; the 2011 EAIGF in Kigali, Rwanda; and the 2010 in Kampala, Uganda? Are the videos for these EAIGF meetings posted online? If so, where? I am also interested in the transcripts and/or videos for any of the national IGFs, including: Burundi, Kenya, Uganda, Tanzania, and Rwanda. Listers I hate to gripe about these issues..We are now sounding like scratched LP Records (for those on the right side of 40 you may remember LPs? :-) )... While browsing at home I decided to check my Safaricom bundle balance and this is the message I got from the SMS response:- *Current Data Bundle: 1448.49MB, expiry 07-10-2012; Night Shift Data: 750MB, expiry 14-09-2012. *1. Why should my bundle even have an expiry date?? I thought Safaricom assured us that this business of expiration dates for bundles bought was a thing of the past? 2. I know for certain that the so called 'Night Shift Data' promotion that Safaricom has been running has an expiry date. Last week this bonus mysteriously disappeared from my modem number. Now I know that this isn't right. Can someone from Safaricom resolve this issue? The community will then have 15 days for its further comments and submissions before the group finalizes its recommendations. The public website should be available early next week. As an internet user footing the bill through my wallet, I'm not only interested with the speed of access, but also the pricing. I think local content and peering will make more sense when ISPs start charging different (meaning cheaper) rates for traffic destined to local hosts. This will also spur growth of hosting infrastructure, growth of applications, and bring local content hosted abroad back home. This is the same model Safaricom uses for voice calls, with calls across networks charged a little bit higher than calls in Safaricom network. So if local data peering at KIXP is charged cheaper than international data, it will make a lot of sense. Charging the same to access Safaricom.com or orange.co.ke with yahoo.com or bbc.com is like KQ charging the same rates from Nairobi to Hethrow and Nairobi to Mombasa. I believe this is the model used by most Asian content's ISPs with the proliferation of local based online gaming. Hi, Over the weekend I happened to be glued in front of the idiot tube (say a lot about me) while surfing channels on my newly acquired StarTimes digital channels I came across a technology program that was covering the structure of a submarine cable. A cross section of a modern submarine communications cable. 1 – Polyethylene 2 – Mylar tape 3 – Stranded steel wires 4 – Aluminium water barrier 5 – Polycarbonate 6 – Copper or aluminium tube 7 – Petroleum jelly 8 – Optical fibers While watching the issue of the marine cable being cut ump tine times came back to me and I thought how exactly did such a re-enforced cable cut. Then today I see an article about spying on internet users after putting 2 and 2 together my conspiracy mind took over and I wondered was there really a cut in the cables or was it a snooping implementation that went temporarily wrong and the only way our was a total rebuild. In all the times that the marine cables have been cut, note that all 3 have been cut at some time, at no time have we been shown any photographic footage of the severed cable and neither have we seen the repair submarine being lowered into the sea as it proceeds to repair the cable. The only way an anchor can pull the cable to separation is if the cable is laid across the channel, but I believe that from the stories that we have been peddled it actually runs along the channel which means that the most that an anchor can do is move it off from the edge. I refuse to accept the argument that the anchor fell on the cable, 3 different times, unless the cable is magnetized and therefore attracts the anchor. Conspiracy ?, fact ? - you decide. It takes a while for the criminal investigation department dealing with these cases to work on them which is very frustrating to the sender. Safaricom appears not to have a sense of urgency to resolve these issues since they have all the information of their clients and can even trace the transactions as they take place. Again, at the police, they give you very discouraging information to the effect that they doubt if such cases are ever resolved. I believe even as we use technology, there is need for certain mechanisms to be put in place so that clients are not punished and inconvenienced by criminals out there abusing technology and the service providers need to be sensitive to this. How should these emerging technology crimes be handled? Just read from todays Nation http://tinyurl.com/97z64zb that the new Postmaster General holds a doctorate from http://www.washint.edu/en/ - Washington International University, a Cyberspace University. Whereas I have nothing against online education - having benefited from one - I just thought that I could share some advice. If you want to do an online program, do it from a PHYSICAL university that has an Online/Distance Learning division. In other words, the university should physically exist. Similar to if you want to do Online banking, better do it from an existing bank (e.g. Equity, Barclays, KCB, etc) who have an online division. That way you are likely to get your quality and credibility issues sorted out. I know Wikipedia is not very authoritative but it is always a good place to go to after asking Google. And so I did and this is what Wikipeidia said about Washington International University. http://en.wikipedia.org/wiki/Washington_International_University It even claims in its list of graduates and I quote " Asman Kamama Abongotum; Kenya's Deputy Minister for Education. He could lose his parliamentary position because of the unrecognized degree" Actually our Commission of Higher Education seems to have a problem with this University. I know the PCK board - that includes our PS Ndemo - may have seen this but argued rightfully that one may NOT need a PhD to ran a simple Postal Service in some developing economy. In which case, our self-nominated candidate, Bobby Yawe should have been called for the interview? Just thinking loudly and hope Kibunja and his friends (the mboys in mblue) dont come for me claiming this is hate speech - because I think its a mixture of advice and belated lobbying :-) walu.

