We are researchers in the Department of Information Science at Cornell University, Ithaca, New York. We are conducting a research study on mobile money’s history in East Africa, drawing on user innovations and social practices such as informal airtime sharing, ‘beeping’ or ‘flashing,’ among others. In particular, we’re interested in the ways people have exchanged things like currency, services, or information; we are calling this broad category, technologies of exchange. We aim to chart historical, missed, and potential future pathways for technologies of exchange in Sub-Saharan Africa. We are seeking nominations for professionals and social commentators in private, public, and donor sectors who were active in the intersection of technology and value exchange in East Africa in the years around mobile money’s gestation (~1998 – 2009). But the research still welcomes nominations for relevant actors from periods other than the aforementioned. You can nominate yourself or someone else. We're mostly interested in speaking to those in current or past roles in engineering, research, innovation, journalism, arts and literature, funding, policy, law, and regulatory affairs, or any other relevant profession. ‘Innovation always precedes regulation’ - A tech myth that needs busting

I think this is an important angle to bring to the fintech innovation (vs) regulation discourse. https://businessday.ng/columnist/article/innovation-always-precedes-regulat… ‘Innovation always precedes regulation’ – A tech myth that needs busting David HundeyinAug 1, 2022 Fintech One of last week’s biggest stories out of Africa was the Kenyan central bank’s decision to effectively blacklist Flutterwave and Chipper Cash from operating in Kenya. Typically, much of the reaction to the story from Nigeria managed to completely sidestep the material facts of the case and turn it into an African macrocosm of Nigeria’s usual ethno-tribal discourse. Flutterwave, according to the narrative, was merely being unfairly targeted because it is a successful Nigerian company operating in Kenya. The “jealous” Kenyan authorities were simply acting as proxies for Flutterwave’s Kenyan competitors who wanted to protect their market share from “de Najeeryans.” When the point was raised that Flutterwave was, in fact, operating illegally in Kenya, in addition to being in clear violation of Anti Money Laundering regulations, the reply that came was, “Obtaining a Kenyan licence is hard. Innovation always precedes regulation.” I have written previously about how there exists a dangerous narrative in Nigerian tech – Fintech especially – that rules are secondary considerations that tech is somehow exempt from. Now, it is time to critically analyse this idea so that if it turns out to lack merit, perhaps we can start the process of killing it dead once and for all. Here goes. “Tech is special” – says who? Earlier in the year, I was approached for a private investigation engagement focusing on an investment scheme promoter who had made away with billions of naira worth of client money. Having registered his investment scheme with the Corporate Affairs Commission, he managed to convince investors that having CAC registration somehow had anything to do with being licensed to offer investment or crowdfunding services in Nigeria. Meanwhile, as anyone with the slightest regulatory awareness knows, only the Securities and Exchange Commission (SEC) has the ability to license investment companies. Unsurprisingly after he disappeared into the night with hundreds of people’s money, there was no way to do anything to him. Because the company had no SEC registration, the commission had nothing to freeze, revoke or investigate. It wasn’t even interested, which is why I was approached. At the point when I was approached, every informed reaction I came across treated the matter as a lesson in the importance of due diligence and making sure that investment schemes have the appropriate regulatory compliance before putting money into them. Nobody made the fatuous argument that perhaps the scheme started off legitimately, and the promoters just needed to get it off the ground first before worrying about SEC registration later. Instead, it was correctly recognised as fraudulent behaviour where other people’s money was involved. Just a few weeks later, however, when news emerged that GetEquity, a tech investment platform purporting to offer access to American stocks was doing exactly the same thing, plus the added illegality of an unrecognised, unenforceable “digital investment token,” the reaction was completely different. This time around, that fatuous argument was thrown around with such regularity that one might have almost begun thinking it was some kind of accepted wisdom. Apparently, when Maxwell Odum floats an investment scheme that has no SEC registration and fraudulently portrays CAC business name registration as “regulatory compliance,” he is correctly recognised as a fraudster who should be prosecuted. When Jude Dike does the EXACT same thing, but slaps a mobile app, a dot io website and a little tryhard tech PR branding on it, he is an “innovator,” a “striver” and a “disruptor” who “moves fast and breaks stuff.” When the story inevitably ends the same way, instead of having private investigators hired to tail his movements around the world, he will instead get to live in peace and security, undisturbed by anyone because apparently fraudulent behaviour is bad, but when you call it https://fraudulentbehaviour.io, it becomes something else. This giant mental black spot is the reason why tech is used to facilitate and abet different kinds of criminality in Africa without so much as an eyelid being raised. Once again, rules exist for a reason In my line of work, a truism that I often come across goes like this: “There is never only one cockroach.” What this statement means to investigators and auditors is that where one serious regulatory or cultural lapse can be observed in an organisation, there will almost certainly be other serious issues afflicting that organisation. In the case of Uber, the initial cockroach was the company’s studious refusal to cooperate with local laws