Listers, PRESS STATEMENT 10th October 2012 NEWS EDITOR RE: PRESS STATEMENT ON MOBILE TERMINATION RATES The attention of the Communications Commission of Kenya (CCK) has been drawn to reports and commentaries in some sections of the media appearing to suggest that the CCK Board has been unable to make a decision on the way forward on the implementation of the glide path on the Mobile Termination Rates (MTRs). The said reports further suggest that the CCK is hostage and beholden to certain political and business interests, thus casting aspersions on the ability of the Communications Commission of Kenya (CCK), as presently constituted, to effectively regulate the fast-growing ICT sector. The reports have elicited disquiet in the local ICT market, and therefore merit a response. Contrary to the said reports, the CCK Board and management are, and have always been committed to promoting a conducive regulatory environment for effective competition in the ICT industry in Kenya. This commitment explains why there is hardly any market segment in the entire communications sector today where competition does not exist. We appreciate that one of the key drivers of competition in any mobile telecommunications market is the regulation of interconnection. Interconnection serves as a critical public policy tool for the proper functioning of a competitive communications market. It is out of this understanding that the CCK commenced regulation of interconnection in 1999 following the licensing of two additional mobile operators - namely Essar Telecoms Kenya and Orange Telecoms. Indeed, the local communications market witnessed significant market developments in the period between 2007 and 2010. Over and above the entry of two new operators, other notable developments that took place in this period included the introduction of the Unified Licensing Framework (ULF), landing of three undersea cables and the roll out of terrestrial optic cables, and tremendous growth in both subscriber numbers and call and data volumes. In order to capture these developments and also include new and up-to-date data in the network cost modeling, CCK undertook a detailed and consultative review of the Network Cost Study in 2010 with the objective of developing a new interconnection framework that promotes competition, operational efficiency of the firms and further growth of the sector through continued investments and innovations. Following the review, CCK issued the Determination No.2 on Interconnection Rates for Fixed and Mobile Telecommunications Networks; Infrastructure Sharing and Co-location; and Broadband Interconnection Services on 16th August 2010. The Determination was to operate from 1st July 2010 to 30th June 2013. Furthermore, the Determination was updated on 30th December 2010 to include Short Message Service (SMS) Termination Rates effective from 1st January 2011 to 30th June 2013. According to this determination, the glide path for Mobile Termination Rates was to proceed as follows: 1. Call Mobile Termination Prices Nominal KES. 1st July 2010 1st July 2011 1st July 2012 1st July 2013 Mobile Termination 2.21 1.44 1.15 0.99 Following the issuance of the Determination No.2 of 2010, retail price competition in the mobile voice services intensified with actual retail off-net call prices falling from a high of KES 12 per Minute in August 2010 to between KES 5 and 3 per Minute currently. In addition, on-net call retail tariffs dropped significantly from a high of KES 8 per Minute to KES 3 per Minute over the same period. The industry also witnessed a significant growth in the number of promotions and special offers as the operators sought to attract and retain subscribers. Moreover, mobile operators also intensified efforts to generate new revenue streams from non-traditional services such as SMS based applications, Internet offerings and mobile money transfer services through cutting edge innovations. In addition, important industry demographics such as mobile subscription and penetration levels improved significantly during the period. Despite these positive signals in the market, some sections of the mobile telecoms industry and some government agencies raised concerns that the ensuing retail price competition arising from the reduction in mobile termination (wholesale) prices was detrimental to the continued growth of the sector and the economy. In particular, concern was raised that the retail price competition in the mobile voice market would adversely affect Government Tax Revenues, stability of the stock market, the Government's macro economic agenda on employment and investments; and the profitability and viability of telecommunication enterprises. The CCK Board considered these issues and at its Meeting held on 20th May 2011 decided to freeze the mobile and fixed termination rate for year 2010/2011 for a further one year as the Commission evaluated the veracity of the issues raised by stakeholders. Consequently, on 8th June 2011, the Commission issued Addendum No.2 to the Determination No.2 of 2010 revising the mobile and fixed termination rates and the attendant glide path as follows: 1. Call Mobile Termination Prices Nominal KES. 1st July 2010 1st July 2011 1st July 2012 1st July 2013 1st July 2014 Mobile Termination 2.21 2.21 1.44 1.15 0.99 CCK has since contracted the services of a consultant to undertake a study on the impact of the ensuing competition in the retail mobile voice market on the Government Tax Revenues, stability of the stock market, Government macro-economic agenda on employment and investments; and the profitability and viability of telecommunication enterprises. The consultant has submitted an inception report and is due to present the interim report to the CCK Management and Board soon. I wish to assure the mobile telecoms industry, consumers of ICT services and other stakeholders that CCK shall make a decision on the MTR as soon as we receive the final report from the contracted consultant. Our decision shall be fair and in the wider interest of consumers and mobile telecoms industry, and without influence from any quarter. I also wish to take note of the ongoing discussions on the need to align our current legal framework - that is the Kenya Information and Communications