Safcom has indeed made some tidy returns. But these returns can evaporate to zero if a wrong regulatory intervention is applied. Actually the elephant in the room is that Safcom has grown to a be a dominant operator (legalese for exhibiting monopolistic behaviour) and we should address that issue appropriately. The books say Mobile Number Portability would cure the problem - but it did not for Kenya. Am not sure tweaking with the interconnection rates further would solve the problem either. It may instead drop every Operator's Returns towards Zero...and there is some evidence of this happening if you have been tracking the CCK quarterly reports - the Average Revenue per User/Customer accrued by the Operators has been dropping consistently...and may theoretically reach a point where staying in that line of business is not longer attractive. In short, am not saying status quo is fine - indeed our internet access costs as a % of our average incomes, 50% - is way too high and is internationally considered unaffordable. However, one must carefully consider long term implications of (regulatory) decisions made to the market. IN SUMMARYIn the past couple of years, the President has intervened in the matter of mobile telephone call costs in a manner that is not only surprising, but also suspect.In the matter of Mobile Termination Rates, he acted in a most unconventional manner -- wading deep into the work of an agency that is more than four levels below his office.The intervention, whatever its merits, has been done in a most irregular manner and in direct contravention of the law that guides the operations of the telecoms sector regulator -- the CCK. High level intervention in the operations and decision-making processes of an independent agency does set a bad precedent.It is not clear why the President chose to use his private secretary to communicate to a State agency. Moreover, to demand that a fresh study of the impact of the new termination rates be done and the report taken to him for consideration amounts to gross violation of the regulator’s mandate.To the best of our knowledge, the CCK has a credible pool of telecoms experts and Mr Kibaki has no expertise in matters telecoms. Project includes 60 capacity building workshops in 30 countries [Johannesburg, South Africa --23 August 2012] – The Internet Society today announced that it has been selected by the African Union (AU) to conduct community mobilization and technical aspects workshops to support the establishment of Internet Exchange Points (IXPs) in AU Member States as part of the African Internet Exchange System (AXIS) project. The AXIS project aims at keeping Africa’s Internet traffic local to the continent by providing capacity building and technical assistance to facilitate the establishment of National Internet Exchange Points and Regional Internet Exchange Points in Africa. The project is funded by the Euro-Africa Infrastructure Fund and the Government of Luxembourg. The Internet Society is committed to organizing 60 community mobilization and technical aspects workshops in 30 African countries. To this effect, the Internet Society will also contribute its own resources for the implementation of this component of the AXIS project. Currently, much of Africa’s Internet traffic is routed through Internet exchange points external to the African continent. As countries establish their own IXPs, Internet traffic will be routed locally, creating a downward pressure on costs and stimulating growth in and distribution of local Internet content. Through the AXIS project, the interests of the AU and the Internet Society, working with other African Internet organizations such as AfriNIC, AfNOG, and AftLD, will be realized in this collaborative effort to assist in the development of a more locally operated and, hence, more robust and economically accessible pan-African Internet. Moctar Yedaly, Head of Information Society Division, African Union Commission, commented,“Africa is paying overseas carriers to exchange ‘local’ (continental) traffic. This is both a costly as well as an inefficient way of handling inter-country exchange of Internet traffic. Independent analysis has shown that Africa pays over US$600 Million to developed countries every year for inter-African traffic exchange that is carried outside the continent. We are therefore pleased that the African Internet Exchange System project will address this challenge by facilitating optimization of Internet traffic to support intra-continental traffic flows in Africa.” Dawit Bekele, Internet Society Regional Bureau Director for Africa, stated, “We are very excited to be selected by the African Union to support the growth of IXPs throughout Africa. We believe the AXIS project is extremely important to the continued health of the Internet ecosystem in Africa, and building the technical infrastructure and training the people to sustain it are fundamental to extending the Internet in Africa. Partnering with the African Union on the AXIS project is central to the Internet Society’s mission to ensure the open development, evolution, and use of the Internet for the benefit of people everywhere.” The Internet Society has provided technical training in Africa since the early 1990s, and supports the development of human and technical capacity to build reliable and sustainable Internet infrastructure in Africa and around the world. The organization’s African Bureau was started in 2006. With 24 Chapters, the Internet Society African Bureau works to promote capacity building and the responsible development of the Internet throughout Africa. Whao! that was fast! I would have thought more time would be required to balance out the political lobbying :-). Either way, congrats to Wangusi, am sure quite a number chicken will be served for dinner in certain parts of the country :-) But on a more serious note, the DG task is quite cut out - especially as we head into the election. Whereas it would have been simply to balance the interests of Operators/Competitors, Govt and Consumers it is now complicated by the interests of (electioneering) Politicians, Bankers (mobile money) and more recently Bloggers (social media - ref. Robert Alai?). It is indeed a full plate ahead of the DG. Talks to resolve row at Internet firm http://www.nation.co.ke/business/news/Talks+to+resolve+row+at+Internet+firm… The multi-stakeholder institution charged with administering Kenya’s Internet domain .ke, is hoping to iron out differences over its recent restructuring in its annual general meeting on Friday.The meeting, which will be held in Nairobi, brings together registrars, government representatives, Internet businesses and other people interested in the ICT sector.Speaking on Thursday, the organisation’s change manager, Mr Sammy Buruchara, said the forum would provide a good platform for the board of the institution to iron out issues facing the company.“It will give the board of the Kenya Network Information Centre (KeNIC) an opportunity to clear the air over all the allegations arising from the ongoing organisational restructure and create rapport on the way forward,” Mr Buruchara said.The AGM comes at a time when the institution is facing questions from the public over its decision to fire all its employees in what it says is an organisational restructure.A number of board members have also left KeNIC in the past two months.In an email, Information and Communications Permanent Secretary Bitange Ndemo termed the decision to terminate employees’ contracts without consulting stakeholders as drastic and unprocedural.“Even in the Government, firing employees has several steps that must be followed to ensure security of tenure. This came as a surprise, yet we are supposed to be stakeholders.
