Dear Civil Society colleagues, Those following/engaging with WIT and ITR related issues please see below a call for proposals for ITU-related micro-grants by Mozilla to engage and participate at the upcoming WCIT in December 2012. best Alice ------------------------ *_Open Internet Microgrants to Support Civil Society Engagement with the ITU_* On December 3rd, the world's governments will begin a ten-day meeting in Dubai to update a key treaty of a UN agency called the International Telecommunication Union (ITU). Some proposed changes to that treaty could threaten Internet openness and innovation, increase access costs, and erode human rights online. We are urgently calling for projects that will help give civil society organizations that support an open Internet a stronger voice before and during that key meeting, the World Conference on International Telecommunications (WCIT). *What We Want to Support* * Efforts to engage with your government in the lead up to the WCIT meeting. * Costs for civil society representatives to participate at WCIT in Dubai, provided you are already a part of your country's delegation or have otherwise demonstrated commitment and expertise in this area. * Provision of basic technical infrastructure and tools that let civil society representatives on the ground in Dubai coordinate and communicate with each other, their home organizations, and the media. *The Details* * The call for proposal opens up on Nov. 12 and closes at 12 AM GMT Nov. 15 (i.e., midnight the night of the 14th). * This is a micro grant fund. There is a total of $10,000 available. Ideally, we will be supporting 8-10 projects from that amount. That means your grant will be approximately $1,000. * You need to be able to receive a wire transfer to a bank account. It can be your personal bank account. Individuals can apply. * We will contact you if we have any questions or to award you the grant. Net Neutrality - A Perspective as a Precursor to tomorrow's WCIT Discussions

Listers As a followup to my posting on *Africa (and Kenya's?) Position to WCIT, Dubai, *I thought I would pen some thoughts on Net Neutrality as a way to get our minds thinking ahead of tomorrow morning's Stakeholders Meeting on WCIT-12 at the Grand Regency. According to Wikipedia:- *Network neutrality* (also *net neutrality*, *Internet neutrality*) is a principle <http://en.wikipedia.org/wiki/Principle> that advocates government regulation of Internet service providers<http://en.wikipedia.org/wiki/Internet_service_provider> ,[1]<http://en.wikipedia.org/wiki/Network_neutrality#cite_note-Information_Week-1> preventing ISPs from restricting consumers' access to networks that participate in the Internet <http://en.wikipedia.org/wiki/Internet>. Specifically, network neutrality would prevent restrictions on content, sites, platforms, types of equipment that may be attached, and modes of communication. Network owners can't interfere with content, applications, services, and devices of users' choice and remains open to all users and uses. Since the early 2000s, advocates of net neutrality and associated rules have raised concerns about the ability of broadband providers to use their last mile <http://en.wikipedia.org/wiki/Last_mile> infrastructure to block Internet applications and content (e.g. websites, services, and protocols), and even block out competitors. (The term "net neutrality" didn't come into popular use until several years later, however.) The possibility of regulations designed to mandate the neutrality of the Internet has been subject to fierce debate, especially in the United States. Neutrality proponents claim that telecom companies seek to impose a tiered service <http://en.wikipedia.org/wiki/Tiered_service> model in order to control the pipeline and thereby remove competition, create artificial scarcity <http://en.wikipedia.org/wiki/Artificial_scarcity>, and oblige subscribers to buy their otherwise uncompetitive services. Many believe net neutrality to be primarily important as a preservation of current freedoms. Opponents of net neutrality claim that broadband service providers have no plans to block content or degrade network performance.[8]<http://en.wikipedia.org/wiki/Network_neutrality#cite_note-books.google.com-8> Despite this claim, there has been a single case where an Internet service provider, Comcast, intentionally slowed peer-to-peer<http://en.wikipedia.org/wiki/Peer-to-peer> (P2P) communications.[9]<http://en.wikipedia.org/wiki/Network_neutrality#cite_note-9> Still other companies have begun to use deep packet inspection<http://en.wikipedia.org/wiki/Deep_packet_inspection> to discriminate against P2P, FTP, and online games, instituting a cell-phone style billing system of overages<http://en.wikipedia.org/wiki/Cellphone_overage_charges>, free-to-telecom "value added" services, and bundling.[10]<http://en.wikipedia.org/wiki/Network_neutrality#cite_note-10> Critics of net neutrality also argue that data discrimination<http://en.wikipedia.org/wiki/Data_discrimination> of some kinds, particularly to guarantee quality of service<http://en.wikipedia.org/wiki/Quality_of_service>, is not problematic, but is actually highly desirable. Bob Kahn<http://en.wikipedia.org/wiki/Bob_Kahn>, co-inventor of the Internet Protocol, has called the term net neutrality a "slogan" and states that he opposes establishing it, but he admits that he is against the fragmentation of the net whenever this becomes excluding to other participants.[11]<http://en.wikipedia.org/wiki/Network_neutrality#cite_note-kahn-vid-11> Opponents of net neutrality regulation also argue that the best solution to discrimination by broadband providers is to encourage greater competition among such providers, which is currently limited in many areas.