Act, CAP 411A - with the requirements of the Constitution of Kenya 2010. The overriding goal of the alignment is to further insulate CCK from commercial and political interests. We appreciate that the rule and law-making responsibility in the sector falls within the remit of the Office of the Minister for Information and Communications. CCK, as an important stakeholder in this process, has already given its input on this ongoing process. CCK is fully in support of this process, and it is our hope that the debate shall be healthy and balanced and in the wider good of the ICT sector. A few folks have pointed out that the act of promoting a particular proposal contradicts the ITU's depiction of the secretariat as a neutral arbiter of the process. I was in Accra and quite concerned to see the Kenya delegation quite vocal in its support for the ETNO proposals notwithstanding the potentially negative repercussions of implementing them in a region that can least afford to be cut off of from content or to pay for content. I would expect given how much our government touts Kenya as a "tech hub" they would take a leadership role in ensuring that we support proposals that are not harmful to our countries / regions. Perhaps the CCK / PS Ndemo reps on the list can articulate more the basis for our positions in Accra. It was interesting to see countries like Uganda, Botswana and Zimbabwe argue in support of more progressive positions, while we tended to be on the side of governments with a clear interest in regulating / controlling the Internet. By the way, post-Accra, Africa is the only region to have fully endorsed the ETNO proposals - another issue of concern...do our governments understand what they are endorsing? Why are we supporting proposals other regions have deemed fit to ignore? Listers, Internet access and usage increases in the country The number of mobile subscribers in Kenya grew by 1.7 percent between March 30 and June 30 this year to stand at 29.7million, thereby increasing the penetration of mobile telephony services to 75.4%. Compared to the same period last year, the annual mobile subscriptions registered a significant growth of 17.5 percent from 25.2million recorded in the 2010/2011 financial year. According to the Quarterly sector statistics report for the fourth quarter of the 2011/2012 financial year, prepaid subscriptions continued to dominate the total mobile subscriptions with 29.4 million pre-paid subscriptions, representing 99.1 percent of the total subscriptions. Annual post-paid subscriptions grew by 18.3 percent to stand at 273,367 as at 30th June 2012. In respect to the Internet, the number of subscriptions rose by 19.2% from 6.4 million in the previous quarter to 7.7million during the quarter under review. The number of estimates Internet users rose by 18.5% to stand at 14.032 million during the quarter under review. The annual growth in the estimated number of Internet users was recorded at 11.9% from 12.5million recorded in the previous year. Of the total number of subscriptions, broadband subscriptions only represented 9.4%. The annual growth in the Internet/data market segment may be attributed to the increase in international connectivity bandwidth by 58.0 percent to 264,584 Mbps during the quarter under review. The total available bandwidth in the country was recorded as 574,704 Mbps during the quarter under review. The used bandwidth represented 46.0 percent of the total available bandwidth capacity. Mobile data/Internet subscriptions continued to dominate the Internet market contributing 98.9 percent of the total Internet/data subscriptions. Mobile money transfer service experienced 2.73 percent growth to record 19.50 million registered subscribers. The total deposits handled during the period was recorded at 192.73 billion representing a 4.0 percent growth from 185.36 billion recorded in the previous period. Mobile money transfer service also continued to create employment opportunities across the country with 49,079 active agents recorded during the quarter. The ICT sector continued to create employment, as a total of 17,596 people were employed in the mobile, data and postal segments, with women making up 38.9 percent. These numbers are expected to continue growing with the expansion of ICT services across the economy. Fixed line network and the postal and courier industry continued to face stiff competition from the telecommunications sector. Total fixed lines (fixed terrestrial lines and fixed wireless) recorded an annual subscription decline of 29.9 percent from 374,942 main fixed lines in FY 2010/11 to 262,711 in the quarter under review. The number of local letters sent annually dropped to 73.9 million in the FY 2011/12 from 109.1 million recorded in the FY 2010/1, a 32.2 percent decrease. International incoming letters declined by 4.2 percent to record 439,986 in FY 2011/12 from 459,342 in the previous financial year. However, international outgoing letters recorded a positive annual growth of 29.3 percent from 6.4 million in FY 2010/11 to 8.3 million in FY 2011/12. Listers, The Internet Society Kenya Chapter will be coordinating the local remote hubs, this is an appeal to our colleagues in Universities or any interested institutions who might be in a position to set up the hubs to pass the message to interested participants within their communities. There are several advantages in creating a hub: - it helps to raise awareness about Internet Governance issues; - it fosters networking among participants and community building; - and it encourages follow-up activities. KeBS to re-emburse fake phone owners