around the world as it followed its “Always Be Hustling” internal motto, moving fast and breaking stuff until the things getting broken were no longer just rules. Read also: Nigerian fintechs grapple with KYC amid rapid growth First came the women who complained about sexual harassment by unvetted Uber drivers, and then came the more serious stuff. Rapes. Homicides. Deaths from traffic accidents caused by fatigued Uber drivers struggling desperately to maintain their near 5-star ratings so as to keep earning a living, while Uber used loss of ratings as grounds for account removal and potential loss of livelihood. All of these issues were avoidable if Uber had spent a few months working with authorities to ensure full compliance first, but “moving fast and breaking stuff” was more important. The story is much the same with Flutterwave, which not only began operating without a licence in Kenya, but then began actively and brazenly facilitating money laundering on its platform in the jurisdiction where it was already operating illegally. It is difficult to picture any other commercial space where such behaviour would not have resulted in conferment of societal pariah status. Can you imagine, say, a Nigerian construction company opening up illegally in Kenya and then deliberately using substandard construction materials resulting in Kenyans’ deaths? Would Nigerians feel moved to defend such a thing? Why then, do so many Nigerian techies feel obliged to defend Flutterwave and its money laundering activities in a country whose last major terror attack was planned and funded using electronic payment platforms? These are the questions that we must ask ourselves as we react to stories like that of Flutterwave. The rules exist for a reason – they are not impediments to the individual egos of people with behavioural disorders who think that they exist as protagonists in a videogame where they can do as they please. Listers, Many thanks to everyone who contributed to the talk to IEBC online discussion. *On July 13, 2022, the Kenya ICT Action Network (KICTANet) paid a courtesy call to Kenya’s elections management body, the Independent Elections and Boundaries Commission (IEBC). The aim of this meeting was to discuss the role of technology in the upcoming elections and beyond, and how KICTANet can collaborate with the IEBC in line with its mandate of delivering free, fair, and credible elections. In attendance were IEBC Chairperson, Mr. Wafula Chebukati, IEBC ICT Committee Chair, Commissioner Justus Nyang’aya, IEBC Legal Affairs Chair, Commissioner Irene Masit, Commissioner Francis Wanderi, Commissioner Prof. Abdi Guliye, Commissioner Boya Molu, the Commission Secretary and Chief Executive Officer (CEO) Marjan Hussein Marjan and IEBC's Director of Information Communication and Technology (ICT), Michael Ouma.* As a follow up to the meeting KICTANet held an online discussion on 14th and 15th July to bring to the fore technology related concerns from members of the mailing list. New Reports Launched During Kenya IGF Week

[image: Reports.png] Dear Listers, During the Kenya IGF Week, several reports were launched and we believe they are very useful and core in realising our four pillars: *Disinformation Pathways Study* This study was part of 5 African country reports on disinformation(Cameroon, Ethiopia, Kenya, Nigeria, and Uganda). The Kenya country study was conducted in the period of June-December 2021. It highlights the main factors around periods of political contestation such as elections and anti-government protests, as well as those that are related to hate speech. The aim was to understand the nature, perpetrators, strategies, and pathways of disinformation, and its effects on democracy actors including civil society, bloggers, government critics, and activists. Further, the study documented the adequacy and effectiveness of remedial measures by platforms, as well as government responses to disinformation. Day 3 Connecting all people and promoting cyber hygiene and emerging issues including youth, online work, inclusion and regulation. Day 1: *Governing Data and Protecting Privacy* *Noted:* The Kenya Data Protection Act <https://www.odpc.go.ke/dpa-act/>was gazetted in 2019, An Act of Parliament to give effect to Article 31(c) and (d) of the Constitution of Kenya, 2010 (Right to privacy); - To establish the Office of the Data Protection Commissioner; - To make provision for the regulation of the processing of personal data; - To provide for the rights of data subjects and obligations of data controllers and processors; and for connected purposes. - *Asked:* as a lister how safe do you feel about the safety of your personal data online? What do you think could be done better to improve the protection of data online? *Answered:* people are over fearful regarding the issue of data protection. It was suggested there is need to take the same approach as organizations are doing by conducting a personal data privacy impact assessment. E.g. what is the real risk of your personal identifiable Information leaking? One example was the personal telephone number. You hide it online but hand out your business cards that have your contact details. *Asked:* how safe are children and persons with disabilities on their data privacy? *Observed:* recently the number of Socially Engineered emails received is at an all-time high. Spam calls also seem to be on the rise. It looks like scammers have realized that the new field of play is the Internet as such I am increasingly weary about engaging in e-commerce transactions online especially using public networks. *Concerned:* to know the current statistics in so far as Internet related fraud is concerned and how many people have actually been charged for perpetrating such acts. Maybe the Ke-CIRT team can assist us with the statistics. *Emphasized:* children are ever ahead of adults in discovering and using tech applications and tool. The Communications Authority has been running a Child Online Protection program for a while and would be keen to know the current state of play in so far as data protection is concerned*. * *Noted: *@Lillian <lillian(a)watotowatchnetwork.org> recently