[12]<http://en.wikipedia.org/wiki/Network_neutrality#cite_note-podhoretz-post-12> http://en.wikipedia.org/wiki/Network_neutrality So what does the Africa Position on ITRs (International Telecommunications Regulations) mean to us? >From the proposal one can deduce that we now intend to turn around Net Neutrality on its head and give ISPs/Telcos a legal standing to charge content providers and application service providers for the privilege of their customers to access any website. What would be the effect of this? As I said in my earlier posting the principle around this is flawed. Why? Because this opens up the opportunity for discrimination and anti-competitive tendencies. We are aware now that some Telcos and ISPs are moving into Content Provision through the Triple Play Mantra (TV, Phone and Internet). What is to stop discrimination in the guise of competition? We must be careful that we do not put a regulator's stamp in a competitiveness environment in favor of one player /industry against another. Nation, Standard, Citizen, Iqra, Google, CIO East Africa, Ma3Racer, Pesapal, Facebook, Twitter etc will all then be bundled together and the prerogative of the ISP/Telco will be what rules and NOT Market Conditions. I have argued before about the ISP/Telco space and whether the current scenario calls for a re-thinking of the business as usual model. There seems to be a tacit agreement that something is amiss where some players (the majority it seems) seem to be bleeding red ink. I cannot presume to be an expert in this space but could the logical step be one of sharing infrastructure to reduce Capex as opposed to everyone running around digging up the whole country in an 'arms race'? Is this an area where the regulator can assist? There is a legend around how Dr.Ndemo (Permanent Secretary, Ministry of Information & Communication) managed to get the first undersea cable landed in Nairobi despite industry not pulling in the same direction (I don't know how true or false this is but the fact that it is being bandied around is in itself a red flag). I suggested possibly that the industry may want to embrace the Principles of 'Frenemy'? Let's ensure we maintain the current status quo that has enabled innovation and entreprenuership in the ICT Sector to blossom. The current discourse about whether 'Silicon Savannah' needs to grow up and move towards creating viable and sustainable businesses is what we should discuss NOT seek to change the very environment that made this possible. Is the state now going to purport to 'coerce' or compel commercial enterprises to enter into commercial agreements? My earlier comments also apply.* * * *41M 6.0.6 The Member States shall take measures to ensure that Operating Agencies have the right to charge providers of international communication applications and services appropriate access charges based on the agreed quality of service.* *Reasons: To balance the revenues across the ecosystem, thus avail revenues for operating agencies to invest in high bandwidth international infrastructures, which will benefit the end users and provide them with innovative services, while lowering ultimately their connectivity charges.* * * *My Comments*** *Is the state now abrogating to itself the right to tell content providers to pay (to Telcos) for people to access their platforms and websites? I'm well aware this is primarily targeted to the big boys - Facebook, Google, the big global media houses etc. however, who is to stop the telco or ISP in Mongolia or Thailand where Ma3Racer (a Kenyan popular gaming platform that has most of its users in Asia) from blocking it and asking it for access fees? *** * * *Correct me if I'm wrong, aren't these content providers already paying for hosting anyway? Listers I have serious misgivings about the Africa Position to WCIT as presented by CCK. I will highlight the main & pertinent proposed changes. There are good clauses within the proposal that are pertinent and in line with current trends. For example:- 38A 4.3A Members States shall ensure transparency of end-user prices and the provision of clear information on how to access the services and the prices thereof, in particular to avoid unreasonable or surprising bills for international services (e.g. mobile roaming and data roaming), and shall ensure that Operating Agencies take the necessary measures to fulfill these requirements. Reasons: This provision considers the users' right to have transparent information on the international charges, bearing in mind the current excessive data charges for roaming users. My Comments This deals with consumer protection and it is high time that it becomes an issue of international concern. 