Hi, We all wish the headline in tomorrows paper would be "KeBS to refund fake owners" as to the best of my knowledge they are mandated and funded by the tax payer to make sure that the items that come into the country meet certain required usage and safety standards. Evert time I import IT items I am charged a fee for KeBS certification what do they do with the money collected if millions of fake (no IMEI numbers) mobile phones, many of which where shipped in container loads, passed right under their nooses. As with most issues we have a tendency of barking up the wrong tree, suing CCK is dealing with a symptom instead of dealing with the core problem which is a standards body that does no work, its time we re-outsourced the function. Steve, Personally, I think you are right in trying to exonerate KeBS from the equation. Why? Because I don't know at what stage CCK involves KeBS during the Type-Approval process for communications equipment. There are fellows from CCK on this list I suppose. While presiding over the opening ceremony the Minister of Transport, Works Supply and communications urged delegates to ensure that the Internet is readily accessible and manageable to the ordinary person in an African village, in addition he emphasised on the need to curb the digital divide between urban and rural areas and the high cost of Internet services in African countries. KBS sticker is not a proof KEBS certification. Downtown in Nairobi you can get any sticker (KEBS, KRA etc) for a song. In my opinion the buck stops with both CCK and KEBS. CCK is mandated to type approve telcom equipments and uses KEBS as an agency to do this. On the other hand KEBS is mandated to ensure that all product sold to consumers meet certain standards. CCK can use another agency if it feels KEBS is not doing a good job. At the same time KEBS can reject any CCK type approved telco product if it is harmful to consumers. ------Original message------ From: S.M. Be on the look out!* **** **** In a city where crime takes different shapes everyday, the monster radio sought out to find out whats really happening in Nairobi. Over the past few months residents in the up market estates (Kileleshwa, Lavington, Kilimani and Westlands) have been complaining of frequent attacks from armed robbers who are riding on motorbikes. Get this right, not tuk tuk motorbikes but strong heavy CC motorbikes; what we call “Hondaa” in slang. The police and victims have identified the robbers as two or three young guys who ride on the same bike and are armed and dangerous. they mostly attack female pedestrians but now are also targeting males and motorists too. they are upmarket and are well kept so you may never have the slight idea of whom they really are. the mastermind in the clique is a skinny dark skin tall guy and the bike rider is chubby and short. the third robber is always in the shadows but is equally dangerous said a female victim whose identity we are withholding for security reasons. last night September 13th, they orchestrated six crimes from 7pm to 11pm within Adams arcade, Hurlingham, Jabavu lane which is just outside Kilimani Police station and Brookside, all of which they robbed victims at gun point and seriously hurt them as well. The robbers take all sorts of valuables i.e, cellphones, watches, rings,gadgets etc and resell them in the black market.Currently the Kilimani area and Kileleshwa police departments are on high alert with police patrols deployed all over the yaya and valley arcade areas. Through HR&A our Master Developer at Konza we met two agencies today in New York involved with the development of a futuristic New York that will be competitive in the next 50 years. Hudson Yards Development Corporation was created by Mayor Bloomberg to redevelop a section of New York that was their industrial area. It covers approximately 300 acres with mostly non high rise buildings. The city now wants high rises to meet future office demands. Here they are buying back most of the land while developing modern infrastructure including the subway. Consultants are working day and night to ensure the redeveloped area meets current and future needs. Later we visited the New York City Development Corporation charged with NY's future competitiveness. They noted that in 1890, NY wad basically a trading centre. In the 1940s, it became an Industrial City and today it is largely a financial and services city. They now want to switch gears to a more technology city. Through a competitive process, they have put together a number of universities to deliberately steer NY into another Silicon Valley. Cornell University is paired with Israel Institute of Technology to deliberately create multi disciplinary programs in applied sciences and entrepreneurship. NY University too will partner with other global centres of excellence such as Indian Institute of Technology to also focus on innovation and entrepreneurship. To help create a competitive future, the city will give free land and other incentives. They are demolishing one of the hospitals in order to create space for a futuristic project. Each of the different university grouping will focus in a specialized area that will be critical in the days to come. They are coming up with courses like health analytics, smart cities etc. This is how in future we can use data to predict our future. This is very critical and many lessons for developing countries. As we continue to do things the same way it has always been done, things remain the same and this ain't good at all. We need to leverage on what we have and do a little more. In the evening I attended a UN sponsored launch of Better than Cash Alliance at the Ford Foundation. Here speaker after speaker lauded Kenya for its contribution towards mobile money. Our own Michael Joseph was in attendance. This was a launch to scale up what has been successful in Kenya (75% of mobile money transactions world wide happens in Kenya). We shall see many researchers coming to Kenya. We must move up the ladder through research and begin to lead the rest of the world. Instead of spending many hours arguing the merits and demerits of SAP training some Kenyans we need a mobile payroll system that can be integrated with Government's Integrated Financial Management System. When Matatus were introduced, there was a regulated transport system in Kenya. Buses could not just stop anywhere. They were like the proprietary software. Mini buses could stop anywhere and charged based on distance travelled and eventually dealt a blow to buses in urban centres. The rest today is history. That is ok for now. Ndemo. Would like to follow up with them on the lack of pedestrian inclusion on Mombasa Road, where more than one person is knocked down daily. There's also a blind roundabout on the Eastern bypass, near Windsor which has led to a number of accidents and deaths. That should at least have rumbles to warn user.