posted an article from Human Rights Watch on misuse of data by companies targeting children, it would be interesting to hear if any measures have been taken by the Office of the Data Protection Commissioner to curb this. *Recommended:* If I may offer you a tip and a safeguard on e-commerce: there are cards that banks issue whether you bank with them or not, which you can load using Mpesa and use to transact online so that you do not expose your main card to fraudsters. I have had one from I&M Bank since 2011 (renewable), and I load it with just the money I need to make a purchase so I never worry about any unauthorized purchases on it. You accept the Terms and Conditions or you don’t. It is good that nowadays, at least in Android that I know well, permissions can be easily denied or limited for apps in relation to accessing certain functions from the device. However this is not the same as using data itself. Hopefully in the future there will be more flexibility and options around what one accepts. With cookies, some websites give options (either a list of several things you can toggle on or off, or options of reject, minimum required, all) though other websites don’t give options at all. *Accentuated:* I am not aware of any voluntary standards in Kenya that a website/app/service could self-certify against or be independently verified against that shows they meet such standards around use of data protection/privacy. An Act really only defines illegal and legal, but it is good to have different options within legal that can show strong, stronger, very strong protections, for example, that are something that is voluntary but could be recognized by users. *Underlined:* we have tonnes of domesticated ISO 27,000 series Standards at the Kenya Bureau of Standards. Together with @John Walubengo <jwalubengo(a)kictanet.or.ke> and other listers we have been involved in local standards development. The Challenge we have always faced is that Standards focusing on ICT are voluntary. Only those touching on Health and Safety are mandatory. With creation of the Office of the Data Protection Commissioner, things might change. *Asked:* since organizations have Standards like the ISO 27000 series, where can individuals get credible standards for self-assessment? *Responded:* I think this would be critical tool kit that can supplement the Data protection laws. KICTANet has actually developed a Curriculum on Digital Security and Privacy that attempts to create awareness and empower Internet end users with skills that enable them to conduct self-assessment. *Asked:* Barrack, are those standards addressing the issue I raise around data protection and privacy, i.e. if you meet the standard then you do not share data to third parties, or that any data you share is anonymized, or to some other definition? I am not an ISO expert, but I thought they focus more on following processes than actual results, and may not be specific enough to convince me they are not sharing my data…. *Observed:* maybe I am just not well enough informed, in which case whoever promotes such ISO standards that can assure me of such are not promoting it very well, or have few apps/websites/services adopting such standards, or both….Being voluntary is a good thing. But there needs to be awareness of the benefits of those standards; and maybe some market pressure to adopt the standards *Emphasized:* the standards are pretty high level but they elicit a sense of responsibility from anyone who acquires them towards ensuring their information assets are properly managed and well protected. Digitalization revolves around processes, the standards actually address such processes. Not sure if there is a simpler solution among other bodies such as ISACA. Itroducing the Kenya Internet Governance Forum Online Discussions #KEIGF2022

Good morning Listers, Receive warm greetings from the Multi Advisory Group (MAG) that has been working to prepare this year's Kenya Internet Governance Forum (KIGF). Ahead of the KIGF week, there shall be a series of online discussions to set the pace for the discussions that shall be held during the KIGF. The online discussion will run from the 22nd to the 24th of June and the following are the discussion topics. Day 1. *Governing data and protecting privacy.* Day 2. *ICT's and the upcoming elections.* Day 3. *Connecting all people and promoting cyber hygiene and emerging issues including youth, online work, inclusion and regulation.* The discussion topics shall be posted by a moderator and we invite all of you to participate. #KeIGF2022: KICTANet Prepares New Voices to Shape The Internet Governance Space

[image: KeSIG 2017.jpg] Dear Listers, To ensure we sustain and bring new voices into the Internet Governance Space, the Kenya School of Internet Governance (KeSIG) virtual sessions began Friday. KeSIG is one of KICTANet's capacity building programs that aims to promote diversity and inclusion in the country’s ICT policy dialogues and beyond. This years' cohort was drawn from a pool of 331 applications. The call for participation was targeted to individuals across the country interested in ICT policy and regulations. 118 applicants were selected ensuring gender, stakeholder and regional balance: Females (62), male (54), preferred not to say (1) and other (1). In terms of sectors, within the civil society organisations (14), academia (23), private sector (53), public sector (20) and from the media. Dear Listers, The Kenya ICT Action Network (KICTANet), in collaboration with Access Now, ARTICLE 19 Eastern and the Africa Center for Intellectual Property and Information Technology Law (CIPIT), considered the four regulations: 1. The Kenya Information and Communications (Broadcasting ) Regulations, 2022; 2. The Kenya Information and Communications (Registration of Telecommunications Service Subscribers) Regulations, 2022; 3. The Kenya Information and Communications (Access and Infrastructure Sharing) regulations; and, 4. The Kenya Information and Communications (Interconnection) Regulations 2022. We prepared a joint submission. The submission highlights key concerns with the regulations and makes key proposals to enrich the regulations.