54A 6.5A Member states shall ensure that each party in a negotiation or agreement related to or arising out of international connectivity matters, will have access to alternative dispute resolution mechanisms and will have recourse to the relevant regulatory or competition authorities of the other party's state. This I believe goes beyond the issue of Telecommunications Regulation and starts to touch on the issue of how free markets operate. We are treading on very thin ice here.. 41L 6.0.5 Member States shall ensure that their regulatory frameworks drive the Operating Agencies to establish mutual commercial agreements with providers of international communication applications and services in alignment with principles of fair competition, innovation, adequate quality of service and security. Reasons: To foster increase in the customer base and enhancement in the quality of experience (QoE), by offering more choices and more confidence in those offerings. My Comments .....drive the Operating Agencies (defined in the document as Any individual, company, corporation or governmental agency which operates a telecommunication installation intended for an international telecommunication service or capable of causing harmful interference with such a service.) to establish mutual commercial agreements with providers of international communication applications and services in alignment with principles of fair competition, innovation, adequate quality of service and security. What does this really mean really? Is the state now going to purport to 'coerce' or compel commercial enterprises to enter into commercial agreements? My earlier comments also apply. 41M 6.0.6 The Member States shall take measures to ensure that Operating Agencies have the right to charge providers of international communication applications and services appropriate access charges based on the agreed quality of service. Reasons: To balance the revenues across the ecosystem, thus avail revenues for operating agencies to invest in high bandwidth international infrastructures, which will benefit the end users and provide them with innovative services, while lowering ultimately their connectivity charges. My Comments Is the state now abrogating to itself the right to tell content providers to pay (to Telcos) for people to access their platforms and websites? I'm well aware this is primarily targeted to the big boys - Facebook, Google, the big global media houses etc. however, who is to stop the telco or ISP in Mongolia or Thailand where Ma3Racer (a Kenyan popular gaming platform that has most of its users in Asia) from blocking it and asking it for access fees? Correct me if I'm wrong, aren't these content providers already paying for hosting anyway? What really is going on here? Contrary to what this Africa Proposal purports to do 'benefit the end users and provide them with innovative services, while lowering ultimately their connectivity charges' my humble opinion is that it will have the long term effect of killing innovation and the openness of the Internet which has basically been responsible for a lot of the innovations that we are currently seeing in this space. Listers Obama continued to stay ahead and the closeness of this election (despite the electorate college votes big margin the battle ground states were won with the slightest of margins) because of his team's sleek use of technology - especially the use of Big Data. The ability to crunch the numbers and glean nuggets of pure gold in terms of voter trends and getting out the voters to vote for him really is the biggest lesson here. In my opinion of course. Are there lessons here for our politicians? How can we engage (through proper use of technology) with all Kenyans to ensure we vote in the right leaders? Or am I being an idealist and romantic and all this is just wishful thinking? Hi Ali, This is interesting , it was good to see the manner of technology used during the US polls , i must say it was top notch, the kind of crisp marketing and use of technology to understand the niche regions was amazing. How about the analytics ,CNN and other media houses were able to give up to date info, removing the possibility of delay. We are going to polls soon and it will be encouraging to at least see some kind of replication, even if we will not go that top-notch, we have the resources to use and definitely the skill. Good morning Listers I would like to thank Jane, Barrack and Topista for views expressed on yesterday's topic Shooting the messenger. They did express the need to place some level of responsibility on both the source of the content and the host platform. Further they underscored the need to have a good information system that operates under a sound policy framework if it is to be useful to society. Today we look at Section 29 of the KICA (improper use of system) http://www.cck.go.ke/regulations/downloads/KenyaInformation-Communications-… that is increasingly being used as a basis for criminal charges for users of technology based platforms. See example: http://www.youtube.com/watch?v=9q7VmsYNsqE 29. A person who by means of a licensed telecommunication system— (a) sends a message or other matter that is grossly offensive or of an indecent, obscene or menacing character; or (b) sends a message that he knows to be false for the purpose of causing annoyance, inconvenience or needless anxiety to another person commits an offence and shall be liable on conviction to a fine not exceeding fifty thousand shillings, or to imprisonment for a term not exceeding three months, or to both. Could misuse of an information system also be used to charge intermediaries? Would this call for the training of the Kenya Police, DPP and Judiciary so that they understand the issues as they litigate and make rulings? Listers, lets hear your views. Alice K, WAmbua, Sounds all good - but it is also fair to say that ITU is really under no obligation to include everyone in their meetings. And they really should not apologise for that since that is how they are constituted by government treaties... So methinks Fiona crashed into a Regulator /ITU meeting and she got kicked out accordingly :-) Am not saying its fair, am just saying I perfectly understand where ITU is coming from and will only change if the same Govts decide to change the nature of the treaties inorder to give smaller fish (Wanjiku) some say. Presidential Debate Par Excellence!