Tuesday, September 25, 2012 - 00:00 -- BY ALPHONCE MUN A man was yesterday ordered to pay a fine of Sh100,000 or 10 months imprisonment for impersonating Voi MP Danson Mwazo and creating Facebook account of him. Liverson Alama Mwashube who appeared before Nairobi senior principal magistrate Paul Biwott admitted the offence of creating Facebook account with intent to defraud. He however denied another charge of Electronic Fraud contrary to section 84B Kenya Information and Communication Act 1998. Reading the facts of the case, chief inspector Robert Kyaa, told the court that on diverse dates between May 2012, and September 2012 at Voi Distrtict within Taita Taveta County, with intent to defraud, the accused created a facebook account of Mwazo thereby impersonating to be him. The court also heard that on the same months, the accused created facebook account of Mr Mwazo where he used to defraud one Diana Mwachofi of Sh2,600. The prosecutor told the court that the matter was investigated where the MP denied having created such facebook account. He said that the facebook also shown M-Pesa account at Equity bank account. The prosecutor said the facebook was created for purpose of impersonation the MP. Mwazo denied having operated such account. (Extracted from the Shared Services Masterplan presented to Directorate of Egovernment and prepared by the Kenya ICT Board under the Ministry of Information and Communications and Accenture in June 2010). These stastitics were collected through research, visits and analysis of public sector documents over several months. The team collected IT budget, spending workfoce asset and project information from 42 ministries and 4 entities. They further assessed detailed application data and infrastructure for 8 ministries.There is also a report for the local government that is similar. 1. There are currently 80+ technology enabled projects in the public sector across 39 ministries worth over Kshs 35 billion. Divided into Digitization, Appilications and Infrastructure. 2. Key among them core projects undertaken by various entities include are: a. The proposed National Lands information management system b. High court registry digitization and application c. Digitization of company registry d. Kenya Government unified communications and messaging e. Education management system f. Integrated Financial Management System (IFMIS) g. Many other applications that are ministry specific. h. KENET bandwidth capacity purchase for universities i. Government data centre j. Government’s core communications network k. Bandwith support to government l. Various other infrastructure projects 3. Above figures exclude some major state corporations projects that were not on the radar at the time of the research. There are many more requirements for digitzation a. Automation of National Social Security Fund b. Digitization and automation of Kenyatta National Hospital 4. The Masterplan proposed the establishment of a shared services centre. The consolidation of IT supports functions from several departments or agencies into a single, stand-alone organization entity whose only mission is to provide services as efficiently and effectively as possible. 5. Government of Kenya spends 0.3% on IT as a percentage of overall spending. This is 20 times less than government industry average of 6.5% . (based on Gartner benchmarks). a. Most of the spending is on hardware at 65% compared to global benchmark of 18%. IT spending on staff is significantly lower 18% as opposed to 38% for global benchmark. Counterfeit Phones/Devices

Listers, Follow my logic for a moment. MNOs will be 'switching off' counterfeit devices soon meaning that they can tell which gadgets are original and which ones are counterfeit. Wouldn't it be a good idea for Safaricom, Airtel, Orange and Yu Mobile to start informing their clients whether their phones will be switched off or not via text? A message in the format "Dear customer, your IMEI number ************* shows that you device is counterfeit. Kindly purchase an original device to continue enjoying our services. Thank you." I would imagine the cost of doing this is Ksh.0 within their networks - but I stand to be corrected. For those who have original devices, the message would read "Dear customer. From your IMEI number, we can tell our device is original. This means that you will continue enjoying our services come ** September 2012. Thank you."

CCK defies Kibaki on mobile tariff cut