Listers, Did anyone watch the 1st Ghanaian Presidential Debate held Live on Tuesday this week? If you missed it, it is worth watching at http://www.youtube.com/watch?annotation_id=annotation_110227&feature=iv&src… It was impressive and I loved the structure of the debate for 3 reasons:- 1. It focused entirely on SUBTANCE (Development Agenda) - ICT issues also featured in the discussions! A pure focus on concrete agenda/vision for the country going forward. 2. The facilitation was very focused with strategic questions posed to the candidates sequentially and they had EXACTLY 3 minutes to succinctly respond and no more! They had only 3 "chances of rebuttal" 3. They had a blend of a researcher/media personality as the co-hosts - which means empirical evidence/research information was consulted to pose piercing and targeted questions. There was no room as such for "dirty politics/ethnic persuasions". The 3rd debate will feature a debate of the running mates! The whole debate series is managed by the Institute of Economic Affairs. As we gear up to Kenya's debate this month, many questions run through my mind: 1. Will Kenya for the first time focus on SUBTANCE and NOT our usual political theatrics? 2. Will we draw on empirical evidence to pose challenging and deep questions? What role can research think tanks play to have substantive issues addressed? 3. How will the 20+ presidential candidates be managed in an effective way to give equal opportunity to all, yet remain focused and substantive? ............the list goes on! I'm sure listers have many more questions! As a community, we should aim to submit concrete pressing questions related to the industry (assuming there's room for this) I hope Julie and her co-host will run Kenya's debate differently and borrow a leaf from Ghana's....avoiding the Kenyan typical style of politics! This is a challenge we throw to the media houses that will be hosting the series of historic debates. Reflective Edith!

Many factors including a failure in rainfall have a negative impact on the availability of food and the cost of living and such factors are not a result of the failure on the part of the state to take appropriate policy and other measures to ensure the realisation by citizens of the socio-economic rights guaranteed under Article 43. When bringing matters of socio economic rights before the court, which have a critical bearing on the rights, lives and livelihoods of citizens, it is not enough to make bare statements with regard to the violation of rights without seriously addressing oneself to the manner in which the violations have occurred and the reasonableness or otherwise of the measures taken to avert or ameliorate their impact. At this nascent stage in the implementation of the Constitution of Kenya 2010, parties in the position of the petitioner, should they determine to take on cases which have a bearing on the public interest, must take them on with all due seriousness. 4. 1. The manner in which the petition was conducted by the petitioner would ordinarily have attracted an award of costs against it. However, the intent of Articles 22 and 23 of the Constitution is that persons should have free and unhindered access to the Constitutional Court for the enforcement of their fundamental rights and freedoms. Similarly, Article 258 allows any person to institute proceedings claiming the Constitution has been violated or is threatened. The imposition of costs would constitute a deterrent and would have a chilling effect on the enforcement of the Bill of Rights. 5. In matters concerning public interest litigation, a litigant who has brought proceedings to advance a legitimate public interest and contributed to a proper understanding of the law in question without private gain should not be deterred from adopting a course that is beneficial to the public for fear of costs being imposed. -- Grace L.N. A good read and hopefully a wakeup call. 24 - 31 October 2012 A Billion Reasons to Believe in Africa: A Rethink - ADVERTISEMENT - Graphics courtesy “There are a billion reasons to believe in Africa,” states Coca-Cola’s new commercial that attempts to capture the spirit of “new” Africa. Africa-optimism has in the recent past gained massive hype. Ernst & Young in its May report on Africa’s attractiveness for foreign direct investment (FDI) states that "…There is a new story emerging about Africa; a story of growth, progress, potential and profitability.” According to the African Developmental Bank, "Africa has started to see an economic resurgence" as a result of stronger demand for its commodities from emerging economies such as Brazil, China, India, and South Africa. With the continent’s middle class clocking 313 million people, the region’s consumer spending has increased. McKinsey Global Institute projects that consumer spending in Africa will reach $1.4 trillion in 2020, from about $860 million in 2008. Over 616 million people out of the 1 billion people that reside in Africa have a cellular phone. The average African drinks about 8 liters of beer per year compared to about 70 liters on average per year for Americans. While the continent is bequeathed with flowery endearments, it must guard against falling prey to the “feel good” trap and ask fundamental questions. For example, how are the endearments changing the lot of Africa's ordinary citizen? How is Africa changing for the better? Is the renewed interest in Africa by emerging and developed economies out to improve the continent's socio-economic wellbeing? While Africa ought to embrace the old and new suitors trooping to the continent, this must be done with caution and on a win-win basis. What happened in Malawi ought to make Africans rethink their celebration. As long as Malawi followed donor dictates and allowed multinational companies to control its agricultural sector, the country was hailed as Africa’s success story on food security. Once Malawi fell out with donors and multinational companies, the country’s food security was crippled. This begs the question: who was driving Malawi’s food security? Between Malawians and merchants of patented and re-engineered seeds and fertilizer manufacturers, who was benefitting most from the ‘success story’? Was this a Malawi success story or a multinational company success story? As global optimism in Africa is hyped, Africa’s land is being grabbed by ‘investors.’ Investors from China and Europe are busy buying land in Kenya and putting up 'Chinese only' and 'European only' real estate. As elegant edifices mushroom in Nairobi and its environs, where is the revenue accrued heading? Won’t we wake up one day and find ourselves legally landless and at the mercy of the so called ‘investors’?What will happen twenty years from now when our children find themselves landless? Isn't this a prescription for a revolution and civil war? Saudi Arabian investors have reportedly paid $100 million for an Ethiopian farm. Uganda has sold 2 million acres to Egypt. Kenya is leasing out 40,000 acres to Qatar. China owns vast tracts of land in Zimbabwe and Algeria. Madagascar was in the process of leasing out 1 million acres to South Korea. Millions of Africans are dying from starvation as African governments lease and sell millions of acres of land to feed populations in China, Saudi Arabia, South Korea, and Qatar among others. Africa is busy working on internet connectivity. In fact, growth in Africa’s Internet and Broadband sector has accelerated. By December 31 2011, Africa had 139,875,242 internet users and 37,739,380 people who had subscribed to Facebook. As we consume this service, do we ever question who is controlling the internet? What would happen if the Internet Corporation for Assigned Names and Numbers (ICANN), which basically holds the keys for any person or business hoping to turn up in search results on the Internet, gave a blackout to the continent? As more computers are dumped into the continent, who is the ultimate beneficiary? Africa, a continent that carries 25% of the world’s diseases is dependent on multinational ‘investors’ for medical supplies. It imports around 70% of its pharmaceutical needs from abroad. Two thirds of global value of pharmaceutical products are produced in 5 countries; USA, Japan, France, Germany and UK. In the banking sector, more than half of countries in Africa have a banking market with either a dominant or a significant share of foreign-owned financial institutions.The continent spends more money servicing its debt, in other words, paying interest to outsiders, than it spends on infrastructural development. On the natural resources front, none of the natural resources Africa is blessed with is under African control. While African countries like Nigeria, Angola, Democratic Republic of the Congo, Gabon, Libya, and Equatorial Guinea among others possess oil in abundance, they don't have the capacity to discover oil; drill for the oil; refine the oil; transport the oil to the destination where it would be refined; repair existing refineries or have the vessel to transport the oil back to Africa for consumption. Africa should not celebrate the “...billion reasons to believe in Africa” craze while the continent is owned stock and barrel by other people. We cannot talk of a thriving economy when we are mere consumers and passive. Before we celebrate Coke’s penetration to most parts of Africa, we ought to ask why we are dying of preventable and treatable diseases; why essential medicines cannot be accessed in African households; why we don't benefit from our rich natural resources; why we are not in control of our economies; why we are food insecure in spite of a good climate; why it is easier to fly to other continents but not our own; why intra-Africa exchange of goods and services is low and why there is no African homegrown brand that the world can celebrate.
